9. Swimming pools and spas.
a. Principal and accessory use.
(1) Principal use. Any swimming pool or spa or screen enclosure owned and operated as a
commercial enterprise existing singularly or in combination with other commercial recreation
uses on 1he same property shall be considered as a principal use subject to the property
development regulations of the applicable district.
(2) Accessory use. Any swimming pool or-spa or screen enclosure operated by a non profit
assembly, social, civic organization, residential homeowners association, or resident of a single-
family dwelling shall be considered as an accessory use and shall exist in conjunction with the
principal use. regulations stated herein. The accessory use shall be located on the same lot of the
principal use except if operated by a residential homeowners association. If operated by a
residential homeowners association then the accessory use shall be located within the
development boundary, as applicable.
b. Setbacks for accessory pools or spas.
(1) Setbacks for Swimming Pools. Setbacks shall be measured to the water's edge:

(2) Setbacks for Spas. Spas shall meet the following setbacks:
(a) Front and Side Comer - 25 feet
(b) Side Interior and Rear - 5 feet
(3) Setback Reductions.
(a) General. Swimming pools or spas may be constructed with a three (3) foot rear or side
interior setback for single family or zero lot line dwelling units provided the entire rear or
side interior property line is adjacent to open space Oake, natural preserve or golf course) a
minimum of fifty (50) feet in depth and all construction and earthwork is completed within
the owner's lot.
(b) Planned Developments. Setbacks for swimming pools or spas may be reduced in accordance
with the flexible regulations in Sec. 6.8.A.8.(f).1 and administrative deviations in Sec.
6.8.A.15.c. '
(c) Building coverage. Swimming pools or spas located at finished grade shall not be included
in the building coverage calculation unless contained in a building or within a screen
enclosure with a solid roof.

enclosure setback request. I find the project involves only minor site
modificatIons. The concerns I do have mvolve the Impact constructIOn of the
pools / screen enclosures will have on the eX1stmg trees located in the buffer
zones, recreatIOn / preserve zones and mdiv1duallots.
4 There are numerous, large, old Live Oak trees located throughout the
Lawrence Oaks PUD m these three zones. The developer of Lawrence Oaks
under Palm Beach County environmental code gUidelInes, had to preserve,
relocate and plant numerous Live Oak trees. There IS a tree management
document that directs protection methodologies for these trees.
5 I would like the applIcant to meet with me on the Lawrence Oaks property to
review these trees. We will then address protection of the trees as part of the
Master Plan Modification request. I have discussed this issue with Mr. Peter
DeStefano who IS willIng to meet with me and bnng the issue before the
Homeowners AssociatIon Board.

Find attached for your review the plans and exhibits for the above-referenced project. Please review the
plans and exhibits and transmit formal written comments or e-mail to Blythe Williamson and I no
later than 5:00 P.M. on June 30. 2000. When preparing your comments, please separate them into
two categories; code deficiencies with code sections referenced and recommendations that you
believe will enhance the project.
Adhering to the following review guidelines will promote a comprehensive review and enable the
applicant to efficiently obtain Technical Review Committee approval
1 Use the review standards specified in Part IV, Land Development Regulations, Site Plan Review
and the applicable code sections of the Code of Ordinances to review and formulate comments
2 The documents submitted for the project were determined to be substantially complete with the
exception of traffic data, however, if the data provided to meet the submittal requirements is
insufficient to properly evaluate and process the project based on the review standards or the
documents show code deficiencies, additional data and/or corrections should be requested by the
reviewer by contacting Lusia Galav, or myself
3 Each comment shall reference the section of the code that is incorrectly depicted on the
documents
4. Technical Review Committee member(s) shall identify in their comments when the plans depict or
when the location and installation of their departmental required improvements may conflict with

other departmental improvements.
5 When a TRC Member finds a code deficiency that is outside of his/her review responsibility, the
comment and the specific code section may be included in their review comments with the name of
the appropriate TRC Member that is responsible for the review specified.
6 If a TRC member finds the plans acceptable, he/she shall forward a memorandum, within the time
frame stated above, to me. The memorandum shall state that the plans are approved and that they
do not have any comments on the plans submitted for review and that they recommend the project
be forwarded through the approval process
All comments shall be typed, addressed and transmitted or e-mailed to Blythe Williamson and I for
distribution to the applicant. Please include the name and phone number of the reviewer on this
memorandum or e-mail. Lusia Galav will be the Planning and Zoning staff member coordinating the review
of the project. First review comments will be transmitted to the applicant along with a list of Technical
Review Committee (TRC) members
