PROPOSAL SUMMARY
Contained herein is a description of the subject project. The subject property is a rectangular-shaped 1.992-acre
parcel comprised of two (2) lots located along the west side of US. 1 in the southern portion of the City. The
property is vacant but contains a mature Banyan tree at the southeast comer of the site. According to the survey,
the site also contains the following tree species: Cabbage Palm, Schefflera, Norfolk Pine, Gumbo Limbo, Oak,
Mamosa, and Pine. The applicant aims to preserve the Banyan Tree in its current state while constructing a fully
enclosed 103,392 square foot self-storage facility. Self-storage facilities are conditional uses in the C-3 zoning
district. According to a recent opinion of the City Attorney, the limited-access self-storage uses are allowed within
the C-3 zoning district. This opinion contrasts the longstanding interpretation of the code to limit such uses to the
C-l zoning district in accordance with the intent of code revisions made in 1987. This circumstance is further
explained below.

BACKGROUND
In summary, in 1987 the zoning code was amended, pursuant to an outside petition, to establish a definition for the
"limited-access self-storage" use, and insert provisions in the code to allow them in close proximity to residential
and office environments. The regulations were written to address appearance, distance separation, height, outdoor
storage, and signage. To prevent their proliferation, and the opportunity cost of them being constructed in all
commercial districts, the approval was intended to limit the uses to the C-l district. Recent interpretation of the
code by legal staff, as initiated by representatives of the applicant, has identified weaknesses in the code
amendments that essentially allow the use to be carried forward into the C-2 and C-3 districts. Once this code
weakness was realized, the city passed Resolution No. R02-135 on August 6, 2002, and followed up with a public
hearing in accordance with procedural requirements established by Ordinance No. 00-53. This "Notice of Intent"
(NOI) process allows for the initiation of a study and/or formulation of code amendments to address a particular
code issue. The current NOI is in effect for 180 days, or until approximately January 6' 2003. Although the NOI
prevents related applications from being submitted during the study period, the subject application was submitted
prior to the passing of the resolution, and is therefore eligible for review and consideration. For purposes of this
review, the code sections applicable to storage uses in the C-l district have applied been applied to the subject
request for a limited-access self-storage uses within the C-3 zoning district.
STANDARDS FOR EV ALUA TING CONDITIONAL USES AND ANALYSIS
Section 11.2.D of the Land Development Regulations contains the following standards to which conditional uses
are required to conform. Following each of these standards is the Planning and Zoning Division's evaluation of the
application as it pertains to standards.
The Planning and Development Board and City Commission shall consider only such conditional uses as are
authorized under the terms of these zoning regulations and, in connection therewith, may grant conditional uses
absolutely or conditioned upon the conditions including, but not limited to, the dedication of property for streets,
alleys, recreation space and sidewalks, as shall be determined necessary for the protection of the surrounding area
and the citizens' general welfare, or deny conditional uses when not in harmony with the intent and purpose of this
section. In evaluating an application for conditional use approval, the Board and Commission shall consider the
effect of the proposed use on the general health, safety and welfare of the community and make written findings
certifying that satisfactory provisions have been made concerning the following standards, where applicable:
1. Ingress and egress to the subject property and proposed structures thereon, with particular reference to
automobile and pedestrian safety and convenience, traffic flow and control, and access in case of fire or
catastrophe.
Ingress / egress will be solely from u.s. 1 in a manner approved by Florida Department of Transportation.
The site plan shows that there will be one (1) ingress lane and one (1) egress lane. They will be separated
by a landscaped median. Although not dimensioned on the site plan, there will be sufficient "throat"
distance so that vehicles entering the site will not be impeded by any vehicles that are exiting the parking
spaces. In addition, a gated driveway onto U.S. 1 will be for emergency vehicle exit only and is anticipated

