I am ok with this process. However, I would attach the revised page (rather than remove the old) with a note on the
approved set "superceded by permit change" and "revised" or something equivalent on both pages. That way there is
the paper trail and no lose of information over time.
Also, Kevin needs to be sure to direct them accordingly in the permit system so that the permit drawings and fee get
modified properly Thanks, MR.

Last week, the landscape architect for the Golden Coral project requested changes to the landscape plan. I asked
the landscape architect to provide Planning & Zoning with a copy of the modified landscape plan. They did. I
forwarded the plans to Kevin for him to determined if the requested changes were major or minor I believe Kevin
determined that the changes were minor Typically, Lusia's position on minor landscape changes is to not do a
minor site plan modification but to rather "keep it downstairs in the permitting process" That is exactly what Kevin
and I are doing.
Kevin is going to initial! date the plan "approved" and give it to Arlette. Arlette will then remove the original
landscape plan from the approved set and attach the new one that Kevin initials.

I understand that the temporary C.O for the restaurant expires today and there are some landscaping issues
to resolve. I have placed on Kevin's desk some documents (I assume the revised landscape plans) for
processing. I also understand that revised plans require review to determine if values in materials have
increase thereby increasing the permit fee. Don feels they may try to circumvent the permit process in getting
the changes approved. Let's do what we have to do to expedite the process particularly since their temporary
CO expires. Keep me in the loop and get my assistance when needed. MR.

The existing site consists of pasture land grassed areas and an existing lake
which was constructed as part of the Boynton CoMmons Shopping Plaza located to
the east (Permit No 50 03S24.PJ The permitted surface water management
system for the Boynton Commons Shopping Plaza consists of exfiltration trench
and dry detentiDn areas. and the existlng lake on this parcel which was
designed to provide additiDnal storage for the Boyntcn Commons Shopping Plaza
The permitted outfall for the shopping plaza is to the LWOD L-24 Canal via a
control structure located on the Shopping plaza site.
The existing lake located on the We'ma~t site that prOvides additional stDrage
for the existing Boynton Commons Development will be relocated on the Walmart
property as part of the Walmart site development Tr,e proposed relocated pond
will have an area of 1.10 acres at the control elevation of B 5 and a total
area of 2.47 acres at elevation 15 0 This will provide 10 41 ac-ft of
storage tOMpared to 9 04 ac-ft of storage that the existing off-site pond
presently provides A copy of the executed Drainage and Off-Site Water
Retention Easement Agreement between the developers that allows this pond

We have reviewed the drainage plans for the above referenced project and do hereby approve
of them for connection to our facilities, subject to the following conditions
(X) Permittee shall reconstruct canal(s) to approved design section along and adjacent to the
project's limits, including clearing and proper sloping of the maintenance berms The
cleared canal berms and side slopes shall be stabilized. Type of stabilization shall be
approved by LWDD This construction shall be completed prior to any building activity
adjacent to LWDD rights-of-way Please be advised that any fill material scheduled to
be removed from the canal may not be relied on for site work.
(X) The emergency control type structure(s) shall remain closed at all times unless specific
written approval is granted by the Lake Worth Drainage District for its operation. At no
time, shall the structure(s) be operated to bypass the water quality detention requirements
for the project or to lower the lake levels below the permitted control elevation for the
project. If for whatever reason, ii is determined that the permittee is not complying with
the directives of the LWDD, and/or is operating the structure(s) contrary to their intended
purpose as an emergency outflow, the structure(s) shall be modified by LWDD to render
the emergency structure(s) inoperable In addition, the emergency structure(s) shall be
equipped with a lock mechanism to prevent its unauthorized use, and a staff gage shall
be installed upstream of the structure(s) so that lake levels within the project can be
quickly determined. By accepting this permit, the permittee and/or assigns agrees to
allow LWDD to ingress/egress and render the emergency portion of the structure(s)
inoperable for non-compliance
(X) Permittee or Permittee's representative shall notify the LWDD Inspection Department 48
hours prior to any work within District rights-of-way to coordinate the extent of work to be
completed. All facilities needing inspection must be observed prior to backfilling.

