South: Right-of-way for the Lake Worth Drainage District (L-27 also known as the Lazy Lake Waterway) lateral canal, then developed single-family residential classified Low Density Residential (4 84 du/ac) and :zoned Single-family Residential (R1-AA) East: Right-of-way for Southwest 13th Street then developed single-family residential (Golfview Harbour) classified Low Density Residential (484 du/ac) and 2Dned Single- family Residential (R 1-AA) West: Right-of-way for Congress Avenue then developed residential property (Isles of Hunter's Run) classified Low Density Residential (LOR) land use at a densityof 484 dulac, and zoned PUD Planned Unit Development. Proposal: Bob Bentz, agent for RSPB, LLC proposes to construct 66 townhouse units on 16 08 acres All site development is proposed to occur in one phase This request for new site plan approval will be contingent upon the approval of the corresponding rezoning application (REZN 02-007) and the amendment of a 1989 Stipulation and Settlement Agreement (see Page 2 , Hampton Court New Site Plan Staff Report Memorandum No PZ 03-023 Background: Background section below) The subject site is a portion of properties located on both the northeast and southeast corners of Southwest 23rd Avenue and Congress Avenue that were the subject of a 1989 "Stipulation and Settlement Agreement" between the property owners and the City Of Boynton Beach. As part of the agreement that allowed the property to be rezoned to R-3 Multi-family Residential zoning, the use of the property was limited to an Adult Congregate Living Facility with 248 units (beds) The agreement also governs building heights, roof pitch, parking lot lighting, dumpster placement, use of the Lake Worth Drainage District Canal right-of-way, buffering, and landscaping (see Exhibit "C" - Conditions of Approval). In September 2002, the property owners and the City requested consent from the Court to allow the Planning & Development Board to review this corresponding rezoning request for the remaining vacant portion of the subject property (see Exhibit "C" - Conditions of Approval). If approved, the settlement agreement V\Ould have to be amended accordingly Site Characteristics: As previously mentioned, the subject property is a rectangular-shaped lot located on the south side of Southwest 23rd Avenue, east of Congress Avenue. According to the Environmental Assessment (January 14, 2003), the majority of the subject parcel had been previously cleared. Vegetation remaining on the parcel consists of a scattered slash pines and exotic trees and shrubs The open areas on the site are comprised of disturbed open field over-grown with native and non-native weedy herbaceous plants. No endangered, threatened, or species of special concern as listed by the US Fish and Wildlife Service (USFWS) and Florida Fish Wildlife Conservation Commission (FFWCC) were observed on the project site. No unique or endangered habitat, migratory bird rookeries, wading bird habitat or colonial bird nesting I roosting areas are located on the subject site Evidence of Osprey utilizing Australian and Slash pine trees as feeding perches was observed However, the Osprey is not listed as a species of special concern in the State of Florida, except for in Monroe County Also, no wetlands or other surface waters are located on this parcel Concurrency: a. Traffic- b. Drainage- A traffic statement for this project was submitted and sent to the Palm Beach County Traffic Division for their review and approval. The Palm Beach County Traffic Division determined that the project meets the Traffic Performance Standards of Palm Beach County Conceptual drainage information was provided for the City's review The City's concurrency ordinance requires drainage certification at time of site plan approval The Engineering Division is recommending that the review of specific drainage solutions be deferred until time of permit review, when more complete engineering documents are required The on-site drainage system shall be accomplished via a combination of green swales, exfiltration trenches, and dry retention The drainage design shall conform to the requirements of the City of Boynton Beach, South Florida Water Management District, and the Lake Worth Drainage District (LWDD) The paving, grading, and drainage plan shows an outfall into the LWDD canal This point of outfall will require permits from the LWDD According to the LWDD, when improving a piece of property that abuts an LWDD right-of-way, the developer is typically required to dredge or improve that portion of the right-of-way (canal) that directly abuts said property in case of an emergency (hurricane) If possible, City staff respectfully