Site Characteristics: The subject property is a vacant outparcel of the Wal-Mart Super Center,
comprised of two lots (Lot 4 & Lot 5), located along Winchester Park
Boulevard.
According to the January 2000 Environmental Resource Permit Staff Review
Summary for the Wal-Mart Super Center, the project site does not contain
preferred habitat for wetland-dependant endangered / threatened species or
species of special concern. No wetland dependant endangered / threatened
species or species or speciai concern were observed on-site, and submitted
information indicates that potential use of the site by such species is minimal.
The site has been cleared and no vegetation exists except, the perimeter
landscaping that Wal-Mart was required to install during its site development
process.
Proposal:
Jeffrey Silberstein of Silberstein Architects, Inc. is requesting site plan
approval to construct a one-story 10,330 square foot restaurant on the above-

referenced lots (see Exhibit "B" - Proposed Site Plan). As currently proposed,
there will be a total of 390 seats. The entire project is to be constructed in one
phase (see Exhibit "B" Proposed Site Plan). The proposed restaurant will be
located on an out-parcel of the Wal-Mart Super Center site.
Concurrency.
a. Traffic. A traffic statement for this project was submitted and sent to the Palm
Beach County Traffic Division for their review and approval. At this
time, the project is still under review and staff has not received
confirmation from the Traffic Division that it meets the Traffic
Performance Standards of Palm Beach County (see Exhibit "C" -
Conditions of Approval).
b. Drainage - Conceptual drainage information was provided for the City's review
The City's concurrency ordinance requires drainage certification at time
of site plan approval. The Engineering Division is recommending that
the review of specific drainage solutions be deferred until time of permit
review, when more complete engineering documents are required.
Driveways: On-site traffic circulation will consist of three (3) points of ingress / egress.
Two (2) entrances are proposed to connect and align with existing Wal-Mart
Super Center drive aisles. The third point of ingress / egress will connect to
one of the Wal-Mart Super Center's main access drives. The proposed
southern entrance is to be utilized by service and emergency vehicies. The
dumpster enclosure and loading zone areas have been strategically located to
the south of the buiiding, near this proposed southern entrance in order to
accommodate larger size vehicles and their respective turning radius. The
dumpster enclosure is angled in such a way to facilitate efficient refuse
removal.
The third entrance, which is proposed along the Wal-Mart Super Center main
access drive, provides ingress I egress from the Wal-Mart site directly to
Winchester Park Boulevard. No entrances are proposed which directly access
Winchester Park Boulevard from the subject site.
Two-way drive aisles 27 feet in width will provide service and customer access
to parking areas located east and north of the building.
Parking Facility'
Required parking for restaurants are based upon either one (1) space per 100
square feet of gross floor area or one (1) space per 2.5 seats, whichever is the
more stringent methodology of the two. Since 390 seats are proposed, the
more stringent scenario is based upon the total number of seats. Therefore, a
total of 156 parking spaces are required. The number of parking spaces
provided equals 170, including six (6) spaces designated for handicap use.
However, since the southern drive aisle to the Wal-Mart Super Center would
eliminate six (6) existing parking spaces, the same number of excess parking
spaces for the Golden Corrai must be preserved for Wal-Mart's use (see
Exhibit "C" - Conditions of Approval). Therefore, the total number of excess
parking spaces for the Golden Corral site will be eight (8) spaces rather than
14 spaces. All spaces, except handicap spaces will be dimensioned nine feet
by eighteen feet (9' x 18'). The parking spaces and drive aisles will surround

