We have reviewed the subject plans and recommend that the request be forwarded for Board review with
the understanding that all remaining comments will be shown in compliance on the working drawings
submitted for permits.

1 Indicate within the site data the occupancy type of the building as defined in Chapter 3 of the 2001
Florida Building Code.
2 Add to the building that is depicted on the drawing titled site plan and floor plan a labeled symbol that
identifies the location of the handicap accessible entrance doors to the building. 2001 Florida Building,
Sections 11-4.1 .2 and 11-4.3.
3 Add a labeled symbol to the site plan drawing that identifies the location of the handicap accessible
parking space. The quantity of the spaces shall be consistent with the regulations specified in the 2001
Florida Building Code. The accessible parking space that serves a use shall be located on the shortest
safely accessible route of travel from adjacent parking to an accessible entrance. The 2001 Florida
Building Code states that buildings with multiple accessible entrances shall have accessible parking
spaces dispersed and located closest to the accessible entrance. 2001 Florida Building Code,
Sections 11-4.1.2(5), 4.3, and 4.6.
4 Add a labeled symbol to the site plan drawing that represents and delineates the path of travel for the
accessible route that is required between the accessible parking space and the accessible entrance
doors to the building. The installed symbol, required along the path, shall start at the accessible
parking space and terminate at the accessible entrance doors to the building. The symbol shall
represent the location of the path of travel, not the location of the detectable warning or other
pavement markings. The location of the accessible path shall not compel the user to travel in a
drive/lane area that is located behind parked vehicles. Identify on the plan the width of the accessible
route. (Note: The minimum width required by the code is forty-four (44) inches). Add text to the
drawing that would indicate that the symbol represents the accessible route and the route is designed
in compliance with Section 11-4.3 (Accessible Route) and 11-4.6 (Parking and Passenger Loading
Zones) of the 2001 Florida Building Code. Please note that at time of permit review, the applicant shall
provide detailed documentation on the plans that will verify that the accessible route is in compliance
with the regulations specified in the 2001 Florida Building Code. This documentation shall include, but
not be limited to, providing finish grade elevations along the path of travel.
5 Identify within the site data the finish floor elevation (lowest floor elevation) that is proposed for
the/each building. Verify that the proposed elevation is in compliance with regulations of the code by
adding specifications to the site data that address the following issues [Section 3107.1.2, Chapter 31
of the 2001 Florida Building Code]:

a) The design professional-of-record for the project shall add the following text to the site data. "The
proposed finish floor elevation _. _ NGVD is above the highest 1 OO-year base flood elevation
applicable to the building site, as determined by the South Florida Water Management District's
surface water management construction development regulations."
b) From the FIRM map, identify in the site data the title of the flood zone that the building is located
within. Where applicable, specify the base flood elevation. If there is no base flood elevation,
indicate that on the plans.
c) Identify the floor elevation that the design professional has established for the building within the
footprint of the building that is shown on the drawings titled site plan, floor plan and pavingl
drainage (civil plans).
6 As required by Chapter 4, Section 7 of the Land Development Regulations, submit a current survey of
the subject property.
7 As required by Chapter 4, Section 7 of the Land Development Regulations, submit a floor plan
drawing. The building plans are not being reviewed for compliance with the applicable building codes.
Therefore, add the words "Floor plan layout is conceptual" below the drawing titled Floor Plan found on
sheet A-3. However, add to the floor plan drawing a labeled symbol that identifies the location of the
handicap accessible entrance doors to the building. The location of the doors shall match the location
of the accessible entrance doors that are depicted on the site plan drawing.
8 As required by the City of Boynton Beach Code of Ordinances, Part III titled "Land Development
Regulations", submit a site plan that clearly depicts the setback dimensions from each property line to
the leading edge of the building. The leading edge of the building begins at the closest point of the
overhang or canopy to the property line.
9 Place a note on the elevation view drawings indicating that the wall openings and wall construction
comply with Table 600 of the 2001 Florida Building Code.
10 On the site plan and floor plan, indicate the number of stories that are in the leach building including,
where applicable, mezzanines. Indicate the overall height of thel each building.
11 Considering that the occupancy classification of the existing building will be changing, indicate on the
floor plan drawing the floor load capacity of the existing floors. Specify on the plan the existing and
proposed occupancy classification as defined in the 2001 Florida Building Code. Also, indicate the
floor load capacity that is required for the new occupancy classification. Changing the occupancy
classification of a building will require that the building comply with Chapter 34 of the 2001 Florida
Building Code. Certification of the floor loads and compliance with Chapter 34 of the 2001 Florida
Building Code will be required at time of permit review.
12 Indicate on the floor plan drawing within the footprint of the building the primary use of the building.
13 At time of permit review, submit signed and sealed working drawings of the proposed construction.
14 Add to all plan view drawings of the site a labeled symbol that represents the location and perimeter of
the limits of construction proposed with the subject request.
15 According to the City of Boynton Beach Comprehensive Plan Policy 3C3.4, the City shall continue to
encourage the use of non-potable water for landscape irrigation. An alternate water source other than
city water shall be utilized for the irrigation system.
16 A water-use permit for the irrigation system is required from the South Florida Water Management
District. A copy of the permit shall be submitted at the time of permit application. Florida Statute
373.216.