requests the applicant petition the LWDD to dredge the right-of-way adjacent to the subject property, to the minimal extent possible (to the satisfaction of the District) so as to not impact the flora and fauna that may be found in the LWDD Page 3 . Hampton Court New Site Plan Staff Report Memorandum No PZ 03-023 Driveways: right-of-way (see Exhibit "C" - Conditions of Approval) One point of ingress I egress, 50 feet in width is proposed along Southwest 23rd Avenue The width of this opening will require approval of an administrative waiver from the Engineering Division of Pulbic Works (see "Exhibit "C" - Conditions of Approval) Staff determined that no deceleration entry lanes are required This opening will consist of two (2) lanes (residents and guests) The resident lane will be 12 feet in width The guest lane will be 15 feet in width. The egress lane will be 15 feet in width According to the site plan, the driveway would accommodate both left and right-turns along South\1\est 23rd Avenue The site plan indicates emergency vehicle ingress I egress will be provided at two (2) gated openings along Southwest 23rd Avenue. The surface of these openings will be made of grass blocks. This will allow for emergency vehicles to enter the site should the main entrance be obstructed Another gated emergency vehicle opening will be located at the end of the cul-de-sac on Southwest 13th Street. Although partially improved, the Engineering Division of Public Works will require the cul-de-sac to be compliant with City standards. The Fire Department will require a Knox or key activated lock at these alternate points of emergency access (see Exhibit "C" - Conditions of Approval). Parking Facility: Parking required for the townhouse units is based on a ratio of two (2) spaces per unit, including five (5) spaces for the recreation area. Since 66 townhouse units and a recreation area are proposed, a total of 137 parking spaces are required. The proposed site plan provides a total of 158 parking spaces The site plan indicates 66 garage spaces, 66 driveway spaces, and 26 guest spaces for a total of 158 parking spaces The handicap spaces will be dimensioned 12 feet in width with five (5) feet of striping by 18 feet - six (6) inches in length. The site plan shows that the drive aisles will be 25 feet wide. As proposed, all parking lot (parking space) and drive aisle dimensions comply with the Engineering Division Standard Drawings Landscaping: The proposed pervious area of the parcel equals 1 95 acres or 41.5% of the total site. The landscape plan shows 399 palm and shade trees, 69.9% of which will be native species The landscape plan also provides for 5,347 shrubs and groundcover, of which 54% will be native The site landscaping will exceed the minimum plant material required by Chapter 7.5 of the Land Development Regulations The depth of the west landscape buffer will vary but when scaled will be at least 27 feet at its widest point and 10 feet where the dumpster enclosure is proposed This west landscape buffer would contain a buffer wall six (6) feet in height. Sweet Mahogany, Red Bay shade trees and Sabal palm trees are proposed to buffer the buildings from the adjacent property The buffer wall will be five (5) feet from the property line. A row of Redtip Cocoplum hedges is proposed on the outside ofthe buffer wall. The size of the south landscape buffer will vary but when scaled, it appears to be at least 25 feet in width at its widest point and approximately nine (9) feet where the pool deck is proposed. The southern buffer will contain two rows of staggered Red Bay shade trees No buffer wall is proposed along the south property line where it is required in accordance with the Stipulation and Settlement Agreement (see E>tlibit "C" - Conditions of Approval). The size of the east landscape buffer (adjacent to Southwest 13th Street) will vary but will be at least 40 feet in width at its widest point and 15 feet from the pool deck. It too will contain Sweet Mahogany, Red Bay shade trees and Sabal palm trees. The buffer wall will be five (5) feet from the property line Similar to the west landscape buffer, a row of Redtip Page 4 Hampton Court New Site Plan Staff Report Memorandum No PZ 03-023 Building I Site: Cocoplum hedges is proposed along the outside of the buffer wall. The landscape buffer adjacent to Southwest 32nd Avenue will be 15 feet in width measured from the property line to the buffer wall This buffer will contain Sweet Mahogany, Red Bay shade trees with Sabal palm trees and Redtip Cocoplum hedges. According to the site plan (sheet "A1"), a C.B S wall, six (6) feet in height would surround the entire property, except for along the southern property