Landscaping:
the north, east, and south sides of the building, except in locations where
loading zones are proposed. All handicap spaces will be located near the front
entrance of the building. No parking is proposed west of the building.
The proposed pervious or "green" area is 26,996 square feet or 23.5% of the
total site. Typically, landscape buffers adjacent to public rights-of-way are
required to be seven (7) feet in width. However, the Wal-Mart Center Master
Plan Design Standards exceeds this Land Development Regulation buffer
width requirement. Therefore, the front landscape buffer along Winchester
Park Boulevard will comply with the Design Standards and be ten (10) feet in
width. This front landscape buffer currently contains existing trees and shrubs
such as Sabal Palmetto, Sweet Mahogany, Viburnum, Green Buttonwood,
Indian Hawthorne, Crinum Lily, and Liriope. Staff recommends that the
existing plant material in this perimeter buffer should not be altered with in
order to maintain consistency with the Wal-Mart Super Center and Sonny's
Bar-B-Q's perimeter landscaping (see Exhibit "C" - Conditions of Approval). In
addition, the landscape plan proposes Drake Elm, Purple Glory Tree, Downey
Jasmine, and Dwarf White Indian Hawthorne. Four (4) Washintonia Palm
trees and 18 Plumbago shrubs are proposed at the front entry sidewalk near
the center of the eastern property line.
The plan proposes Washingtonia Palm, Wax Jasmine, Purple Glory Tree, and
Gold Lantana in the northern perimeter buffer The southern and western
perimeter buffer will contain Sweet Mahogany trees and Viburnum hedges.
The interior and terminal landscaped islands in the parking areas will contain
Washigtonia Palm, Drake Elm, Dwarf Yaupon Holly, and Parson's Juniper
Downey Jasmine, Gold Lantana, and two (2) Purple Glory Trees are proposed
at the southern project entrance. The north entrance will contain
Washingtonia Palm, Downey Jasmine, Gold Lantana, and four (4) Purple
Glory Trees.
Building and Site: Building and site regulations will be fully met when staff comments are
incorporated into the permit drawings. The building will be 150 feet - 6 inches
in width and approximately 65 feet in depth.
Community Design: This project is reviewed in part, according to the standards as specified in the
Wal-Mart Center Master Plan Design Standards June 1999 (see Exhibit "C"-
Conditions of Approval). The proposed building will be a one-story structure
with the top of the roof to stand nearly 21 feet in height. The ends of the
building (north and south elevation) will have faux chimneys that will reach a
height of approximately 27 feet. The main wall color will be a light cream
(Benjamin Moore Adobe White - 2166.70). The front entrance and the
chimneys will be painted a tan color (Benjamin Moore Creamy Orange -
2166.50). The roof will be made of flat Terra Cotta concrete roof tiles,
manufactured by Monier Lifetile. The front fa<;:ade (east elevation) will have
four (4) dormers to break up the expanse of roof area. These dormers will be
painted to match the main wall color (Benjamin Moore Adobe White -
2166.70). The walls of the building will have a smooth stucco finish. All
dormers will have white decorative aluminum shades. All windows will have
white aluminum hurricane impact resistant windows with clear glass. All trim
pieces, windows, door frames, and shades are to be painted white. The

gutters and downspouts will be painted white as well. The roof style, building
color and design for the proposed project are compatible with the colors used
for the Wal-Mart building, Sonny's BBQ restaurant, and Boynton Commons
Shopping Center The Steak & Shake restaurant was not subject to the Wal-
Mart Center Master Plan Design Standards.
Signage:
The maximum allowable wall signage area is based upon the standard of one
and one-half (1 - )12) square-feet of sign area for each one (1) linear foot of
building frontage. As proposed, the maximum allowable area for all wall signs
shall not exceed 225 square feet (see Exhibit "C" - Conditions of Approval).
The elevations indicate that the wall signs would be located above the front
entrance and also on the sides (faux chimneys) of the building. The "Golden
Corral" sign will have red channel letters and the "Buffet and Grill" will have
white letters on a black background cabinet sign. As currently proposed, the
total area of all wall signs would be 178.8 square feet.
The applicant is proposing one (1) monument sign to be located at the
northeast corner of the property This sign will be eight (8) feet - ten (10)
inches wide and stand ten (10) feet in height. It will have a concrete block
structure base with the finish and color to match the proposed building (either
Benjamin Moore Creamy Orange or Adobe White). The "Golden Corral Buffet
and Grill" sign will be internally lit and have a molded plastic lense with brown
colored border The word "Golden" appears to be orange and the word
"Corral" appears to be yellow The words "Buffet and Grill" appear to be white.
All letters will be on a red background. The site address will be located on the
base of the sign above the color groundcover plants.
RECOMMENDATION:
Staff recommends that this site plan request be approved subject to the comments included in
Exhibit "C" - Conditions of Approval. The Technical Review Committee (TRC) recommends that the
deficiencies identified in this exhibit be corrected on the set of plans submitted for building permit.

It is now a requirement to install an approved keyed lock box to store safety data sheets. floor
plans, site plans, and building access keys for authorized use in the case of an emergency by
the Fire Rescue Department. The approved keyed lock box must be installed within ninety (90)
days of receipt of this written notice from the Fire Rescue Department. The specifications and
location of the required keyed lock box shall be as designated by the Fire Rescue Department.
The National Fire Protection Association (NFPA) Standard 704, Standard System for
Identification of the Fire Hazards of Materials, shall be incorporated with the application of the
keyed lock box to provide exterior warning symbols for emergency responders. Hazardous
materials identification placard(s) shall be installed in accordance with NFPA Standard 704
Applications for an approved keyed lock box may be obtained by mail by calling 742-6600 or
fax your request to 364-7382,
The Fire Rescue Department may direct that the items specified above be revised or reinstalled
at any time The City shall bear no expense for initial or subsequent work required of a user

