The Codes Enforcement Board has heard testimony at the Codes EnforcelDent Board hearing
held the ~ day of Februarv, 1990. and based on the evidence. the Codes Enforcement
Board enters the following FINDINGS OF FACT. CONCLUSIO~S OF LAW. AND ORDER.
FINDINGS Of FACT
I, Nicholas Oi Lorenzo is the owner of the subject property. The owner was pI'oped)'
served.
2. The owner did appear at the hearing.
3, Hubert Hurst. Code & License Inspector. testified the subject property contained corl~
violations. The property is not landscaped with a hedge along the road right-of-way,
Landscaplng is not maintained in a healthy condition. One (1) photograph of the subject

GENERAL
Florida Statute 335.01 defines all roads which are open and available for the use by the public and dedicated to
the public use, according to law or by prescription as "public roads". Public roads are statutorily divided into four
systems - the state highway system, the state park road system, the county road system and the city street
system. These systems are defined in S. 334.01 (3), (7), (21), (22) and (23), F.S. Right of way maps for the road
systems are filed in the office of the clerk of the circuit court of the appropriate county. Information about public
roads is also available from the road and bridge departments of the state, county or municipality.

Prior to September 1, 1971
Before September 1, 1971, no rights in streets were acquired by the public until the offer to dedicate was
accepted. Acceptance could be evidenced by either a formal acceptance by the appropriate governmental
authority (city or county), or by an implied acceptance through the public use of the street. .
a) A common law dedication is the appropriation of land for public use, for which there must be
both a clear intention by the owner to dedicate the property to public use and an acceptance of
that dedication by the public through the use of that dedicated street or alley.
b) The offer to dedicate streets may be implied from the filing of a plat showing the streets, unless
the plat sets forth a contrary intention. Such a contrary intention would be a statement by the
dedicator that the streets shown on the plat are not dedicated to the public or that they are only
dedicated to the owners of property within the boundary of the plat. A certificate of approval
placed on the plat signed by the appropriate governing body does not by itself amount to a
formal acceptance of the offer to dedicate. Board of County Com'rs v. F.A.Sebring Realty Co.,
63 SO.2d 256 (Fla. 1953). Likewise, an ordinance vacating a street does not necessarily
indicate that there was a previous formal acceptance of the street.
c) The acceptance of one street by public use may constitute an acceptance of all the streets
shown on the plat. In Town of Palm Beach v. Palm Beach County, 313 SO.2d 770 (FlaAth DCA
1975), the recorded plat had not been formally accepted by the Town. However, part of the
roads shown on the plat were paved and maintained by the Town and used by the public. The
court held that the acceptance of a portion of the rights-of-way constituted an acceptance of the
entire network of rights-of-way within the plat so as to make them available for the public use.
Additionally, the courts have ruled that there can be an acceptance of a common law dedication
of the full width of the property without improving, repairing or using the entire amount offered
for dedication. Thus, the full width of a 30-foot right-of-way had been accepted by the city even
though only 20 feet thereof had been paved. Smith v. City of Melbourne, 211 SO.2d 66 (Fla. 4th
DCA 1968).

PROCEDURE
Municipalities
The vacation of a street in the public interest or when a street is no longer required for public use is a function
which may be performed by a municipality. Although currently there is no Florida statute which specifically grants
municipalities the power to vacate or abandon streets, s. 166.042(1), F.S. would appear to give municipalities the
general power to vacate streets within their boundaries. The municipal charter establishes the procedure which
must be followed. If no specific procedure was established in the charter, the city must adopt an ordinance
pursuant to S. 166.041, F.S. If the procedure follows the conditions of the charter or ordinance, generally, the
Company may insure without exception to the public rights in that street. However, if the action to be taken is the
vacation of the plat (and not just the vacation of the street), sections 177.071 and 177.101 (4), F.S. seem to
require both the county and the city to vacate subdivision plats where the property lies partly within the limits of a
city in order to eliminate the public rights.

OWNERSHIP OF VACATED STREETS
Interior Streets
The general rule is that where a street originally dedicated by one owner is discontinued through legal process
(vacation, judicial abandonment, etc.), the abutting lot owners take the fee title to the center of the street. Uniform
Title Standard 11.4.
Where an owner of land plats it with streets indicated on the plat, the owner has evidenced an intention to
dedicate an easement in the street to public use. Title to the land under the street is still with the owner.
Subsequently, when the owner conveys the fee title in a lot by reference to the plat, the ownership of the lot
carries with it title to the center of the street in the absence of an expressed contrary intent, subject to the public
easement. Upon vacation, the street is free of the public easement. Title to the centerline of the former street is in
the owner of the abutting lot at the time of vacation. Smith v. Horn, 70 So.435 (Fla.1915); Uniform Title Standard
11.5.
Effective July 1, 1972, Florida Statute 177.085 provides that when an owner of land subdivides it and dedicates
streets or other roadways on the plat and the dedication contains a provision that the reversionary interests in the
street or roadway is reserved to the dedicator or his heirs, successors, assigns or legal representatives, and
thereafter conveys abutting lots, the conveyance of the lot shall carry the reversionary interest in the abutting
street to the centerline or other appropriate boundary, unless the owner clearly provides otherwise in the
conveyance. See also Uniform Title Standard 11.3. Agents should contact the Underwriting Department in regard
to any questions they may have on reversionary interests in streets.
Sometimes a plat may contain a reversionary clause similar to the following:
All avenues, roads and boulevards as shown on this plat are hereby dedicated to the perpetual use of
the public, reserving to ourselves, our heirs, administrators, executors or assigns the reversion thereof
if ever discontinued by law.
The Florida Supreme Court in United States v. 16.33 Acres of Land in Gty. of Dade, 342 SO.2d 476 (Fla.1977)
held that when all the lots were sold by reference to the plat, and when there was no mention of any reversionary
interest in those deeds, the rule stated in Smith v. Horn, supra., applies. That is, the ownership of the lot carries
with it title to the center of the street.