(X) Permittee shall restore LWDD's rights-of-way to its original or better conditions where
disturbed by construction activity
(X) The Lake Worth Drainage District cannot accept any water from dewatering either on or
off-site until written notification of approval from SFWMD has been submitted to this
office
(X) It shall be the responsibility of the permittee to locate and protect any underground
facilities within LWDD's rights-of-way prior to construction.
(X) Permittee shall take all reasonable precautions necessary to prevent turbidity or silting
upstream or downstream during construction.
(X) At the time of installation, a permanent benchmark shall be established on top of the
control structure(s) with the elevation c1earlv defined.
(X) Where improvements are erected on lots or parcels contiguous to LWDD canals, the
developer shall install gutters and downspouts eliminating surplus water overland flow,
assuring the route of said water into the on-site drainage facility and/or storm sewer
system.
(X) Permittee shall submit "record drawings" within sixty (60) days of project completion.
Drawings should show perimeter grading at or above the design storm and control
structure elevations. Failure on the Developer/Owner/Permittee's part to provide these
drawings within the time specified, will result in LWDD requesting that all permits involved
within this project be put on hold until they are received.
(X) Permittee shall obtain any and all permits required by EPA, FDEP, USACE, FDOT,
SFWMD, Palm Beach County, and/or any municipality that may be involved, prior to the
commencement of any construction.
(X) All unpermitted drainage facilities installed before ':Jr during construction shall be removed
prior to the project's final acceptance.
() Permittee has provided a bond in favor of LWDD in the amount of 110% of the cost of the
pipe and its installation. Bond can be released upon issuance of final inspection by
LWDD and developer's submittal of "record drawings" to LWDD
(X) Permittee agrees that significant construction must start within one year to the date of
permit issuance or this permit is void and a new permit must be applied for prior to any
construction activity on site. The new application must meet current operating policies.
(X) The Permittee, assigns, or successors in title agree to operate and maintain the drainage
system in perpetuity

The first outside layer shall bc a combination of colorful groundcover plants (annuals may be
supplemental to other groundcover plants but not be a substitute) and a minimum of two colorful shrub
species planted in a continuous row or in clusters spaced no greater than 20 feet apart beginning at the
project entrance or comer (individual clusters being a minimum of five (5) feet wide; excluding
properties zoned M-Ithat front on local streets). For sides of property with linear distances less than 40
feet, the first layer of plants shall only be required at project comcrs. The next layer shall consist of a
continuous hedge or decorative site wall and one (I) tree spaced a maximum of 30 feet apart (spacing
may decrease to a maximum of 10 feet for unsightly, vehicle-intensive, or other USeS requiring greater
buffering as recommended by the Director).
E. Buffer requirements. On the site of a building or structure or open lot use providing an uIT-
street parking area or other vehicular use area, such area shall be provided with a landscaped barrier,
preferably a hedge not less than four (4) feet nor greater than six (6) feet in height to fonn a continuous
screen between the off-street parking area or other vehicular use area and such abutting property Such
landscape buffer shall be 2 112 feet deep and located between the conunon lot line and the off-street
parking area or other vehicular use area except where an industrial or commercial zoning district abuts a
residential zoning district, this planting strip shall not be less than 5 feet in depth between commercial
and residential zoning districts and 15 feet in depth between industrial and residential zoning districts.