to experience little use. According to the survey, a four (4) foot wide sidewalk exists along the east
property line. To comply with code, during construction of the site, the sidewalk will be enlarged to five (5)
feet in width.
A traffic statement was submitted and sent to the Palm Beach County Traffic Division for their review and
approval. The Palm Beach County Traffic Division determined that the project would generate 237 new
average daily trips, and would meet the Traffic Peiformance Standards of Palm Beach County.
2. Off-street parking and loading areas where required, with particular attention to the items in subsection 1
above, and the economic, glare, noise, and odor effects the conditional use will have on adjacent and
nearby properties, and the city as a whole.
The proposed building will be a low traffic generator. This is evidenced by the findings of the Palm Beach
County Traffic Division. The parking required for the self-storage facility shall be provided at a rate of
one (1) space per 75 storage bays, plus 1 space per 300 square feet of office and 2 security spaces (see
Exhibit "c" - Conditions of Approval). A total of 14 spaces will be required since the building will have
599 storage bays and 1000 square feet of office. The plan provides a total of 17 parking spaces, two (2) of
which, are designated for handicapped use. All parking spaces will be dimensioned at least nine (9) feet in
width by 18 feet in length, except for the handicap spaces, which will be 12 feet in width by 20 feet in
length.
There will be one (1) loading zone located at the rear of the building not facing u. S. 1. The loading
Area is adjacent to a one-way 15 foot wide drive aisle that will provide easy access around the building
and to the loading and dumpster area. According to the applicant, because of the nature of the business,
there will be virtually no impact on adjacent and nearby properties, or the City as a whole, with respect to
glare, noise, or odor. The storage bays shall not be used to manufacture, fabricate, service or repair
vehicles, boats, small engines or electrical equipment, or to conduct similar repair activities; conduct
garage sales or retail sales of any kind; or conduct any other commercial or industrial activity on the site
(see Exhibit "c" - Conditions of Approval). All of the storage bays will be inside a wholly enclosed space
with no doors having direct access to the outside of the building.
3. Refuse and service areas, with particular reference to the items m subsection 1 and 2 above.
A dumpster enclosure with wooden gates is proposed at the southwest corner of the site. It will face north
and be angled in such a way as to facilitate the efficient removal of trash. Additional landscaping will be
required around the base of three sides of the dumpster enclosure (see Exhibit "C" - Conditions of
Approval).
4. Utilities, with reference to locations, availability, and compatibility.
Consistent with Comprehensive Plan policies and city regulations, all utilities, including potable water and
sanitary sewer will be in place prior to the issuance of a certificate of occupancy. The demand for water
and sewer capacity will be very limited.
5. Screening, buffering and landscaping with reference to type, dimensions, and character.
A buffer wall six (6) feet in height is proposed along the west property line and a 1l0joot portion of the
north property line, where the subject property abuts residential property. The wall will be painted on both
sides to match the building. It will be constructed prior to the issuance of a certificate of occupancy. Staff

recommends that the style of the buffer wall be enhanced with details such as cornices, columns, and
multiple colors tones to match building colors (see Exhibit "c" - Conditions of Approval).
According to the applicant, the landscaping to be installed will be that of a "lush Florida Hammock".
Also, the intent is to preserve the mature Banyan Tree located at the southeast corner of the site. The
project perimeters include: a 30-foot wide landscape buffer strip along U.S .1, afive (5)foot wide buffer
strip along both north and south sides of the project, and a 12-foot wide buffer strip at the rear (west)
adjacent to the residential property. Along the north, west, and south property lines, the landscape plan
proposes 35 Green Buttonwood trees spaced at least 1 tree for every 30 linear feet. These trees, coupled
with the six (6) foot wall will provide lower and upper level buffers between the abutting residential
properties.
6. Signs, and proposed exterior lighting, with reference to glare, traffic safety, economic effect, and
compatibility and harmony with adjacent and nearby properties.
The maximum allowable wall signage area is based upon the linear frontage of the proposed self-storage
building. The ratio is based upon 1'l2 square feet of sign area for every one (1) foot of linear building
frontage. According to the elevations, one (1) wall sign is proposed on the north far;ade. The elevations
show the location of the proposed wall sign to be centered above the building's main entrance. It will be a
back-lit sign, 54 square feet in area, with two (2) foot high letters.
The plan proposes afreestanding monument sign to be located south of the egress lane along U.S. 1. It will
be placed at least 10 feet from the property line. According to the elevations, the monument sign face will
be 32 square feet in area. As proposed, the monument sign will be eight (8) feet in height and be eight (8)
feet in width. The site plan shows that the sign will be an internally lit double-faced signjace type. The
letters and cabinet will be dark green (Sherman Williams Olive Grove #2369) on a white background. The
base will match the texture and color of the main building far;ade. Staff recommends that the lettering style
and color of the monument sign shall match the wall the lettering and color of the wall sign (see Exhibit
"c" - Conditions of Approval). The site address will be identified on top of the monument sign.
Except for the required outdoor site lighting, which is consistent with Code, no additional outside lighting
is proposed that could create excessive light.
7. Required setbacks and other open spaces.
The building will meet all required setbacks of the C-3 zoning district.
8. General compatibility with adjacent property and other property in the zoning district.
In general, the proposed project is compatible with the existing commercial uses adjacent to the subject
property. There will be little or no impact to the adjacent properties or to the general area. A self-storage
facility is not considered as an intensive use. The conditions of approval clearly outline that no one can
operate a business from any of the storage bays.
9. Height of building and structures, with reference to compatibility and harmony to adjacent and nearby
properties, and the city as a whole.
Victoria's Closet is designed as a three-story building with the top of the decorative barrel tile roof to be
43 feet in height. The top of the parapet wall will be 32 feet - six (6) inches in height. The roofline will be
30 feet in height.

