Woolbright Grille Mike, In my researching the process necessary to get a slow zone or manatee zone signage designation for the Woolbright Grill site: . On August 26, 2002 I spoke to the Florida Marine Patrol (regulatory agency for either of the two types of zones). . Only a government entity may apply for either of the above two types of zones initiated from a letter of request from the Woolbright Grill business owner . On August 26, 2002 I telephoned the Woolbright Grill owner and told him to write the letter of request to me so I couid initiate the zone request from the City of Boynton Beach to the Florida Marine Patrol in Tallahassee, Florida. . The City of Boynton Beach would then take the letter of request and provide the mile post location of the waterway next to the Woolbright Grill and submit an application for either of the two types of zones. . The Florida Marine Patrol would decide if the waterway location had the minimum number of boatinq accidents at the specific mile post location to qualify for either of the two types of zones. . The Florida Marine Patrol office would then review the application and address any and all requirements to the City of Boynton Beach as the applicant for the type of zone. The owner of the Woolbright Grill has not yet sent me a letter of request pertaining to the zone(s) designation. If you need any additional information, please contact me. Thanks. Well, lots of things to discuss regarding the Woolbright Grille project. First. I sent out informational letters (with Mike's signature) to those concerned Ocean Ridge citizens who wrote to us and are opposed to the project. Second: last Monday, ~ick and I met with the City Attorney, the applicant, and Quintus to discuss the parking situation. think the parking situation may be cleared up I will discuss this with you later Mike and I met with Rob Levy and the applicant on Friday to again, discuss the parking situation. Third: On Fr[>lpy, the applicant gave me a copy of a parking variance (1984) indicating that they were approved for an additional 26qlarking spaces, We need to verify ~ Fourth: The applicant still needs to meet with Laurinda in order to satisfy her one-way / two-way drive aisle comments at the rear of the Winn-Oixie building. I think they were going to see Laurinda Friday afternoon. We'll see how that turned out. Fifth: By Wednesday or Thursday (4/24 - /4/25), the appiicant will provide us with another Riverwalk Shopping overall site plan that accurately shows the existing / proposed parking spaces. They / I want to talk with you first before they start working on it. Sixth: Rob Levy mentioned to Mike and I at our Friday meeting that he would like to see the current variances abandoned, move the restaurant towards Woolbright Road, and request a building setback variance. The applicant told us that they would move the building to the north only if staff would support such a request. This restaurant project is proposed on two (2) vacant parcels of land on the east side of Riverwalk Plaza, just west of the Intracoastal Waterway (Parcell and Parcel 2). The restaurant is to be constructed on Parcell while its required parking is proposed on Parcel 2. The Planning & Zoning Division has reviewed the plans to ensure its compliance with the Land Development Regulations. One outstanding issue however is their parking situation. The restaurant's proposed parking lot on Parcel 2 will not fully support the demand of a 160-seat restaurant. Apparently, in 1970, the previous owner of the subject properties had a reciprocal-parking agreement with the Riverwalk Plaza. The parking agreement assured that a proposed restaurant on the vacant parcels would be able to utilize the parking spaces from Riverwalk Plaza (see attached). Please be advised that Riverwalk Plaza is currently a non-conforming site in terms of its own parking demand. My wife and I have a residence in Ocean Ridge directly across the Intracoastal, which will be facing the new proposed restaurant and bar If the Intracoastal was not directly across at our back doors, and there was land between us, it would take less then one minute for us to walk from our back doors to the proposed restaurant. Noise carries over water and we can hear casual conversations of fisherman on the sea wall, vagrants or homeless people who live In the woods south of Winn Dixie. We now have to deal with Wlnn Dixie and their service trucks pulling in all day and night with beepers, trash being dumped and picked up banging cans at three in the morning along with the dumpster trucks picking up before seven in the morning waking us up from sound sleep, along with the noise of the refrigeration units on top of Winn Dixie that run constantly Now you want to add another Banana Boat type restaurant, outdoor seating for seventy and a large inside bar with door walls that open up the deck to the bar. You know, when people have had a few drinks they get loud. We will also have people with drinks strolling along the proposed board walk waiting to get a table at the new restaurant. In the very near future I can see them putting in parallel parking for boats along the board walk and sea wall with boats clanging all day long and night If they allow overnight dockage. Then there are the Issues of the hours they will be open. I know if I owned a good bar and restaurant, I would want to stay open for as many hours I had customers What can you do to help us? I would like to see the hours restricted, the deck area should be totally closed in with glass like the Old Calypso restaurant, and not allow drinks out on the board walk. We like our home but you are going to make It impossible for us to live here. We now have two dumpsters that get picked up very early in the morning and now you are adding another. I know there is a sound ordinance, which you could enforce, if the sound goes over a certain decibel range, but that Is hard to prove because it Is not constant. In order to accommodate another restaurant and parking, the trees and shrubs will probably be removed exposing the back end of Winn-Dixie with all of the garbage dumpsters and bright lights facing us. The noise factor associated with a waterfront restaurant is another concern