Dear Mike,
I received the Development Order for the project. I want to thank you and your
staff for helping this project go smoothly.
We do agree to the following Conditions of Approval based Exhibit 'c' of the
second review with June 21, 2002 Planning and Zoning Department date stamp marking:
Public Works (General and Traffic), Utilities, Fire, Engineering #2, 3, 5, 6, & 7 (#4 was
omitted per #12 of CRA), Parks/Recreation, Forester/Environmentalist, Planning/Zoning
#10, & 11 (see below for #9), CRA #13, 14, 19, 20 & 21. CRA #15, 16, & 17 were
deleted by City Commission.
Re: Item #9 - Per City Commission, the monument sign was sized at 8'-0" wide X
7' -0" high. The wall sign was submitted to Eric Johnson on 6/29/02 for review. The sign
contractor will submit shop drawings prior to installation.
Re: Item # 18 - Per City Commission, the dumpster enclosure shall remain as
shown. Should an abundance of trash require a dumpster, parking space #14 and existing
trash enclosure can be removed and a dumpster enclosure can be constructed.

This letter is in response to your letter dated September 6, 2002, wherem you request confirmatIOn of
the "red tag" Issued by the City of Boynton Beach for unpermItted work mvolvmg a portIOn of the
above-referenced easement partially located at 202 West Boynton Beach Boulevard.
As mdlcated by the attached copies of the above-described documents, please be mformed that work
has been halted at thIS location, and the vIOlatIOn noticed for the removal of paving "along the
mgress/egress access" WIthout a permIt. ThIS process now reqmres that proper permIts be requested
and issued for the deSIred actiVIties, WIthin the time proVIded by the Code Compliance DIVISIOn of the
Police Department. Although I antiCIpate the need for addItional time to obtam the necessary permIts,
of more importance IS the fact that the review of Said permIt applicatIOns WIll draw the appropnate
attention to the access easement wluch has until now been absent from SIte plan and permIt documents

Dear Mr. Rumpf:
Please be advised that I represent Barbara Matthews, the owner of the
real property located at 220 West Boynton Beach Boulevard. The parcel
adjacent to the eastern boundary of my client's property was recently
purchased by Mr. Glenn Francis. A curb cut and driveway separates the
two (2) parcels pursuant to an Easement Agreement, which has existed
since June 7, 1976 (see Agreement attached). Mr. Francis has requested
my client to allow him to remove said driveway (less the curb cut) so that
he can complete construction of a day school on his property.
Ms. Matthews directed me to advise Mr. Francis that she was not
agreeable to changing the mutual private easement in any respect and
directed that he take no action that would obstruct her ingress and egress
(see copy of letter attached). Unfortunately, Mr. Francis has chosen
to disregard the provisions of the Easement Agreement and my letter by
proceeding to remove his portion of the driveway without the benefit
of a City of Boynton Beach permit. Due to his violation of the Easement
Agreement and failure to obtain an appropriate permit, it is our under-
standing that the City has "red flagged" Mr. Francis' project and that
no permits will be issued to him until the matter involving the private
easement is resolved. I would very much appreciate your contacting me
to confirm this understanding.

Dear Mr. Francis:
Please be advised that I represent Barbara Matthews, the owner of
the real property located at 220 W. Boynton Beach Boulevard. I have
reviewed with my client your letter to her of August 15, 2002 indicating
your proposal that you give her full access to the curb cut which lies
half on each side of your respective property lines, while you would
be taking your half of the driveway to complete the project you are
building. Please be advised that this proposal is not acceptable to
my client, as she requires the use of the complete driveway to permit
ingress and egress access to the parking lot to the rear of her building.
This private easement has existed since June 7, 1976, pursuant to
the Easement Agreement entered into by my client with Peter Genna and
Mary Genna, his wife, the predecessors in title to your property (see
copy of Easement attached). You will note that the Easement Agreement
provides that its purpose would be to establish an easement allowing
the parties, their guests, and invitees to use the property for ingress
and egress purposes and shall not be obstructed or blocked at any time
unless mutually agreed. This easement is to remain in full force and
h'ffect unless terminated by an instrument in writing executed by the
arties or their respective heirs, successors, person~l representatives,
,and assigns.
since Mrs. Matthews is not agreeable to changing this mutual private
easement in any respect, you are to take no action that would obstruct
her ingress and egress along the easement which both parties have enjoyed
since 1976. You should have received a copy of this Agreement as an
exception to any title insurance coverage which you received when you
purchased the property. In any event, please contact me should you
have any questions.

The demolition permit was applied for on 7-12-02 for a singled family residence (period) Apparently Building dept does
not require any type of drawing showing the scope of the work, they only require proof that all utilities have been removed
& the structure is safe to demolish The permit was issued on the same day 7-12 in what is termed a "quick turn-
around" permit. P&Z had no reason to be involved
Last Friday Ms. Matthews came in and spoke with Laurinda, indicating the demo contractor had stated the driveway was
scheduled to be removed on Saturday She provided Laurinda a copy of the easement agreement, which prompted her
to call Scott Blaise at Code Enforcement with a request to watch Ms Matthews property over the weekend
According to Laurinda, Scott advised her CE doesn't work on the weekend & apparently he forwarded the request to the
Police Dept. to keep an eye open
(Eric got involved at some point on Friday and provided a copy of the agreement to me, so I could add pertinent
comments to the Site Plan Review)
At some point on Wednesday Scott drove by the property & notice the driveway removal in progress. He called Laurinda,
who in turn sent Frantz out to halt the work, and Scott sent one of his crew also out to cite the contractor
Jr~nt7 red taa. simplv indicated to stop work & apply for a permit at 4X the II~II~I fee
I have no idea what the tag from Code Enforcement states.
To my knowledge no other action has happened since yesterday other then our meeting with Ms. Matthews
If you will want any information as to the city's path regarding the follow up to violations,l am told Don Johnson would be
the knowledgeable source to discuss that with

