Mr. Ted James Powell with Symcor, addressed the Commission.
~e remarked that he too had heard horror stories about the
review process in Boynton Beach. As a result of that fear
they had arranged for numerous meetings with staff and they
turned out to be good solid work sessions. He felt that the
plan had been developed through their joint efforts and
cooperation. Relative to traffic and their million dollar
roadway system, Mr. Powell clarified that this was not
brought about by the City. The Traffic Engineer that they
hired stated that this should be done and they agreed to do
it.
Jim GOlden, Senior City Planner stated that the shopping
center is located at the northeast corner of Congress Ave.

and 22nd Ave. There were two previous site plan approvals
for this property under the names of Savannah Square and
Sybar Square. Those expired without the developer pulling
permits in either instance. The request currently before
the commission received the unanimous recommendation of
the Planning and zoning Board and a recommendation for
approval from staff. The reason it is under Development
Plans and not under Consent Agenda is because of the shared
parking approval which is a special request. The shared
parking is a mechanism to reduce the number of required
parking spaces that would be required by the zoning
Ordinance, because uses occur at different times. The
applicant was agreeable with all staff comments.

Description:
Mr. Golden said north of the site is the L-2l Canal. Across
the canal to the north is Dos Lagos. To the east is Quantum
Park, and south is N. W. 22nd Avenue. Further south is
Motorola. To the west is Congress Avenue. Across Congress
Avenue is Post. Landing and Mahogany Bay. Quantum Boulevard
bisects the property east to west, creating two parcels on
the north and south sides. There were two previous approvals
for the site hamed Savannah Square and Sybar Square, but
those projects were never built.
On the parcel north of Quantum Boulevard, there will be an
eight screen cinema and a branch bank of NCNB. Access will
be provided by a main drive onto Quantum Boulevard and a
secondary driveway, which will bea right turn in and right
turn Qut only onto Congress Avenue.
Mr. Golden continued by saying the parcel south of Quantum
Boulevard consists of general retail floor space. The major
tenants are Freddy I s and Luria IS. Access will be at two
points from N. W. 22nd Avenue. Quantum Boulevard also has

to him. When you look at the Cross creek Shopping Center,
which is much smaller than th.isone, cars are coming down
Boynton Be<;l.ch Boulevard 40 m.p.h. They have to brake hard
to :make a right turn, and there have been close situations.
Mr., Lehnertz felt they should have right turn deacceleration
lanes. Mr. Rossi stated that they do have them. in place.

had any problems with the staff comments. Mr. Diaz and Mr.
Matthews stated that they did not. Mr. Ryder moved to
approve the site plan and shared parking for Sybar Square

personally wanted to see signs with one color. Mayor
Cassandra said the ugliest signs are at the Winn-Dixie
shopping center on U. S. 1. As an Architect who has done a
lot of shopping centers, Mr. Lawrence wanted to give the
merchant&some chance at individuality. The building is very
~isciplined, and they will have little chance at individual-
ity except for their signs. There was more discussion by
Mayor Cassandra and Mr. Lawrence.
Mayor Cassandra said the size of the signs are not to exceed
36 inches. M,r. Lawrence called attention to the criteria.
Mayor Cassandra said whatever the Commission decided would
be the Code for this development.
Commissioner Hester moved to approve the signage subject to
all ,staff comments. Commissioner Zibelli asked what they
were approving. Mayor Cassandra indicated the sign they
w~re approving and said it was with a variation of three
colors for the stores. Mr. Lawrence had a sample of the
yellow that ~ould be in the awnings, which Mayor Cassandra
said, the Commission was also approving. Commissioner
Zibelli seconded the motion. The motion carried 4-1.
Mayor Cassandra voted against the motion.
2. Consider request submitted by CarIbs Diaz, Matthews and
Associates, Agent for Sybar-Square Joint Venture, for a
variance to Section 5-l4l(g)(6) "Major Driveways" of the
Parking Lot Regulations. This project is located at
North Congress Avenue and NW 22nd Avenue, northeast
corner (Sybar Square)
Built into the modification of the parking lot regulations,
Mr. Annunziato said there was the requirement that if the
P&Z Board did not unanimously approve a parking lot variance
request, the Co~tssion would sit in final judgment of the
application. This was what happened in connection with this
application.
The request was to allow an encroachment into a major drive-
way by an intervening driveway within 100 feet of the length
of the driveway. Mr. Annunziato indicated Quantum Boulevard
(the northerly exit from Quantum onto Congress Avenue on the
west). 22nd Avenue is to the south. To the north, across
the canal, is Dos Lagos. The applicant was requesting to
break the 100 foot throat required at a driveway with an
intervening driveway to allow right in and right out turning
movements. The recommendation of the TRB to the P&Z Board

