CKE Group, Inc. 15500 New Barn Road, Suite 106 Miami Lakes, FL 33014 Re: Mobil on the Run (aka Old Citgo Gas Station at 1601 South Federal Highway) - Canopy Change MMSP 01-062 Dear Mr. Carcache,: In response to your request for the administrative review and approval of the modifications proposed to the above-referenced, approved site plan, please be informed that the change to the canopy height as shown on revised plans date stamped 08/09/01 are "minor", as defined within the Land Development Regulations, Chapter 4- Site Plan Review. The existing canopy is a non-conforming structure because it encroaches into the required front yard setback. Pursuant to Chapter 2, Section 11.1.E., a nonconforming structure may not be added to or altered in a fashion so as to increase the degree of non- conformity. Raising the height of the canopy to 16 feet will not increase the degree of non-conformity. This project may continue to be processed by the Building Division as a permit application. The plans have been revised in order to raise the canopy to a clear height of 16 feet to the bottom and 19 feet overall. The canopy is being raised in order to reduce the constant repairs due to trucks hitting it. In addition the sides will be extended 10 feet in order to provide better protection from the weather for patrons. These extensions will be kept 20 feet from the property line to meet current setback requirements; however, the existing portion of the canopy being raised will maintain the existing setback. We feel that this canopy improvement will benefit the customers without having any negative impact on the surrounding areas.