since noise is magnified over the water. We are all aware of the noise surrounding the Banana Boat at very late hours, and I would not want to live across from such an establishment. In addition, if there were docking facilities at the restaurant in this narrow part of the Intracoastal, that situation would add more noise and traffic to an already overly congested area lBlder and around the bridge from speeding boats. I would ask you to consider these objections because the quality of life in this complex will be adversely affected by building this type of establishment due to the factors mentioned above. Boynton Beach Blvd POBox 310 Boynton Beach, Florida 33425-0310 We live in the Ocean Ridge Yacht Club, a community offorty-four homes directly across the intracoastal from the proposed Woolbright Grill. When we first moved here we had the rear of a K Mart across from us, a very unsightly view Winn Dixie went in the view greatly improved do to the new landscaping along the intracoastal. Although the view improved, the noise level increased. We here the delivery tricks, back up beepers, the extremely loud emptying of the dumpsters and the hum from the rooftop air conditioning and refrigeration units. These nOIses are often deafeningly loud but at least they are intermittent. Most of the time it is relatively quiet. The intracoastalls qUite narrow here and we are so close that we can hear a couple of people talking on the seawall opposite us. The Woolbright Grill as planned would bring increased and almost constant noise. Obviously we would prefer another use for the property such as offices or a store. But if you must approve a restaurant we request that It should be enclosed - no out door dining. Glass windows not door walls along the rear 2. No outdoor music or P A Systems that announce "Smith table is six" 3 No rear exit and entry along the intracoastal. Entry and exit should be from the front. 4 Hours of operation should be limited to evening not late night. 5 Locate the dumpsters so that they are not right at the sea wall. The existing dumpsters are a major problem for us. Dumpsters to be serviced at reasonable hours, not in the middle of the night. Other concerns are control the smell and lighting. Will the driveway behind Winn Dixie become a problem? Obviously density could easily be doubled putting tables closer together What constitutes "fine dinning and sit down" restaurants? Once the restaurant is built won't the owner go to anything that brings in customers? Before you approve the plans for the Woolbright Grill, we ask that you take into consideration the large number of people whose serenity and property values will be impacted by the noise of this restaurant. The applicant, John Therien, came to the City of Delray to build a restaurant on the Intracoastal several years ago, I am writing because I feel there is a great similarity between his current application and the one years ago for the Old Calypso. The Old Calypso is now open and doing very well. There were many people in the condominiums that were opposed to the restauran1. It was Iheir belieftbat the restaurant would be similar to the Banana Boa1. Mr. Therien owned and operated the Fifth Avenue Grill in Delray Beach at that lime alsn. I can honestly say rrom the City's standpoint the applicant worked diligently with the neighboring owners and condominiums to review all of their concerns and address Ihem to their satisfaction. This included the design of the building, location of the dumpsters, parking, and many other smaller concerns. Here we are 4 years later, and the restaurant is very successful and the City of Delray Beach is very pleased that all arrangements with the City were honored and carried out. In conclusion, as Mayor, you often have many people complianing about what is happening. I can honestly lell you il is a pleasure working with John Therien. He did not have to do many ofthe th,ings he did in order to be a good neighbor and resolve their issues. He did it to make them feel comfortable and did it willingly He did an excellent job with the project in Delray and will do so again in Boynton Beach. I know that he does not intend to build a restaurant similar to the Banana Boat. .it would be foolish to do this with the Banana Boat so close. The location of this proposed restaurant is on the east side of Riverwalk Plaza, along the Intracoastal Waterway near Woolbright Road. The applicant submitted the original plans to the Division on February 12, 2002 but have since been revised. Firstly, allow me to explain how the City of Boynton Beach site plan review process works. The process is approximately three months long; although it may be longer depending how well the project complies with codes. The applicant is required to submit a complete application and twelve sets of plans, which include a current survey, site plan, landscape plan, architectural elevations, floor plan, and preliminary drainage plans. The Planning & Zoning Division distributes the plans to staff members of the Technical Review Committee (TRC) who review the project for compliance with the City's Land Development Regulations and other applicable codes. Each TRC member reviews the plans within two weeks. If the project fails to meet a certain code requirement, then staff will generate comments to address said deficiencies. All comments from the TRC are forwarded to the applicant and the plans are revised. If the applicant fails to revise the plans to the satisfaction of staff, then those comments are converted into the project's Conditions of Approval. These conditions are appended to the staffreport and forwarded to the Community Redevelopment Agency (CRA) Board. Acting in an advisory capacity, the CRA will review a project and render a recommendation to the City Commission. The CRA will either recommend approval, approval with conditions, or denial of a project. The City Commission will heed the CRA recommendation to form the basis for their final decision. Secondly, let me inform you that the subject properties are zoned C-3, Community Commercial. A restaurant is a permitted use in this zoning district as long as the project complies with all applicable codes. Staff is aware of