was that he be allowed to do this. It would free up move-
ments in the parking lot in connection with a major theater
to be built at that location.
Mr. Annunziato continued by saying the TRB conditioned its
recommendation to the P&Z Board with the requirement that
the applicant construct a concrete barrier in the driveway,
therefore eliminating southbound lefts into the parking lot
or westbound lefts out of the parking lot. In other words,
if you ,left the parking lot, you could only go right. A
condition like this is at the Meadows Square Shopping
Center's exit on Hypoluxo Road. Mr. Annunziato explained.
The request went to the P&Z Board with a recommendation from
the TRB to approve in part and deny in part. The denial was
related to a similar request north of Quantum Boulevard. In
the interim, the applicant amended his site plan and
eliminated that tie. Therefore, they were only talking about
this request. The P&Z Board approved the request on a 5-2
vote.
Mayor Cassandra asked if the barrier was in the middle of
the driveway. Mr. Annunziato answered affirmatively and
showed that it splits ingress and egress property, so
traffic entering cannot turn left into the parking lot.
Mr. Annunziato explained.
Sam Matthews, Matthews & Associates, Architects,
2600 Douglas Road, Suite #795, Coral Gables, Florida 33134,
noticed the term "barrier" was being discussed, and he said
they were not talking about a barrier but were talking about
a concrete median.
Mayor Cassandra asked how they would stop people from making
a lefthand turn. Mr. Matthews confirmed City Manager
Cheney's statement that there would be arrows saying, "One
Way", but he agreed with Mayor Cassandra that you cannot
stop people from making a lefthand turn. He added that you
also cannot stop them from speeding. After discussion,
Mayor Cassandra said if it was slanted parking, he could see
it because the cars would be facing a particular way. He
suggested they look to see if the strip could be slanted
parking so the cars backing out must go out that way. Mr.
Matthews said their real concern was more than this par-
ticular traffic. He designated a point on the overlay and
said it was having individuals come into that area and not
being able to get back into the center. After explaining,
Mr. Matthews said they felt that would be more of a hazard.

Mr. Annunziato explained what was on the plat and said it
came to the Commission with a positive recommendation from
the P&Z Board. Vice Mayor Marchese moved, seconded by
Commissioner Zibelli, to approve the request" subject to
staff comments. Motion carried 5-0.
4. Consider request submitted by Carlos Diaz, Matthews and
Associates, Agent for Sybar-Savannah Square Joint Venture,
for site plan and shared parking approval, to construct a
173,200, square foot shopping center, including an eight

This !project is to be located at North Congress Avenue
and NW 22nd Avenue, northeast corner (Sybar Square)
Mr. Annunziato said the P&Z Board recommended approval of
the request, subject to staff comments. Included in the
R&Z Board's recommendation was a recommendation to approve a
~hared parking analysis, which shares parking between the
~inema and other uses. Secondly, the P&Z Board noted that
the elevations submitted by the applicant were included in
its approval, and the Board recommended to the City
Commission that the applicant plant trees 20 feet on center,
~O feet in height along the north property line to buffer
~he residences at Dos Lagos.
There was discussion about movie houses, which was brought
up by Mayor Cassandra. Mr. Annunziato said this was
qiscussed at some length at the P&Z meeting. There was
concern as to how much of one thing you can have. Mr.
Annunziato did not think there was very much anyone could do
a;bout it. There were further comments.

end and said that would hide nothing because they will have
25 feet of trunk and trees on the top. Mayor Cassandra
asked if there was spme way to put something between the
trees and the low barrier. Mr. Matthews informed him that
a wall is being constructed on the north end of the site,
~nd there will. also be a hedge on the north s ide of the wal,l.
In answer to quel;"ies- by Mayor Cassandra, Mr. Matthews
believed the trees were 40 feet on center and 12 feet high
on Congress Avenue. Mayor Cassandra voiced objections.
Mr. Matthews apprised the Commission that the Review Boards
requested more landscaping, and they complied with the
requests made by those Boards. He informed,Mayor Cassandra
that the Review Boards asked them to increase the number of
trees in the parking lot above the Code.
Mayor Cassandra alluded to a large asphalt jungle of cars on
Congress Avenue and said the buildings are in the back.

