Project size:
5,146 square foot church (240 seats)
Site Characteristic: The subject parcel is comprised of two (2) square-shaped lots located on the
eastside of Hoadley Road near the terminus of the right-of-way. The vacant lots
are undeveloped, relatively flat in contour, and vegetated by field grasses. The site
contains a scrub oak, several Cabbage palms, and a Strangler Fig. Several
unidentified trees are located along and outside the west property line. The parcel
is nestled in an area dominated by single-family homes. According to the survey,
the asphalt of the right-of-way stops short of the subject property. The developer
will be required to extend the asphalt of the Hoadley Road right-of-way. The
existing width of the Hoadley Road right-of-way is 30 feet. By today's standards,
this type of roadway (classification - local road) requires the right-of-way to be 50
feet in width. The actual pavement of Hoadley Road from Old Boynton Road to the
subject property varies in width but is approximately 18 feet wide as it approaches
the subject property.
BACKGROUND
Proposal:
Mr. Alfred Daise of Daise Management Corporation is proposing to construct a
5,146 square foot church with 240 seats. The project would be built in one (1)
phase. The project was previously by the Technical Review Committee. It was
also reviewed at the September 24, 2002 Planning & Development Board meeting.
During that meeting, there was much discussion regarding emergency vehicle
access to the subject site and the plans' omission of a cul-de-sac, which is typically
used at the terminus of rights-of-way. The Planning & Development Board
approved the site plan 6 - 1 with the condition that the City would be responsible
to pay for the off-site improvements. The Board, however, may have been
unaware of the then-current condition of the roadway. At the October 1, 2002 City
Commission meeting, more discussion ensued regarding the condition of the
roadway and the improvements required by staff. At that meeting, it was
estimated by staff that improving the roadway with asphalt surface would cost
between $5,000 and $7,000. The Commission wrestled with who should bear the
cost of improving the roadway and what the impacts would be on adjacent
neighbors. The item was unanimously tabled to the fOllowing Commission meeting
(October 15, 2002). Staff's position is that the cost of the roadway should be
borne by the developer, not the City. At the October 15, 2002 City Commission
meeting, staff suggested that the required infrastructure (water main) should be
placed along the west edge of the 30-foot right-of-way. The combination of
constructing the water main and improving the pavement to 22 feet in width would
result in the removal of most or all existing Seagrape hedges, currently planted
within the right-of-way. The applicant was prepared to install the water line and

remove the hedges but argued that the roadway should have been improved to 22
feet in width in the first place. The Commission tabled the project until the
November 6, 2002 meeting. At that meeting, staff reported to the Commission that
a power pole, which is located within the right-of-way, could be relocated as close
to the property line as possible. Staff would accept improving the asphalt surface
to 20-feet in width but that 22 feet would be preferable. No parking would be
allowed within the right-of-way. More discussion ensued regarding who would pay
the costs for roadway improvements. The City Commission then remanded the
project back to the Planning & Development Board for their review of Hoadley Road
and the right-of-way width, slope, easements, landscaping, and drainage. The
intent of the Commission's motion was for the Board to focus more on the road
itself and not on the use. The Commission also recommended that Planning &
Development Board's original condition of approval be retracted. Before the project
could be heard at any Planning & Development Board meeting, the applicant would
have to submit roadway improvement plans to the City for review and approval. At
the April 29, 2003 Technical Review Committee meeting, the applicant submitted
Hoadley Road widening plans (sheet C-1 of 2) showing a 3D-foot wide right-of-way.
Staff examined the plans and found them to be adequate for the more detailed
review directed by the City Commission. The right-of-way would consist of the
following: 20 feet of asphalt, an eastern swale of 2- V2 feet in width, and a western
swale of 7- V2 feet in width. On April 25, 2003, staff approved the applicant's
request to waive the requirement for a sidewalk along both sides of Hoadley Road
(see Exhibit "D" - Sidewalk Waiver). It is likely that during the roadway
construction, the trees located within the right-of-way would have to be removed
but the Seagrape hedges could be preserved. Perpetual accessibility to the homes
located on Hoadley Road would be maintained during the time of roadway
improvements.
ANALYSIS
Concurrency:
Traffic: In 2001, a traffic impact statement for this project was submitted and sent to the
Palm Beach County Traffic Division for their review and approval. The Palm Beach
County Traffic Division determined that the project would generate less than 200
new daily trips, and therefore, meets the Traffic Performance Standards of Palm
Beach County.
Drainage: Conceptual drainage information was provided for the City's review. The
Engineering Division has found the conceptual information for the right-of-way and
the subject property to be adequate and is recommending that the review of
specific drainage solutions be deferred until time of permit review. All South Florida
Water Management District permits and other drainage related permits must be
submitted at time of building permit (see Exhibit "C" - Conditions of Approval).
School: This project is exempt from the school concurrency requirements of Palm Beach
County.
Driveways: The subject property fronts on Hoadley Road. Two (2) points of ingress / egress

