Dear Mr. O'Brien:
In response to your request for the administrative review and approval of the modifications proposed to the above-
referenced, approved site plan, please be informed the changes as shown on the revised plans date stamped 05/19/03
are "minor", as defined within the Land Development Regulations, Chapter 4- Site Plan Review.
This project may continue to be processed by the Building Division as a permit application subject to the following
conditions:
I. If dumpster locations are existing, and do not represent relocation of same then the enclosures are
not required to be landscaped pursuant to current city regulations;
2. Iffa,ade changes are planned, elevation drawings showing material and colors shall be provided
to the Planning & Zoning Division for review and approval as part of this review of minor site
modifications;
3. Planned landscape materials (type and quality) shall be shown on the subject drawings and be
limited to a minimum of 50% native species;
4. Any planned improvements within public rights-of-way shall require city approval;
5. The revised plans, dated 5/19/03 no longer indicates a proposed storage area along north and
south sides of southernmost building. Any new outdoor storage areas shall be adequately screened
pursuant to city regulations; and
6. Any use of, or improvements to any leased property, shall be in accordance with respective lease
agreements.
Be advised that the proposed changes may require a modification to the building permit. Please contact me at

The above referenced minor modification, received on May 29, 2003, was reviewed against the
requirements outlined in the Citv of Boynton Beach Code of Ordinances and Enaineerina Desian
Handbook & Construction Standards (February, 2003), as well as the (undated) "1st Review Comments"
for the above referenced project.
I have signed off on all remaining comments for Public Works - General and Engineering (see attached).
In response to the request in the applicant's letter, dated May 18, 2003, regarding waiver of landscaping
around the dumpster enclosure, Staff defers to Planning & Zoning to make that determination.

believe reflect all that we need to do to properly respond to staff comments. I have
attached a copy of your last comments from November 7,2001 for your convenience in
the review.
Please note the following as to those comments:
Public Works:
Dumpster:
The dumpsters shown on the attached site plan will be enclosed in concrete
enclosures per the City of Boynton Beach Drawing #G-4. However, in as much
as these are existing dumpsters and therefore would not require the enclosures
and in that it is not in the interest of the City or our interest to do anything to
reduce parking space, we request that you waiye the requirements for
landscaping around the dumpster enclosures.
Engineering:
The attached plans are as reviewed and approved by Luarinda Logan, Senior
Engineer, Boynton Beach Engineering Department. The drainage and paving
details are shown. There is no separate and dedicated site lighting as the tenants
in the property will only operate in the daylight. Each tenant will haye some
lighting attached to the building as appropriate. Fences are existing as shown.

(November 7,2001) on the Minor Modification request for the above referenced project.
All Public Works cornments can be addressed during the permit application process, as can
Notes No.2, 3, and 4 for Engineering; that is, these comments do not need to be addressed as
part of the Minor Modification approval process. Note No. I under
Recomrnendations/Corrections is in error and should be ignored.
To clarify Engineering Note No.1, we are requesting the Owner/Developer provide information
on the site plan indicating the current and proposed overland flows. The Owner/Developer needs

I have reviewed the above referenced plans, forwarded to me on November 2, 2001, against the
requirements outlined in the City of Boynton Beach Code of Ordinances.
Please note that the Engineering Department's greatest concern regarding this request for a
minor modification is that an agreement not be entered into with the owner to allow parking in
front of the building in the future in the event they lose their lease with the railroad.
Following are my additional comments on the site plan provided, with the appropriate Code and
Land Development Regulations (LDR) referenced.
PUBLIC WORKS

1. Provide a detail for the required dumpster enclosure. (LDR, Chapter 7.5, Article II, Section
5.J and Article III, Section 9.A.9.a)
2. The required gates for the dumpster shall contain long steel rods to drop into the pavement in

I am in receipt of another letter from Planning and Zoning which again
requests drainage, fence details etc. I want to remind you that (a) where I
come from a deal is a deal and our deal was that this is maintenance on the
parking area and requires neither drainage nor fence details nor anything
else other than pavement and (b) I can use this property with 12 white
stripes on the existing pavement. Let's stop this fooling around and do
what's right for the property and right for the City.
I must have approval AS IS on the site plan submitted by this FRIDAY or I
must use the 12 stripe solution. This path we are on is STUPID and this
delay is costing me a lot of money ($500+ per day in lost revenue).
Let's do the right thing here. One of you please call me today with approval

Staff has met numerous times with Andrew O'Brien regarding his request to make several modifications to the
site plan for 208 & 210 SE 12th Avenue. The above referenced request for a minor site plan modification was
received on October 26, 2001. The subject property is generally located north of Woolbright Road, east of
Seacrest Boulevard; just south of Southeast 12th Avenue and west of the Florida East Coast railroad right-of-
way, more particularly described as the address referenced above. The property is zoned M-l.
The applicant proposes several modifications to the existing site. Attached, you will find a copy of the plans,
the application letter, and Pre-Application rneeting notes.
I have to review the request to determine if the proposal meets the Zoning Code. Please review this application
for its compliance with all applicable codes (in your discipline). Although this application is not scheduled to go
before the C.R.A. or City Commission, please return the plans and provide written comments to me at your
earliest convenience. Lusia and I were hoping for your comments no later than Tuesday November 6, 2001.
After we receive your comments, we will set up another Pre-application meeting with Mr. O'Brien to discuss
the site planning issues. We would kindly request your presence at that meeting as well.
Our thoughts on the plans are as follows:
. Indicate new and existing dumpster locations;
. Indicate leased area property from the F.E.C. railroad;
. Provide fence detail;
. Clarify parking / maintenance as proposed in the letter;
. Provide paving, grading, and drainage plans;
. Will storage area be screened? If so, provide fence or wall detail;
. Provide and show proposed landscaping.

This letter shall serve as our request for a minor site plan modification for our property
at 208 & 210 SE 12111 Ave. This property is owned by Boynton 12 Investments, LLC
which company is a wholly owned subSidiary of SunTropic Investments LLC. We haye
enclosed six copies of the proposed site plan and the $100.00 fee.
Dear Mr. Rumpf:
This site plan revision primarily concerns parking/ parking lot and access issues. Your
attention is directed to the following:
· The proposed 3' landscape strip on the west side of the building will have several
drives and walkways crossing it as our exact needs for overhead and pedestrian
doors is determined. As we at present have 100% access to SE 1st Street for this
purpose and this is a major component of our leasing plan and therefore the
property's yalue, we reserve the right to continue this access as useful.
· The new access/drop off service drive at the east side of the small building
should help to remove some traffic off of the center of the intersection and is
important to the operation of the property.
· The addition of the minor amount of asphalt paving and the relocation of the
fence to the east is to be considered maintenance instead of new parking and as
such will merely only need a paving permit and a fence permit one site plan
modification is complete.
· The area at the north of the small building is grass now but we propose
deepening this area to catch water from SE 12111 Ayenue. This area is so small
that unless the 4:1 slope begins at the south edge of SE 12111 Avenue's
payement, the are would not be worth the cost and we would not want this to be

a art of this site plan modification. Additionally, we are only proposing to deepen
the area at a 4: 1 slope and re-sod. If there will be additional requirements by the
City, please remoye this from the proposed modification.
