The request applies to the required parking per City Land Development Regulations, Chapter 2, Zoning Section 11 ,H, 16,d, 1 which states that restaurants shall provide parking spaces at the rate of 1 space per 2,5 seats but no less than 1 space per 100 square feet of gross floor area, Chick-fil-A is able to comply to the lesser of the two requirements by only proposing 92 seats in the restaurant but not the gross area requirement with a proposed 3972 SF building, The gross area of the building would normally require 40 parking spaces; Chick-fil-A is proposing 37 new spaces, There are several factors that should be taken into consideration when reviewing the variance request, Once these items are revealed we feel that an approval of the variance is not an unreasonable request, 1, Tract C is a very narrow tract, It is the last outparcel in the development to be developed and it is not developed most likely due to its narrow width. The site is 0,87 acres and only 157 ft, wide, The site is further reduced in width due to the main access road into the development running along the west boundary effectively reducing the developable width by 33 feet resulting in a net development width of only 124 feet, The overall development plan originally approved this tract for a 5,700 SF restaurant with 57 spaces, I doubt a plan was ever generated reflecting those numbers but nonetheless we are proposing less than that which was approved for this tract, 2, The overall development has 3 different existing uses within the development, There is a 108,532 SF Retail (BJ's Wholesale Club) building requiring 543 spaces with 544 actually provided. There is a 4,998 SF Restaurant (Applebee's) building requiring 76 spaces with 76 provided, Also, Southtrust Bank is 4,875 SF which requires 20 spaces with 26 spaces actually constructed, Therefore, the overall development has an additional 7 spaces over the minimum requirement, If you consider the overall development as a whole the minimum required spaces would still be in compliance if the proposed Chick-fil-A is even 7 spaces below the required 40 spaces, If it is reviewed in this regard, then a variance request would not even be necessary however City code does not appear to address this issue specifically, Many mixed use developments in many municipalities are allowed to reduce the overall parking requirement due to the fact that it can be assumed that customers will utilize more than one business within the development on any given trip, This helps to reduce any unnecessary parking spaces and helps reduce the "Sea of Asphalt' resulting from each use having to stand on its own, ARCHITECTURE . Chick-fil-A's building is rather unique in its design and use of space within the restaurant. Although the gross floor area is required to be used in the calculation for parking spaces not all of the gross floor area should be considered in the parking calculations, The following uses within the building footprint should not be used in the calculations for the following reasons. First, many fast food restaurants locate their freezer/cooler outside of the main building or they will tack it on to the outside of the building. These structures are usually not integrated with the architectural theme or style of the building. Chick-fil-A has included the freezer/cooler within the building which encompasses 140 SF of floor area. Secondly, the mechanical room which is accessed only by a door from the outside of the building covers 33 SF of floor area and could not feasibly be used for cooking or seating area, Thirdly, Chick-fil-A provides a state of the art playground for the enjoyment of their guesfs children, Chick-fil-A used to locate playground outside open to the elements but found that it is much safer and enjoyable when it is in a climate controlled environment, Although allowed to be located outside Chick-fil-A has decided for many reasons to locate it inside but the benefit to the community is one of increased aesthetics from the public view, The playground encompasses 304 SF which we feel should not be considered in the strict interpretation of restaurant uses within a building, By combining all of the above square footages and reducing that from the overall building size, it results in a 3,495 SF building which would require a net of 35 parking spaces. This figure more accurately represents the building area which should be used in the parking requirement analysis. A floor plan is attached which shows the three uses within the building for reference, I would like to elaborate on the Statement of Special Conditions criteria and how it relates to our variance request. A. That special conditions and circumstances exist which are peculiar to the land, structure or building involved and which are not applicable to other lands, structures or buildings in the same zoning district, This particular tract is of a very narrow size, only 157 feet wide, which alone is difficult to develop with that width. But this tract also has the main shopping center access road running along the west property with extensive landscaping on both sides of the road. This effectively narrows the site by an additional 33 feet resulting in a net 124 feet width. Anybody developing this property would have difficulty placing any type of business on this site, much less someone reputable such as Chick-fil-A. Access to the site is limited as well to the rear of the site only which limits any design flexibility forcing you to create a loop around the building to get customers in and out of the site, No other site in this development has the hindrances this site possesses. That the special conditions and circumstances do not result from the actions of the applicant. The applicant has made every attempt to fit on this site and has reduced the amount of concessions from five to just one variance request since this project began the design stage. The special condition is not an advantage but a disadvantage in that it reduces the amount of options to the customer. C. That granting the variance requested will not confer on the applicant any special privilege that is denied by this ordinance to other lands, buildings or structures in the same zoning district, A reduction in parking in the commercial industry is not considered to be a special privilege except in cases where development costs are a concem. A reduction in parking on site is not seen as a positive in this case. Chick-fil-A is allowing this situation due to cross parking agreements being in place that will allow customers visiting other businesses within the development, the opportuni1y to walk over to Chick-fil-A. D, That literal interpretation of the provisions of this chapter would deprive the applicant of rights commonly enjoyed by other properties in the same zoning district under the terms of the Ordinance and would work unnecessary and undue hardship on the applicant. Literal interpretation of the provisions would not permit Chick-fil-A to develop this particular property in that it could never achieve the number of parking spaces required. As stated above they have decided to move forward with this site due to the presence of a cross parking agreement and the ideal demographics in the area. E, That the variance granted is the minimum variance that will make possible the reasonable use of the land, building or structure, The calculations shown on the gross building area show that no less than 35 parking spaces would be permitted for this site in order for Chick-fil-A to develop this site. Based on the number of seats proposed 37 spaces are being requested. F. That the granting of the variance will be in harmony with the general intent and purpose of this chapter and that such variance will not be injurious to the area involved or otherwise detrimental to the public welfare. The general intent of parking space requirements is to provide enough parking for the patrons based on a typical restaurant. Chick-fil-A is unique in that they provide a safer playground for the children in a controlled climate so that it can be utilized in any weather. It is also unique that they utilize valuable and costly indoor floor space for the freezer/cooler for aesthetics as well as convenience of operations. An added bonus to having the freezer indoors is that it also provides added securi1y for the employees so that they do not have to exit the building each time food product is needed. OR~DO ~~ c~G6GO development services for restaurant, retail, hospitality and commercial programs . www.lnterplanorlando.com INTERPLAN LLC In conclusion we feel that granting such a variance makes sense in many ways, The granting of the variance in no way gives them a competitive edge over any other restaurant or retail development in the area. 60% of Chick-fil-A's business is in the drive thru sales so on site parking is critical during peak hours only, The overall development still has the required number of minimum spaces to satisfy code, Due to the fact that a large portion of the Chick-fil-A lot is encumbered by the main access road where no other parcel is encumbered by this same scenario, it is amazing that the overall development can still satisfy the minimum requirements. Chick-fil-A is a well respected and very active member in every community that they are located within. They are involved in charity events and fund raisers for many schools, churches and businesses, They bring a sense of community involvement into a community where it is rarely seen by others. They are excited about this project and hope this site can be the first freestanding location in South Florida.