are proposed on Hoadley Road. Each point of ingress / egress will be 23 feet in
width and separated approximately 180 feet from each other. The location of the
entrances was determined to be in the optimal locations to allow for emergency and
/ or service vehicle ingress / egress. Both entrances will have adequate pavement
markings and appropriate signage for safety purposes.
Parking Facility: Parking required for a place of worship is based on either one (1) parking space per
100 square feet of gross floor area or one (1) space per four (4) seats in the
auditorium, whichever is more stringent. The more restrictive parking methodology
will be based upon the total number of seats. A total of 63 parking spaces will be
required for the project (includes office area). The proposed site plan provides a
total of 63 parking spaces. The parking lot would surround the north and west
sides of the building. Of the 63 parking spaces, three (3) spaces are designated for
handicap use. All handicap spaces would be situated in close proximity to the
building entrances in order to satisfy American with Disabilities Act (ADA)
requirements. All new standard parking spaces will be angled 90 degrees. The
dimensions of the standard parking spaces will be nine (9) feet in width by 18 feet
in length, except for the handicap spaces, which will be 12 feet in width (with 5
feet of striping) by 18 feet in length. According to the site plan, the backup
distance for the parking spaces and drive aisles will be 27 feet in width as required
by code.
Landscaping: The proposed pervious or "green" area of the lot will be 47,502 square feet or
57.326% of the total site. Much of the pervious area along Hoadley Road and to
the south of the building will be used for water retention purposes.
The west landscape buffer (adjacent to Hoadley Road) will be approximately 40
feet in width. The landscape plan proposes five (5) Live Oak trees and three (3)
clusters of Sabal Palm trees. In addition, two (2) Yellow Elder trees (signature
tree) will be located on both sides of the project's entrances. A row of Viburnum
and Blue Plumbago shrubs with clusters of Schefflera arboricola will be planted
within this west landscape buffer.
The southern landscape buffer will basically contain 40 Slash Pine trees. No
vehicular use areas are proposed along the southern perimeter, which abuts a
canal and commercial property. However, four (4) Live Oak trees and a row of
Redtip Cocoplum hedges are proposed along the east side of the parking lot and
drive aisle (in the southern portion of the site).
The landscaping around the building will consist of a cluster of three (3) Viburnum
hedges, two (2) Pygmy Date palms, two (2) Hibiscus trees, two (2) Crape Myrtle
trees, and a row of Redtip Cocoplum Hedges.
The north and east landscape buffers will be 20 feet in width. The north buffer will
contain a landscape berm with a row of Viburnum hedge and Areca palm trees. In
addition, six (6) Mahogany trees will line the northern landscape buffer. This plant
material will serve as a significant buffer between the subject property and the
single-family home to the north. The east buffer will have a row of Simpson

Stopper hedge and six (6) Sweet Mahogany trees. According to the landscape
plan, all trees will be installed at least 15 feet from all outdoor freestanding lighting
fixtures.
Building and Site: Building and site regulations will be fully met when staff comments are
incorporated into the permit drawings. The proposed one-story church building will
have an overall height of 23 feet - four (4) inches. The maximum allowed height
in the R-1AA zoning district is 30 feet. The building will be 59 feet- six (6) inches
in length and 94 feet - four (4) inches in depth.
Design: As proposed, the exterior surface will be stuccoed and painted white (Sherwin
Williams - SW#2123). The roof will be made of asphalt shingles (GafTimberline),
which appear to be tan in color. The two (2) inch by eight (8) inch facia board will
also be painted tan to match the roof. All window and door frames will be painted
white (Sherwin Williams - SW#2123) to match the wall colors. Staff recommends
incorporating more architectural enhancements (such as score lines) into the
design to enhance the overall appearance of the building (see Exhibit "C" -
Conditions of Approval).
Signage: No wall or monument sign is proposed. All future signage will require additional
review and approval by the Planning & Development Board.
RECOMMENDATION:
The Technical Review Committee (TRC) has reviewed this request for new site plan approval. Staff
recommends approval, contingent upon all comments indicated in Exhibit "C" - Conditions of Approval.
The Technical Review Committee (TRC) recommends that the deficiencies identified in this exhibit be
corrected on the set of plans submitted for building permit. Also, any additional conditions recommended
by the Board or City Commission shall be documented accordingly in the Conditions of Approval. With
respect to costs of off-site improvements, it is standard procedure to require such impacts to be the
responsibility of the respective owner / developer. Staff asserts that the cost of improvements should be
borne by the developer and not paid for by the City. Past examples are numerous but recently have
included projects such as Quantum Park Charter School, Lowe's, and Villa Del Sol.

