In response to your inquiry regarding documentation on the above-referenced application, our
records indicate that an application was filed on April 12, 2002 requesting our review and
administrative approval of site modifications as "minor" changes (see attached letters dated April
5, 2002), the application included a set of plans showing interior and site modifications and date-
stamped May 22, 2002, and the proposed modifications were deemed "minor" as indicated in the
approval letter issued by the City of Boynton Beach on June 13, 2002 (see attached copy). The
Planning & Zoning Division file number for this application is MMSP 02 - 029, meaning it was the
29th application for a minor site plan modification filed with the City in the Year 2002.

the utilization of the parking lot at the Gulfstream Mall. It is understood that Charter
School of Boynton Beach will use the parking lot between the hours of7 am.-7 p.rn. on
weekdays and Club Ovation Inc. will use the parking lot between the hours of7 p.m. - 7
am. seven days a week.

Thank you for your assistance in our request for Minor Modification to Site Plan Application
for the commercial project for the Charter School of Boynton Beach in Gulfstream Mall. The site
is zoned C-3 Please find attached, answers to the criteria stated in the application questions a
through g:
a This modification does not increase the build able square footage of the existing
development by five percent (5 %).
b. This modification does not reduce the number of parking spaces.
c. This modification does not cause the development to fall below the applicable zoning
district standards or the Land Development Code and Regulations.
d. This interior renovation does not l!-dversely effect the adjacent or nearby properties,
or nearby property, or reduce buffers. No trees or hedges will be touched for this
project.
e. This interior renovation does not adversely effect the elevation design of the structure
or nearby property, or reduce buffers. No trees or hedges will be touched for this
project.
f. This modification meets the concurrency requirements of the Boynton Beach
Comprehensive Plan.
g. This modification does not alter the site layout so that the modified site plan does not
resemble the approved site plan.

In response to your request for the administrative review and approval of the modification proposed to the
above-referenced, approved site plan, please be informed that the interior renovations and parking lot changes as
shown on the revised plans date stamped OS/22/02 are "minor", as defined within the Land Development
Regulations, Chapter 4- Site Plan Review The plan also shows the addition of 59 parking spaces.
This project may continue to be processed by the Building Division as a permit application subject to the
following conditions:
1. If the scope of the project demands removal of plant material then the new plant material and/or
relocation of existing plant material is subject to review and approval of the City Forester /
Environmentalist;
2. The two (2) new dumpsters shall have dumpster enclosures to be constructed in accordance with City
Standard A-8807 The dumpster enclosure shall have a six (6) foot high, C.B.S. wall on three sides with
hinged gates in the front on a 12-foot wide by II-foot deep slab. The color of the walls shall match that
of the principal building with accent shrubs planted on all three (3) sides.
Be advised that the proposed changes may require a modification to the building permit. Please contact me at

approval. The landlord and new tenants request a children's outdoor play area to replace the existing
outdoor fenced area, and a school bus drop-off area to the north of the site. These two site plan
modifications will not reduced, nor change the number of existing parking spaces. Secondly, the
Charter School requests permission to post "Special Event Signs"as shown on the site plan attached.
The landlord has drafted and executed a "Shared Parking Agreement" between the tenants
to allow double use of the available parking spaces by separating daytime and nighttime uses by the
tenants' operational hours. (See the attached letter) We respectfully request the approval of this
request for minor site plan modification based on the subtnitted documents. Additionally, "The
Charter School of Boynton Beach" will only operate daytime hours from 7'00 a.m. to 6:00 pm on
weekdays only, and the executed lease has a restriction on the school's operational hours. The
building permit drawings will be subtnitted for building permit after your division's approval.
The Charter School of Boynton Beach appreciates your assistance in this application process
and occupational process. Thank you for your timely action.

It was a pleasure to meet recently with Boynton Beach city staff, you, Matt Jr and the prospective lessee, and
my prospect, the Charter School of Boynton Beach.
As a result of this meeting, 1 concluded from Michael Rumph, Senior Planner, that the intended school use for
your building is in compliance with the current zoning of the property
The City Of Boynton Beach staff also in attendance, Ed Yates, Eric Johnson, Lusia Galar and Jose Alfera
mutually confirmed city code compliance to the intended use and required number of parking spaces for this
specific use.
At the suggestion of city staff, I will recommend to my prospect Pamela Owens, representing the Charter School
of Boynton Beach, that she request a fire code inspection ofthe property to ascertain compliance to local fire
codes and regulations.
Lastly, 1 will remind your attorney Michael Weiner, whom I understand will be drafting the formal lease, to
include in the document the customary ten per cent (10%) commission of each month's rental payment, as earned
compensation to the procuring real estate broker of this lease transaction, T -Barr, Inc.' .
Ifthere is a negotiated lease option to purchase, as was my prospect's initial intent, please confirm with your
attorney that this language also be added to the document re: t~ procuring broker be compensated paid six per
cent (6%) of the sales price at the time of the formal closing.

StrategIc Plan
Phase I/Y ear 1 - Student Development: Classroom Plans/Objectives
A. Establish a school center to accommodate grades kindergarten, first, second, third, fourth and fifth grades. The
classrooms are to be equipped with networked computers and peripherals (headphones, speakers, printers, and
microphones) and select, reviewed and approved educational software and foreign languages curriculum.
B. Implement a theme-based computer curriculum and effective foreign language techniques that utilize the scope and
sequence concept, integrated thematic lesson plans and other innovative instructional methods. The curriculum will
meetthe requirements of the Florida Sunshine State Curriculum Standards. The curriculum also will incorporate the
National Council Teachers of Mathematics Standards, National Educational Technology Standards and the National
Science Education Standards. Students will develop classroom projects using the best educational software from
leading developers.
C. Utilize a student assessment tool that assists teachers in monitoring and reinforcing subject areas and skills with the
students, The skills assessment tool determines the students' strengths and needs. Approaches to strategies for
academic and skills improvement are determined and used by the teachers to help students progress academically