The entire building, particularly the fafade facing the U.S. 1 rights-of-way, has been designed to enhance
the overall appearance of the commercial corridor. The exterior walls of this new structure will have
smooth stucco finish and be painted in multiple colors.
10. Economic effects on adjacent and nearby properties, and the city as a whole.
The construction of Victoria's Closet will represent the only new development in the immediate area in
many years. The proposed use will constitute additional convenience and choice for residents of the City
and neighboring residential subdivisions.
11. Conformance to the standards and requirements which apply to site plans, as set forth in Chapter 19, Article
II of the City of Boynton Beach Code of Ordinances. (Part III Chapter 4 Site Plan Review).
With incorporation of staff comments, the proposed project will comply with all requirements of applicable
sections of city code.
12. Compliance with, and abatement of nuisances and hazards in accordance with the performance standards
within Section 4 of the zoning regulations; also, conformance to the City of Boynton Beach Noise Control
Ordinance.
With incorporation of all conditions and staff recommendations contained herein, the proposed self-storage
facility would operate in a manner that is in compliance with the above-referenced codes and ordinances of
the City of Boynton Beach. In particular, the applicant will have to apply for and obtain all necessary
approvals and licenses from all applicable governing bodies.
RECOMMENDA TION
Based on the discussions contained herein, in compliance with all applicable development regulations, and the
consistency with the Comprehensive Plan, staff recommends that this request be approved subject to satisfying all
Conditions of Approval as contained in Exhibit "C". Furthermore, pursuant to Chapter 2 - Zoning, Section 11.2
Conditional Uses, a time limit is to be set within which the proposed project is to be developed. Staff
recommends that a period of one (1) year be allowed to initiate this project (obtain a building permit).

PUBLIC WORKS - General
Comments:
1. City Ordinance (CODE, Chapter 10) requires that arrangements be made with /
the Public Works Department for any waste disposal associated with this site
plan. AND/OR prior to permit application contact the Public Works
Department (561-742-6200) regarding the storage and handling of refuse.
2. The site dumpster enclosure is to be constructed in accordance with City /'
Standard A-8807. The dumpster will be supplied by Public Works (561-742-
6200).
3. A minimum dumpster pad is required measuring 10 feet x 10 feet (inside
dimension including gates) (LDR, Chapter 7.5, Article II, Section 5.J and ./
Article III, Section 9.A.9.a). The enclosure shown on the plans does not scale
to meet this requirement.
4. The required gates for the dumpster shall contain long steel rods to drop into
the pavement in order to secure the gates in the open and closed positions. /'
Drilled holes (for concrete) or metal sleeves (for asphalt) shall be provided for
the locking rods.
5. Wall for the enclosure shall be provided on three sides and are to be a /
minimum of 6 feet high and shall be CBS construction with a finish matching

6. Staff has concerns regarding the availability of adequate stacking space at the /'
entrance into the development off of Federal Highway. This provides the
potential for rear-end collisions for vehicles in the queue and on Federal
Highway, which carries high-volume, high-speed traffic through this corridor.
7. Show location of call box at entrance. The location will affect the queuing at /

UTILITIES
Comments:
9. All existing and proposed utility easements shall be shown on the Site and
Landscape Plans so that we may determine which trees may interfere with
utilities. Water and sewer lines to be owned and operated by the City shall be ./
included within utility easements. All proposed easernents shall be a
~
minimum of 12 feet in width. The easements shall be dedicated via separate
instrument to the City as stated in CODE Sec. 26-33(a). In general, palms will
be the only tree species allowed within utility easements. Canopy trees may
be planted outside of the easement so that roots and branches will not impact
those utilities within the easement in the foreseeable future. The LDR,
Chapter 7.5, Article I, Section 18.1 gives public utilities the authority to
remove any trees that interfere with utility services, either in utility easements
or public rights-of-way.
10. Palm Beach County Health Department permits will be required for the water ~
and sewer systems serving this project (CODE, Section 26-12).
11. Fire flow calculations will be required demonstrating the City Code
requirement of 1,500 g.p.m. as stated in the LDR, Chapter 6, Article IV, /
Section 16, or the requirement imposed by insurance underwriters, whichever
is greater (see CODE, Section 26-16(b)).
12. The CODE, Section 26-34(E) requires that a capacity reservation fee be paid /
for this project either upon the request for the Department's signature on the
Health Department application forms or within 30 days of site plan approval,
whichever occurs first. This fee will be determined based upon final meter
size, or expected demand.
13. Comprehensive Plan Policy 3.C.3.4. reqUIres the conservation of potable /
water. City water may not, therefore, be used for irrigation where other
sources are readily available. Indicate irrigation water source.
14. The LDR, Chapter 6, Article IV, Section 16 requires that all points on each
building will be within 200 feet of an existing or proposed fire hydrant. /
Please demonstrate that the plan meets this condition, by showing all
hydrants.
15. Appropriate backflow preventers will be required on the domestic water /
service to the building, and the fire sprinkler line if there is one, in accordance
with the CODE, Section 26-207.
16. The LDR, Chapter 3, Article IV, Section 3.P requires a statement be included /
that other support utilities are available and will be provided by the

