Congress Avenue MMSP 03-067 Dear Mr. Chess: In response to your request dated August 5, 2003 for the administrative review and approval of the modifications proposed to the above-referenced approved site plan, depicting the following: . Enclosure of 201 square feet of the overhang along the north side of the building with storefront glass to serve as additional service and seating area for six tables and twelve chairs. Please be informed that the proposed changes on the revised plan date stamped OS/05/03 are "minor" as defined within the Land Development Regulations, Chapter 4- Site Plan Review. This project may continue to be processed by the Building Division as a permit application, subject to the following conditions: 1. If the scope of the project demands removal of plant material, then such plant material must be relocated to an area subj ect to approval of the City Foresteri 2. The construction conform to the elevations depicted on page A-2 of the attached drawings (north elevation) i 3. The installation of foundation plantings along the north elevation Upon completion of the new construction, utilizing the same species of shrub material already existing on the site and meeting current day code for size, spacing and spreadi and . The acceptance and understanding on the part of the City and the applicant that the approved Parking Agreement for the Catalina Center currently reflects a total excess parking for the entire site of 139 spaces or a 11.4% buffer. With the approval of this site plan modification, the excess parking is reduced to 134 parking spaces and a buffer of 11.0%, exceeding the City requirement for a minimum 10% buffer. Director of Development Review,N\;t\ &~ By this submittal, presented by McDonald's Corporation, we are requesting approval of a-1tnodified site plan for the proposed remodel of an existing restaurant. The existing 4,3DO-sq. ft. restaurant has a 5-ft. overhang surrounding the entire building. McDonald's proposes to endose 201-sq. ft. of the overhang along the north side of the building with storefront glass to serve as additional dining and service area. The additionaI201-sq. ft. would make the total restaurant 4,501 sq. ft. There appears to be adequate traffic trip capacity on the adjacent road system for the proposed use. Said proposed modications have been reviewed and approved by Palm Beach County Engineering. Parking has been adequately provided for per the approved site plan. McDonald's is proposing seating of no more than 107 seats at this time. There are currently 44 parking spaces available (14 on site, 30+ shared with shopping center), which allows for 132 seats per the ULDC Section 7.2. Drainage meets current ULDC criteria. There will be no adverse impact from the proposed remodel. The area in question is impervious at this time. The site is part of a shopping center with an approved drainage system in place and is adjacent to a LWDD canal. The existing paving I drainage plan will be provided for permit review if required. No Drainage Statement has been provided. Utilities for this restaurant are existing and provided by the City of Boynton Beach Utility Department. See attached water I sewer statement. We believe the proposed project has meet all your concerns as put forth by the City of Boynton Beach Zoning standards. We look forward to hearing from you and request that the City of Boynton Beach grant approval of the proposed McDonald's Restaurant modification.