INFORMATION LETTER
Hazardous substances and hazardous waste which are present in the community may pose
acute and chronic health hazards to individuals who live and work in the City of Boynton Beach
if such individuals are exposed to these substances as a result of fires, spills, industrial
accidents or other types of releases or emissions, Emergency service personnel in the City
have a need to know of the use and dangers of hazardous materials in the community in order
to plan for the response to potential emergencies and exposure to such materials, Basic
information on the location, type and the health risks of hazardous materials being used or
stored in the City is not now sufficiently available to firefighters, health officials, planners, and
other emergency response personnel. Disclosure of such information is essential to these
persons in meeting their responsibilities for the health and welfare of the community
Hazardous Material: means any substance or product for which the manufacturer or producer is
required to prepare a Material Safety Data Sheet (MSDS) for the substance or product pursuant
to the Superfund Amendments and Reauthorization Act (SARA) Title, III, October, 1986 and/or
Chapter 252, Florida Statutes the Florida Hazardous Materials Emergency Response and
Community Right-To-Know Act. July. 1988, provided that a substance may additionally be
deemed a hazardous material or hazardous waste upon a finding by the Fire Chief that the
substance, because of its quantity, concentration or physical or chemical characteristics, poses
a significant potential hazard to human health and safety or to the environment if released into
the community Should the Fire Chief at any time determine that otherwise exempted materials
should be subject to disclosure, the Fire Chief may require the submission of a disclosure form.
Hazardous waste means any material that is identified in the Code of Federal Regulations,
Title, 40, Sections 261.31-261 33,
DISCLOSURE FORM REQUIREMENTS AND EXEMPTIONS.

Any person who uses or handles a hazardous material must semiannually,
during the months of January and July, submit a complete disclosure form to the
Boynton Beach Fire Rescue Department.

amounts are not exempt from disclosure
c) Any person, while engaged in the transportation or storage of hazardous
materials, within the provisions of Title 49 of the Code of Federal
Regulations, Subchapter c, as exists or as hereafter amended or
changed.
d) Infectious waste generated by hospitals, medical centers, clinics, and
other health care facilities
7 Record keeping; exemption from public disclosure,
a) Upon receipt of a disclosure form, the Fire Rescue Department shall
maintain files of all disclosure forms received,
b) Under the provisions of 252.88(3), Florida Statutes, any and all
information, including but not limited to, site plans and specific location
information on hazardous materials furnished to the Fire Rescue
Department pursuant to this section shall be confidential and exempt from
the provisions of 119 07(1), Florida Statutes
Enforcement. The Fire Chief or designee is authorized and empowered to enforce the
provisions of this Chapter The enforcement may include the inspection of hazardous materials
in use, storage, or disposal, review of hazardous materials records, the sampling and testing of
haza~dous materials, and other activities directly related to the enforcement of this section, No
person shall obstruct or interfere with the Fire Chief or designee in the performance of these
duties
Violations In addition to the penalties and remedies provided in section 252.66, Florida
Statutes, any violations of the provisions of this section shall be punishable as provided for in
section 2-91 and 9-61 of the City of Boynton Beach Code of Ordinances,

2, Any person, who, during the calendar year, for the first time becomes a user or
handler of any hazardous material, must submit a completed disclosure form to
the Boynton Beach Fire Rescue Department within fifteen (15) days of becoming
a user or handler Thereafter, any such user or handler shall comply with the
provisions of Subsection (b) (1) above
3_ The City of Boynton Beach Fire Rescue Department may, upon written notice,
require the submittal of a disclosure form of any user or handler The user or
handler shall submit a completed disclosure form within fifteen (15) days,
4 Any person required to submit a disclosure form pursuant to this Section shall file
with the Boynton Beach Fire Rescue Department an updated disclosure form
within fifteen (15) days of any of the following:
a) A change in business address
b) A change in business ownership
c) A change in business name,
d) Cessation of business operations.
e) The use or handling of a previously undisclosed hazardous material.
f) A significant change in the use, handling, or manufacturing of a hazardous
material for which disclosure has been previously made.
g) The hazardous characteristics of every hazardous material disclosed,
including, but not limited to, toxicity, flammability, reactivity, and corrosivity as
may be required by the Fire Rescue Department.
5 Upon request, all users must provide the following information.
a) To the Fire Rescue Department, any information determined by the
Department to be necessary to protect the public health, safety, or the
environment.
b) To any physician, where the physician determines that such information is
necessary to the medical treatment of his or her patient and to the extent
allowed by law
6 Exemptions From Disclosure, The following materials or persons are exempt
from disclosure requirements:
a) Hazardous materials or substances contained in food, drug, cosmetic, or
tobacco products,
b) Hazardous materials contained solely in consumer products packaged for
use by and distributed to the general public unless the product is
repackaged or altered in any way; provided, however, the manufacture