appropriate agencies. This statement is lacking on the submitted plans.
FIRE
Comments:
17. Design documents shall demonstrate compliance with LDR Chapter 6,
Section 16, which provides requirements for hydrants. Hydrants in
commercial applications shall be no more than 300 feet apart and the remotest ./
part of any structure shall be no more than 200 feet from a hydrant.
Connections shall be to mains no less than six (6) inches in diameter. In
addition to domestic requirements at a residual pressure of not less than 20
psi, a fire flow of at least 1500 gpm is required. (Note: Although the
proposed hydrant coverage leaves a small portion of Building "A" beyond
200 ft., it is acceptable due to the sprinkler protection.)
18. Design documents where underground water mains and hydrants are to be /
provided, must demonstrate that they will be installed, completed, and in
service prior to construction work per the Florida Fire Prevention Code,
(2000) Section 29-2.3.2.
19. Pursuant to City Ordinance 9-3F, the Fire Marshal has developed an /
Administrative Order dated May 9,2001 that provides the minimum
performance for all security gates and emergency access. (Attached)
20. Emergency access shall be provided at the start of a project and be maintained /
throughout construction per the Florida Fire Prevention Code, Section 3-5,
and NFP A 241, (1996) Safeguarding Construction, Alteration, and
Demolition Operations, Section 5-4.3.
21. City Ordinance Section 9-6, 3. /7-11 requires approved automatic fire
sprinkler systems throughout the following: /
a) All buildings or structures regardless of the type of construction which are 3
stories or more in height or all buildings or structures in excess of 30 feet in
height as measured from finish ground floor grade to the underside of the
topmost roof assembly.
b) All buildings or structures regardless of the type of construction that are in
excess of 12,000 square feet per floor.
22. Mark the roadway around the building as a fire lane in an effort to maintain a /
clear path for emergency vehicles.

ENGINEERING DIVISION
Comments:
23. Add a general note to the Site Plan that all plans submitted for specific
permits shall meet the City's Code requirements at time of application. These
permits include, but are not limited to, the following: paving, drainage,
curbing, site lighting, landscaping and irrigation. Permits required from other
permitting agencies such as Florida Department of Transportation (FDOT),
South Florida Water Management District (SFWMD), Lake Worth Drainage
District (L WDD), Florida Department of Environmental Protection (FDEP),
Palm Beach County Health Department (PBCHD), Palm Beach County
Engineering Department (PBCED), Palm Beach County Department of
Environmental Resource Management (PBCDERM) and any others, shall be
included with the permit request.
24. FDOT permits will be required for the two proposed driveways and for the
signing to be placed within the FDOT right-of-way.
25. Provide a sealed survey, not older than six (6) months providing the
information required in the LDR, Chapter 4, Section 7.A The survey
provided lacks the following information:
o No date given for most recent field work associated with this survey
(state law).
o No "benchmark of origin" or benchmark number given (state law).
o No tie to a known point given (state law).
o No tie(s) to the closest intersection(s) indicated (LDR, Chapter 6,
Article IV, Section I.A).
o Provide a location or vicinity map on the Survey.
o Elevations needed for the 25 feet north, south and west of the
property line.
26. Show on the Site, Engineering and Landscaping plans the proposed site
lighting (LDR, Chapter 4, Section 7.BA.) On the Lighting Plan, specify that
the light poles shall withstand a 140 MPH wind load (LDR, Chapter 23,
Article II, Section A.1.a. and current Florida Building Code). Add a note that
the fixtures shall be operated by photo-electrical control and to remain on
until 2:00 a.m. (LDR, Chapter 23, Article II, Section A1.a.)
27. The provided Photometric Plan lacks, or has incorrectly given, the pole wind
loading and pole details in conformance with the LDR, Chapter 6, Article IV,
Section 11, Chapter 23, Article I, Section 5.B.7 and Chapter 23, Article II,
Section A. Additionally there are two light poles in the front parking area and
one in the rear lot which appear to have been incorrectly located.

fixtures to eliminate future shadowing on the parking surface (LDR, Chapter
23, Article II, Section A1.b). Unable to determine if any conflicts exist as
plans are incomplete.
29. Landscaped areas shall be protected from vehicular encroachment by a
continuous, raised curb (LDR, Chapter 7.5, Article II, Section 5.A and ~
Chapter 22, Article II, Section E.) Curb needs to be added at each of the
driveways.
30. Provide an engineer's certification on the Drainage Plan as specified in LDR, ~
Chapter 4, Section 7.F.2.
3 I. Indicate, by note or detail, that drainage will conform to City Standard /
Drawing B-91007 (modified as necessary).
32. Provide proposed and existing elevations on the Paving, Grading & Drainage
Plan so that an evaluation may be made of the pre- and post-development i/
conditions. There appears to be a discrepancy between the elevations shown
on the Paving, Grading & Drainage Plan and Section C2.
33. Show the location of the roof downspouts on the Paving, Grading & Drainage ~
Plan.
34. Indicate, by note, that catch basin and manhole covers shall be bicycle proof v"
(LDR, Chapter 6, Article IV, Section 5.A2.f).
35. Sidewalks shall be 4 feet wide along local streets, and 5 feet wide along
streets of higher classification (LDR, Chapter 6, Article IV, Section 1O.T., V
and Chapter 22, Article I, Section 5). Upgrade existing 4 foot sidewalk along
Federal Highway to 5 foot from property line to property line.
36. Add a note to the Landscape Plan that within the sight triangles there shall be ,/
an unobstructed cross-visibility at a level between 2.5 feet and 6 feet above
the pavement (LDR, Chapter 7.5, Article II, Section 5.H.).
37. On the Site and Civil plans, show and identify all necessary traffic control
devices such as stop bars, stop signs, double yellow lane separators striping, /'
directional arrows and "Do Not Enter" signage, etc. Reference City Standard v
Drawings B-9800 1 and B-900 13 on the plans for striping details.
38. Fire lane signage and markings shall conform to LDR Chapter 23, Article II,
Sections B. & M. The 3-foot high "Fire Lane" words shall be placed along v/
both lanes and staggered. Please note this requirement is applicable to
buildings with a gross area greater than 15,000 SF.
39. Add "Wrong Way/Do Not Enter" (R5-1 and/or R5-1a) signs at the northwest ~
and southeast comers of the building to prevent traffic from entering the one-
way drives in the wrong direction of flow.