5. Full drainage plans in accordance with the Chapter 6, Article IV, Section 5
will be required at the time of permitting.
6. At the time of permitting, provide a signed and sealed survey, not older lhan
six (6) months in conformance with the Chapter 23, Article I, Section 5.B.2.
The surveyor shall dimension the remaining portion of a lot(s) when part of a
lot is not included within the description. The adjoining property to the north
shall read "West 250 feet of Tract 59", not the "East 250 feet as shown" (for

9. At time of permit review, provide a completed and executed City unity of title
form. The form shall describe all lots, parcels or tracts combined as one lot.
A copy of the recorded deed with legal descriptions of each property that is
being unified is required to be submitted to process the form. The property
owner that is identified on each deed shall match.
10. At time of permit review, submit signed and sealed working drawings of the
proposed construction.

Just want to keep you in the loop.
Today I spoke with Chris Heggen, an engineer for Kimley Horne (840-0248). Chris is goingrc, perform the civil design
work on Hoadley. We have agreed to a preparation of civil plans that will show the following:
1. Right of way and property lines.
2. Existing road location.
3. Location of all existing landscaping, poles, etc.
4. Proposed road widening to 20 feel.
5. Location of pedestrian clearance area and impact on landscaping.
I have asked for this much for an exhibit for the time being. This exhibit can be "built upon" for future engineering
drawings during the permit stage. Chris said that Alfred Daise asked about the pending schedule of approvals. Alfred
does not believe that the matter should go back to P&D. I advised Chris that we had no choice because this was the
direction of the City Commission. Alfred will likely be calling you to discuss scheduling.

Proposed New Alliance Haitian Church
The following is a response to recent concerns from the public, regarding the proposed New Alliance
Haitian Church on Hoadley Road:
1. Are Churches permitted uses in the R1AA Zoning District? What about Day Care Facilities, are
they permitted uses in the R1AA Zoning District?
Development - Churches, and other places of worship, are permitted as a matter of right in the R-1-
AA zoning district. Accessory uses such as daycare and preschool facilities are permitted as a
conditional use. Conditional uses require a public hearing before the Planning & Development Board
and City Commission.
2. What is the parking requirement for the church and how is it calculated? The site plan shows a
building area of 5,146 sq. ft. and sanctuary seating of 240 seats. How does the City calculate the
parking requirements for such uses?
Development - The requirement is one space for every 4 seats in the sanctuary or one space for
every 100 square feet of gross floor area whichever is more stringent. The church is providing the
required 63 parking spaces.
3. Is there room on the site for building expansion? Did the church disclose any subsequent phases
for construction? Will the site support anymore impervious surface. (It now is 47,502 sq. ft. of the
82,871 sq. ft.)
Public Works - This property could potentially support more impervious area. However, staff has
not conducted stormwater calcs to verify this so this is a preliminary opinion at best. In general, the
amount of impervious areas that properties can support as part of development is based upon the
developer's willingness to fund the required stormwater improvements.
4. The news media reported that the Church anticipates a day care facility and other ancillary uses
for the building. Please contact the representatives of the Church to obtain information on the
ancillary uses planned. Is there any anticipated use of the church for a group home? We might as
well factor all uses rather deal with a possible problem later. How are parking and traffic issues for
day care centers dealt with? Is there a parking and traffic demand analysis that is needed? Are
shared parking and site access times factored? If so, what is the methodology and who approves?
Public Works - The day care traffic will depend on the type of day care. Will this be on weekdays? If
so, the daily traffic will increase on weekdays. Is the Day Care during church services in a support

role? If so, the day care will have little impact on traffic. In the event that a day care is proposed, this
would be a conditional use.
Development - The quote in the local newspaper notwithstanding, the designated agent for the
church has stated that the church has no plans to expand or to place a day care center or any other
ancillary use on the site.
5. How will water and sewer utilities be extended to the site? Will there be any looping of the water
main for fire flow? Who pays for this?
Public Works - The Church will be connecting to a sanitary manhole located on the centerline of
Hoadley at the church's north property line. This will be a normal tap. The water main located in the
rear of the shopping center will be tapped for fire and domestic service by the Church. There is no
need for a water main extension since we will allow them to tap into the main by going under the wall.
There will be one fire hydrant on site.
6. How will storm water be handled on the site? Will any runoff from the site go to or through the
residential property to the north or east? Who pays for this?
Public Works:
. All storm-water will be retained on site and is directed to two retention ponds, one in the southeast
corner and one along the west boundary. The site is bounded on the south and east by canals,
on the west by Hoadley Road, and on the north by residential.
. Water from the roadway is being directed to the retention pond on the west boundary.
. Stormwater improvements will be constructed by the owner/developers
7. How will site access to and from the property be handled? What is the pavement configuration
options for Hoadley Rd. being considered? How wide will the pavement be? Where will overflow
parking be located? Is there room on site to construct parking or a turf area for overflow parking?
Who pays for the Hoadley Rd. pavement?
Public Works - Hoadley Road should ideally be a 22-foot wide pavement. However, this width will
mean that more of the neighborhood is disturbed by the removal of more green space and landscape
buffers Thus, staff would consider reducing the road width to 20 feet to allow for more green space.
At this writing, all pavement improvements will be paid for by the developer. There will not be room
for parking on Hoadley for Church overflow. Planning should comment on the on site parking issues.
Development - The plan meets the City requirements for the number of parking spaces. Any
overflow parking cannot be predicted and, therefore, has not been considered. Stabilized turf parking
can be allowed if indicated on site plan.
8. What impact, if any will the roadway improvements have on the existing landscaping (Sea grapes
and trees) located along the west masonry wall of the shopping center? Who pays for changes?
Public Works - The Developer is currently considering placement of the road surface in one of three
potential locations. They are considering hugging the east ROW, the west ROWand an alignment
that "meanders" down the center of the ROW. The Developer will be showing the impact to the trees,
sea grapes, and other landscape elements depending upon which alignment is selected and/or
preferable to the neighbors. From an engineering perspective, all alignments are satisfactory.