RE, Security Gates and Emergency Access
To Whom It May Concern:
Boynton Beach Fire Rescue continues to maintain the position that security gates are
potentially detrimental to fire and rescue operations, The proliferation of security gated
communities has resulted in many problems for responding emergency apparatus trying to gain
entry
The minimum performance for all security gates shall be as follows:
1 All security/entrance gates must have an electronic key number pad
2, The keypad will allow entrance by the simple act of pushing four (4) or five (5) buttons
3 All gales must have a security entry code approved in advance by the Fire Marshal.
4 Gates may be operable by telephone from our dispatch office A phone call from our
dispatchers will open the gate and a second call will be required to close the gate
5 In case of power failure, the gate shall open automatically and remain open,
6 An exception will be where a 24-hour security guafd is stationed at the gate,
7 A back-up device such as an authorized security box or key switch is required to operate the
gate in the event the number pad entry does not work,
8 A key box shall be installed for such areas or buildings when the Fire Marshal determines
that access is necessary for all life-saving or fire-fighting purposes The type and location of
the key box shall be approved by the Fire Marshal and shall contain,
. Keys to locked points of egress, whether in common areas or on the interior or exterior
of such buildings;
. Keys to locked mechanical equipment rooms,
. Keys to locked electrical rooms,
. Keys to elevator controls,
9 No other code numbers, operating methods, or key systems will be kept on file by the Fire
Rescue Department.
10 In the event that our units are unable to gain rapid entry with the above methods, it will
require the use of rapid forcible entry methods to gain entry The City of Boynton Beach

result of gaining access to a specific area,

I have reviewed the above referenced Site Plans, forwarded to me on November 26,2001, against the Site
Plan Review requirements outlined in the City of Boynton Beach Code of Ordinances_ Following are my
comments with the appropriate Code and Land Development Regulations (LDR) referenced.
PUBLIC WORKS
Code Requirements
I The site compactor enclosure shall be constructed in accordance with City Standard A-88007 The
dumpster shall be supplied by Public Works (561-742-6200).
2. A minimum pad is required measuring 10 ft x 10 ft (inside dimension). (LDR, Chapter 7_5, Article II,
Section 5.J and Article III, Section 9.A.9.a)
3 The required gates for the enclosure shall contain long steel rods to drop into the pavement to secure
the gates in the open and closed positions. Drilled holes (for concrete) or metal sleeves (for asphalt)
shall be provided for the locking rods.
4 Walls for the enclosure shall be provided on three sides and are to be a minimum of 6 ft high and shall
be CBS construction with a finish matching that of the adjacent building(s) (indicated by note in the
plans/details). Accent shrubs shall be provided along the screen walles) (LDR, Chapter 7.5, Article II,
Section 5.1, Section 5 J and Article III, Section 9.A.9.a; and Chapter 9, Section 10.C.3),
ENGINEERING
Code Requirements
I On the Site Plan, add a general note that all plans submitted for specific permits shall meet the City's
Code requirements at time of application. These permits include, but are limited to, the following:
paving, drainage, curbing, site lighting, landscaping and irrigation. Permits required from other
permitting agencies such as Florida Department of Transportation (FDOT), South Florida Water
Management District (SFWMD), Lake Worth Drainage District (LWDD), Florida Department of
Environmental Protection (FDEP), Palm Beach County Health Department (PBCHD), Palm Beach

3 Provide an engineer's certification on the Drainage Plan (LDR, Chapter 4, Section 7.F_2) that meets
the SFWMD permit conditions placed on the Wal-Mart Master Site Plan_
4 Provide a statement on the plans showing that the containment capacity of the drainage system shall
contain the first 2Y, inches of storm water on the site per LDR, Chapter 23, Article II, Section F
5 Maximum runoff distance over impervious surfaces, before diversion to percolation areas, is 50 feet
(LDR, Chapter 6, Article IV, Section 5.B.2.a). Areas within the proposed parking lot exceed that
distance.
6. Indicate, by note, that the drainage system will conform to City Standard Drawing B-91007, at a
mlll1mum.
7 Catch basin and manhole covers shall be bicycle proof (LDR, Chapter 6, Article IV, Section 5.A2,f).
8. A manhole shall be required at the southwest tie-in to the existing storm sewer system. No core
connection will be allowed directly into an existing pipe conduit
9 Sidewalks shall be 5 feet wide (LDR, Chapter 6, Article IV, Section IO.T., and Chapter 22, Article I,
Section 5). New concrete sidewalk for pedestrian access from Winchester Boulevard. to the Golden
Corral does not meet the minimum standard width (44 inches) for handicap accessibility Also add
sidewalk along the rear of the building (west side) for pedestrian access from parking to the restaurant
If this area is already intended to have concrete sidewalk, please indicate so by note.
10. Sidewalks adjacent to parking lots shall be continuous through all driveways and shall be 6 in. thick
within driveways (LDR, Chapter 23, Article II, Section Pl.
II Show location of lighting on the Landscape Plan so conflicts between lighting and landscaping can
more easily be determined.
12. Replace or relocate large canopy trees adjacent to light fixtures to eliminate future shadowing on the
parking surface (LDR, Chapter 23, Article II, Section Al.b). There is a direct conflict between the
two northernmost light poles and the proposed Washington Palms in the landscaping islands. There is
the potential for future shadowing due to the proximity of the Drake Elm to the southernmost light
pole. Ensure there is no height conflict between the light on the south side of the building and trucks
using the Loading Zone.
13 Provide additional lighting along/at the rear of the building (west side). If lighting is available from
the adjacent site (Wal-Mart) so indicate by note_