Signs
Every structure and commercial complex should be designed with a precise concept for
adequate signing. Provisions for sign placement, sign scale in relationship to the building, and
sign readability should be considered in developing the signing concept. All signing should be
highly compatible with the building and site design relative to color, material, and placement.
COLOR
Color is one of the most important aspects of visual communication. It can be used to catch
the eye or to communicate ideas and feelings. Too many colors used simultaneously can
confuse and negate the message of a sign. Even the most carefully planned sign may look
unattractive due to poor color selection. Consider the following:
A. Limit the number of colors to 2 or 3 on anyone sign. Small accents of several colors
may make a sign unique, but the competition of large areas of many different colors
decreases readability.
B. Colors or color combinations that interfere with legibility of the sign copy or that
compete for attention and, therefore, interfere with viewer identification of other signs,
should be avoided.
C. Sign colors should complement the colors used on the adjacent buildings and the area
as a whole.
D. Contrast is an important influence on the legibility of signs. Light letters on a dark
background or dark letters on a light background are most legible. For any internally
illuminated cabinet signs, use white letters on black or dark color opaque background.

MATERIAL
Signs can be fabricated from many materials; brick, concrete, glass, metal, plastic, stone,
wood, and even painted directly onto the store. While there is nothing inherently wrong with
any of these materials, insensitive use of materials can cause a deterioration of Boynton
Beach's visual environment.
A. Sign materials should be compatible with the materials on the facade where they are
placed.
B. The selected materials should contribute to the legibility of the sign. For example,
glossy finishes are often difficult to read because of glare and reflections.

C. Neon tubes are a popular sign material and can contribute to the night time ambiance
of the area. However, care must be taken not to over do the use of neon signs,
because of their brightness and attention attracting properties. ""' "
D. Paper and cloth signs/banners are not appropriate for prolonged exterior use because
they deteriorate quickly and do not present a quality business image. Paper and cloth
signs are appropriate for interior temporary use only.

SIGN ILLUMINATION
The way in which a sign is to be illuminated should be considered carefully. Like color,
illumination has considerable value for visual communication.
A. First, consider if the sign needs to be lighted at all. Lights in the window display may be
sufficient to identify the business. This is particularly true if good window graphics are
used. Often, nearby street lights provide ample illumination of a sign after dark.
B. If the sign can be illuminated by an indirect source of light, this is usually the best
arrangement because the sign will appear to be better integrated with the buildings'
architecture. Light fixtures supported in front of the sign will cast light on the sign and
generally a portion of the facade as well. Thus, indirect lighting emphasizes the
continuity of the buildings' surface and the sign becomes an integral part of the facade.
C. Internally illuminated light fixtures, usually fluorescent tubes placed within a translucent
sign, have an advantage over indirect/external sign illumination in that the fixtures are
protected from weather and vandals, and the sign cabinet has a cleaner profile,
uncluttered by the struts of most indirect lighting systems. Although there are these
advantages, there is a disadvantage that when lighted, the sign alone becomes bright,
separating it from the buildings' surface. The sign then becomes an element that is
obviously attached to the facade of the building rather than a part of it.
D. Individually cut three dimensional back-lighted solid letters (reverse channel letter sign),
are a preferred alternative to internally illuminated letters or cabinet signs. Signs
comprised of individual letters mounted directly on a building can often use a distinctive
element of the building's facade as a backdrop, thereby providing a better integration
of the sign with the building.

PLACEMENT
Signs should be placed in a way that enhances the character of the architecture and therefore
the quality of the building.
A. Look at the facade of the building in relation to where adjacent businesses have placed
their signs. It may be that there is already an established pattern of sign locations.
Locating signs in this fashion can establish visual continuity among the storefronts, and
at the same time provide uniform sight lines for viewers.
B. The size and shape of a sign should be proportionate with the scale of the structure.
C. When the architectural details of a building do not suggest the shape of the signs,
choose simple shapes. Squares, circles, rectangles, and ovals are considered to be
most effective for visual communication. Avoid signs with strange shapes. Signs that
are unnecessarily narrow or oddly shaped can restrict the legibility of the message.
D. Place signs consistent with the proportions of building elements within the facade.
Within a building facade, the sign may be placed in different areas. A particular sign
may fare well on a plain wall area, but would overpower the finer scale and proportion
of the lower storefront. A sign appropriate near the building entry may look tiny and out
of place above the ground level.

PERMANENT WINDOW SIGNS:
On ground level, coverage should not exceed 20% of the total window and door area visible
from the exterior. On the building's second level, coverage should not exceed 30% per
window.

TEMPORARY SIGNS:
On ground level, coverage should not exceed 20% of the total window area visible from the
exterior. If there is a combination of permanent and temporary signs, the total window
coverage should not exceed 40%. This allows for displays and makes the signs more
readable. Temporary signs should not be displayed on the second story.
