The undersigned as applicant for Final Site Plan Approval does hereby acknowledge, represent and agree that
all plans, specifications, drawings, engineering, and other data submitted wth this application for review by the
City of Boynton Beach shall be reviewed by the various boards, commissions, staff personnel and other parties
designated, appointed or employed by the City of Boynton Beach, and any such party reviewing the same shall
rely upon the accuracy thereof, and any change in any item submitted shall be deemed material and
substantial.
The undersigned hereby agrees that all plans, specifications, drawings, engineering and other data
which may be approved by the City of Boynton Beach, or its boards, commissions, staf or designees shall be
constructed in strict compliance wth the form in which they are approved, and any change to the same shall be

The applicant agrees to allow the City of Boynton Beach all rights and remedies as pro\ided for by the

Mr. DeLuca said that he owns Lots 2 and 3 of Block A and wants to sell Lot 2 to
Kent McMillan.
Mike advised that by selling off Lot 2, that Lot 3 would become non-conforming in
terms of lot size and structure. A variance would be required in order to create a
non-conformin2 lot.
Jose advised that the separation of the two lots would create a non-conformin210t.
Mike request a letter from the two parties acknowledging the creation of the one
non-conformin2 lot.
Mr. DeLuca indicated the two (2) lots are not combined by a unity of title and that
the lot and structure are already non-conformin2.
Mike advised that the City Attorney's office responded negatively to the dissection
of the two lots.
Jose advised Mr. DeLuca regarding the Commission's approval ofthe US1
Corridor Study for "plannin2 area #2".
Mr. DeLuca complained that the neighboring business' customers were parking on
his lot. Mr. DeLuca asked staff if he could divide his business in half and/ or use the
building for his personal storage. He is retired and needs a place to keep all his old
business records.
Mike advised Mr. DeLuca that his request is unclear and that he could not provide
an answer to Mr. DeLuca at the time. Mike advised if the use is non-conforming
and has not been in existence for 6 months, then it loses its 2randfatherin2 status.