9. Will there be a gate or other limitation for access to the Church property from Hoadley Rd?
Development - No.
10. What type of buffering is required to separate the church use from adjoining residential uses?
Development - None is required when a use such as church is permitted by right.
11. What type of lighting fixtures are planned for the parking lot and for the exterior of the building.
Public Works - The information provided for lighting at this stage is somewhat vague (we're at third
review). We did receive a photometric plan which appears to be in reasonable order. Photometrics
are not required until the time of permitting although we always ask for them during TRC. They are
supposed to give us some kind of details on light fixtures, which they did not, and the plans do not
indicate if wall packs will be used. Having said all that, the Developer does have a note on the plans
that states that all plans submitted for specific permits shall meet the City's Code requirements. So at
some point prior to the issuance of a building permit we'll have all our information on lighting.
12. Is access to the site from the south possible via a box culvert in the canal to the south of the
Church site? Has staff looked at this with access (and surplus parking) available from the shopping
center to the south (not west)? Would this obviate the need to improve Hoadley Rd except for Fire
access? Who has jurisdiction over the canal?
Public Works - It is possible to construct a driveway to the south. However this is highly improbable
for the following reasons. First, the cost of a pre-cast box culvert, backfill, road, railing, sidewalks, etc
could easily approach $100,000, if not more. Additionally, the access would be into the parking lot of
the Blockbuster Video thus access rights would have to be granted and the City would need to
approve the reduction in parking availability at Blockbuster. If this access was constructed, there is a
significant amount of parking adjacent to Blockbuster that could be available to the Church for
overflow parking pending some sort of a lease arrangement. If legal access was granted to the site
from Boynton Beach Blvd, then access to Hoadley Road would not be required. Fire Rescue advises
that they would reserve a secondary emergency access point on Hoadley and use a knox box for
access. The canal is maintained by the Lake Worth Drainage District.

I am providing you this update on this project. Yesterday, 12/16, I spoke with Chris Heggen, an engineer for Kimley
Horne. Chris and I have been conversing for the past several weeks about the scope of the design work for the
improvement required on Hoadley Road to support the traffic generated by the Church. He understands that we are
NOT asking for a full blown civil design that includes cross sections, storm water, etc. We are asking only for minimal
CAD plans depicting road geometrics and impacts on the right of way and landscaping as a result of the widening.
Chris questioned me further about the need for drainage improvements. I advised that the City still intends to evaluate
drainage on a larger scale in the area and that they need not consider drainage improvements on Hoadley as a result of
this minor widening. Chris also advised that his firm is still waiting on the initial land survey prepared for Don Senatore
(project architect) and that they can't really begin design work unt,l they have this. Lastly, and most notably, he said that
his firm has yet to be given a written contract from the Church to proceed with the design work.
I wished to advise you of the status of this project. Our staff awaits plans. Once we receive them we will work
cooperatively with the engineer, architect and the contractor to move this project forward quickly and minimize any
additional perceived delays.

