ORDINANCE NO. 02",011
AN ORDINANCE OF THE CITY COMMISSION OF THE
CITY OF BOYNTON BEACH, FLORIDA AMENDING
CHAPTER 2., SECTION 4.F.2 TO ADD "PLACES OF
ASSEMBLY" TO THE LIST OF HEIGHT LIMITATIONS
AND ExCEPTIONS; PROVIDING FOR CONFLICTS,
SEVEltABILITY, CODIFICATION AND AN EFFECTIVE
DATE.
WHEREAS, the City Commission, upon recommendation of sta.:m has deemed it
appropriate to amend Clulpter 2, Section 4.F .2., of the Land Development Regulations to add
''Places of Assembly" to the list of exceptions to the maximum building height; and
NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1.
The foregoing whereas clauses are true and correct and are noW ratified
. and confirmed by the City Commission.
Section 2.
That Chapter 2 _ Zoning. Section 4. F. 2 is hereby amended by adding
language in underlined type, as follows:
Water, cooling and fire towers, radio and television towers of commercial
nature, church spires, places of assembly, domes, cupolas, flagpoles, electrical and
mechanical support systems, parapets and similar structures, and their necessary
mechanical appurtenances may be erected within a structure or on top of a structure,
above the district height limitations provided herein, after obtaining approval of the
city commission based on their consideration of the standards for evaluating
exceptions to district height regulations set forth in paragraph 3 below.
Section 3.
Each and every other provision of the Land Development RegulatIons
not herein specifically amended, shall remain in full force and effect as originally adopted.

Section 4.
All laws and ordinances applying to the City of Boynton Beach in
conflict with any provisions of this ordinance are hereby repealed.
Section 5.
Should any section or provision of this Ordinance or any portion
thereof be declared bya court of competent jurisdiction to be invalid, such decision shall not
affect the remainder of this Ordinance.
Section 6.
Authority is hereby given to codify this Ordinance.
Section 7.
This Ordinance shall become effective immediately.

AN ORDINANCE OF THE CITY COMMISSION OF THE
CITY OF BOYNTON BEACH, FLORIDA AMENDING
LAND DEVELOPMENT REGULATIONS, CHAPTER 1,
ARTICLE II. DEFINITIONS REVISING THE DEFINITION
OF "BUILDING HEIGHT" AND CREATING A
DEFINiT~ON FOR "PLACES OF ASSEMBLY";
PROVIDING FOR CONFLICTS, SEVERABILITY,
CODIFICATION AND AN EFFECTIVE DATE.
WHEREAS, Chapter I, Article JI, Definitions of the Land Development Regu1ations
sets forth definitions and staff bas recommended a revision to the definition of "BUllding
Height", as well as to add a definition for "Places of Assembly"; and
NOW TIlEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF

Section 1.