The above referenced Site Plans, forwarded on July 24, 2002, were reviewed against the appropriate
requirements outlined in the City of Boynton Beach Code of Ordinances (available on-line at
www.cLbovnton-beach.fl.us). Following are the comments with the appropriate Code and Land
Development Regulations (LDR) referenced.
PUBLIC WORKS - GENERAL
1. City Ordinance (CODE, Chapter 10) requires that arrangements be made with the Public Works
Department for any waste disposal associated with this site plan. AND/OR prior to permit application
contact the Public Works Department (561-742-6200) regarding the storage and handling of refuse.
2. The site dumpster enclosure is to be constructed in accordance with City Standard A-BB07. The
dumpster will be supplied by Public Works (561-742-6200).
3. A minimum dumpster pad is required measuring 10 ft x 10 ft (inside dimension including gates) (LDR,
Chapter 7.5, Article II, Section 5.J and Article III, Section 9.A.9.a). The enclosure shown on the plans
does not scale to meet this requirement.
4. The required gates for the dumpster shall contain long steel rods to drop into the pavement in order to
secure the gates in the open and closed positions. Drilled holes (for concrete) or metal sleeves (for
asphalt) shall be provided for the locking rods.
5. Wall for the enclosure shall be provided on three sides and are to be a minimum of 6 ft high and shall be
CBS construction with a finish matching that of the adjacent building(s). Accent shrubs shall be provided
along the screen wall(s) (LDR, Chapter 7.5, Article II, Section 5.J, ~t:d;OII 6.J and Article III, Section
9.A.9.a, and Chapter 9, Section 10.C.3)
PUBLIC WORKS - TRAFFIC
1. Staff has concerns regarding the availability of adequate stacking space at the entrance into the
development off of Federal Highway. This provides the potential for rear-end collisions for vehicles in the
queue and on Federal Highway, which carries high-volume, high-speed traffic through this corridor.

3. Show location of call box at entrance. The location will affect the queuing at the entrance.
4. Reference FOOT Standard Index 546 for the sight triangles along all collector and arterial roadways. A
10ft. x 10ft. sight triangle is inadequate for Federal Highway.
ENGINEERING
1. Add a general note to the Site Plan that all plans submitted for specific permits shall meet the City's
Code requirements at time of application. These permits include, but are not limited to, the following:
paving, drainage, curbing, site lighting, landscaping and irrigation. Permits required from other
permitting agencies such as Florida Department of Transportation (FOOT), South Florida Water
Management District (SFWMD), Lake Worth Drainage District (LWDD), Florida Department of
Environmental Protection (FDEP), Palm Beach County Health Department (PBCHD), Palm Beach
County Engineering Department (PBCED), Palm Beach County Department of Environmental Resource
Management (PBCDERM) and any others, shall be included with the permit request.
2. FOOT permits will be required for the two proposed driveways and for the signing to be placed within the
FOOT right-of-way.
3. Provide a sealed survey, not older than six (6) months providing the information required in the LOR,
Chapter 4, Section 7.A. The survey provided lacks the following information:
o No date given for most recent field work associated with this survey (state law).
o No "benchmark of origin" or benchmark number given (state law).
o No tie to a known point given (state law).
o No tie(s) to the closest intersection(s) indicated (LOR, Chapter 6, Article IV, Section 1.A).
o Provide a location or vicinity map on the Survey.
o Elevations needed for the 25 feet north, south and west of the property line.
4. Show on the Site, Engineering and Landscaping plans the proposed site lighting (LOR, Chapter 4,
Section 7.B.4.) On the Lighting Plan, specify that the light poles shall withstand a 140 MPH wind load
(LOR, Chapter 23, Article II, Section A.1.a. and current Florida Building Code). Add a note that the
fixtures shall be operated by photo-electrical control and to remain on until 2:00 a.m. (LOR, Chapter 23,
Article II, Section A.1.a.)
5. The provided Photometric Plan lacks, or has incorrectly given, the pole wind loading and pole details in
conformance with the LOR, Chapter 6, Article IV, Section 11, Chapter 23, Article I, Section 5.B.7 and
Chapter 23, Article II, Section A. Additionally there are two light poles in the front parking area and one
in the rear lot which appear to have been incorrectly located.
6. It may be necessary to replace or relocate large canopy trees adjacent to light fixtures to eliminate future
shadowing on the parking surface (LOR, Chapter 23, Article II, Section A.1.b). Unable to determine if
any conflicts exist as plans are incomplete.
7. Landscaped areas shall be protected from vehicular encroachment by a continuous, raised curb (LOR,
Chapter 7.5, Article II, Section 5.A. and Chapter 22, Article II, Section E.) Curb needs to be added at
each of the driveways.
8. Provide an engineer's certification on the Drainage Plan as specified in LOR, Chapter 4, Section 7.F.2.

