RE Security Gates and Emergency Access
To Whom It May Concern
Boynton Beach Fire Rescue continues to maintain the pOSition that security gates are
potentially detrimental to fire and rescue operations The proliferation of security gated
communities has resulted in many problems for responding emergency apparatus trying to gain
entry
The minimum performance for all security gates shall be as follows
1 All security/entrance gates must have an electronic key number pad
2 The keypad will allow entrance by the simple act of pushing four (4) or five (5) buttons
3 All gates must have a security entry code approved in advance by the Fire Marshal
4 Gates may be operable by telephone from our dispatch office A phone call from our
dispatchers will open the gate and a second call will be required to close the gate
5 In case of power failure, the gate shall open automatically and remain open
6 An exception will be where a 24-hour security guard is stationed at the gate
7 A back-up device such as an authorized security box or key switch is required to operate the
gate in the event the number pad entry does not work
8 A key box shall be installed for such areas or buildings when the Fire Marshal determines
that access is necessary for all life-saving or fire-fighting purposes The type and location of
the key box shall be approved by the Fire Marshal and shall contain
· Keys to locked points of egress, whether in common areas or on the interior or exterior
of such buildings,
· Keys to locked mechanical equipment rooms,
· Keys to locked electrical rooms,
· Keys to elevator controls
9 No other code numbers, operating methods, or key systems will be kept on file by the Fire
Rescue Department.
10. In the event that our units are unable to gain rapid entry with the above methods, it will
require the use of rapid forCible entry methods to gain entry The City of Boynton Beach
and/or the Fire Rescue Department shall not be responsible for, or incur any costs as a
result of gaining access to a specific area
11 Information on where authorized key security boxes can be purchased is available from
Boynton Beach Fire Rescue, Fire and Life Safety Division by calling (561) 742-6600 during
normal business hours
Failure to comply will result in the violation of Boynton Beach Code of Ordinances Section 9-3F
and Section 9-15 The liability of delayed Fire Rescue response to an emergency in your
community should be a serious concern

RE 9-71 Boynton Beach Fire Code
It is now a requirement to install an approved keyed lock box to store safety data sheets, floor
plans, site plans, and building access keys for authorized use in the case of an emergency by
the Fire Rescue Department. The approved keyed lock box must be installed within ninety (90)
days of receipt of this written notice from the Fire Rescue Department. The specifications and
location of the required keyed lock box shall be as designated by the Fire Rescue Department.
The National Fire Protection Association (NFPA) Standard 704, Standard System for
Identification of the Fire Hazards of Materials, shall be incorporated with the application of the
keyed lock box to provide exterior warning symbols for emergency responders Hazardous
materials identification placard(s) shall be installed in accordance with NFPA Standard 704
Applications for an approved keyed lock box may be obtained by mail by calling 742-6600 or
fax your request to 364-7382
The Fire Rescue Department may direct that the Items specified above be revised or reinstalled
at any time The City shall bear no expense for initial or subsequent work required of a user
under this section

7 Record keeping, exemption from public disclosure
a) Upon receipt of a disclosure form, the Fire Rescue Department shall
maintain files of all disclosure forms received
b) Under the provisions of 25288(3), Florida Statutes, any and all
information, including but not limited to, site plans and specific location
information on hazardous materials furnished to the Fire Rescue
Department pursuant to this section shall be confidential and exempt from
the provisions of 119 07(1), Florida Statutes
Enforcement. The Fire Chief or designee is authorized and empowered to enforce the
provisions of this Chapter The enforcement may include the inspection of hazardous materials
in use, storage, or disposal, review of hazardous materials records, the sampling and testing of
haza~dous materials, and other activities directly related to the enforcement of this section No
person shall obstruct or interfere with the Fire Chief or designee in the performance of these
duties
Violations In addition to the penalties and remedies provided in section 252 66, Florida
Statutes, any violations of the provisions of this section shall be punishable as provided for in
section 2-91 and 9-61 of the City of Boynton Beach Code of Ordinances

When Paul Worrell and I met with you last, we talked about signage. We would like to have 2 main
signs - one at the southwest corner of the property at Boynton & 1 st and another at the northeast
corner of the property at Seacrest and 3rd. Paul would like to get started with the signs. When we
were talking it sounded as if there may be some new sign regulations. Could you please confirm for

BED AND BREAKFAST ESTABLISHMENT Any building originally constructed for
residential use that is a contributing or outstanding structure in an Historic
District as designated by the City Commission and that is a place of temporary
lodging that provides either three (3) or four (4) rooms for rent for a length
of stay not to exceed two (2) weeks, that is the owner's primary residence and
is occupied by the owner at the time of rental, and in which the only meal served
to guests is breakfast.
BERM Mounding of soil, which is planted with living plant material designed as
a natural landscape feature or buffer to screen incompatible land uses or to
absorb or otherwise reduce undesirable impacts, such as noise, smoke, glare, or
other similar nuisances.