14 Indicate sight triangles graphically on Site plan and Landscape Plan. Sight triangle requirements must
be met at all points of ingress and egress, as well as at all intersections,
15 Indicate, by note on the Landscape Plan, that within the sight triangles there shall be an unobstructed
cross-visibility at a level between 2.5' and 6' above the pavement (LDR, Chapter 7.5, Article II,
Section 5.H.).
16, Any proposed (or existing) trees within the utility easement paralleling Winchester Blvd. shall be
removed or relocated. Only palms will be considered for planting within any utility easements.
17 On the Site and Civil Plans, show and identify all necessary traffic control devices such as stop bars,
stop signs, double yellow lane separator striping, directional arrows, "Do Not Enter" signage, etc_
Delineate and stripe the "Loading Area", include a pavement message in yellow indicating "No
Parking - Loading Zone" See City Standard Drawings B-98001 and B-90013 for striping details.
18. Locate stop bars and stop signs four (4) feet behind the sidewalks.
Recommendations/Corrections
1 The City of Boynton Beach Code of Ordinances and Land Development Regulations can be viewed at
www.ci.bovnton-beach_fl.us.
2. Indicate which edition of the FDOT Standard Specifications for Road & Bridge and Standard Index is
to be used - the 2000 Specifications are recommended since they have both English and Metric units.
3 Proof of other agency permits shall be required prior to the issuance of the paving and drainage
permit.
4 Identify owner of storm drain system. Provide proof of agreement with owner of storm drain system
that allows tie-in to the existing facility Provide a copy of the SFWMD modified permit.
5 Show a graphic scale with the written scale, Sheet A-I O.
6, Provide a "Standard Duty Concrete Pavement" detail. Since asphalt is not called out in the plans, the
"Standard Duty Asphalt Pavement" detail is not necessary, unless that is your intention. If so, please
correct the plans accordingly
7 Specify minimum compressive strength of 3500 psi for the concrete pavement. Minimum depth of
subgrade is 12 inches. (LDR, Chapter 23, Article II, Section Q),
8, At the three (3) egress drive(s) show double, 4 inch yellow stripes delineating the two-way traffic
lanes for clarity (LDR, Chapter 23, Article I, SectIOn B),

9 Add stop bars and stop signs at the east/west drive aisles at the north egress driveway Eliminate the
northbound stop bars and stop signs for the northbound drive aisle immediately south of the north
driveway and for the next aisle to the west. This will establish vehicular right-of-way in this area
(LDR, Chapter 23, Article I, Section 1.B)
10. Show and identify "Pedestrian Crossing" signs on site plan. (Sheet A-1.0)
II It is recommended that a 12 inch wide stripe, with 24 inch spacing, be used for the pedestrian
crosswalk from Winchester Boulevard to the restaurant.
12. Provide lighting details as specified in the LDR, Chapter 23, Article II, Section A.I.a.
13 Separate wheel stops are not necessary with a continuous curb around the exterior parking spaces.
Where continuous curb is used, it may be moved into the parking spaces two feet to act as a
continuous wheel stop,
UTILITIES
Code Requirements
I No improvement plan or utility plan was included with this submittal, therefore the Utilities
Department considers this plan incomplete as submitted. However, since this proposal is located
where utility support is available, we are providing a cursory review ofthe plan submittaL
2. All utility easements shall be shown on the rectified site plan and landscaping drawings so that we
may determine which trees may interfere with utilities. In general, palm trees will be the only tree
species allowed within utility easements. Canopy trees may be planted outside of the easement so
that roots and branches will not impact those utilities within the easement in the foreseeable future.
The LDR, Chapter 7.5, Section 18.1 gives public utilities the authority to remove any trees that
interfere with utility services, either in utility easements or public rights-of-way
3 Palm Beach County Health Department permits may be required for the water and sewer systems
serving this project (CODE, Section 26-12).
4 Fire flow calculations will be required demonstrating the City Code requirement of 1,500 g.p.m.
as stated in the LDR, Chapter 6, Article IV, Section 16, or the requirement imposed by insurance
underwriters, whichever is greater (CODE, Section 26-16(a)).
5 CODE, Section 26-34(E) requires that a capacity reservation fee be paid for this project either
upon the request for the Department's signature on the Health Department application forms or
within 30 days of site plan approval, whichever occurs first. This fee will be determined based
upon final meter size, or expected demand,
6. Comprehensive Plan Policy 3 C.3 4 requires the conservation of potable water City water may
not, therefore, be used for irrigation where other sources are readily available.