9. Indicate, by note or detail, that drainage will conform to City Standard Drawing B-91007 (modified as
necessary).
10. Provide proposed and existing elevations on the Paving, Grading & Drainage Plan so that an evaluation
may be made of the pre- and post-development conditions. There appears to be a discrepancy between
the elevations shown on the Paving, Grading & Drainage Plan and Section C2.
11. Show the location of the roof downspouts on the Paving, Grading & Drainage Plan.
12. Indicate, by note, that catch basin and manhole covers shall be bicycle proof (LOR, Chapter 6, Article
IV, Section 5.A.2.f).
13. Sidewalks shall be 4 feet wide along local streets, and 5 feet wide along streets of higher classification
(LOR, Chapter 6, Article IV, Section 10.T., and Chapter 22, Article I, Section 5). Upgrade existing 4 foot
sidewalk along Federal Highway to 5 foot from property line to property line.
14. Add a note to the Landscape Plan that within the sight triangles there shall be an unobstructed cross-
visibility at a level between 2.5' and 6' above the pavement (LOR, Chapter 7.5, Article II, Section 5.H.).
15. On the Site and Civil plans, show and identify all necessary traffic control devices such as stop bars,
stop signs, double yellow lane separators striping, directional arrows and "Do Not Enter" signage, etc.
Reference City Standard Drawings B-98001 and B-90013 on the plans for striping details.
Fire lane signage and markings shall conform to LOR Chapter 23, Article II, Sections B. & M. The 3-foot
high "Fire Lane" words shall be placed along both lanes and staggered. Please note this requirement is
applicable to buildings with a gross area greater than 15,000 SF.
16. Add "Wrong Way/Do Not Enter" (R5-1 and/or R5-1 a) signs at the northwest and southeast corners of
the building to prevent traffic from entering the one-way drives in the wrong direction of flow.
17. Add a One-Way arrow sign (R6-1) in the median across from the south driveway.
18. Add "Left Turn Only" (R3-5) signs at the north and south ends of the front drive aisle.
19. Add a "No Left Turn" (R3-2) at the south driveway.
20. Indicate a Handicap Parking sign in front of the handicap stall.
21. Indicate to what standard the project is to be constructed; if the FOOT Standard Specifications for Road
& Bridge Construction and Standard Index are to be used - the 2000 Specifications are recommended
since they contain both English and Metric units.
22. Provide written and graphic scales on all sheets.
23. Show site dimensioning on all sheets.
24. At both sets of Handicap Stalls (on site and civil plans) show the sidewalk at the same elevation as the
five foot accessible paths with 1 :12 ramps up in both directions (FL Accessibility Code 4.6.3). This
needs to be reflected in the details on Sheet 5 of 9 (Civil Plans).

25. In Section C2 (Paving, Grading & Drainage Plan Sheet 2 of 2) the face of the masonry wall should be
placed 2 feet inside the property line.
UTILITIES
1. All existing and proposed utility easements shall be shown on the Site and Landscape Plans so that we
may determine which trees may interfere with utilities. Water and sewer lines to be owned and operated
by the City shall be included within utility easements. All proposed easements shall be a minimum of 12
feet in width. The easements shall be dedicated via separate instrument to the City as stated in CODE
Sec. 26-33(a). In general, palms will be the only tree species allowed within utility easements. Canopy
trees may be planted outside of the easement so that roots and branches will not impact those utilities
within the easement in the foreseeable future. The LDR, Chapter 7.5, Article I, Section 18.1 gives public
utilities the authority to remove any trees that interfere with utility services, either in utility easements or
public rights-of-way.
2. Palm Beach County Health Department permits will be required for the water and sewer systems
serving this project (CODE, Section 26-12).
3. Fire flow calculations will be required demonstrating the City Code requirement of 1,500 g.p.m. as stated
in the LDR, Chapter 6, Article IV, Section 16, or the requirement imposed by insurance underwriters,
whichever is greater (see CODE, Section 26-16(b)).
4. The CODE, Section 26-34(E) requires that a capacity reservation fee be paid for this project either upon
the request for the Department's signature on the Health Department application forms or within 30 days
of site plan approval, whichever occurs first. This fee will be determined based upon final meter size, or
expected demand.
5. Comprehensive Plan Policy 3.C.3.4. requires the conservation of potable water. City water may not,
therefore, be used for irrigation where other sources are readily available. Indicate irrigation water
source.
6. The LDR, Chapter 6, Article IV, Section 16 requires that all points on each building will be within 200
feet of an existing or proposed fire hydrant. Please demonstrate that the plan meets this condition, by
showing all hydrants.
7. Appropriate backflow preventers will be required on the domestic water service to the building, and the
fire sprinkler line if there is one, in accordance with the CODE, Section 26-207.
8. The LDR, Chapter 3, Article IV, Section 3.P requires a statement be included that other support utilities
are available and will be provided by the appropriate agencies. This statement is lacking on the
submitted plans.