The above referenced Site Plan, received on May 16, 2003, was reviewed against the requirements
outlined in the City of Bovnton Beach Code of Ordinances and Enqineerinq Desiqn Handbook &
Construction Standards (February, 2003). Following are comments with the appropriate codes and
standards.
PUBLIC WORKS - GENERAL
1. Indicate how solid waste storage and pickup is being handled.
PUBLIC WORKS - TRAFFIC
2. Provide a traffic analysis/statement and notice of concurrency (Traffic Performance Standards
Review) from Palm Beach County Traffic Engineering.
3. On the Site and Civil plans, show and identify all necessary traffic control devices such as stop bars,
stop signs, double yellow lane separators striping, directional arrows and "Do Not Enter" signage, etc.
See City Standard Drawings "K" Series for striping details.
ENGINEERING
4. All comments requiring changes and/or corrections to the plans shall be reflected on all appropriate
sheets.
5. Please note that changes or revIsions to these plans may generate additional comments.
Acceptance of these plans during the TRC process does not ensure that additional comments may
not be generated by the Commission and at permit review.
6. Provide written and graphic scales on all sheets. Also check the scale given - it does not scale out
at %" = 1 '-0".
7. Indicate to what standard the project is to be constructed; if the FDOT Standard Specifications for
Road & Bridge Construction and Standard Index are to be used - the 2000 Specifications are
recommended since they contain both English and Metric units.

8. Provide a site survey, not older than six months, in accordance with the LOR, Chapter 4, Section 7.A.
9. Show zoning and land use on Site Characteristics Map (Survey) (LOR, Chapter 4, Section 7.A.)
10. Show all existing utilities on Site Oevelopment plan (LOR, Chapter 4, Section 7.A.3).
11. The use of stabilized sod will not be allowed for the proposed parking. Stabilized sod may only be
considered for less than 50% of the total required parking (LOR, Chapter 2, Section 11.H.)
Additionally stabilized sod is only allowed for the parking spaces only, and does not include driving
surfaces, aisles and maneuvering areas, which are required to be hard surfaced by the same
regulation.
12. Show proposed site lighting on the Site and Landscape plans (LOR, Chapter 4, Section 7.B.4.) The
lighting design shall provide a minimum average light level of one foot-candle. On the Lighting Plan,
specify that the light poles shall withstand a 140 MPH wind load (LOR, Chapter 23, Article II, Section
A.1.a and Florida Building Code). Provide a note that the fixtures shall be operated by photo-
electrical control and are to remain on until 2:00 a.m. (LOR, Chapter 23, Article II, Section A.1.a.)
Include pole wind loading, and pole details in conformance with the LOR, Chapter 6, Article IV,
Section 11, Chapter 23, Article I, Section 5.B.7 and Chapter 23, Article II, Section A on the Lighting
Plan. Glare which is readily perceptible at any point at or beyond the property on which the use is
located is prohibited (LOR, Chapter 2, Section 4.N.7). Lighting shall be directed away from any
residential uses (LOR, Chapter 2, Section 4.N.7). Lighting shall not be used as a form of advertising
in a manner that draws more attention to the building or grounds at night than in the day (LOR,
Chapter 9, Section 10.F.5). If possible please provide photometries as part of your TRC plan
submittals - it is much easier to identify and correct any deficiencies now than while you are waiting
on a permit!
13. Show sight triangles on the Landscape plans (LOR, Chapter 7.5, Article II, Section 5.H.). Reference
FOOT Standard Index 546 for the sight triangles along Federal Highway.
14. Indicate, by note on the Landscape Plan, that within the sight triangles there shall be an unobstructed
cross-visibility at a level between 2.5' and 6' above the pavement (LOR, Chapter 7.5, Article II,
Section 5.H.).
15. Landscaped areas shall be protected from vehicular encroachment by a continuous, raised curb
(LOR, Chapter 7.5, Article II, Section 5.A. and Chapter 22, Article II, Section E.) Add Type "0" curb
around the landscaped area abutting the proposed parking. Type "0" curb may be eliminated along
the east edge of the easternmost parking area if parking blocks are used to protect the landscaped
buffer at that location.
16. The medians on Federal Highway and the chase area(s) immediately south of this project have
existing irrigation and plant material belonging to the City of Boynton Beach. Any damage to the
irrigation system and/or plant material as a result of the contractor's operations shall be repaired or
replaced to the equivalent or better grade, as approved by the City of Boynton Beach, and shall be
the sole responsibility of the developer. Please acknowledge this notice in your comments response
and add a note to the plans with the above stated information.

