It is our understanding that you are processing a site plan through the City of Boynton Beach to construct a 48-unit Congregate Care Facility. Under the Palm Beach County Unified Land Development, all proposed properties are subject to the criteria of Article 15 of the Code, the Countywide Traffic Performance Standard. Based on the analysis contained herein, it is the opinion of this office that the project as proposed should be classified as a project which generates De Minimus traffic significant levels and therefore is compliant with the County's Traffic Performance Standard. The first portion of the analysis involves estimating the potential traffic generation activity for the Congregate Care Facility. As noted previously, the planned development is to provide for a total of 48 units to be housed within the Congregate Care Facility. As such, traffic generation standards were examined relative to the planned 48 units. The authoritative source used in Palm Beach County to estimate traffic generation levels is the Institute of Transportation Engineers (ITE) Trip Generation Manual, 5th Edition. Land Use Code (LUC) 252 provides the standards for a Congregate Care Facility on a daily, a.m. and p.m. peak hour basis. Table 1, attached hereto, has been prepared accordingly based on the criteria of LUC 252. The criteria of the Traffic Performance Standard indicates that an assessment of the development's directly accessed link should be examined. As SW 19 Avenue is not a County thoughfare roadway, the directly accessed link is Congress Avenue. Congress Avenue is a six-lane divided facility traversing in a north/south direction and parallels Interstate 95 to the west. The latest criteria of the Traffic Performance Standard indicates that the carrying capacity for this section of Congress Avenue, based on a six-lane divided cross section, provides for a maximum of 48,900 vehicles per day. The City of Boynton Beach through Palm Beach County, has since adopted the De Minimus Traffic Significance Level as of March 2000. This Significance Level indicates that a level of 0.5% of the adopted Level of Service 'D' capacity now applies to project traffic on the directly accessed roadway segment and those roadway segments within 0.5 miles of the project's entrance. Previously, any project traffic within 0.5 miles of the project entrance had to be address against the Standard. Now those roadway segments need to be analyzed only if the project traffic exceeds the 0.5% significant level. As noted previously, this section of Congress Avenue has a carrying capacity of 48,900 vehicles per day. Considering the significance percentage of 0.5, the significant level would provide for a maximum of 244 vehicles to be impacted by this development on Congress Avenue. As noted from the traffic generation in Table 1, the entire project is projected to generate only 103 trips per day. This is less than what is allowed on the roadway segment (244 trips per day) under the County's De Minimus Traffic Significance Level. As such, being that the project is expected to generate volumes well below the traffic significance level, we are requesting that the project be considered as a De Minimus traffic generator and therefore be approved relative to the criteria of Article 15 of the Palm Beach County Unified Land Development Code, the Traffic Performance Standard. Stevens, III, Attorney for Palm Beach County Property Appraiser. As the letter indicates, the City of Boynton Beach sometime in the past, approved the Palm Walk Adult Congregate Living Facility to be developed into a 48 bed adult living facility which was to be developed within a certain time period. The City conditioned the approval of the project on the unification of the above listed parcels. The attached unification of title instrument states that the unified parcels shall be considered as one plot and that no portion of the plot may be sold, transferred or assigned separately. According to Mr. Stevens, the project never got off the ground and accordingly, the ad valorem taxes were not paid on some of these unified parcels. Consequently, the unpaid taxes eventually resulted in tax certificates and the tax certificate holders have applied to the County Property Appraiser for tax deeds. There is a County ordinance which prohibits the sale of a piece of property which is attached to another by a unity of title. Because of this prohibition, the County Appraisal is unable to issue the tax certificates to holders of tax deeds in this case. The Property Appraiser is now looking to the City to release the unity of title on the grounds that the project in this case has been abandoned. My preliminary research indicates that the Commission at one point approved an extension for this facility. Please review your records and determine whether the applicant in this case has in deed abandoned the project and proceed to prepare a release of the unity of title if appropriate. As we discussed, a unity of title, has been filed on the referenced properties, (A copy of the Unity of Title is enclosed for your convenience). At the time, the property was to be developed intg a 48 Bed Adult Living Facility. The project never got off the ground. I have confirmed that the property has not been ---- developed with Pat Burger of the Boynton Beach Building Department who advises that the property is still vacant. Ad va.!grem taxes were not paid on certain parcels. The unpaid taxes eventually resulted in tax certificates and now the certificate holders have applied for tax deeds, However, because of the Unity of Title, the Clerk of Court cannot sell tax deeds.