At it's meeting on October 1, 2002, the City Commission reviewed plans for a proposed church
on the southerly end of Hoadley Road, south of old Boynton road, in the City of Boynton Beach.
The New Haitian Alliance Church group has proposed the placement of 5,146 sq ft church on a
vacant parcel of property that is slightly greater than I acre in size. Church representatives have
proceeded through the staff based technical review committee process as well as the Planning and
Development Board. The matter has now come before the City Commission. On October 1, the
Commission tabled action on the new Haitian Alliance Church in deference to a comment by the
Planning & Development Board that the City should be responsible for roadwork improvements
on Hoadley Road south of Vela ire.
City staff has been consistent through the entire review process and has required that the church
developer be responsible for !!!Lpublic infrastructure improvements that are necessary to support
the proposed land use on the south end of Hoadley Road. As part of the review process, staff
found that it was necessary for the church developer to provide a water main from Old Boynton
Road to the southerly terminus of Hoadley Road in order to provide water to the church property.
Furthermore staff found that the existing pavement width to be deficient on Hoadley Road south
of Vela ire to the southerly terminus of Hoadley Road where the church property begins. As a
result of substandard road width, staff also recommended that the church developer be required to
improve Hoadley Road south of Vela ire such that the minimum width of the pavement be 22 ft.
wide.
Staff believes that it is appropriate to provide you and the City Commission with background
justification regarding staffs recommendations. As part of the plan review process staff reviewed
a traffic impact analysis conducted by Kimley-Horn & Associates, Inc. dated November 29,
200 I. This report provided by Kimley-Horn evaluates traffic impact according to the Palm Beach
County traffic performance standards ordinance. Therefore Kimley-Hom has evaluated traffic
Impact on the regional roadway network and finds that the impact of traffic volume generated by
the proposed church will be of minimal consequence on Old Boynton Road. Therefore it is the
opinion of Kimmel-Horn that the new Haitian Alliance Church meets the conditions of Palm
Beach County's traffic performance standards and that there are no off site road way
improvements required. Kimley-Horn bases this analysis on the weekday traffic analysis only.
Staff, however, is concerned that churches generally generate a higher traffic volume on Sundays
when church is in session. Therefore, the Public Works staff has applied Sunday trip generation
rates and finds that for a church based upon 5,146 gross sq ft of floor area that there would be 162
traffic trips generated per a day on a Sunday. The peak hour traffic on a Sunday according to Trip
Generation Rates published by The Institute of Transportation Engineers is approximately 70
trips during the peak hour. For reference staff has utilized the fourth generation of the Institute of

As noted, staff is concerned that the church will generate 162 trips per day on a Sunday. This
contrasts with Kimley-Horn's analysis that suggests that there would be 48 additional traffic tnps
on a weekday. Because staff notes that there would be 162 additional trips on a Sunday, staff is
concerned that the existing pavement structure on Hoadley Road is of insufficient width in order
to accommodate the additional traffic volume upon this roadway segment. Therefore,
Development staffs recommendation to support the proposed land use (Church) on Hoadley
Road is contingent upon the church developer improving the Hoadley Road pavement withm the
existing 30 ft right of way.
The most pronounced impediment to roadway improvements on Hoadley Road way is the fact
that there is only 30 feet of right a way dedicated to public roadway purposes. As one might
imagine, it is very difficult to place a 22 ft wide road way surface within a 30 ft wide space and
still accommodate roadway, drainage, and landscape elements. Therefore statT finds that it would
be necessary to remove a significant amount oflandscaping within the Hoadley right a way in
order to accommodate the road way widening to support the additional traffic. Staff believes that
in order to accommodate the road way improvements as well as the placement of the water main
on the west side of the Hoadley Road right of way it would be necessary to remove all trees in the
westerly right of way. Staff also believes that it would be necessary to remove the sea grapes that
serve as a visual landscape barrier to the masonry wall that exist between the Hoadley Road right
of way and the commercial development to the west. Even if the roadway improvements were
not constructed and only a water main was placed in the western portion of the right of way, the
normal construction techniques and excavation for the water main would, in all likelihood, kill
the sea grapes anyway, Thus staff believes it important to note to you, the Commission, and the
public that the placement of the water main and the subsequent road way widening will have a
significant visual impact upon the neighborhood. Staff is not pleased with this. However, the
realty is that we are dealing with a mere 30 feet of right of way in order to construct a 22 ft wide
paved surface and place a public water main. It would be possible to shift the roadway area to the
east. However, this would require the church to acquire property from owners along the east side
of Hoadley Road, This may not be a viable solution.
At the Planning & Development Board meeting and the last City Commission meeting, there was
discussion relative to who bears the responsibility for paying for public improvements necessary
to support the New Haitian Alliance Church, The City of Boynton Beach, as is common in other
cities throughout the country, has always required developers to fund and place necessary
improvements to support their private developments rather then rely on public tax dollars.
Essentially that's how are cities are built. It is rare that cities will fund public infrastructure needs
unless there are defined economic incentives attached. However, in this scenario there are a
number of public infrastructure elements that could be considered as deficient even without the
construction of the new Haitian Alliance Church, For example, neighbors have made it very clear
to city staff that there is a defined storm water drainage problem in the general Venetian Isles
area, Staff acknowledges that widening the pavement on Hoadley Road will add to the storm
water deficiency however not to the degree that the church developer should be reqUIred to fund
and construct storm water improvements on Hoadley Road. Staff believes that the storm water
improvements should be designed, constructed, and financed by the City of Boynton Beach.
However it is unlikely that these improvements will be in place prior to the construction of the
church and the necessary roadway improvements on Hoadley Road. Therefore staff recommends
that the city endeavor to construct these storm water improvements in the Venetian Isles area and
on Hoadley Road as soon as practical.
With respect to the roadway, staff continues to believe that it is the responsibility f thp Q~"eIQ]3Br

