RIDER TO SITE PLAN APPLICATION
The undersigned as applicant for Final Site Plan Approval does hereby acknowledge, represent and agree that
all plans, specifications, drawings, engineering, and other data submitted with this application for review by the
City of Boynton Beach shall be reviewed by the various boards, commissions, staff personnel and other parties
designated, appointed or employed by the City of Boynton Beach, and any such party reviewing the same shall
rely upon the accuracy thereof, and any change in any item submitted shall be deemed material and
substantial.

WATER AND SEWER EASEMENT, AND
MAINTENANCE AGREEMENT

THIS DECLARATION, made this ~ day of November, 2001 by FIDELITY
FEDERAL BANK & TRUST hereinafter referred to as Declarant who recites and provides as
follows:
WITNESSETH
WHEREAS, FIDELITY FEDERAL BANK & TRUST (hereinafter referred to as
<<Declarant") is currently the owners of Parcel Number One and Parcel NUInber Two as legally
described on Exhibit <CA" and is in the process of selling Parcel Number Two, and
WHEREAS, it is desired that Parcel Number One and Parcel NUIIlber Two be bound by
the tenns and conditions of this Declaration for thenlselves, theirs successors, heirs and assigns,
business invitees, mortgagees, tenants, agents, employees, customers, licensees and all others
having similar rights thereto.
NOW, THEREFORE, in consideration of the grants and easements herein made and in
consideration of the purchase of Parcel Number Two, and other good and valuable consideration,
the receipt and sufficiency of which is hereby acknowledged, the Declarant hereby subjects the
Parcels of Property to the following:
1. The owners of Parcel Number One and Parcel Number 'IWo shall have a non-exclusive cross
access ingress and egress for vehicular traffic over and through all roads and driveways
constructed or to be constnIcted on their respective properties for the pmpose of accessing
any public or private rights-of-way. The owners of Parcels Number One and Two shall have
two cross accesses as shown on the site pl.an attached hereto as Exhibit "B". The site plan
attached hereto is for the purpose of showing the locations of the cross accesses locations.
Either party shall be entitled to revise their site plan in accordance with any approvals of any
required govemmental authorities, provided 1t does not interfere with the location of the other
parties' roads or driveways. The owner of Parcel Number Two, subject to approval of all
required govenunental authorities shall be entitled to have aCCess to Parcel Number One on
the north side of the property as shown on the site plan; provided, however, this access shall
be restricted to one-way traffic going west. The owner of Parcel Number Two agrees that lus
use of the joint access provided by this Declaration shall not interfere with the free-flow of
the Declarant's drive-in facilities. There shall be no cross-maintenance obligations as to
ingress and egress and each owner of Parcel Nwnber One and Parcel Number Two shall be
responsible for maintaining his own property.
2. The Declarant has provided "Water and sewer to both Parcel Number One and Parcel Number
Two and the improvements have been permitted, installed, and copies of the plans have been
fumished to the perspective purchaser of Parcel Number Two. Subject to the approval of any
govenunental authorities, Parcel Number Two m.ay connect to the water and sewer systems
and shall not be obligated to reimburse the oWner of Parcel Number One for any cost which
the Declarant incurred. Provided, however, the mamtenance, repair or replacement of the
common facilities shall be born by the users of the common facilities in accordance with the
proportion of square-footage of land that they own divided by the total square-footage of the

land using the common facilities. In the event that.Declarant should grant use o:fthe water or
sewer facilities to the party described in paragraph fOUT of this Declaration. that party shall be
responsible for bearing its share of the expenses based upon this formula and the then
existing maintenance then being paid by the owners of Parcel Number One and Parcel
Nwnber Two shall be reduced proportionately.
3. The Declarant hereby establishes utility easements for the benefit of the owners of Parcels
Number One and Two, their successors and/or assigns. as shown and legally described on
attached Exhibit "CU. The location of these easements which shall be considered private
easements which may be altered by mutual agreement of the parties.
4. The Declarant has granted the owner of the property to the east of Parcels Number One and
Number Two the nght to connect to the water and sewer system in exchange for the payxnent
ofa fee to the Declarant_ The owner of Parcel Number Two acknowledges that it shall have
no right to participate in any "such fee" charged by the Declarant. In the event that the
owner- of the property to the east decide to connect either to the water or the sewer, the
Declarant reserves the right to grant an easement to such party over the private utilIty
easement shown on Exhibit "C" attached hereto.

JOINT USE EASEMENT AGREEMENT

between lAKE WORTH DRAINAGE DISTRICT, a Special Taxing District in the State of

hereinafter referred to as MDISTRICT", and FIDELITY FEDERAL SAVINGS BANK OF

WHEREAS, FIDELITY is the owner of certain property located in Palm Beach County,
Florida, adjacent to the DISTRICT'S lateral Canal No. 26; and
WHEREAS, DISTRICT owns, controls and maintains that canal identified as lateral
Canal No, 26, which is upon and within that property owned by FIDelITY; and
WHEREAS, the parties desire to enter into a Joint Use Easement Agreement over, on
and upon that property (hereinafter referred to MEasement AreaII') as more particularly
described on Exhibit MA" attached hereto and made a part hereof~
NOW, THEREFORE, for Ten Dollars ($10.00) and other good and valuable
considerations, received by each party from the other, it is hereby agreed as follows:
1. The above recitals are true and correct and incorporated herein by reference.
2. FIDELITY shall, concurrently with the execution of this Joint Use Easement
Agreement, execute and deliver to the DISTRICT a non~xclusive Easement over, on and
upon that property as more particularly described in Exhibit MA", which Easement is
encumbered.

3. FIDEL TIY shall install paving for parkins within the Easement Area, as shown
on the Map of Boundary Survey, prepared by O'Brien, Suiter & O'Brien, Inc., Drawing No.
78-615db"B" (Survey dated January 23, 2001). Further, FIDELITY shall install landscaping
within the Easement Area, pursuant to the landscaping plans prepared by Kilday &
Associates, dated March 29, 2001, as shown on the Map of Boundary Survey, prepared by
O'Brien, Suiter & O'Brien, Inc., Drawing No. 78-61 Sdb"B" (Survey dated January 23,
2001).
4. FIDELITY shall be responsible for obtaining the necessary permits from the
appropriate governmental agency for the construction of the project.
5. FIDELITY shall indemnify and hold harmless the DISTRICT for any and all
damages that may be caused by the DISTRICT to the paving and landscaping, while
exercising its responsibilities and obligations of the maintenance of its drainage system.
6. DISTRICT shall have the right to approve in writing the successors and assigns
of transfer of any rights or conditions contained in this Joint Use Easement Agreement, which
approval shall not be unreasonably withheld.
