1. D & B shall inst~ll a fence two (2) teet north ot the
common lot line between Lot~ 5 and 6. Construction and maint~nance
costs A~all be shared equally by D & B and Phillips.
2. Phillips shall install trees and shrUbS, as required by
the City of Boynton Beach, two (2) teet South of the comlllon lot
line between Lots 5 and 6. Construction and maintenance costs shall
be shared equally by D , B and Phillips.
3. D. B shall install ~ sprinkler irrig4tion systam, as
r&qUir~d by the City of Boynton aeach, between the fence (see
paragraph 1) and the tree/shrub lIne (see paragraph 1) . Construction
and maintenance costs shall be shared equally by V & Band
Phillips.
4. Phillips shall be responsible for the actual maintenance
of the landscaping (paragraph 2) and D & B shall be responsible for
thQ cost the water used in the sprinkler irrigation system
(paragraph J)
5. This Joint Use and Cooperation Aqree~ent shall be
perpetual, non-exclusive, run with the land and shall inuro to the
benefit of, and be bindinq upon, D & Band Pbillips, their