~here is a 3 foot hedge along the perimeter of the property
~nd added that the property is entirely surrounded by a
hedge. Mr. Carnival, o~er of the property, said if Mayor
Cassan(ira would look at it, he would see there is a lot of
~reen area between the trees and the hedges. After
~iscussion, the only objection Mr. Carnival had as a shopping
~eveloper was that so frequently, they put up the trees

~r. Matthews referred to Mayor Cassandra's statement that
~here "is a sea of parking", but he thought when the center
was finished, the Commission would see that there are quite
~ number of trees on the site. As they look across, they
will see a number of trees.
Vice Mayor Marchese moved, seconded by Commissioner zibelli,
to approve the request, subject to staff comments, and with
~he amendment of the added trees. Motion carried 5-0.

SYBAR SQUARE~SHARED PARKING ALLOCATION
Section l1-R(13) of the ZOhing Code contains the following
provision for shared parking:
13. Parking spaces required'in this Ordinance for one use or
structure may he allocated in part or in whole for the
required parking spaces. of another use or structure if
quantitative evideI1ce is provided showing that parking
demand for the' different uses or structures ,'lQuld occur on
different days of the week or at different hours.
Quantitative evidence shall include but not be limited to
the following:
(a) Field studies and traffic counts prepared by a traffic
consultant experienced in parking studies.
(b) Adjustments for seasonal variations.
(c}Estimates for peak parking demand based on statistical
data furnished by the Urban Land Institute or some
other recognized land planning and design organization.
All data furnished must be statistically valid. In
addition, a minimum buffer of 10% shall be provided to
ensure that a,sufficient number of parking spaces are
available at times. of peak hour use. Said buffer is to be
calculated based on the fOllowing formula:

The proposed si t'e plan for the sybar square Shopping Center, _
consists essentially of tvlO independent site plan requests for
-cheparcels located on the north and south side's of Quantu.rn
Boulevard. The parcel located on the north side of Quantum
Boulevard consists of 58,100 square feet of floor space,
including 45,100 squa:refeet or retail floor space and 13,000
square ~eet of office fIbor space. The parcel located on the
~outh side of Quantum BOulevard consist's of 115,100 square feet
. of floor space, inCluding 66,600' square' feet.;:.of retail floor
space, 13,000' square ,feet. of office flc6r spa'ce, and a 35,SOa
square foot. (2,288 seat) cinema consisting of eightscreen~.
The Shared Park,ing Study prepared'by 'i:,!urray-Dudek and .u..ssociates
for Rossi and Malavasi Engineers has neencocurnented to provide
fqr two' independE:nt: shared parking allocations .for the parcels
lqcated on the north a'ndsouth sides of Quantum Boulevard. The
study assumes that due to the existence of Quantum Boulevard,
'i;inich forms a physical barrier bet\veen the north and south
parcels, no Sharing will occur between these two parcels.
Rather, all sharing is to occur within each individual parcel.
The documentation prepared by Murray-Dudek for the parcel located
cn the north side of Quantll.\11 Boulevard indicates that the peak
parking accumulation for this site would occur on weekdays at
approximately 2:00 P.!v:I. and would 'require approximately 246 of
the 264 parking spaces provided (291 spaces would be required-by
code). This projection of peak hour parking demand is based on
Urban Land Institute data which has been adjusted in part to .
incorporate site-specific conditions. Of the 65 parking spaces
that would be required by code for the office building, 38 have
been provided on-site~ with the remaining 27 parking spaces being
shared from ~he unoccupied parking available from the retail
development. The remaining 16 surplus parking spaces not
required by the retail development at the 2:00 weekday peak are
allocated toward the calculation of the required 10% buffer as
follows:

Therefore, given the WOrst case scenario of total parking
accumulation (weekdays at 2:00P.i"1.), the shared parking
allocationfo~ the northern parcel would still allow for a
statistical surplus of twenty four (16) parking spaces.

on the south side of Quantum Eoulevard indicates that the peak
parking accumulation for the retail development, the office
building, and the cinema combined would occur on'weekq.ays at
approximately 8:00 P.M. and would, require approximately 648 of
the 798 parking spaces provided, (970 spaces would be required by
code). This projection of peak ~our parking demand is based on
Urban Land Institute data which has been adjusted in part to
incorporate site-specific conditions. Of the 572 parking spaces
that would be required by code for the cinema, 400 have been
provided on-site with the remaining 172 parki~g spaces being

On Tuesday, October 6', 1987, the Technical Review Board met to__
review the plans'and documents submitted, at, which time, they'
recommended approval of the Nurray-Dudek Shared Parking Study as
submitted. ' It was,the consensus of the Technical Review Board
that the proposed shared parking allocation '.vas prepared and
dqcumemted in accordance with code requirements,. and that
sufficient opportunity exists for shared parking to occur
on-site,. given the mix of uses in the proposed~shopping center.