F Accessways. The maximum width of an accessway (whether one- or two-way traffic) through
the required perimeter landscape strip to an off-street parking or other vehicular use area shall be thirty-
two (32) feet. The balance of such street frontage not involved with accessways shall be landscaped in
accordance with the provisions of this section.
G. Parking IITea interior landscaping. Off-street parking areas shall have at least twenty (20)
square feet of interior landscaping for each parking space excluding those spaces abulling a perimetcr
for which landscaping is required by other sections hercof and excluding all parking spaccs which are
directly served by an aisle abutting and running parallel to such a perimeter Each separate landscaped
arca sball contain a minimum of twenty-five (2S) square feet and shall have a minimum dimension of at
least five (5) feet and shall include at lcast one trce having a clear trunk of at least five (5) feet, with thc
remaining area adequately landscaped with shrubs, ground cover or other authorized landscaping
material not to exceed three (3) feet in height. Ibe total number of trees shall not be less than one (I)
interior tree for every ten (10) parking spaces. Trees provided adjacent to rights-of-way, abutbng
propenies, and building walls shall not contribute toward this requirement. Such landscaped areas shall
be located in such a manner as to divide and break up the expense of paving.
Point of access. When an accessway intersects a puhlic right-of-way or when the subject
p abuts the intersection of two (2) or more public rights-of-way. all landscaping within the
triangular areas described below shall provide unobstructed cross-visibility at a level between thirty (30)
inches and six (6) feel above pavement, provided, however, trees or palms having limbs and foliage
trimmed in such a manner that nO limbs or foliage extend into the cross-visibility area shall be allowed,
provided they are located so as not to create a traffic hazard. Landscaping, except required grass or
ground cover, shall not be located closer than three (3) feet from the edge of any accessway pavement.

abutting public right-of-way lines, measured from their point of intersection, and the third side being a

I. Existing plant material. In instances where e y p ant material exists on a site prior to il~
development, in part or in whole, for purposes of off-street parking or other vehicular use areas, the
department may adjust the application of the above-mcntioned standards to allow credit for such plant
material if, in its opinion, such an adjuSlment is in keeping with and will preserve the inlent of this
article.
J. Landscaping and dumpsters. All dumpsters should be placed on a concrete pad ten (10) feet
wide with IllI approprial" depth and be screened on three (3) sides as described in Chapter 9, Section 10,
Paragraph C.3 Provide accent shrubs along the screen wall.
K. General landscaping for cluster and multifamily housing developments. In addition to the
landscaping require!d by olh"r s"ctions of this code, the following number of trees are required for open
common ureas.
I A minimum of one tree for each one thousand five hundred (1,500) square feet (or fraction
lhereof) of developed area. Trees that are preserved on site in open common area shall receive credit
against the landscape area requirements. It is the intent of this section to create a park-like
environment. This section is included in order to create privacy, shaded areas and an aesthetically
pleasing envirorunent, Md in determining thc validity of any
site pllm in accordance with Section 6, the planning and development board shall take these factors into
consideration.
L. Foundation landscaping. Foundation landscaping shall be required in the front and side of ellch
multifamily or cluster dwelling in order to enhance the visual appearance of the building and to promote
pnvacy
M. Landscaping of open walls. The provisiqns of this seclion shall lIpply to the front elevation
wall and two side elevation walls (and rear elevations where visible from adjacent rights-ot~way) of lIll
COIllll1ercial Dr non-residential buildings (excluding industrial uses with exposure limited to local streets)
wher<;: that portion of the base level void of windows, awnings, and doorways exceeds 25 lineal feel, or
where otherwise recommended by the Director for minimal aesthetic improvem"nl. Foundation

continuous colorful shrub and groundcover compatible with perimeter landscaping (rights-of-way), or a

the wall of hug"r prujects or shupping cenlAOrs. Height of trees when planted shall be a minimum of 1/2
building height at time of planting. Palm tree species should be slow growing, multi-trunk, with the
majority of the tree CIlllOPy providing a visual barrier of the open wall. Eligible palm tree species may
be one or more of the following: Pygmy Date Palm, Paurotis, Adonidia, Foxtail, and Royal. For
properties zoned M-I, this requirement shall only apply to facades oriented toward abutting streets.

Petition for Administrative Proceedings
1 A person whose substantial interests are
affected by the South Florida Water Management District's
(SFWMD) action has the right to request an administrative
hearing on that action. The affected person may request
either a formal or an informal hearing, as set forth below A
point of entry into administrative proceedings is govemed
by Rules 28-106.111 and 40E-l.511, Fla. Admin. Code,
(also published as an exception to the Uniform Rules of
Procedure as Rule 40E-O.l09), as set forth below
Petitions are deemed filed upon receipt of the original
documents by the SFWMD Cleric
2. Fcrmal Administrative Hearinq: If a
genuine issue(s) of material fact is in dispute. the affected
person seeking a formal hearing on a SFWMD decision
which does or may determine their substantial interests
shall file a petition for hearing pursuant to Sections 120 569
and 120.57(1), Fla. Stat. or for mediation pursuant to
Section 120.573, Fla. Stat. within 21 days, except as
pruvided in subsections c. and d. below, of either written
notice through mail or posting or publication of notice that
the SFWMD has or intends to take final agency action.
Petitions must substantially comply with the requirements
of Rule 28-106.201(2), Fla. Admin. Code, a copy of the

