Community Redevelopment April 23, 2002 Mr. Jeffrey Silberstein Silberstein Architects 524 Northeast 2"d Street Delray Beach, FL 33483 Re: Golden Corral - Photometric Plan MMSP 02-023 Dear Mr Silberstein: This letter is written in response to your request for the administrative review and approval of the modifications proposed to the above-referenced photometric plan date stamped 3/27/02. The basic objective of the request is to increase foot-candle levels from 4 foot-candles to 10-12 foot-candles. The proposed plan was reviewed in part and compared with the photometric plans of the abutting commercial properties. Staff reviews each photometric plan for its basic compliance with City of Boynton Beach Code of Ordinances (Code) and Land Development Regulations (LOR). The Code and LOR do not specifically address an upper limit for lighting levels for uses other than gas stations. However, your proposal seems to contradict the intent of a number of different code requirements. LOR, Chapter 2, Section 7.N.7, specifically prohibits glare, which is readily perceptible at any point at or beyond the property line of the property on which the use is located. LOR, Chapter 9, Section IO.F.5 also states that lighting shall not be used as a form of advertising in a manner that draws more attention to the building or grounds at night than in the day Moreover, the type, style, and illumination levels of the outdoor lighting fixtures were addressed in the project's I" review comments of new site plan review as follows, "Provide a detail or typical of all outdoor freestanding lighting fixtures. The detail must include the pole material. height, and color. Their design, style, and illumination level shall be compatible with the building design (height) and shall consider safety, function, and aesthetic value (Chapter 9, Section lOT!.). Although the language of the aforementioned code references do not specifically prohibit the proposed foot-candles, the photometric plan as proposed in this instance is in my opinion incompatible with the lighting levels of the adjacent properties. Furthermore, the request seems to violate the cumulative intent of all regulations that were established to protect the health, safety, and morals oflhe general public. You may, however, request a major site plan modification. This would entail full site plan review including Planning & Development Board and City Commission approval. Golden Corral Minor Modification File No. NWSP 02-023 I have reviewed the above referenced Lighting Plan, forwarded to me on March 28, 2002, against the appropriate sections of the City of Boynton Beach Code of Ordinances. The applicant is requesting increasing the average foot-candle level from 4 foot-candles to 10-12 foot-candles. The Code and Land Development Regulations (LDR) do not specifically address an upper limit for lighting levels. The LDR, Chapter 2, Section ?N.? however, does specifically prohibit glare which is readily perceptible at any point at or beyond the property line of the property on which the use is located, and requires that lighting be directed away from any residential use. The LDR, Chapter 9, Section 10.F.5 also states that lighting shall not be used as a form of advertising in a manner that draws more attention to the building or grounds at night than in the day In reviewing the Lighting Plan I see that lighting outside the property line is expected to range from 1 to 2 foot-candles on both Winchester Park Boulevard and Old Boynton Road. Additionally a lighting level of 10-12 foot-candles will draw attention to the restaurant. This lighting level should be compared to the lighting level of the adjacent Wal-Mart and other out- parcel parking lots to see if this level is comparable to the other sites. It is my opinion that the lighting level proposed is excessive and should not be allowed If however, the lighting level of the surrounding area is comparable to that proposed by the Golden Corral it may be allowed provided that adjustments are made to reduce the light "bleeding" off the property onto the adjacent streets.
