all plans, specifications, drawings, engineering, and other data submitted with this application for review by the
City of Boynton Beach shall be reviewed by the various boards, commissions, staff personnel and other parties
designated, appointed or employed by the City of Boynton Beach, and any such party reviewing the same shall

The applicants indicated they wanted to develop a restaurant on a vacant parcel in
Riverwalk Plaza. They indicated that they own two separate vacant parcel within the
Plaza, Lot I 17,000 sf Lot 2.10,400 sf= 27,400 s.f.
The applicants indicated that they had 65 parking spaces available to them from the
shopping center and that they would be willing to provide 18 spaces on Lot 2 for a total
of 83 parking spaces. Eric indicated that they would have to enter into a cross-parking
agreement and cross access agreement with the adi acent shoppinQ: center
Jose indicated that they could join the two properties (Lot I and Lot 2) together via unity
of title, even though the two properties do not abut eachother.
Eric informed the applicants of the parking requirements for restaurant (1 space per 100
sf of GF A or 1 per 2.5 seats). Eric informed Paul that the City would require the parking
for the more strinQ:ent of the two.
Ed Yates informed the applicants that in order to sell hard liquor, a 4COP license would
be required. If a 4COP is required, then the restaurant would require conditional use
approval from the City Commission. Eric explained the site planning and property
notification processes and gave them the CRA & CC schedules.
The applicants indicated that the front door of the proposed restaurant would face
towards Josie's Pizza and Pacific Grill. They would provide valet service in the drive
aisle and would ensure that the drive aisle would remain at code reauired 21' in width
f
Eric asked about drainage and how the restaurant would provide legal outfall. The
applicants told staff that the adjacent shopping center has an existing underground
drainage pipe running through the subj ect property that outfalls to the Intracoastal
Waterway Eric encouraged the applicants to make a deal with the adjacent shopping
center owner (Mr Levy) to possibly tie the subject property's drainage into the existing
shopping center's drain. The new restaurant may need to move the existing underground
drain because the weight of a new building built over the drain may collapse the pipes.
Eric told the applicants that the City's Engineering Department may require a drainage
easement somewhere else on the property They would have to get U.S. Army Corps or
En ineerin a roval as well.
At the time, Jose could not determine the front, side, and rear property lines and told
them that he would seek a determination from the Plannin Director.
Jose mentioned that the Code requires a masonry wall six (6) feet in along the southern
property line of Lot 2 because the southern property line is adjacent to residentially
zoned property He also mentioned that the shopping center was approved for a variance
to allow a chain-link fence instead of the maso wall.

SECOND AMENDMENT TO
RECIPROCAL PARKING INDENTURE
THIS SECONDAMENDMENTTO RECIPROCAL PARKING INDENTURE entered into
this the day of June, 1998 by and between the CITY OF BOYNTON BEACH, whose
address is 100 E. Boynton Beach Blvd., Boynton Beach, FL 33425-0310, hereinafter referred
to as "City", TAJ ENTERPRISES, a Florida General Partnership, whose address is POBox
790, Dekay Beach, FL 33447-790, hereinafter referred to as "TAJ", and RIVERWALK
SHOPPING PLAZA, whose address is 1690 So, Congress Avenue, Suite 200, Delray Beach,
FL 33445, hereinafter referred to as "Plaza"
WHEREAS, Plaza is the owner of that real property described in Exhibit "A" attached
hereto and made a part hereof by this reference, which real property is hereinafter referred to
as "Plaza Center"; and
WHEREAS, TAJ is the owner of that real property described in Exhibit "B" attached
hereto and made a part hereof by this reference, Said real property is located immediately to
the East of the Plaza center, which real property is hereinafter referred to as the "Restaurant
property"; and
WHEREAS, the prior owner of the Plaza and TAJ Enterprises previously executed a
Reciprocal Parking Indenture and Amendment to Reciprocal Parking Indenture which sets forth
joint access and joint parking usages for the Plaza Center and the Restaurant Property; and
WHEREAS, Plaza is redeveloping the shopping center located at the southeast corner
of U S Highway One and Woolbright Road in Boynton Beach, FL, and
WHEREAS, the Plaza has obtained a site plan approval from the City dated May 6,
1998; and
WHEREAS, the subject property owned by the Owners is not part of the subject site
plan; and
WHEREAS, it is the intent of the parties to agree to site plan changes of the Plaza
Center which will be implemented at the time of the development of the Restaurant Property
NOW, THEREFORE, in consideration of the sum of Ten ($10.00) Dollars and other
good and valuable consideration, the receipt and SUfficiency of which are hereby
acknowledged, the parties agree as follows.
RECITALS
1 The above recitals are true and correct and incorporated herein.

2. The parties agree that the parking spaces located at the northeast corner of the
Plaza Center adjacent to the restaurant property shall be deleted and access shall be available
to the subject restaurant property as depicted on exhibit "C"
3. The parties agree that the directional sign and the no-entry sign which are
located at the northeast corner of the Plaza Center shall be relocated approximately 60 feet 10
the south so that access for deliveries will be available to the Restaurant Property This change
of signage location and access is depicted on the attached exhibit "c" and made a part hereof.
The parties agree that the loading area located at the northeast corner of the Plaza Center
adjacent to the restaurant property shall be deleted as depicated on exhibit "c"
4 The parties agree that the parcel of property located at the southeastern portion
of the plaza indicated N,I.C shall be provided at least two vehicular access points as indicated
on exhibit "c"
5. The parties agree that the dumpster which is located on the northeastern portion
of the Plaza Center adjacent to the Restaurant Property may be relocated southerly so as to
provide additional access and parking for the restaurant.
6. The parties agree that the agreements contained herein shall not waive or
release any zoning and/or building requirements for the development of the restaurant site,
which shall include but not be limited to parking.
7 In all other respects, the Indenture and Amendment shall remain unamended,
unmodified and unchanged and in full force and effect.

A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF BOYNTON BEACH, FLORIDA, AUTHORIZING THE
MAYOR AND CITY CLERK TO EXECUTE A SECOND
AMENDMENT TO THE RECIPROCAL PARKING
INDENTURE AGREEMENT BETWEEN THE CITY OF

RIVERWALK SHOPPING PLAZA, SUBJECT TO STAFF
COMMENTS, AND PROVIDING AN EFFECfIVE DATE.
WHEREAS, the City Commission of the City of Boynton Beach, upon
recommendation of staff, does hereby authorize and direct the Mayor and City Clerk
to execute a Second Amendment to the Reciprocal Parking Indenture Agreement
between the City of Boynton Beach, TAJ Enterprises and Riverwalk Shopping Plaza,
subject to staff comments, as outlined in the attached letter from the City of
Boynton Beach Director of Development, dated October 27, 1998, and made a part
hereof;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA THAT:
Section 1. The City Commission of the City of Boynton Beach, Florida, hereby
authorizes and directs the Mayor a:ld City Clerk to execute a Second Amendment to
the Reciprocal Parking Indenture Agreement between the City of Boynton Beach,
TAJ Enterprises and Riverwalk Shopping Plaza, subject to staff comments, as
outlined in the attached letter from the City of Boynton Beach Director of

When and if an application for a site plan approval is received from your client,
Holding and Management, Inc., for the development of the two landlocked parcels,
the Department of Development will undertake the site plan review process. At !hat
time, all the issues and possibly others mentioned in your Second Amendment will
be addressed and conditions for approval will be detennined.
At this time, without prejudging the site plan review process and including or
excluding conditions for approval, I have no objection to proceeding with the
execution of the Amendment for reasons of convenience. The Department reserves
the right to revisit these conditions when appropriate.
