Your facsimile further requests that the legal description and sketch be referenced m the approving ordinance "so that it is clear that the area has been abandoned and that the ownership reverts to the developer". Perhaps you are mixing the abandonment procedures utilized by the city; the following recapitulatIOn is submitted for your reVIew. In accordance with the City's Land Development RegulatIons (LDR), Chapter 22 (Streets and Sidewalks), Article III (Street and Easement Abandonment), the applicant requestmg a vacation and/or abandonment of a street (or portion thereof) submits the request (in writing) in triplicate to the City Clerk containing several items (who, what, where, why, etc.) and other necessary documentation. An application fee (currently $500) would be attached. The City Clerk would review it for completeness and provide copies to the Director of Development, the Director of Planning and the Director ofUtIhties for review and comment. This takes twenty (20) days. The City Clerk would then set a date for the public hearing (held by the City Commission), publish a notice of the hearing in a general newspaper (mmimum of 15 days advance notice), and/or provIde notice to the adjacent property owners of the abutting properties. The City Commission would consider the above noted reviews of the applicatIOn within forty-five (45) days after the review(s) receIpt. Their acceptance, modification or denial of the recommendatIOn can be in the form of an ordinance, resolutIOn or other commissIOn action; the LDR does not specify which they are required to take. If you wish this course of action for the roadway abandonment, you can antiCIpate at least sixty (60) days, which would have to be completed prior to the replatting process. However, having saId that, this department would msist upon a new cul-de-sac be dedicated to the city in ItS new location and bUllt to the city standards (asphalt, curb & gutter, drainage, sidewalk, etc). The other option is to do the abandonment as a part of the replatting process. The proposed record plat is still reviewed by the same people (includmg the Director of Public Works or his designee) and a surveyor and mapper eIther under contract or employed by the city. Re: HIgh Ridge PID Replat Page Two shortened by combming two tasks in the same tIme frame of the replatting procedures. This IS the chOIce that the applIcant elected. In discussing the "how to" combine the replatting with the abandonment (and the applicant's choice in constructing a paver brick cul-de-sac to which the city will not assume maintenance responsibility), the department elected to allow the relocated cul-de-sac to be a total ingress, egress and utIlity easement while abandoning the positIOn of the old cul-de-sac location in the replatting process. Thus, in, my discussions WIth Mr. Alexander Duchart, PSM, with Sun-Tech Engmeering, Inc. of Fort Lauderdale, we determined that it would be best to define that portion of the old roadway locatIOn as an abandonment in the dedication and reflect the new cul-de-sac location as a multiple easement. Thus, both the dedicator (with ItS notary acknowledgement) and the city (also as an acknowledgement) sign the dedication portion of the record plat, effecting both actIOns taking place. ObVIOusly, the city will also sign the record plat m the approval block, accepting the new configuration of the area contained in the said plat. However, I am now requesting of Mr. Duchart that the right-of-way abandonment legal description be include in that proviso area of the dedIcation and indicate in the city's portion ofthe acknowledgement that it is agreeing with that specific proviso only (as part of the dedicatIOn language). In additIOn, there are several record plat preparation comments that have not be addressed or require clarification and/or additIOn. The list and suggested language is attached for the preparer. Further, I will re-review the record plat subsequent to this change to msure that it complies with the LDR Chapter 5 (Platting) requirements, and Chapter 177 F.S. This change should make it clear to the property appraiser that a portion of the roadway has been abandoned and "reconfiguring the lot and ownership records" should be on the tax rolls. In addition, please add back in the same easement effecting the north side of the property, to cover the water main for the north building. This was erased erronessly by a previous city comment.