CODE REQUIREMENTS
Design documents shall demonstrate compliance with LDR Chapter 6,
Section 16, which provides requirements for hydrants. Hydrants in
commercial applications shall be no more than 300 ft. apart and the
remotest part of any structure shall be no more than 200 ft. from a
hydrant. Connections shall be to mains no less than 6 inches in diameter.
In addition to domestic requirements at a residual pressure of not less
than 20 psi, a fire flow of at least 1500 gpm is required. (Note: Although
the proposed hydrant coverage leaves a small portion of Building ''A''
beyond 200 ft., it is acceptable due to the sprinkler protection.)
Design documents where underground water mains and hydrants are to
be provided, must demonstrate that they will be installed, completed, and
in service prior to construction work per the Florida Fire Prevention Code,
(2000) Section 29-2.3.2.
Pursuant to City Ordinance 9-3F, the Fire Marshal has developed an
Administrative Order dated May 9, 2001 that provides the minimum
performance for all security gates and emergency access. (Attached)

Emergency access shall be provided at the start of a project and be
maintained throughout construction per the Florida Fire Prevention Code,
Section 3-5, and NFPA 241, (1996) Safeguarding Construction, Alteration,
and Demolition Operations, Section 5-4.3.
City Ordinance Section 9-6, 3. /7-11 requires approved automatic fire
sprinkler systems throughout the following:
1. All buildings or structures regardless of the type of
construction which are 3 stories or more in height or all
buildings or structures in excess of 30 ft. in height as
measured from finish ground floor grade to the underside of
the topmost roof assembly.
2. All buildings or structures regardless of the type of
construction that are in excess of 12,000 square feet per
floor.
RECOMMENDATIONS
Mark the roadway around the building as a fire lane in an effort to maintain
a clear path for emergency vehicles.

RE: Security Gates and Emergency Access
To Whom It May Concern:
Boynton Beach Fire Rescue continues to main lain the position thai securily gates are
potentially detrimental to fire and rescue operations. The proliferation of security galed
communities has resulted in many problems for responding emergency apparatus trying to gain
entry.
The minimum performance for all security gates shall be as follows:
1. All security/entrance gates must have an electronic key number pad,
2. The keypad will allow entrance by lhe simple act of pushing four (4) or five (5) buttons.
3. All gates must have a security entry code approved in advance by the Fire Marshal.
4, Gates may be operable by telephone from our dispatch office, A phone call from our
dispatchers will open the gate and a second call will be required to close the gate.
5. In case of power failure, the gate shall open aulomatically and remain open,
6. An exception will be where a 24-hour securily guard is stationed at lhe gate.
7. A back-up device such as an aulhorized securily box or key swilch is required to operate the
gate in the event the number pad entry does not work.
8. A key box shall be installed for such areas or buildings when the Fire Marshal determines
that access is necessary for all life-saving or fire-fighting purposes, The type and location of
the key box shall be approved by the Fire Marshal and shall contain:
· Keys to locked points of egress, whether in common areas or on the interior or exlerior
of such buildings;
· Keys to locked mechanical equipment rooms;
· Keys to locked electrical rooms;
· Keys to elevator controls.
9. No other code numbers, operating methods, or key systems will be kept on file by the Fire
Rescue Department.
10. In the event that our units are unable to gain rapid entry with the above methods, it will
require the use of rapid forcible entry methods to gain entry. The City of Boynton Beach
and/or the Fire Rescue Department shall not be responsible for, or incur any costs as a
result of gaining access to a specific area,
11. Information on where authorized key security boxes can be purchased is available from
Boynton Beach Fire Rescue, Fire and Life Safety Division by calling (561) 742-6600 during
normal business hours.
Failure to comply will result in lhe violation of Boynlon Beach Code of Ordinances Section 9-3F
and Section 9-15. The liability of delayed Fire Rescue response to an emergency in your
community should be a serious concern.