Recommendations/Corrections
I Water and sewer lines to be owned and operated by the City shall be included within utility
easements. Please show all proposed easements on the engineering drawings, using a minimum
width of 12 feet. The easements shall be dedicated via the record plat or by separate instrument to
the City as stated in the CODE, Section 26-33(a),
2_ The LDR, Chapter 6, Article IV, Section 16 requires that all points on each building will be within
200 feet of an existing or proposed fire hydrant. Please demonstrate that the plan meets this
condition, by showing all hydrants.
3 PVC material is not permitted on the City's water system. All lines shall be DIP
4 Water meter sizes are smaller than normally installed for the service line size specified. Please
provide engineering calculations, or an explanation of why the service lines are over-sized.
5 Appropriate backflow preventers will be required on the domestic water service to the building,
and the fire sprinkler line ifthere is one, in accordance with CODE, Section 26-207

handicap accessible entrance doors to the building. The location of the door(s)
shall match the location of the accessible entrance doors that are depicted on the

3 Add a labeled symbol to the site plan drawing that represents and delineates the
path of travel for the accessible route that is required between the accessible
parking spaces and the accessible entrance doors to the building. The symbol

of travel, not the location of the detectable warning or other pavement markings
that are required to be installed along the path. The location of the accessible path
shall not compel the user to travel in a drive/lane area that is located behind

drawing that would indicate that the symbol represents the accessible route and

provide detailed documentation on the plans that will verify that the accessible
route is in compliance with the regulations specified in the Florida Accessibility

5. Identify within the site data the finish floor elevation (lowest floor elevation) that is
proposed for the building{s)_ Verify that the proposed elevation is in compliance
with regulations of the code by adding specifications to the site data that address
the following issues [Section 3107 1.2, Chapter 31 of the Boynton Beach
amendments to the 1997 edition of the Standard Building Code]:
a) The design professional-of-record for the project shall add the following text to
the site data. "The proposed finish floor elevation _ _ NGVD is above the
highest 100-year base flood elevation applicable to the building site, as
determined by the South Florida Water Management District's surface water
management construction development regulations."
b) From the FIRM map, identify in the site data the title of the flood zone that the
building is located within. Where applicable, specify the base flood elevation, If
there is no base flood elevation, indicate that on the plans.
c) Identify the floor elevation that the design professional has established for the
building within the footprint of the building that is shown on the drawings titled
site plan, floor plan and paving/ drainage (civil plans).
5 As required by Chapter 4, section 7 of the Land Development Regulations, submit
a floor plan drawing. The building plans are not being reviewed for compliance with
the applicable building codes. Therefore, add the words "Floor plan layout is
conceptual" below the drawing titled Floor Plan found on sheets A-2.0 However,
add to the floor plan drawing a labeled symbol that identifies the location of the
handicap accessible entrance doors to the building. The location of the doors shall
match the location of the accessible entrance doors that are depicted on the site
plan drawing.
6. Add to the site plan drawing all existing easements that are shown on the survey
Also, add all proposed easements. The location, type and size of the easements
shall be shown and identified on the site plan. Where applicable, amend the plans
so that structures do not encroach into an easement.
7 Place a note on the elevation view drawings indicating that the wall openings and
wall construction comply with Table 600 of the 1997 edition of the Standard
Building Code.
8 On the site plan, indicate within the footprint of the building the number of stories
that are in the building including, where applicable, mezzanines. Also, add to the
site data the number of stories in the building including identifying mezzanines,
where applicable. Indicate the overall height of the building within the site data_
The overall height of the building shall not exceed the height limitations of the
Zoning Code.
9 On all floor plan drawings, indicate within the footprint of the building the number of
stories that are in the building including, where applicable, mezzanines.
10 At time of permit review, provide a completed and executed City unity of title form.
The form shall describe all lots, parcels or tracts combined as one lot. A copy of
the recorded deed with legal descriptions of each property that is being unified is
required to be submitted to process the form. The property owner that is identified
on each deed shall match.
11 At time of permit review, submit signed and sealed working drawings of the
proposed construction.
12. At time of permit review, submit a copy of the recorded resolution that verifies the
abandonment of the allev. riaht-ot-wav or easement.
13 To properly determine the impact fees that will be assessed for the project, identify
on the site plan if the restaurant is a high quality, eat-in high turn over, or fast food
with drive-through type of restaurant. Also, identify on the site plan the number of
existing seats, number of new seats and the total number of seats provided_ On
the floor plan, chronologically number all seats including those seats that are
around the bar
14 At time of permit review, submit for review an addressing plan for the project.
15. Add to all plan view drawings of the site a labeled symbol that represents the

CODE REQUIREMENTS
The site plan and master plan design documents shall adhere to Chapter 9 of the
Code of Ordinances of the City of Boynton Beach entitled "Fire Protection and
Prevention," This ordinance adopts NFPA I, Fire Prevention Code, 1997 editIOn,
and NFP A 101, Life Safety Code, 1997 edition.
2, Design documents shall demonstrate compliance with LDR Chapter 6, Section 16,
which provides requirements for hydrants, Hydrants in commercial applications
shall be no more than 300 ft. apart and the remotest part of any structure shall be
no more than 200 ft. from a hydrant. Connections shall be to mains no less than 6
inches in diameter ]n addition to domestic requirements at a residual pressure of
not less than 20 psi, a fire flow of at least 1500 gpm is required.
3 Design documents where underground water mains and hydrants are to be
provided, must demonstrate that they will be installed, completed, and in service
prior to construction work per NFP A I, (1997) Section 41-2.3.2,
4 Pursuant to City Ordinance 9-3F, the Fire Marshal has developed an
Administrative Order dated May 9, 2001, that provides the minimum performance
for all security gates and emergency access. Another Administrative Order dated
May 15,2001 addresses Knox Box storage of information forresponding
emergency personnel.

