Scott, the restaurant above-referenced is licensed for 44 seats, same number of seats with capital fees paid for. On May 7,
2003, Peter McCray counted 113 seats in total, including 57 outside on an unpermitted deck along Federal Hwy. On
Wednesday April 28, 2004, Peter and I visited the site and counted a total of 80 seats, including 35 outside. I did point to
the owner the excess of seating from the 44 licensed and his responsibilty to pay for both extra fees for OL and capital's.
His excuse was that since he has submitted drawings for approval then he was OK (I assume he referenced to building
permit) and that he will pay until the time of approval. He acknowledged with disregard the existence or the possibility of
fines.
A little of history. In April of 2001 a Minor Site Plan Modification was approved for the then Mario's Pizzeria restaurant to
Increase the number of seats to 56 from 44 to be accommodated on a pergola area facing the parking to the North. No OL
nor capital fees paid for and no pergola built. In February 2002 another Minor Mod was approved to increase the number
of seats to 100 based on a parking agreement with a neighboring church. No capital nor OL fees paid for the increase. A
buiiding permit 03-1404 was applied for on April 2003 that became voided. In December of 2003 another Minor Mod was
approved to set the total number of seats to 90, among other things approved requiring building permits, such as:
- New wooden deck facing parking to the North;
- Relocating unpermitted awning on the unpermitted deck along Federal Hwy. to the parking facing
North on the new deck;
- Apply for permit for existing deck along Federal Hwy;
- 278 sf of kitchen addition.
No such building permits have been applied as of today (April 30, 2004). On the letter of approval in December 2003 the
applicant was made aware of the capital and OL fees. I have no concern regarding the lack of permits, my concern is the
lack of payment for both capital and OL fees. However, if the applicant has not secured permits with final inspections he
shouldn't be occupying unpermitted structures. He could have all the seats able to accommodate inside providing fees
payment. Therefore, I will appreciate if you can contact the applicant. Let me know your findings, please. By the way, is

administrative review and approval of the modifications proposed to
the above-referenced approved site plan, depicting the following:
· Relocation of a white canvas awning from the east side of
the structure to the north, within three (3) existing
parking spaces (as depicted on the attached drawings) .
· Construction of a new wood deck on the north side of the
building and bar, to be located under the relocated awning
(as depicted on the attached drawings) .
· Reduction in maximum seating from 100 to 90 patrons (as
depicted on the attached drawings) .

Please be informed that the proposed changes on the revised
date stamped 12/16/03 are "minor" as defined within the

7. The kitchen addition be constructed to have the same type of
exterior finish and color as the remainder of the building .

The following items are not all inclusive of my issued regarding this site:
1) There is no history of a permit being issued for the "existing wood deck". The
proposed "new" and "existing" deck would require proper permits and inspections
per the City of Boynton Beach Amendments to the 2001 FBC, Section 104.1.1.
2) The awning and the decking and any other structures shall be required to comply
with the wind load provisions of the 2001 FBC, Section 1606 and be designed to
withstand 140 mph wind.
3) Capital facility charges (water and sewer) would be required to be paid for all
additional seating.
4) The existing structure needs to be reviewed to ensure the existing exits are sufficient
to accommodate the additional occupants per 2001 FBC, Table 1004.1.
Of course, a comprehensive plan review will be performed when plans are submitted for
permitting.

The enclosed drawings are a re-submittal in response to comments and questions previously issued
by the zoning department. Ralph and Rosie's Restaurant is an existing restaurant currently in
operation at the above referenced address. The property has an existing awning structure located
on the east side of the building. The awning, which provides cover for exterior dining, encroaches
into the required 20' front setback. With this minor site plan modification, we are requesting
approval to remove and relocate the awning to the north side of the building and to construct a new
wood deck area and bar below it for outdoor dining. The deck will be constructed to maintain ali
handicapped access points. The awning was originaliy installed in 2002 and is in relatively new
condition. It is a white canvas awning on an aluminum frame.
The relocation of the awning to this area requires the removal of 3 parking spaces. The property
was originaliy permitted for 100 seats at 1 parking space per 2.5 seats. A total of 40 spaces was
achieved by means of a shared parking agreement with the Church located adjacent to the south
property line. The restaurant currently seats 40 diners. This application will reduce the maximum
seating to 90 with a total of 37 parking spaces.
We are also requesting an addition of 278 square feet to the northwest corner of the building. This
space will increase the area of the kitchen and allow the owner to replace his existing walk in cooler
for a newer, larger model.
We respectfully request review and approval of the attached site plan. As the project is currently in
violation of the zoning code, we would like to resolve this matter and pursue a building permit as
quickly as possible. I would be happy to meet with you, at your request, to further describe the

additional information is required in order to process your request. Please submit the following
infomlation:

The majority of their regular customer base at the restaurant has shown a preference for outdoor
seating. This is due in large part to the recent smoking laws enacted in Florida. In an effort to
provide their customers with a suitable atmosphere for outdoor dining, the owner wishes to increase
his "open air" dining area. This can be achieved by modifying the location of the existing exterior
storefront glass walls to create additional exterior space below the existing roof structure.
We are also requesting an addition of 278 square feet to the northwest corner of the building. This
space will increase the area of the kitchen and allow the owner to replace his existing walk in cooler
for a newer, larger model.

Thanks, Kevin. Mike, was the applicant in agreement that a minor mod is required? what will be the next step? I
think someone has to explain him the capital fee issue before he incurs in any extra effort (Tim...?). Also, he
needs to submit a seating sketch to verify fire and building codes compliance. Mean whiie, Karen and I will keep
