The undersigned, pursuant to Ordinance NO. 76-27 of the City of Boynton Beach, Florida, hereby applies to the
City Commission to vacate/abandon, and discontinue the,(check one):

Said application is to be filed with Planning and Zoning in duplicate and applications involving more than one of
the above listed non fee interests shall be filed separately. Each application so filed shall be complete in every
respect.
Representative of the project must be present at all Technical Review Committee, Planning and
Development and City Commission meetings held to review this project.
The undersigned hereby certify:
1. That a complete and accurate legal description with the specific property interest sought to be vacated or
abandoned, including where possible a plat map or drawing showing the general area and location
involved, is set forth in Exhibit "A" attached hereto.

the City of Boynton Beach, Florida; is not a part of any state or federal highway system; and was not
acquired or dedicated for state or federal highway purposes.
5. That the following constitutes a complete and accurate schedule of all owners and occupants bDunding
and abutting the property interest described above.
6. The names and addresses on labels and/or addressed envelopes of the owners and occupants of abutting
real property and 1" class postage (stamps or pay for required postage).

SCHEDULE B - SECTION 1
REQUIREMENTS
The following are requirements to be complied with:
1. Payment of the full consideration to or for the account of the grantors or mortgagors.
2. Instrument(s) creating the estate or interest to be insured must be approved, executed
and filed for record:
a) Evidence satisfactory to the Company, of the proper completion of Right-of-Way
Abandonment Proceedings to abandon the property to be insured (also known as
Nautica Boulevard) in compliance with all procedures and rules set forth in the
Charter, By-Laws, Resolutions and Ordinances of the City of Boynton Beach,
including compliance with Chapter 22, Code of Laws and Ordinances of the City of
Boynton Beach, said evidence to include proof of the proper notification of all
parties, together with the proof of publication of said proceedings. This Company
reserves the right to make further requirements and/or exceptions to this
Commitment.
b) Recordation of the Resolution or Ordinance of the City of Boynton Beach,
abandoning and vacating the property to be insured upon completion of the
proceeding required herein above.
3. Payment of all taxes, charges, assessments, levied and assessed against subject
premises, which are due and payable.
4. Proof of payment, satisfactory to the Company, of all special assessments, recorded or
unrecorded, including but not limited to special assessments arising under Chapter 159
of the Florida Statutes.
5. A survey, satisfactory to the Company, must be furnished. If said survey shouid
disclose building setback lines, easements, encroachments, overlaps, boundary iine
disputes, or other adverse matters, they will appear as exceptions in Schedule B of the
Owner's Policy and Schedule B, Part 1 of the Loan Policy to be issued.
NOTE: 2001 taxes have been paid in the following amount (s) Exempt for 2001.

EXCEPTIONS
The policy or policies to be issued will contain exceptions to the following unless the same
are disposed of to the satisfaction of the Company:
1. Defects, liens, encumbrances, adverse claims or other matters, if any, created, first
appearing in the public records or attaching subsequent to the effective date hereof but
prior to the date the proposed insured acquires for value of record the estate or interest
or mortgage thereon covered by this Commitment.
2. Taxes and assessments for the year 2002 and subsequent years.
3. Easements or claims of easements not shown by the Public Records, boundary line
disputes, overlaps, encroachments, and any matters not of record which would be
disclosed by an accurate survey and inspection of the premises.
4. Rights of parties in possession other than the record owner.
5. Any lien, or right to a lien, for services, labor, or materials heretofore or hereafter
furnished, imposed by law and not shown by the Public Records.
6. Restrictions, dedications and easements as shown on the Plat of Nautica P.U.D. - Plat
One recorded in Plat Book 74, Page 170.
7. Restrictions, covenants, conditions, easements and assessments as set forth in that
instrument recorded the Declaration of Covenants, Restrictions and Easements for
Nautica in Official Records Book 8789, Page 1171, as supplemented in Official Records
Book 8789, Page 1258, as amended in Official Records Book 9046, Page 237; Official
Records Book 9046, Page 243 and Official Records Book 9483, Page 1661 and together
with Consent and Subordination in Official Records Book 9463, Page 1564.
8. Rights and obligations of Nautica Homeowners' Association, Inc., as set forth in Quit
Claim Deed recorded in Official Records Book 9483, Page 1676.
9. Easement(s) in favor of Fairbanks Communications, Inc., set forth in instrument(s)
recorded in Official Records Book 8927, Page 448.
10. Terms, conditions, and provisions of Removal Agreement, recorded in Official Records