the concern that the project will negatively affect the nearby neighborhoods, and has therefore attempted to minimize these effects with recommendations on lighting, outdoor sound systems, outdoor seating, boat docking and landscaping. In fact, staff has repeatedly generated comments to address several issues that have also been raised by concerned citizens. However, please understand the staff comments are limited to enforcement of the Land Development Regulations obligated to make, which are to protect the health, safety, and welfare of the public while simultaneously embracing the principles of private property rights. Noise carries over water and we can hear casual conversations of fisherman on the sea wall, vagrants or homeless people who live in the woods south of Winn Dixie, We now have to deal with Winn Dixie and their service trucks pulling in all day and night with beepers, trash being dumped and picked up banging cans at three in the morning along with the dumpster trucks picking up before seven in the morning waking us up from sound sleep, along with the noise of the refrigeration units on top of Winn Dixie that run constantly Now you want to add another Banana Boat type restaurant, outdoor seating for seventy and a large inside bar with door walls that open up the deck to the bar You know, when people have had a few drinks they get loud. We will also have people with drinks strolling along the proposed board walk waiting to get a table at the new restaurant, In the very near future I can see them putting in parallel parking for boats along the board walk and sea wall with boats clanging all day long and night if they allow overnight dockage, Then there are the issues of the hours they will be open, I know if I owned a good bar and restaurant, I would want to stay open for as many hours I had customers What can you do to help us? I would like to see the hours restricted, the deck area should be totally closed in with glass like the Old Calypso restaurant, and not allow drinks out on the board walk. In order to accommodate another restaurant and parking, the trees and shrubs will probably be removed exposing the back end of Winn-Dixie with all of the garbage dumpsters and bright lights facing us. The noise factor associated with a waterfront restaurant is another concern since noise is magnified over the water We are all aware of the noise surrounding the Banana Boat at very late hours, and I would not want to live across from such an establishment. In addition, if there were docking fucilities at the restaurant in this narrow part of the Intracoastal, that situation would add more noise and traffic to an already overly congested area under and around the bridge from speeding boats. I would ask you to consider these objections because the quality of life in this complex will be adversely affected by building this type of establishment due to the factors mentioned above. In order to accommodate another restaurant and parking, the trees and shrubs will probably be removed exposing the back end of Winn-Dixie with all of the garbage dumpsters and bright lights facing us. The noise factor associated with a waterfront restaurant is another concern since noise is magnified over the water. We are all aware of the noise surrounding the Banana Boat at very late hours, and I would not want to live across from such an establishment. In addition, if there were docking facilities at the restaurant in this narrow part of the Intracoastal, that situation would add more noise and traffic to an already overly congested area under and around the bridge from speeding boats. I would ask you to consider these objections because the quality of life in this complex will be adversely affected by building this type of establishment due to the factors mentioned above. Woolbright Grille Dear Ms. Roland: As you know, the above project has been submitted to the Planning & Zoning Division for the construction of a 7,829 square-foot restaurant to be located on the east side of Riverwalk Plaza, along the Intracoastal Waterway near Woolbright Road. The applicant submitted these plans to the Division on February 12, 2002. First, allow me to explain how the site plan review process works. The process is roughly three months long. The applicant is required to submit a formal application and twelve sets of plans (current survey, site plan, landscape plan, architectural elevations, floor plan, and preliminary drainage plans). The Planning & Zoning Division distributes the plans to staff members of the Technical Review Corrunittee (TRC). Each TRC member reviews the plans for a period of2 weeks. Staff will ensure that the project complies with the City's Land Development Regulations and other applicable codes. However, if the project fails to meet a certain code requirement, then a staff team member will generate conunents to address said deficiencies. A compilation of the conunents from each staff team member is forwarded to the applicant so that plan revisions can be made in a timely manner Please be advised that a plan can evolve during the review process. However, if the applicant fails to revise the plans to the satisfaction of the staff team member, then those conunents are converted into the project's Conditions of Approval. These conditions of approval will follow the project to the Conununity Redevelopment Agency (CRA) Board meeting. The CRA will review the project and render a reconunendation to the City Conunission. The CRA will either reconunend approval, approval with conditions, or denial of a project. The City Corrunission will heed the CRA reconunendation to form the basis for the final decision. Staff is aware of the concern that the project will negatively affect the nearby neighborhoods, and will attempt to minimize these effects through conunents on lighting, outdoor sound systems, and landscaping. However, the CRA Board meeting is open to the public to provide a forum for the conununity to address outstanding concerns (i.e. noise, traffic, odor, landscaping, etc.). At the meeting, the eRA Board may generate additional project conditions of approval if they feel the plans do not adequately address the critical issues of staff and the public.
