In response to your request for the administrative review and approval of the modification proposed to the above-
referenced, approved site plan, please be informed that the changes as shown on the revised plans date stamped
07101/02 are "minor", as defined within the Land Development Regulations, Chapter 4- Site Plan Review The
following changes to the plan are approved as follows:
. Relocate dumpster enclosure to southwest corner of site
. Eliminate drive aisle
. Install new landscaping and pervious area.
This project may continue to be processed by the Building Division as a permit application subject to the following
conditions:
1. The removal of plant material is subject to review and approval of the City Forester / Environmentalist;
2. Continue the hedge around all three (3) sides of the dumpster enclosure so that it complies with Chapter 9,
Section lO.C.3.
3. Indicate by note that the site dumpster enclosure is to be constructed in accordance with City Standard A-
8807
4 Indicate by note, or on a dumpster detail that the required gates for the dumpster shall contain long steel rods
to drop into the pavement in order to secure the gates in the open and closed positions. Drilled holes (for
concrete) or metal sleeves (for asphalt) shall be provided for the locking rods.

AN ORDINANCE OF THE CITY OF BOYNTON BEACH,
FLORIDA, AMENDING CHAPTER 23 OF THE LAND
DEVELOPMENT REGULATIONS OF THE CODE OF
ORDINANCES OF THE CITY OF BOYNTON BEACH,
FLORIDA, PROVIDING FOR SEPARATE PARKING LOT
STANDARDS FOR THE coMMUNITY
REDEVELOPMENT AREA, PROVIDING FOR
SEVERABILITY, CONFLICTS, AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the City Commission by Resolution No. 81-SS and Ordinance 83-41
eated the Community Redevelopment Agency to eliminate conditions of blight and
romote economic growth and development; and
WHEREAS, such economic growth and development aids the City and is a benefit to
e public becau~e it provides jobs for the residents of the City, increases the ad-valorem tax
ase of the City, and provides income for residents of the City; and
WHEREAS, the structural age, lot sizes, amount of vacant land, densities and
hysical character of the Community Redevelopment Area is generally different from that of
e rest of the City; and
WHEREAS, the economic growth and development of this area reqUITes a
ecognition of its different physical character; and

WHEREAS, typical suburban development standards do not recognize this difference
character or allow for ,the density of development I).ecessary to promote growth and
evelopment in the Community Redevelopment Are~ and

WHEREAS, parking lot standards are one of the elements that have an impact on
owth and development in the Community Redevelopment Area;
NOW, THEREFORE, BE IT ORDAll'lED BY THE CTIY COMMISSION OF
CITY OF BOYNTON BEACH, FLORIDA THAT:
Section 1.
The foregoing Whereas clauses are true and correct and incorporated
erein by this reference.
Section 2. Chapter 23, of the Land Development Regulations of the City of
oynton Beach is hereby amended as follows:

Article II. Required Improvements.
Parking lot layout
1 Dimensions, Parking lots shall be designed to meet or exceed the dimensional
requirements for stalls, driveways and access aisles as provided in city standards.
Seoarate city standards shall aoolv in the Community Redevelooment Area
boundaries and said Standards shall be in a seoarate document and shall be
known as " City Parkinf! Lot Standards (or the Communitv Redevelopment Area"
as shown in Attachment "A".
Section 3. Should any section or provision of this ordinance or portion hereof,
any paragraph, sentence or word be declared by a court of competent jurisdiction to be
invalid, such decision shall not affect the remainder of this ordinance.
Section 4.
Authority is hereby granted to codify said ordinance.
Section 5.
This ordinance shall become effective immediately upon passage,

As requested by Planning & Zoning I reviewed the above referenced minor modification plan for the
change in dumpster location. We have no objections to the proposed change. Please have the designer
ensure the following items are addressed on the construction plans:
o Indicate, by note, that the site dumpster enclosure is to be constructed in accordance with City
Standard A-8807
o Indicate, by note, or on a dumpster detail that the required gates for the dumpster shall contain long
steel rods to drop into the pavement in order to secure the gates in the open and closed positions.
Drilled holes (for concrete) or metal sleeves (for asphalt) shall be provided for the locking rods.
o The Landscape plan provided did not indicate accent shrubs around the enclosure. Show that
accent shrubs shill be provided along the screen walls on the Site and Landscape plans (LDR,
Chapter 7.5, Article II, Section 5.J, Section 5.J and Article III, Section 9.A.9.a, and Chapter 9, Section
10.C.3)

permits shall meet the City's Code requirements at time of application.
These permits include, but are limited to, the following: paving, drainage,
curbing, site lighting, landscaping and irrigation. Permits required from

(FDOT), South Florida Water Management District (SFWMD), Lake

The follCMling information regarding the reference above is provided for your review.
The subject property consists of a parcel of land in the southeast of section 28, township 45 south
ranges 43 east, Boynton Beach, Palm Beach County, Florida. The land Use Map Designation of C3
(Community Commercial District) is consistent with the existing land use of Shopping and Church.
The proposal is to improve the existing building elevations and the quality of the existing parking lot by
doing the follCMling:
. Remove existing mansard roof on the East, North and South Church elevations
. Remove existing roof galleria on the East Shopping elevation
. Remove existing Church entrance and existing planter
. Add a new side walk on East and South Church elevations
. Add new continuous canopy roof on the East shopping elevation and the East and South
Church elevations.
. Add new ceiling mounted light fIXtures under new canopy roof,
. Apply new stucco finish on existing walls at East and South Church elevations and East
Shopping elevation.
. Re-paint of the existing North, West and South elevations.
. Add new landscape areas at the parldng lot, which will improve the site circulation.
. Add new lighting pole fixtures at the parldng lot.
. Add new pavers on the existing asphalt Church entrance.

We request a "minor modification" determination based on the following considerations:
. The above project description with the proposed modifications does not increase the building
square footage.
. The proposed modification does not cause the development to be below the development
standards for the zoning district in which it is located or other applicable standards in the Land
Development Regulations.
. The land uses does not vary.
. The proposed modification does not reduce the provided number of parking spaces below the
required number of parking spaces.
. The proposed modification does not have an adverse effect on adjacent or nearby property or
reduces required physical buffers.
. The proposed modification does not adversely affect the elevation design of the structure or
reduces the overall design of the structure below the standards stated in the community design
plan.
. The proposed modifications meet the concurrency requirements of the Boynton Beach
comprehensive plan.