by the church. Staff has opined that there would be an additional 162 traffic trips generated per a
day on a Sunday along this portion of the roadway that corresponds with the church traffic. This
compares to approximately 30 vehicles per a day at most that currently exist on Hoadley Road
south of Velaire. However, because the city should provide future storm drainage improvements,
staff does not believe that the church developer should be required to fund 100% of the roadway
improvements. Rather staff believes that it should be the developer's responsibility to provide
asphalt widening as part of the water main construction. As part of future storm drainage
improvements, the city should be required to completely resurface and renovate Hoadley Road.
Therefore staff believes that a shared approach to cost expense for improvements required to
support the church is desirable.
Staff recommends the following actions:
1. The church developer should be required to fund and construct the following
improvements:
A. Water main from Old Boynton Road to the southerly terminus of Hoadley Road.
B. Road widening on the west side of pavement to accommodate a 22ft pavement
width from Velaire to the southerly terminus of Hoadley Road where the
development begins.
C. All infrastructure in the public right of way adjacent to the church property this
includes pavement, water main, etc.
D. All tree removals and landscape removal on the westem side of the Hoadley
Road pavement in order to accommodate the road widening and water main
construction.
E. All other public improvements as required by staff and noted on the plans shall
be constructed and the cost of same bome by the Church developer.
2. Staff believes that it is city responsibility to endeavor to quickly construct storm
water drainage improvements in the Venetian Isles area, particularly along Hoadley
Road. Stafffurthermore believes that it is the city's responsibility to place the final
asphalt surface course on Hoadley Road south of Vela ire to the church property
rather than having the church place this asphalt surface course at this time.
For reference, staff has suggested that it be the church's responsibility to fund and construct the
pavement and widening from Velaire south to the subject parceL Staff estimates that the cost of
this pavement widening is approximately $5,700, assuming that the water main is placed in the
western portion of the right of way and is back filled with aggregate fill suitable for pavement
base.

We offer the following comments on the above noted project:
GENERAL COMMENTS
1) All utility easements shall be shown on the rectified site plan and landscaping drawings so that we
may determine which trees may interfere with utilities. In general, palm trees will be the only tree
species allowed within utility easements. Canopy trees may be planted outside of the easement so
that roots and branches will not impact those utilities within the easement in the foreseeable future.
LDR Sec. 7.5-18.1 give public utilities the authority to remove any trees that interfere with utility
services, either in utility easements or public rights-of-way.
2) Palm Beach County Health Department permits will be required for the water and sewer systems
serving this project (CODE Sec. 26-12).
3) Fire flow calculations will be required demonstrating the City Code requirement of 1,500 g.p.m.
as stated in LDR Chap. 6, Art. IV, Sec. 16, or the requirement imposed by insurance underwriters,
whichever is greater (see CODE Sec. 26-l6(a)). The submitted plans do not indicate whether the
building is to have a sprinkler system or not. As stated in our letter of July 9, 2001, the water
main extension will require a fire hydrant at the south terminus for flushing (if not for fire
protection).
4) CODE Sec. 26-34(E) requires that a capacity reservation fee be paid for this project either upon
the request for the Department's signature on the Health Department application forms or within
30 days of site plan approval, whichever occurs first. This fee will be determined based upon final
meter size, or expected demand.
5) Comprehensive Plan Policy 3.C.3.4. requires the conservation of potable water. City water may
not, therefore, be used for irrigation where other sources are readily available.
6) Provide an engineer's written certification that drainage will conform to all rules of the City and
the South Florida Water Management District (SFWMD) (per LDR Chap. 4, Sec. 7F).

SPECIFIC CONDITIONS
I. Water and sewer lines to be owned and operated by the City shall be included within the road
right-of-way or utility easements. Please show any and all proposed utility easements on the
engineering drawings, using a minimum width of 12 feet. The easements shall be dedicated via
separate instrument to the City as stated in CODE Sec. 26-33(a).
2. This office will not require surety for installation of the water and sewer utilities, on conditions
that the systems be fully completed, and given to the City Utilities Department before the
permanent meter is set. Note that setting of a permanent water meter is a prerequisite to obtaining
the Certificate of Occupancy.
3. LDR Chap. 6, Art. IV, Sec. 16 requires that all points on each building will be within 200 feet of
an existing or proposed fire hydrant. Please demonstrate that the plan meets this condition, by
showing all hydrants. [Note Comment 3) above in regards to building sprinkler system.]
4. PVC material not permitted on the City's water system. All lines shall be DIP.
5. Appropriate backflow preventer(s) will be required on the domestic water service to the building,
and the fire sprinkler line ifthere is one, in accordance with CODE Sec. 26-207.
6. A building permit for this project shall not be issued until this Department has approved the plans
for the water and/or sewer improvements required to support this project, in accordance with
CODE Sec. 26-15.
7. LDR Chap. 3, Art. IV, Sec. 3(P) requires a statement be included that utilities are available and
will be provided by the appropriate agencies. This statement is lacking on the submitted plans.

