In response to your request for the administrative review and approval of the modifications proposed to
the above-referenced, approved site plan, please be informed that the increase in the number of seats as
indicated in the tabular data as shown on the revised plans date stamped 01/28/02 are "minor", as
defined within the Land Development Regulations, Chapter 4- Site Plan Review.
This project may continue to be processed by the Building Division as a permit application. Be
advised that the proposed changes may require a modification to the building permit. Please contact

Church of Our Savior MCC has entered into a Cross Parking Agreement
with Ralph & Rosie, Inc. dba Ralph & Rosie's Restaurant. This agreement
allows Ralph and Rosie's Restaurant to use seventeen (17) parking spaces
on the church property.
The Church Services are Sundays, from 10:00 - 11 :00 AM. Office hours are
Tuesdays, Wednesdays, and Thursdays from 12:00 Noon to 8:00 PM. 8 to
10 parking spaces are needed during office hours.

Dear Mr. Rumph:
This letter is to request a Minor Site Plan Modification and a "Cross Parking
Agreement" between Ralph & Rosie's Restaurant (Restaurant) and the Church of Our
Savior (Church), 2011 South Federal Highway. A required parking study was done
by H. Burton Smith, PE, Civil Engineer for this project, which is enclosed.
The original restaurant (doing business as Mario's Pizzeria) was operating with
approximately 50 seats and the approved site plan indicated 23 parking spaces. Mr.
Devito has increased the seating capacity of the restaurant from 50 seats to 100
seats, requiring 40 parking spaces 11 space / 2.5 seats). Since there is only enough
room on this site for 23 parking spaces, the additional 17 spaces must be off site.
Mr. Devito has negotiated with the Church next door to the south for the additional
parking spaces. The operating hours of the restaurant are 4:00 PM to 2:00 AM.
The church site is located adjacent to the restaurant on the south side and has a
paved parking lot with 33 parking spaces. The church has services on Sunday
mornings from 10:00 - 11 :00 AM and office hours on Tuesday, Wednesday and
Thursday between 12:00 noon and 8:00 PM, when they require approximately 8 to
10 parking spaces. Therefore, the church is not open nor does it need the remaining
parking spaces when the restaurant is open.
We are requesting the City of Boynton Beach to approve a Minor Modification to the
Ralph & Rosie Restaurant Site Plan to increase the seating capacity from 50 seats to
100 seats, and a "Cross Parking Agreement" between the Church of Our Savior and
Ralph and Rosie's Restaurant for the restaurant to use 17 parking spaces on the
church property re ired for the a ditional seating.

The restaurant owners have contacted the Church of Our Savior, which is immediately
south of the restaurant, to work out the details of allowing the additional restaurant
customers to use the excess church parking. The Church of Our Savior has 3 1 parking
spaces and has only two regularly scheduled meetings per week. There is a Bible study
class on Wednesday night and the Sunday morning service. The only time that the church
requires most of their parking spaces is for the Sunday morning service.

As previously stated, the restaurant is desirous of increasing its seating capacity to 100.
This would require an additional 17 parking spaces, over the 23 currently available.
These additional parking spaces are available on the Church of Our Savior property,
immediateiy to the south of the restaurant.
The church's Sunday service will conclude approximately the time that the restaurant will
open and the church's Wednesday Bibie class is for approximately one hour on
Wednesday evening, which requires only 8 - 10 parking spaces. This leaves 21 - 23
spaces on the church's property available for the restaurant's use. There will be no other
conflict in the hours of operation between the church and the restaurant.
Attached are site plans for both the Church of Our Savior and Ralph & Rosie's restaurant
for verification ofthe existing parking.
Conclusion
Based upon the available parking spaces on the Church of Our Savior property and the
difference in operating hours, the additional seating requested in Ralph & Rosie's
restaurant can be approved by allowing for shared parking on the church's property.