BOARDING HOUSE A building, other than a hotel, where lodging or lodging and
meals are provided on a fee basis for three (3) or more persons.
BOATEL A motel and marina combination accessible to boats as well as
automobiles and which may include boat sales and servicing facilities, overnight
accommodations for transient,s, and eating and drinking facilities.
BORROW PIT A source, other than required excavation, of material for creating
embankments, for providing fill, and for related purposes.
BREAKAWAY WALL A wall that is not part of the structural support of the
building and is intended through its design and construction to collapse under
specified lateral loading forces without causing damage to the elevated portion
of the building or the supporting foundation system.
BUFFER OR BUFFER STRIP A screening device used to moderate the adverse impacts
of one land use upon another. Buffers may include walls, hedges, landscaped
areas, berms, additional setbacks, or combinations of the above.
BUFFER, LANDSCAPE A continuous area of land which is required by the Code to be
set aside along the perimeter of a lot in which existing native vegetation,
relocated native vegetation, and landscaping is used to provide a transition
between and to reduce the negative environmental, aesthetic, compatibility and
other impacts of one land use upon another.
BUILDING{S) For purposes of the Flood Prevention and Control regulations of
this Code, a building is any structure built for support, shelter or enclosure
for any occupancy or storage. For Historic Preservation purposes, Building shall
be defined as a Structure created to shelter people or things, such as a house,
commercial structure, church, hotel, warehouse, or similar structure, including
an historically related complex, such as a courthouse and jailor a house and
garage apartment. A Building shall include Appurtenances, as applicable, located

BUILDING OFFICIAL The Director of the Department of Building and Zoning and all
inspectors working under that official's authority and direction.
BUILDING, PRINCIPAL A building or, where the context so indicates, a grouping
of buildin~s. in which is cQpducted tne principal use of the -lot on which such
building or such grouping is located.
BUILDING SETBACK LINE That line establishing building setback distance from
street or lot lines, established by the Zoning Code of the City of West Palm
Beach, Florida.
BULKHEAD LINE A line established in or along a body of water delineating the
maximum distance from the existing shoreline within which dredge and fill,
bulkhead construction, and related activities may be permitted.
BUSINESS SERVICES Establishments primarily engaged in rendering services to
: business establishments on a fee or contract basis, such as advertising and
. mailing, building and maintenance, employment service, management and commercial
research, development and testing, photo finishing, and personal supply services.
CANOPY
The upper portion of a tree consisting of limbs, branches and leaves.
'CARPORT A roofed accessory structure open on two (2) or more sides, intended
or used for the parking and storage of automobiles.
CELLAR See "BASEMENT".
CEMETERY Property used for interring of the dead.
- CERTIFICATE OF ECONOMIC HARDSHIP, or sometimes CERTIFICATE. For Historic
Preservation purposes, a certificate issued by the Preservation Board authorizing
an Alteration, Construction, Relocation, Stabilization, Mechanical System,
Ordinary Repair and Maintenance, or Demolition, even though a permit has
previously been denied by the Board.
CERTIFICATE OF OCCUPANCY A document signed by a Building Official that
jcertifies that a building and the use of said building or structure complies with
'all applicable requirements of this Code, the Building Code, and all other
applicable laws and regulations at the date the building permit is issued.
Official certification that a premise conforms to provisions of this Code and the
jBuilding Code and may be used or occupied. Such a certificate is granted for new
construction or for alterations or additions to existing structures.
CERTIFICATE TO DIG A Certificate that is necessary prior to: (1) issuance of
a development order for parcels identified on the map of known archaeological
sites; (2) to removal of a suspension order on a site where artifacts or
'fossilized human remains or non-human vertebrate fossils are found during the