I have reviewed the above referenced Site Plans, forwarded to me on August 6, 2001, against the Site Plan
Review requirements outlined in the City of Boynton Beach Code of Ordinances. Following are my
comments with the appropriate Code and Land Development Regulations (LDR) referenced.
Code Requirements
1. On the Site Plan, add a general note that all plans submitted for specific permits shall meet the City's
Code requirements at time of application. These permits include, but are not limited to, the following:
paving, drainage, curbing, excavation, fill, work within the public right-of-way, site lighting,
landscaping and irrigation. Permits required from other permitting agencies such as Florida
Department of Transportation (FDOT), South Florida Water Management District (SFWMD), Lake
Worth Drainage District (LWDD), Florida Department of Environmental Protection (FDEP), Palm
Beach County Health Department (PBCHD), Palm Beach County Engineering Department (PBCED),
Palm Beach County Department of Environmental Resource Management (PBCDERM) and any
others, shall be included with the permit request.
2. Show zoning and land use on Site Characteristics Map (Survey) (LDR, Chapter 4, Section 7.A.)
3. Show all existing utilities and connections on Site Characteristics Map (Survey) and Site
Development plan (LDR, Chapter 4, Section A.3).
4. Indicate method and location of trash storage and pickup. If a dumpster is to be used indicate location

7. Sidewalks on abutting streets are not identified. Sidewalks shall be 4 feet wide along local streets, and
5 feet wide along streets of higher classification (LDR, Chapter 6, Article IV, Section lOT., and
Chapter 22, Article I, Section 5).
8. Sidewalks adjacent to parking lots shall be continuous through all driveways and shall be 6 in. thick
within driveways (LDR, Chapter 23, Article II, Section Pl. Indicate concrete strength required and
specification(s)/standards to which sidewalk is to be constructed.
9. Ensure sidewalks are handicap accessible at driveway intersections (LDR, Chapter 23, Article I,
Section 1.B.5 and FL Accessibility Code 4.6.3).
10. Provide a lighting plan including photometrics, pole wind loading, and pole details in conformance
with the LDR, Chapter 23, Article I, Section 5.B.7 and Chapter 23, Article II.B.
II. Add a note to the Landscape Plan that within the sight triangles there shall be an unobstructed cross-
visibility as a level between 2.5' and 6' above the pavement (LDR, Chapter 7.5, Article II, Section
5.H.). Show site triangles graphically on the Landscape Plan. Adjust landscaping as necessary.
12. Provide a Signing and Striping Plan in conformance with the LDR, Chapter 23, Article I, Section
5.B.5 and Chapter 23, Article II.B. Show and identify all necessary traffic control devices such as stop
bars, stop signs, double yellow lane separators striping, directional arrows and "Do Not Enter"
sign age, etc. See City Standard Drawings B-98001 and B-90013 for standard striping details.
13. Provide an Irrigation Plan in conformance with the LDR, Chapter 7.5, Article II, Section 5.A.
14. Provide a signed and sealed survey, not older than six (6) months in conformance with the LDR,
Chapter 23, Article I, Section 5.B.2.
Surveyor shall dimension the remaining portion ofa lot(s) when part ofa lot is not included within the
descri ption.
The adjoining property to the north shall read "West 250 feet of Tract 59", not the "East 250 feet as
shown" (for consistency with Legal Description).

18. The road right-of-way fronting the proposed Hoadley Road church lot(s) is currently only platted at30
feel. The roadway itself is not paved. An additional 20 feet of right-of-way will be required to be
deeded to the City of Boynton Beach and roadway plans developed and made part of this plan.
Roadway widths and surfacing sections shall be in accordance with all applicable sections of the Land
Development Regulations (LDR, Chapter 6, Article IV, Section 10.B-D). Prior to the issuance of any
building permit, signed and sealed plans shall be submitted and approved for the construction of
Hoadley Road to its termination point per City Standard B-91005. A permit will be required for
construction within the public right-of-way.
19. Ifa lift station is installed it shall be screened as specified in the LDR, Chapter 9, Section 10.C.3.
Recommendations/Corrections
1. All design professionals shall sign and seal their respective plans for the Technical Review Committee
(TRC) review.
2. Indicate which edition of the FDOT Standard Specifications for Road & Bridge and Standard Index is
to be used - the 2000 Specifications are recommended since they have both English and Metric units.
3. Make corrections to the Site Plan Notes as red-lined on Sheet A-2 and C-2 (Civil Engineering review
set).
4. Delete the reference to sod parking on the site plan (Sheet A-2) since the Paving, Grading & Drainage
Plan shows asphalt only.
5. Revise Site Plan Note "S" (site and civil plans) to read: "Double, yellow 25' lane separation stripes".
Add an "S" at the north driveway on the civil plans.
6. Clarify "Edge of Sidewalk" detail to state that mesh is not allowed through driveways.
7. Specify and detail a 5' x 5' handicap pavement symbol (City Standard Drawings B-98001) on the

