A. That special conditions and circumstances exist which are peculiar to the land, structure
or building involved and which are not applicable to other lands, structures or buildings
in the same zoning district:

privilege that is denied by this Ordinance to other lands, buildings or structures in the
same zoning district;

(A) This piece of property is approximately ,22 of an acre. It is an extremely small
lot and presents a myriad of problems regarding the location of the building and
particularly the handicap parking space. I have been attempting to receive a
building permit for this upscale, single-story law office building for over a year
(See building permit number 03446). My original plans were approved by the
city commission. However, the handicapped parking spot could and cannot be
located close to the entrance, because of the size of the lot.I then applied, and
was granted, a minor modification to locate the handicap spot across the
parking lot. However, when I applied for the building permits, it was rejected.
The engineer department representative stated the handicap parking space
must be on the west side of the building, close to the entrance, However,
because of the landscape requirement of 1', pursuant to Boynton Beach
Landscape Code, Article II, sec. 5(0), there is not enough room. Instead of
litigation, I am requesting this variance, which is well-deserved after receiving
the run-around from the city for over a year.
(B) I have done nothing to affect the special circumstances. The lot is just a little
too small to fit the handicap parking spot and the additional regular parking
spot. The only alternative is a design with a notch in the building which has an
unpleasant aesthetic design, This variance would provide a better looking
building and a better utilization of the land. This better design would benefit the
applicant and the City of Boynton Beach, because of the better looking building.
(C) No other building or lot in the area is as small as the lot in question and is,
therefore, unique to the area.
(0) It would be an extreme hardship to the applicant and to the applicant's clients to
deny this variance. The applicant is a lawyer. The building is to be used as a
law office. The applicant has many clients that are elderly, frail or handicapped.
The applicant's handicapped clients should be able to enter the office without
traveling across the parking lot. Further, to redesign the building, with a notch,
would be an undue hardship because the building would be displeasing to the
eye and might affect the future value of the building. It is important for a law
office to be the most aesthetically pleasing as possible because of attitudes of
the general public. A first impression of a law office may determine whether a
lawyer retains a client or not. Therefore, not only for future clients would it be a
hardship, but for the applicant as well.
(E) I am requesting only one variance. It is the minimum amount that I need to
squeeze in the handicap parking spot and one regular spot. I am requesting an
additional 4' 2" into the landscape barrier for the handicap spot, and onlv 11"
into the landscape barrier for the regular parking spot.
(F) The variance will absolutely be in harmony with the general intent and purpose
of the chapter because the applicant's building will be a quality, up-scale
lawyer's office in a fairly run down section of the city. Even with the granting of
the variance, with a smaller strip of landscaping on the west side of the building,
the office, which is proposed, will be the most aesthetically pleasing building in
the area.
