I have reviewed the documents faxed/received September 8th. The documents have no extra
pages thereby eliminating the 2 comments I had forwarded. THE RECORDED DOCUMENTS ARE NOW

Mike: Today I have re-faxed the copies I originally faxed to you on August 26th with
request to let me know if originals needed to be mailed. I had also called for you but
learned you were in a meeting that day so I asked to talk to Karen Main. As she was away
from her desk, I left a voice mail with essentially the same message. I did not hear back
from either Karen or yourself until receiving your September 5th message this morning.
Please confirm whether or not I need to forward originals. Also, I would like to receive
the unusable portion of the deficient documents my personnel had apparently mis-assembled.
Apparently they dropped off everything in their files rather than explicitly following
pre-instruction to drop off only the two recorded copies of the amended agreements. Sorry
for the confusion, we'll get this done right eventually I hope. Unfortunately I was not
able to handle this personally, allowing improper correlation of the documents. Merle

Merle, I did not receive any subsequent copies of the agreements. I have
completed reviewing the versions submitted in the permit system and comment
that I do not have a recorded first page of the completed DB/Phillips
agreement, also there is a generally-duplicate version of the DB/CC
agreement with a different date at the top of the first page. This is part
of Tim's confusion when submitted. The signature page has a slight
difference in signatures. One copy (dated 5th of August does not show
recordation on first page). Perhaps you could explain and or supply us with
clean-up versions all showing proper recording stamps.

Merle, We have reviewed the proposed modifications to the agreements and
have a couple simple comments.
C&C / D&B agreement:
Change the last sentence within 1.A to read ".. .to meet the irrigation
requirements of the Land Development Regulations of the City of Boynton
Beach as my be amended from time to time."
Phillips / D&B agreement:
Where as the D&B / C&C amended agreement acknowledges in paragraph 1.A
the Phillips' agreement and water use, the Phillips / D&B agreement does not
acknowledge the C&C agreement and its use. It only references a paragraph
#2. Perhaps some text was inadvertently left out. Compare the two and this
comment should be clear;
and

The comments below should be included as a condition of approval for the Vermeer plan:
The landscape buffer adjacent to West Industrial A venue shall contain another layer of plant material. This layer of plant material
shall be a combination of colorful groundcover plants and a minimum of two colorful shrub species planted in a continuous row.
Landscaping at project entrances shall contain a minimum of one (1) "signature tree" on both sides of the entrances (Chapter 7.5,
Article II, Section 5.N.). Note that signature trees do not contribute toward the total number of required perimeter trees or parking area
interior landscaping. Provide one (1) additional signature tree, such as Yellow Elder, Tibouchina granulosa, or Bougainvillea at each
side of the project entrance. These signature trees shall have a minimum of six (6) feet of clear trunk to preserve the clear sight area.
All above ground mechanical equipment such as exterior utility boxes, meters, and transformers proposed in front of the building shall
be visually screened (Chapter 9, Section 1O.CA.). Equipment placed on the walls of the building shall be painted to match the building
color.

Irrigation agreement
Hello Merle,
I'm notifying you that we have not yet received the recorded copy of the Joint Use and Agreement document for the
irrigation system for permit #02 - 3667. As noted in the copy you faxed to the City dated June 24,2003 an amended
agreement will be submitted to the City of Boynton Beach for review, and if approved a recorded copy shall be submitted
to the City within 30 days of the date of the last signature on the document. The date of the last signature was July 7.
2003 which places your deadline at August 7, 2003.This date is quickly approaching and it is imperative that this

pay for the cost of power to run the well and sprinkler irrigation pump. All other costs and
expenses shall be shared equally,"

Dear Mr. Kruger,
In response to your correspondence of March 21, and March 26, 2003 this letter is to serve as
concurrence of your request to make revisions to the approved construction plans. We offer the
following:
1. The proposed headwalls on the 24 inch culverts under the north and south driveways may be
constructed as sand-cement riprap. Construction shall be in accordance with FOOT Standard
Index 258. A copy of this index shall be attached to the Building Permit Modification request.
2. The rear yard area may be constructed using the proposed surfacing section of 4 inches of
crushed/recycled asphalt (1 Y:z inch crusher run) over 6 inches of stabilized subgrade, as
recommended by the Geotechnical Engineer. The owner shall be solely responsible for warranty
and maintenance of the rear yard area. City of Boynton Beach accepts no liability for this design.
If you have any questions or need additional information regarding this request, please feel free to contact
me at 561-742-6482. You may proceed with a Minor Modification through the Planning and Zoning
Department, with this letter of concurrence.