I. Add to the building that is depicted on the drawing titled site plan a labeled symbol that

2. On the floor plan drawings, add a labeled symbol that identifies the location of the
handicap accessible entrance doors to the building. The location ofthe doors shall match
the location of the accessible entrance doors that are depicted on the site plan drawing.

accessible parking spaces. The quantity of the spaces shall be consistent with the

accessible route of travel from adjacent parking to an accessible entrance. The Florida
Accessibility Code for Building Construction states that buildings with multiple
accessible entrances shall have accessible parking spaces dispersed and located closest to

4. Add a labeled symbol to the site plan drawing that represents and delineates the path of
travel for the accessible route that is required between the accessible parking spaces and
the accessible entrance doors to the building. The symbol shall start at the accessible
parking spaces and terminate at the accessible entrance doors to the building. The
symbol shall represent the location ofthe path of travel, not the location of the detectable
warning or other pavement markings that are required to be installed along the path. The
location of the accessible path shall not compel the user to travel in a drive/lane area that
is located behind parked vehicles. Identify on the plan the width of the accessible route.
(Note: The minimum width required by the code is forty-four (44) inches). Add text to
the drawing that would indicate that the symbol represents the accessible route and the
route is designed in compliance with Section 4.3 (Accessible Route) and 4.6 (Parking and
Passenger Loading Zones) of the Florida Accessibility Code for Building Construction.

Please note that at time of permit review, the applicant shall provide detailed
documentation on the plans that will verify that the accessible route is in compliance with
the regulations specified in the Florida Accessibility Code for Building Construction.
This documentation shall include, but not be limited to, providing finish grade elevations
along the path of travel.
5. Identify within the site data the finish floor elevation (lowest floor elevation) that is
proposed for the building. Verify that the proposed elevation is in compliance with
regulations of the code by adding specifications to the site data that address the following
issues [Section 3107.1.2, Chapter 31 ofthe Boynton Beach amendments to the 1997
edition of the Standard Building Code]:
a) The design professional-of-record for the project shall add the following text to the
site data. 'The proposed finish floor elevation _' _ NGVD is above the highest
I OO-year base flood elevation applicable to the building site, as determined by the
South Florida Water Management District's surface water management construction
development regulations."
b) From the FIRM map, identify in the site data the title of the flood zone that the
building is located within. Where applicable, specify the base flood elevation. If
there is no base flood elevation, indicate that on the plans.
c) Identify the floor elevation that the design professional has established for the
building within the footprint of the building that is shown on the drawings titled site
plan, floor plan and paving! drainage (civil plans).
6. As required by Chapter 4, section 7 of the Land Development Regulations, submit a floor
plan drawing. The building plans are not being reviewed for compliance with the
applicable building codes. Therefore, add the words "Floor plan layout is conceptual"
below the drawing titled Floor Plan found on sheet A-4. However, add to the floor plan
drawing a labeled symbol that identifies the location of the handicap accessible entrance
doors to the building. The location of the doors shall match the location of the accessible
entrance doors that are depicted on the site plan drawing.
7. Place a note on the elevation view drawings indicating that the wall openings and wall
construction comply with Table 600 of the 1997 edition of the Standard Building Code.
8. On the site plan, indicate within the footprint of the building the number of stories that
are in the building including, where applicable, mezzanines. Indicate the overall height
of the building within the site data. The overall height of the building shall not exceed
the height limitations ofthe Zoning Code.
9. On all floor plan drawings, indicate within the footprint ofthe building the number of
stories that are in the building including, where applicable, mezzanines.
10. To verify that the proposed building is in compliance with the applicable building
setbacks, show and dimension on the site plan the width ofthe building overhang. Also,
identify the size or width of the covered walkways, awnings, canopies and/or other
roofed areas that extend out beyond the main walls of the building.

11. At time of permit review, provide a completed and executed City unity of title form. The
form shall describe all lots, parcels or tracts combined as one lot. A copy of the recorded
deed with legal descriptions of each property that is being unified is required to be
submitted to process the form. The property owner that is identified on each deed shall
match.
12. At time of permit review, submit signed and sealed working drawings of the proposed
construction.
13. Add to the drawing the calculations that were used to identify the minimum number of
required handicap accessible parking spaces. Also, state the code section that is
applicable to the computations.
14. At time of permit review, submit for review an addressing plan for the project.
15. Add to all plan view drawings of the site a labeled symbol that represents the location and
perimeter of the limits of construction proposed with the subject request.
16. Clarify the minimum number of required sanitary facilities on sheet A-2. Sheet A-2
notes 240 seats, yet the sanitary facilities are based on an occupant load of 101-200
persons.
17. The handicap parking space on sheet A-3 shall comply with Florida Accessibility Code
for Building Construction Figure 9 (A).
