Outparcel at Wal-Mart Store #2789-00, New SC
Winchester Park Site
We are in receipt of Ms. Angelena May's Kimley-Hom and Associates, Inc. letter of January 29, 2001
(copy attached), which requested a waiver of platting of a portion of Tract 42, which is a part oftlie 39.54
acrescompci';ing the Wal-Mart Supercenter Store site.
We have reviewed both surveys as prepared by American Surveying Company of Tampa, Inc., dated
January 26, 2001, for both the Wal-Mart site and the proposed outparcel which is currently being
developed as a Sonny's Bar-B-Q Restaurant site.
This office has no objection in supporting a waiver of platting request pursuant to LDR, Chapter 5, Article
II, Section l.A. & l.A.3., and Section l.B., with the following provisos:
l. That the parent part of those parcels comprising the main component of the Wal-Mart site be
combined into an "Unity of Title" in the name of the owner ofWal-Mart, and record in the Public
Records of Palm Beach County. This means that those parcels shown on the Map of Survey
issued by American Surveying Company of Tampa, Inc. field dated 11/17/00 as drawing number
100015198R-5, specifically those parcels labeled, I, I-A, II, III, IV & V be combined into the
Unity of Title document.
2. That portion of Parcel I labeled as "Not Included" located to the south side of the drainage canal
can remain as a separate parcel.

Standard Application Items
LOR section 2.4.3(A)
1. A copy of the latest recorded warranty deed, and a certificate from an attorney or
title insurance company (not title insurance) certifying who the current fee simple
title holders of record of the subject property are, and the nature and extent of their
interest therein.
2. The written consent of the owner(s) must be provided in a certified form (page 6).
When an application is executed on behalf of a corporation or business entity,
documentation must be provided which demonstrates that the corporation's
representative is authorized to act on behalf of the corporation. These forms are
available from the Planning and Zoning Department.
3. A vicinity map which clearly shows the subject property, adjacent properties, and
their relationship to streets located within one-half mile of the property.
4. Survey (2 copies) which shows the property described pursuant to the legal
description contained in the warranty deed. Such survey shall show all
improvements on the property and must be certified as reflecting conditions on the
site as they existed within six (6) months prior to the filing of the application.
5. A list of property owners within a icloo' radius of the subject property along with their
typed mailing labels taken from the latest official County tax roll, and a tax map
showing all property lying within /joO' of the subject property I [LOR Section
2.4.2(B)(1)(n)]. -,
6. Application filing fee, pursuant to LOR Section 2.4.3(K)(1).
In addition to the above a traffic study which addresses the most intense development
potential of the site at both the existing and proposed zoning classifications must be
provided. The study shall be prepared in accordance with Palm Beach County Unified
Land Development Code, Traffic Performance Ordinance. Note: This requirement may
be waived if it is determined by the Planning and Zoning Director that the existing and
proposed zoning classifications are of similar intensity and that the potential changes in
traffic are insignificant.
