RE: PALM WALK CONGREGATE CARE FACILITY
CITY OF BOYNTON BEACH, FLORIDA
TINTER ASSOCIATES PROJECT NO. 01-2042
Dear Sir / Madam:
The firm of Tinter Associates, Inc. has completed its assessment of traffic impacts associated
with a proposed Congregate Care Facility to be located on the north side of SW 19th Ave
immediately east of Congress Ave in the City of Boynton Beach, Florida. It is our understanding
that you are processing a site plan through the City of Boynton Beach to construct a 48-unit
Congregate Care Facility. Under the Palm Beach County Unified Land Development, all
proposed properties are subject to the criteria of Article 15 of the Code, the Countywide Traffic
Performance Standard.
Based on the analysis contained herein, it is the opinion of this office that the project as
proposed should be classified as a project which generates De Minimus traffic significant levels
and therefore is compliant with the County's Traffic Performance Standard.
The first portion of the analysis involves estimating the potential traffic generation activity for the
Congregate Care Facility. As noted previously, the planned development is to provide for a total
of 48 units to be housed within the Congregate Care Facility. As such, traffic generation
standards were examined relative to the planned 48 units. The authoritative source used in
Palm Beach County to estimate traffic generation levels is the Institute of Transportation
Engineers (ITE) Trip Generation Manual, 5th Edition. Land Use Code (LUC) 252 provides the
standards for a Congregate Care Facility on a daily, a.m. and p.m. peak hour basis. Table 1,
attached hereto, has been prepared accordingly based on the criteria of LUC 252. As Table 1
indicates, the project as planned is only projected to generate a total of 103 daily trips of which
three trips will be generated during the a.m. peak hour while eight trips will be generated during
the p.m. peak hour.

As noted, the project is planned to be located along the north side of SW 19th Avenue
immediately east of Congress Avenue in Boynton Beach, Florida. The criteria of the Traffic
Performance Standard indicates that an assessment of the development's directly accessed link
should be examined. As SW 19 Avenue is not a County thoughfare roadway, the directly
accessed link is Congress Avenue. Congress Avenue is a six-lane divided facility traversing in
a north/south direction and parallels Interstate 95 to the west. The latest criteria of the Traffic
Performance Standard indicates that the carrying capacity for this section of Congress Avenue,
based on a six-lane divided cross section, provides for a maximum of 48,900 vehicles per day.
The City of Boynton Beach through Palm Beach County, has since adopted the De Minimus
Traffic Significance Level as of March 2000. This Significance Level indicates that a level of
0.5% of the adopted Level of Service 'D' capacity now applies to project traffic on the directly
accessed roadway segment and those roadway segments within 0.5 miles of the project's
entrance. Previously, any project traffic within 0.5 miles of the project entrance had to be
address against the Standard. Now those roadway segments need to be analyzed only if the
project traffic exceeds the 0.5% significant level.
As noted previously, this section of Congress Avenue has a carrying capacity of 48,900 vehicles
per day. Considering the significance percentage of 0.5, the significant level would provide for a
maximum of 244 vehicles to be impacted by this development on Congress Avenue. As noted
from the traffic generation in Table 1, the entire project is projected to generate only 103 trips
per day. This is less than what is allowed on the roadway segment (244 trips per day) under the
County's De Minimus Traffic Significance Level.
As such, being that the project is expected to generate volumes well below the traffic
significance level, we are requesting that the project be considered as a De Minimus traffic
generator and therefore be approved relative to the criteria of Article 15 of the Palm Beach
County Unified Land Development Code, the Traffic Performance Standard.
As always, should you have any questions regarding this matter please feel free to contact me
directly.

Re: Palm Walk ACLF - Site Plan/Conditional Use Application
Dear Mr. Feldman:
Pursuant to the pre-application meeting held yesterday, I have prepared a tentative
development review schedule for the above referenced project.
1. May 2,2001:
2. June 5, 2001 :
3. June 26, 2001:
4. July 3, 2001:
Application Submittal to P&Z Division
Technical Review Committee Meeting
Planning and Development Board Meeting/Public Hearing
City Commission Meeting/Public Hearing
Please be advised that this schedule is contingent upon the receipt of the Site Plan/Conditional
Use application by 5:00 PM on May 2, 2001. This is required to meet the advertising deadlines
associated with a conditional use application. Also, to accommodate this project, the review time

DATE:

I forward for your review and action a letter received from Eddie E. Stevens, III, Attorney for
Palm Beach County Property Appraiser. As the letter indicates, the City of Boynton Beach
sometime in the past, approved the Palm Walk Adult Congregate Living Facility to be developed
into a 48 bed adult living facility which was to be developed within a certain time period. The
City conditioned the approval of the project on the unification of the above listed parcels. The
attached unification of title instrument states that the unified parcels shall be considered as one
plot and that no portion of the plot may be sold, transferred or assigned separately.
According to Mr. Stevens, the project never got off the ground and accordingly, the ad valorem
taxes were not paid on some of these unified parcels. Consequently, the unpaid taxes eventually
resulted in tax certificates and the tax certificate holders have applied to the County Property
Appraiser for tax deeds.
There is a County ordinance which prohibits the sale of a piece of property which is attached to
another by a unity of title. Because of this prohibition, the County Appraisal is unable to issue
the tax certificates to holders of tax deeds in this case. The Property Appraiser is now looking to
the City to release the unity of title on the grounds that the project in this case has been
abandoned.
My preliminary research indicates that the Commission at one point approved an extension for
this facility. Please review your records and determine whether the applicant in this case has in
deed abandoned the project and proceed to prepare a release of the unity of title if appropriate. If
you need additional information on this matter, please let me know.

Re: Tax Certificates sold on the following Boynton Beach property:
PCNs: 08-43-45-32-12-000-0090 thru 08-43-45-32-12-002-0240 and
08-43-45-32-12-000-0420 thru 08-43-45-32-12-000-0480
Dear Mr. Igwe:
Thank you for taking the time to talk about the above referenced properties with me. As we
discussed, a unity of title, has been filed on the referenced properties, (A copy of the Unity of Title
is enclosed for your convenience). At the time, the property was to be developed intg a 48 Bed Adult
Living Facility.
The project never got off the ground. I have confirmed that the property has not been
----
developed with Pat Burger of the Boynton Beach Building Department who advises that the property
is still vacant.
Ad va.!grem taxes were not paid on certain parcels. The unpaid taxes eventually resulted in
tax certificates and now the certificate holders have applied for tax deeds,
However, because of the Unity of Title, the Clerk of Court cannot sell tax deeds. There is
a County Ordinance which prohibits the sale of a piece of property which is attached to another
property by Unity of Title,
We are now looking to the City of Boynton Beach to release the Unity of Title so that Tax
/ Deeds can be sold, This should not be an issue since the purpose of the Unity of Title (to develop
" a 48 Bed Adult Living Facility) has been abandoned and the Property Owner has stopped paying his
ad valorem taxes on the subject property,

re: 1 ~T REVIEW COMMENTS FOR
Palm Walk - ACLF
Please find attached the first review comments for your project. To stay on the
current review schedule, please do the following steps listed below, and bring all
documents to the TRC scheduled for June 26, 2001.
1. Revise your plans incorporating all comments listed herein, including the addition of
notes on plans to confirm response to general statements/ comments, and bring 10 copies
to the TRC review meeting (full sets including all pages originally submitted);
2. Submit the additional information as requested within the attached comments; ( i.e. traffic
analysis, engineering certification, etc.)
3. Prepare a written response (7 copies) consisting of a list briefly summarizing how each
comment has been addressed on the revised plans or with the supplemental information
including location on the plans ( this promotes an expeditious 2nd review by staff and
your project representatives during the TRC meeting );and
4.
Submit reductions (8 'l2 X 11) for the proposed
site plans, elevations and landscaping plan (this
is required for the final report and public
presentation).
Planning and Zoning Division
City of Boynton Beach
Boynton Beach, Florida 33425

Fax: 742-6259
The applicant should not attend a TRC (2nd review) until all documents have been revised and
copied for staff review. If plans will not be fully revised and brought to the scheduled TRC
meeting, contact Lusia Galav in this office by the Thursday prior to the scheduled meeting date.
Projects deviating from the original schedule are eligible for review at subsequent meetings,
which are held every Tuesday. To reschedule, contact Elizabeth Cabrera, by the Thursday prior
to the Tuesday TRC meeting that you desire to attend. The remainder of the review schedule
will be adjusted accordingly. If you have questions on the attached comments, please contact the
respective reviewer using the attached list of TRC representatives.
If the plans are reasonably complete and all significant comments are addressed following TRC
(2nd review), the project is forwarded to the Planning and Development Board Meeting that falls
approximately 2 to 3 weeks following the TRC meeting. An "*,, by any comment identifies a
comment that must be addressed prior to moving forward to the Planning and Development
board.
Note: Items recognized by staff as typically outstanding at this point include a traffic report
and/or confirmation of the traffic concurrency approval from the Palm Beach County
drainage certification by a licensed engineer, signed "Rider to Site Plan Application"
form and colored elevations of the proposed project. This information is necessary for
the project to proceed. If you have submitted this information, please disregard this note.