17. Identify plantings on the Landscape Detail (Sheet A-2).
18. Provide a drainage plan in accordance with the LOR, Chapter 4, Section 7.F.
19. Provide an engineer's certification on the Drainage Plan as specified in LOR, Chapter 4, Section

20. Full drainage plans in accordance with the LOR, Chapter 6, Article IV, Section 5 will be required at
the time of permitting.
21. Indicate by note that catch basin and manhole covers shall be bicycle proof (LOR, Chapter 6, Article

UTILITIES
24. Show all utility easements on the site plan and landscape drawings so that we may determine which
trees may interfere with utilities. In general, palm trees will be the only tree species allowed within
utility easements. Canopy trees may be planted outside of the easement so that roots and branches
will not impact those utilities within the easement in the foreseeable future. The LOR, Chapter 7.5,
Article I, Section 18.1 gives public utilities the authority to remove any trees that interfere with utility
services, either in utility easements or public rights-of-way.
25. Comprehensive Plan Policy 3.C.3.4. requires the conservation of potable water. City water may not,
therefore, be used for irrigation where other sources are readily available.
26. The LOR, Chapter 6, Article IV, Section 16 requires that all points on each building be within 200 feet
of an existing or proposed fire hydrant. Please demonstrate that the plan meets this condition, by
showing all hydrants. (The applicant has reflected hydrants on the Site Plan sheet, but no support
lineage is shown or the source direction of supply.)
27. The LOR, Chapter 3, Article IV, Section 3(0) requires all utilities on or adjacent to the tract be shown.
The plan must therefore show the point of service for water and sewer.

Indicate the proposed use for the project in the site plan tabular data.

The landscape buffers adjacent to US Highway 1 right-of-way shall contain two layers of plant
material. The first layer shall be a combination of colorful groundcover plants and a minimum of
two colorful shrub species planted in a continuous row. The next layer shall consist of a
continuous hedge or decorative site wall. The continuous hedge (2nd layer) shall be a minimum of
24 inches in height, 24 inches in spread and planted with tip-to-tip spacing immediately after
planting. The hedge shall be maintained at four (4) feet (Chapter 7.5, Article II, Section S.D.).
Label and dimension required landscape buffer on the site plan and landscape plan.
On the Landscape plan, label all proposed landscape material, including trees, shrubs,
groundcovers, etc.
Indicate which trees and shrub material are native species. At least 50% of all required plant
material must be native species.