line adjacent to the LWDD canal The exclusion of a wall along the south property line conflicts with the Stipulation and Settlement Agreement (see Exhibit "C" - Conditions of Approval) A fence would be required around the pool area pursuant to the Florida Building Code for safety reasons (see Exhibit "C" - Conditions of Approval). The 66 dwelling units are proposed within eight (8) separate buildings on the 4.70-acre site The proposed density is 14.07 dwelling units per acre which has been tabulated using the Stipulation and Settlement Agreement's maximum bed figures, unbuilt beds on the affected property and a conversion of surplus beds approved under the Stipulation and Settlement Agreement's to dwelling units (2 3 bed / unit) This total density is inconsistent with the Future Land Use Map but arguably, from the applicant's perspective, supported by the Stipulation and Settlement Agreement. Each of the eight (8) buildings would contain one (1) of five (5) types of units. The unit types will range between two (2) and three (3) bedrooms but vary slightly in terms of their overall living area and number of floors. The townhouse buildings will be setback as follows' 40 feet from Southwest 32nd Avenue, 20 feet from the west property line; 40 feet from the east property line (which abuts Southwest 13th Street), and at 25 feet from the south property line. The buildings will be separated from each other by at least 25 feet. The cabana building, located at the southeast corner of the property will be setback approximately 29 feet from both the east and south property lines. The dumpster enclosure will be located 10 feet from the west property line. The dumpster enclosure location conflicts with the Stipulation and Settlement Agreement (see Exhibit "C" - Conditions of Approval). The plans do not show any proposed improvements within the LWDD right-of-way Community Design: The PUD zoning district allows a maximum building height of 45 feet; however, a lesser height could be imposed if compatibility with adjacent properties becomes an issue. The proposed two (2)-story fee-simple townhouses will be 29 feet - 10 inches at the peak of the roof (see Exhibit "C" - Conditions of Approval) The slope of the roof is four and one-half (41'2) to 12, which is steeper than the four (4) to 14 required by the Stipulation and Settlement Agreement allows (see Exhibit "C" - Conditions of Approval) The proposed buildings would be primarily tan in color (Sherwin Williams SW#2044 - Bedouin Beige) with a light yellow base (Sherwin Williams (SW#1366 - Harvest Moon) The roof will be made of concrete roof tiles According to the Typical Light Detail shown on the site plan, the freestanding outdoor lighting fixtures will be 10 feet in height and be illuminated until 2 00 a m. Although the height of the pole is not an issue, the Stipulation and Settlement Agreement only allows the lights to be on until 11.00 p m (see Exhibit "C" - Conditions of Approval) Signage: The elevations show that no building wall signs are proposed. An "entry wall" sign is proposed along the northern buffer wall as shown on sheet "SP 2 of 2". The plans are absent of details; however, according to the applicant, the sign will be blue and the letters will be gold The detail of the proposed entry sign(s) shall include the total signage area and colors in order to confirm architectural compatibility with the buildings. The Comprehensive Plan justifies the approval of 66 units and is not inconsistent with this development plan. To understand why 66 units should be approved by the City of Boynton Beach, it is important to understand the history of the property. This property was involved in litigation in which a settlement was reached in a Stipulation and Settlement Agreement ("Agreement") dated October 31, 1989. This Agreement zoned the property R-3 (multi-family) ACLF with no less than 248 units. Since this property has been subject to litigation, there are unique circumstances specific to this property which support the approval of 66 units Policy 1.16.3 of the Future Land Use Element states that the City shall continue to implement the recommendations as set forth in the Land Use Problems and Opportunities section of the support documents for the Future Land Use Element. This policy indicates that the recommendations contained in this section shall apply "regardless of the status of the City's development regulations". Section 8.c. of the Land Use Problems and Opportunities section discusses the property on the southeast corner of Golf Road and Congress Avenue and clearly states that the land use, zoning and the use and development of the property shall be in accordance with the Agreement.