c. Administrative Complaint and Order:
If a Respondent objects to a SFWMD Administrative
Complaint and Order pursuant to Section 373.119, Fla.
Stat. (1997), the person named in the Administrative
Complaint and Order may file a petition for a hearing no
later than 14 days after the date such order is served.

of either subsection a. or b. above.
d. State Lands Environmental Resource
Permit: Pursuant to Section 373427, Fla. Stat., and Rule
40E-1 511(3), Fla. Admin. Code (also published as an
exception to the Uniform Rules of Procedure as Rule 40E-
0.109(2)(c)). a petition objecting to the SFWMD's agency
action regarding consolidated applications for
Environmental Resource Permits and Use of Sovereign
Submerged Lands (SLERPs), must be filed within 14 days
of the notice of consolidated intent to grant or deny the
SLERP Pe@ons must substantially comply with the
requirements of either subSection a. or b. above.
e. Emeruencv Authorization and Order:
A person whose substantial interests are affected by a
SFWMD Emergency Authorization and Order, has a right
to file a petition under Sections 120.569, 120.57(1), and
120.57(2) Fla. Stat. as provided in subsections a. and b.
above. However the person, or the agent of the person
responsible for causing or contributing to the emergency
conditions shall take whatever action necessary to cause
immediate compliance with the terms of the Emergency
Authorization and Order
f. Order for Emeruencv Action: A person
whose substantial interests are affected by a SFWMD
Order for Emergency Action has a right to file a petition
pursuant to Rules 28-107005 and 40E-l.611, Fla. Admin.
Code, copies of which are attached to this Notice of Rights,
and :::'ection 373119(3), Fla. Stat.. for a hearing on the
Order Any subsequent agency action or proposed agency
action to initiate a formal revocation proceeding shall be
separately noticed pursuant to section g. below.
g. Permit Suspension, Revocation.
Annulment. and Wrthdrawal: If the SFWMD issues an
administrative complaint to suspend, revoke. annul, or
withdraw a permit, the permittee may request a hearing to
be conducted in accordance with Sections 120.569 and
120.57 Fla. Stat., within 21 days of either written notice
through mail or posting or publication of notice that the
SFWMD has or intends to take final agency action.
Petitions must substantially comply with the requirements
of Rule 28-107.004(3), Fla. Admin. Code, a copy of the

2. Because the administrative hearing process
is designed to formulate final agency action, the filing of
a petition means that the SFWMD's final action may be
different from the position taken by it previously
Persons whose substantial interests may be affected by