Landscaping at project entrances shall contain a minimum of two (2) colorful shrub species on
both sides of the entrance and a signature tree (Chapter 7.5, Article II, Section 5.N.). Note that
signature trees do not contribute toward the total number of required perimeter trees.
All required trees shall be at minimum 12 feet overall height and 3 caliper inches when planted
(Chapter 7.5, Article II, Section 5.C.2.).
All trees proposed in perimeter landscape buffers shall be spaced one (1) tree per every 30 linear
feet. In addition, this requirement must be indicated as such in the tabular data on the landscape
plan (Chapter 7.5, Article II, Section 5.D.and Chapter 7.5, Article II, Section 5.E.).

7. The LDR, Chapter 3, Article IV, Section 3(0) requires all utilities on or

driving surfaces, aisles and maneuvering areas, which are required to be
hard surfaced by the same regulation.
16. Show proposed site lighting on the Site and Landscape plans (LDR, Chapter
4, Section 7.BA.) The lighting design shall provide a minimum average
light level of one foot-candle. On the Lighting Plan, specify that the light
poles shall withstand a 140 MPR wind load (LDR, Chapter 23, Article II,
Section A.l.a and Florida Building Code). Provide a note that the fixtures
shall be operated by photo-electrical control and are to remain on until 2:00
a.m. (LDR, Chapter 23, Article II, Section A.1.a.) Include pole wind
loading, and pole details in conformance with the LDR, Chapter 6, Article
IV, Section 11, Chapter 23, Article I, Section 5.B.7 and Chapter 23, Article
II, Section A on the Lighting Plan. Glare which is readily perceptible at any
point at or beyond the property on which the use is located is prohibited
(LDR, Chapter 2, Section 4.N.7). Lighting shall be directed away from any

residential uses (LDR, Chapter 2, Section 4.N.7). Lighting shall not be used
as a form of advertising in a manner that draws more attention to the
building or grounds at night than in the day (LDR, Chapter 9, Section
lO.F.5). Provide photometrics as part of your TRC plan submittals.
17. Show sight triangles on the Landscape plans (LDR, Chapter 7.5, Article II,
Section 5.H.). Reference FDOT Standard Index 546 for the sight triangles
along Federal Highway.
18. Indicate, by note on the Landscape Plan, that within the sight triangles there
shall be an unobstructed cross-visibility at a level between 2.5' and 6' above
the pavement (LDR, Chapter 7.5, Article II, Section 5.H.).
19. Landscaped areas shall be protected from vehicular encroachment by a

material as a result of the contractor's operations shall be repaired or
replaced to the equivalent or better grade, as approved by the City of
Boynton Beach, and shall be the sole responsibility of the developer. Please

34. As required by Chapter 4, Section 7 of the Land Development Regulations,
submit a floor plan drawing. The building plans are not being reviewed for
compliance with the applicable building codes. Therefore, add the words
"Floor plan layout is conceptual" below the drawing titled Floor Plan found
on sheet A-3. However, add to the floor plan drawing a labeled symbol that
identifies the location of the handicap accessible entrance doors to the
building. The location of the doors shall match the location of the accessible
entrance doors that are depicted on the site plan drawing.
35. As required by the City of Boynton Beach Code of Ordinances, Part III
titled "Land Development Regulations", submit a site plan that clearly
depicts the setback dimensions from each property line to the leading edge

Changing the occupancy classification of a building will require that the

By means of this letter we are making formal request for a "Minor Modification"
for "Miss Jody's place to dance".
The minor modification involves, what is currently known as the Act II
consignment shop, converting it from a retail store to a place of dance instruction.
The exterior of the building will remain the same with only a change in color and
signage. The interior will have most partitions removed and an installation of a
large dance studio along with (2) two fully accessible uni-sex toilet rooms, (1) one
dressing room and a front office and storage area.
The site will consist of installing (8) eight additional parking spaces on the
property to the north and rearranging (1) fully accessible parking space and
walkway adjacent to the building.
The building will meet the city landscape ordinance. This will be accomplished by
means of "Xeriscape" landscaping as outlined by SFWMD. Therefore it will be
necessary for a short period of time to use potable water and than water only for
maintenance.
There is a critical time element in this submittal. The owners have their "Due-
Diligence" period over on May 9, 2003. which happens to be the same day they
close on the property. We respectfully request that a verbal on whether this
project can move forward or not. This is just so the client can have a comfort
level that somewhere down the road the city ma\l say they could not proceed with
this project.