5 Design documents must demonstrate compliance with the requirements for fire
lanes that are provided in Section 9-21 of the City Ordinances. Signing and
marking are described in LOR Chapter 23 Section B2

This project will require a cross access agreement with the property to the west. Prior to the issuance
of any permits, the Wal-Mart site plan must be administratively approved for a minor site plan
modification to allow for the new entrance (southwest comer of Golden Corral property).
No building permit shall be issued until the plat is recorded.
An acceptable traffic study is required for this project.
Include a note on the site plan's parking summary that this project will utilize six (6) of Wal-Mart's
parking spaces via the construction of a drive aisle. The note should also indicate that in the future, at
least six (6) of the restaurant's excess parking spaces should remain and made available to Wal-Mart.
The landscape plan must identify the existing plant material (in the perimeter landscape buffers only)
and their specifications in order to ensure that the project landscaping meets current code.
The landscape plan must provide a tabular summary of proposed I required trees and shrubs.
The configuration of the parking lot on the photometric plan does not match the parking lot on the site
plan, All plans must match.
The total lot area shown on the tabular data of the site plan does not match the total lot area on the
survey Provide the lot area expressed in acres as welL
Submit a color sample I swatch of all major exterior finishes_ Each sample and I or elevation shall
include the manufacturer's name and color code. On the elevations, identify where each color will go
as it relates to the paint color schedule (Chapter 4, Section 7,D I ).
Normally, landscape buffers adjacent to public rights-of-way are required to be seven (7) feet in
width. However, the Wal-Mart Center Master Plan Design Standards will supersede the standard
buffer width requirement. According to the Wal-Mart Center Master Plan Design Standards, the
subject property's perimeter landscape buffer shall be 10 feet in width along Winchester Park
Boulevard.
The front landscape buffer along Winchester Park Boulevard shall contain two layers of plant
materiaL The first layer shall be a combination of colorful p,oundcover plants and a minimum of two
colorful shrub species planted in a continuous row The 2n layer shall consist of a continuous hedge
or decorative site wall. The continuous hedge (2nd layer) shall be a minimum of 24 inches in height,
24 inches in spread and planted with tip-to-tip spacing immediately after planting. The hedge shall be
maintained at four (4) feet. If a decorative site wall is used, it shall be constructed not less than three
(3) feet in height (Chapter 7.5, Article II, Section 5.D).
Landscaping at project entrances shall contain a minimum of two (2) colorful shrub species on both
sides of the entrance and a signature tree (Chapter 7.5, Article II, Section 5.N.). Note that signature
trees do not contribute toward the total number of required perimeter trees or parking area interior
landscaping. (Chapter 7.5, Article II, Section 5 G.). Provide one (I) additional signature tree, such as
Yellow Elder, Tibouchina granulosa, or Bougainvillea at each side of the project entrances. These
signature trees shall have a minimum of six (6) feet of clear trunk to preserve the clear sight area,
All required trees shall be at minimum 12 feet overall height and 3 caliper inches when planted
(Chapter 7.5, Article 11, Section 5.C.2.).
The base of the monument sign shall be enhanced with colorful groundcover plants and a minimum of
two (2) colorful shrub species (Chapter 7,5, Article 11, Section 5 0 ).
At least fifty (50) percent of the site landscape material must be native species and verified as such in
the tabular data of the landscape plan (Chapter 7.5, Article 11, Section 5.P ).
Sculptures, fountains, gardens, and benches shall be encouraged within the site design (Chapter 9,
Section 10.H.).
All above ground mechanical equipment such as exterior utility boxes, meters, and transformers shall
be visually screened with appropriate landscaping I hedge material. (Chapter 9, Section IO.CA.). The
backflow preventer shall be painted to match the principle structure,

pole material, height, and color. The design, style, and illumination level shall be compatible with the