1. Add to the building that is depicted on the drawing titled site plan and floor plan a
labeled symbol that identifies the location of the handicap accessible entrance
doors to the building. Florida Accessibility Code for Building Construction, Section
4.1.2,4.3.
2. Add a labeled symbol to the site plan drawing that identifies the location of the
handicap accessible parking spaces. The quantity of the spaces shall be
consistent with the regulations specified in the Florida Accessibility Code for
Building Construction. The accessible parking spaces that serve a use shall be
located on the shortest safely accessible route of travel from adjacent parking to an
accessible entrance. The Florida Accessibility Code for Building Construction
states that buildings with multiple accessible entrances shall have accessible
parking spaces dispersed and located closest to the accessible entrance. Florida
Accessibility Code for Building Construction, Section 4.1.2(5), 4.3, 4.6.
3. Add a labeled symbol to the site plan drawing that represents and delineates the
path of travel for the accessible route that is required between the accessible
parking spaces and the accessible entrance doors to the building. The symbol,
required to be installed along the path, shall start at the accessible parking spaces
and terminate at the accessible entrance doors to the building. The symbol shall
represent the location of the path of travel, not the location of the detectable
warning or other pavement markings. The location of the accessible path shall not
compel the user to travel in a drive/lane area that is located behind parked
vehicles. Identify on the plan the width of the accessible route. (Note: The

minimum width required by the code is forty-four (44) inches). Add text to the
drawing that would indicate that the symbol represents the accessible route and
the route is designed in compliance with Section 4.3 (Accessible Route) and 4.6
(Parking and Passenger Loading Zones) of the Florida Accessibility Code for
Building Construction. Please note that at time of permit review, the applicant shall
provide detailed documentation on the plans that will verify that the accessible
route is in compliance with the regulations specified in the Florida Accessibility
Code for Building Construction. This documentation shall include, but not be
limited to, providing finish grade elevations along the path of travel.
4. Identify within the site data the finish floor elevation (lowest floor elevation) that is
proposed for the/each building. Verify that the proposed elevation is in compliance
with regulations of the code by adding specifications to the site data that address
the following issues [Section 3107.1.2, Chapter 31 of the 2001 Florida Building
Code]:
a) The design professional-of-record for the project shall add the following text to
the site data. "The proposed finish floor elevation _' _ NGVD is above the
highest 100-year base flood elevation applicable to the building site, as
determined by the South Florida Water Management District's surface water
management construction development regulations."
b) From the FIRM map, identify in the site data the title of the flood zone that the
building is located within. Where applicable, specify the base flood elevation. If
there is no base flood elevation, indicate that on the plans.
c) Identify the floor elevation that the design professional has established for the
building within the footprint of the building that is shown on the drawings titled
site plan, floor plan and paving/ drainage (civil plans).
5. On the drawing titled site plan, identify and label the symbol that represents the
property line.
6. As required by Chapter 4, section 7 of the Land Development Regulations, submit
a floor plan drawing. The building plans are not being reviewed for compliance with
the applicable building codes. Therefore, add the words "Floor plan layout is
conceptual" below the drawing titled Floor Plan found on sheet A-1. However, add
to the floor plan drawing a labeled symbol that identifies the location of the
handicap accessible entrance doors to the building. The location of the doors shall
match the location of the accessible entrance doors that are depicted on the site
plan drawing.
7. Place a note on the elevation view drawings indicating that the wall openings and
wall construction comply with Table 600 of the 2001 Florida Building Code.
8. At time of permit review, provide a completed and executed City of Boynton Beach
Unity of Title form. The form shall describe all lots, parcels or tracts combined as
one lot. A copy of the recorded deed with legal descriptions, of each property that
is being unified, is required to be submitted to process the form. The property
owner that is identified on each deed shall match.

9. At time of permit review, submit signed and sealed working drawings of the
proposed construction.
10. Add to the submittal a partial elevation view drawing of the proposed perimeter
wall/fence. Identify the type of the wall/fence material and the type of material that
supports the wall/fence, including the typical distance between supports. Also,
provide a typical section view drawing of the wall/fence that includes the depth that
the wall/fence supports are below finish grade and the height that the wall/fence is
above finish grade. The location and height of the wall/fence shall comply with the
wall/fence regulations specified in the Zoning Code.
11. Add to the drawing the calculations that were used to identify the minimum number
of required handicap accessible parking spaces. Also, state the code section that
is applicable to the computations.
12. Add a labeled symbol to the site plan drawing that represents and delineates the
path of travel for the accessible route that is required between the accessible
parking spaces and the accessible entrance doors to the building. The symbol
shall start at the accessible parking spaces and terminate at the accessible
entrance door to the building. The symbol shall represent the location of the path of
travel, not the location of the detectable warning or other pavement markings
required to be installed along the path. The location of the accessible path shall not
compel the user to travel in a drive/lane area that is located behind parked
vehicles. Identify on the plan the width of the accessible route. (Note: The
minimum width required by the Code is 44 inches). Add text that would indicate
that the symbol represents the accessible route and the route is designed in
compliance with regulations specified in the Federal Fair Housing Act. Please note
that at time of permit review, the applicant shall provide detailed documentation on
the plans that will verify that the accessible route is in compliance with the
regulations specified in the Florida Accessibility Code for Building Construction.
This documentation shall include, but not be limited to, providing finish grade
elevations along the path of travel.
13. Add to all plan view drawings of the site a labeled symbol that represents the
location and perimeter of the limits of construction proposed with the subject
request.
