in the above-referenced approved site plan, please be informed that the driveway closure to
accommodate additional parking and landscaping as shown on the revised plans date stamped
03/20/01 is "minor", as defined within the Land Development Regulations, Chapter 4- Site Plan
Review.
This project may continue to be processed by the Building Division as a permit application
subject to the following conditions:
1. The existing driveway to be removed must be replaced with sod.
2. All landscaped areas are to be irrigated per City code requirements.
Be advised that the proposed change may require a modification to the building permit. Please

Please be advised that on Thursday, November 9,2000, the Environmental Review Committtee
approved the establishment for Auto Body Repair at 4000 Thor Drive, Boynton Beach Florida,
subject to the conditions in the attached Building Division Memorandum No. 00-365, Fire and
Life Safety Division Memorandum 2000-150, and Utilities Department Memorandum No. 00-
260.
Also, and in compliance with the Code Compliance Division, please:
1) replace deed/missing trees and shrubs;
2) repair and deweed asphalt on driveway and parking lot;
3) repair screening along rear parking lot perimeter.
In compliance with parking lot requirements from Land Development Regulations, please
contact the office of Planning and Zoning to modify the existing site plan via Minor Site Plan
Modification.
To complete the environmental review process, a pre-requisite to issuance of an occupational
license, an environmental review permit must be issued. For issuance of an environmental
review permit, please obtain the signatures of those departments indicated on the attached
environmental review permit form. A department ,will not sign off until all of the conditions
(including pulling of any necessary building permits and receiving inspection thereof) imposed
by that department have been satisfied.
Planning and Zoning shall be contacted last to sign off and shall validate the environmental
review permit after all signatures are obtained and after the $250 environmental review permit
fee is received. After the environmental review permit has been issued and validated by
Planning and Zoning, an occupational license process completed (provided that the building to
be occupied has a valid certificate of occupancy). If an application for an occupational license

was filed prior to validation of the environmental review permit, the occupational license
division should be contacted (742-6360) to reactivate the occupational license process.
Approval be the Environmental Review Board shall expire on November 9,2001, one (1) year.
from the date of approval, if a building permit has not been issued, where required, or if an
occupational license has not been issued, in the case where a building permit is not required.
However, approval by Environmental Review committee does not entitle you to operate the
proposed use at this location until an environmental review and occupational license have been
issued. Such illegal occupancy shall be subject to code enforcement action.
Once an environmental review permit and occupational license have been secured, operation of
the approved use in a manner which violates the Environmental Review Committee conditions
and limitations stated in this letter of which exceeds the scope of the Environmental Review
Committee approval as documented in the permit application, shall be subject to code
enforcement action or possible suspension or revocation of the environmental review permit.
Such changes in the operation of the approved use may be granted by modifying the
environmental review permit. Planning and Zoning shall be contacted to request a modification.

On November 9,2000, I conducted an ERC inspection at the above address and offer the
following:
1. The 1997 Standard Building Code, Section 411.5.1 defines a repair garage as any building
or part thereof which is used for painting, body and fender work, engine overhauling or
other major repair of motor vehicles.
2. The previous occupancy of this building was a Group F Occupancy, which was a shutter
manufacturer. This current use constitutes a change of occupancy.
3. Section 3401.2.2.1 of the 1997 Standard Building Code states "If the occupancy
classification or occupancy subclassification of any existing building or structure is
changed, the building, electrical, gas, mechanical and plumbing systems shall be made to
conform to the intent of the technical codes as required by the building official."
4. The applicant is proposing to install paint spray booths, air compressor and air lines, frame
straightening machines, automobile lifts, electrical to support work areas for various
automobiles and to close in some existing doorways.
In conclusion, a design professional needs to evaluate the proposed use and applicable code
requirements, specifically Section 411.5 ofthe 1997 Standard Building Code, which deals with
repair garages. If the administrative, clerical offices and similar rooms do not exceed 25% of the
floor area of the major use, a rated wall separating the offices from the automotive garage may
not be necessary. Due to the change of occupancy, existing restrooms and offices will have to
meet handicapped accessibility requirements. Licensed contractors shall file applications, secure
permits and receive applicable inspections.

Dear Mike:
I enjoyed meeting with you and your staff on December 5, and thank you for explaining
the code as it applies to towing businesses.
I plan to file an application for a Towing License. The towing business will be run be me
and my staff at Master Auto Body (Masters, LLC) under a separate corporation (this on
the advice of my attorney). The only additional employee needed will be a tow truck
driver.
We presently have a surplus of approximately forty (40) parking spaces per day, so that I
do not anticipate any problems with parking and temporarily storing vehicles.
We intend to tow in vehicles and store them in our enclosed, screened yard. Our plan is
to tow cars in and repair them here, or have them removed to other shops for repair. I do
not intend to or wish to store any vehicle for more than thirty (30) days.
Again, thank you for your help and I will be applying for the license in the near future.