This project is reviewed in part, according to the standards as specified in the Wal-Mart Center Master
Plan Design Standards June 1999 Staff recommends utilizing all or some of the same colors that were
used for the Wal-Mart building, Sonny's BBQ restaurant, and I or Boynton Commons Shopping
Center. Please note that the Steak & Shake restaurant is not subject to the Wal-Mart Center Master
Plan Design Standards,
Provide an improved representation of the proposed monument sign, including total signage area and
materials I colors which accurately show the appearance of the sign in order to confirm architectural
compatibility with the principle building. According to the Wal-Mart Center Master Plan Design
Guidelines, the maximum allowable signage area is 48 square feet on each side_ In addition, clearly
identify the site address on the monument sign (Chapter 21, Article IV, Section 2.B)
The maximum allowable area for all wall signs shall not exceed 225 75 square feet. On the
elevations, indicate the wall signage area on each facade (when applicable) to ensure that collectively,
all wall signs do not exceed this amount (Chapter 21, Article N, Section 2.C.). In addition, staff
recommends that the signage area for each sign should be shown in a table format as well.
Lighting shall not be used as a form of advertising in a manner that draws more attention to the
building or grounds at night than in the day Staff strongly recommends eliminating the "neon"
lighting from the project elevations. Staff recommends substituting the neon lighting regarding the
walls signs with channel letters or cabinet signs. Lighting may be used to illuminate a building and its
grounds for safety purposes and to enhance its beauty However, the visual effect shall be subtle
(Chapter 21, Section IO.F). Neon lighting would be contrary to the intent of the Code,

Find attached for your review the plans and exhibits for the above-referenced project. Please review the
plans and exhibits and transmit formal written comments. Comments should be made available
via e-mail to Sherie Coale and I no later than 5:00 P.M. on December 11, 2001. When preparing
your comments, please separate them into two categories; code deficiencies with code sections
referenced and recommendations that you believe will enhance the project.
Adhering to the following review guidelines will promote a comprehensive review and enable the
applicant to efficientiy obtain Technical Review Committee approval:
1 Use the review standards specified in Part IV, Land Development Regulations, Site Plan Review
and the applicable code sections of the Code of Ordinances to review and formulate comments_
2, The documents submitted for the project were determined to be substantially complete with the
exception of traffic data, however, if the data provided to meet the submittal requirements is
insufficient to properly evaluate and process the project based on the review standards or the
documents show code deficiencies, additional data and/or corrections should be requested by the
reviewer by contacting Lusia Galav, or myself
3, Each comment shall reference the section of the code that is incorrectly depicted on the
documents.
4 Technical Review Committee member(s) shall identify in their comments when the plans depict or
when the location and installation of their departmental required improvements may conflict with

5 When a TRC Member finds a code deficiency that is outside of his/her review responsibility, the

frame stated above, to me_ The memorandum shall state that the plans are approved and that they
do not have any comments on the plans submitted for review and that they recommend the project
be forwarded through the approval process.

On January 29,2003, I performed an inspection of the landscape installation for the Golden Coral
Restaurant on Winchester Park Boulevard in Boynton Beach, Although the installed material differed
from that which was specified, the overall appearance was good, Following is a list of (A) what needs to
be planted to complete the installation process and (B) acceptable changes to the plan, which occurred
during construction or were existing conditions at the time of planting_
A. I Plant balance (l17:J:.) of Indian Hawthorn, as specified at the north and east edges of the property
2. Plant balance (133:J:.) of Cocoplum as backing to hedge along Winchester Park Boulevard.
3 Plant third tree Ligustrum along the west edge of the building as specified.
4 Plant 12 Dwarf Scheftlera to enhance the screening of the west side of the dumpster wall at the
southwest corner of the building.
5 Plant 20% additional "undersized" groundcovers to fill in the plantings as follows:
Add 62 Croton (specified 18" ht.! installed 6-14" ht).
Add 28 DwarfYaupon (specified 10" x 12"/installed 6"x6" - 8"x8" ht.)
6, Replace dead Mahogany in the parking lot "finger-island" along the Winchester Park Boulevard,
7 Stake all the trees per specifications.
B. I Washington Palms (29 each) replaced with Cabbage Palms (natives)_
2_ 12' Tibouchina replaced (2.1) with 6' Tibouchina.
3 Plantings along Winchester Park Boulevard shifted closer to the parking lot. Planted on the crest
ofbennlbetter screen and presentation from Winchester
4 Three Cabbage Palms proposed in the southwest corner shifted to the northeast corner due to the
constricted space/larger canopy trees in place.

Thank you for speaking with me earlier today regarding the landscape plan for the
Golden Corral Boynton Beach project located at the intersection of Old Boynton
Road and Winchester Park Boulevard.
As we discussed, the current landscape plan dated March 13,2002 (Revised May
28,2002) reflects an existing plant material list indicating 168 existing
Raphiolepis indica, Indian Hawthorn and a proposed plant list material indicating
89 proposed Indian Hawthorn. The landscape plan graphically shows 168 Indian
Hawthorn, but only calls out 49 existing Indian Hawthorn on plan. Please be
advised that there are 119 existing Indian Hawthorn shrubs graphically shown
along the north property border of the landscape plan. These shrubs are not called
out in plan view Please see the attached drawing.
As sPecified in the City Commission approved plans_ the llroposed Golden Corral
Boynton Beach restaurant llroieet will be constructed to contain more thaT) 206
RaDhio/eois indica. Indian Hawthorn shrubs. as specified in the City Commission