publication of notice that the SFWMD has or intends to
take final agency action. Choosing mediation will not
adversely affect the right to an administrative hearing if
mediation does not resutt in settlement.
Purseant to Rule 28-106 402. Fla. Admin. Code the
CDntents of the petition for mediation shall CDntain the
following information:
(1) the name. address. and telephone
number of the person requesting mediation and that
person S representative, if any.
(2) a statement of the preliminary agency
action;
(3) an explanation of how the person s
substantial interests will be affected by the agency
determination; and
(4) a statement of relief sought.
As provided in Section 120573, Fla. Stat. (1997), the
timely agreement of all the parties to mediate will toll the
time limitations imposed by Sections 120.569 and 120 57,
Fla. Stat., for requesting and holding an administrative
hearing. Unless otherwise agreed by the parties, the
mediation must be CDnduded within 60 days of the
execu1ion of the agreement. If mediation results in
settlement of the dispute the SFWMD must enter a final
order incorporating the agreement of the parties. Persons
whose substantial interest will be affected by such a
modified agency decision have a right to petition for
hearing within 21 days of receipt of the final order in
accordance with the requirements of Sections 120.569 and
120.57, Fla. Stat., and SFWMD Rule 28-106.201(2), Fla.
Admin. Code. If mediation terminates without settlement of
the dispute, the SFWMD shall notify all parties in writing
that the administrative hearing process under Sections
120.569 and 120.57, Fla. Stat., remain available for
disposition of the dispute and the notice will specify the
deadlines that then will apply for challenging the agency
action.
VARJANCES AND WAIVERS
13. A person who is subject to regulation
pursuant to a SFWMD rule and believes the application of
that rule will create a substantial hardship or will violate
principles of faimess (as those terms are defined in
Subsection 120.542(2), Fla. Stat.) and can demonstrate
that the purpose of the underlying statute will be or has
been achieved by other means, may file a petition with the
SFWMD Cieri< requesting a variance from or waiver of the
SFWMD rule. Applying for a variance or waiver does not
substitute or extend the time for filing a petition for an
administrative hearing or exercising any other right that a
person may have concerning the SFWMD's action.
Pursuant to Rule 28-104.002(2), Fla. Admin. Code, the
petition must indude the following information:
(a) the caption shall read:
Petition for (Variance from) or (Waiver 01) Rule (Citation)
(b) The name, address, telephone number
and any facsimile numger of the petitioner
(c) The name, address telephone number
and any facsimile number of the attomey or qualified
representative of the petitioner (If any);
(d) the applicable rule or portion of the rule;
(e) the citation to the statue the rule is
implementing:
(I) the type of aaion requested;
(g) the specific facts that demonstrate a
substantial hardship or violation of principals ot faimess
that would justify a waiver or variance for the petitioner,
(h) the reason why the variance or the waiver
requested would serve the purposes of the underlying
statute. and
(I) a statement of whether the variance or
waiver is permanent or temporary, It the variance or
waiver is temporary, the petition shall indude the dates
indicating the duration of the requested variance or waiver.
A person requesting an emergency variance from or
waiver ot a SFWMD rule must dearly so state in the
caption of the petition. In addition to the requirements at
Section 120 542(5) Fla. Stat. pursuant to Rule 28-
104004(2). Fla. Admin. Code the petition must also
include.
a) the specific facts that make the situation an
emergency. and
b) the specific facts to show that the petitioner will
suffer immediate adverse effect unless the variance or
waiver is issued by the SFWMD more expeditiously than
the applicable timeframes set forth in Section 120.542, Fla.
Stat.

The project area is located on the west side of Winchester Park Boulevard
between Old Boynton West Road and Boynton Beach Boulevard The Lake Worth
Drainage District L-24 Canal (labeled as SW-4 in the inventory table and on
the enclosed exhibits) is located along the south side of the project area
The majority of the site has been under use as cattle pasture and the soils
have also been substantially disturbed by past filling and earthwork activity
The proposed development of the site will require fllling three existing
manmade pond areas totalling 4 13 acres of other surface waters as shown on
the enclosed exhibits However there are no wetlands located at the site
Therefore adverse impacts to wetlands are not anticipated as a result of the
proposed project
The proposed activlties have been evaluated for potential secondary and
cumulative impacts and to determine if the project is contrary to the public
interest Based upon the proposed project design the District has determined
that the project will not cause adverse secondary or cumulative impacts to the
water resources and is not contrary to the public interest

Dear Michael:
The Palm Beach County Traffic Division has reviewed the traffic study for the
development project entitled; Golden Corral. pursuant to the Traffic Performance
Standards in Article 15 of the Palm Beach County Land Development Code. The
project is summarized as follows:

Based on our review, the Traffic Division has determined that the project meets the
Traffic Performance Standards of Palm Beach County, given the fOllowing:
. Provision of both exclusive right and left-turn lanes on Old Boynton Road, at
the project access driveway
. Provision of both exclusive right and left-turn lanes on Winchester Park
Boulevard, at the northern project access driveway
. Prohibition of egress left-turns out of the project access driveway on old
Boynton Road.
Some of the above turn-lanes are already in place. If you have any questions
