At the request of the applicant I re-reviewed my comment to your office regarding the use of Creeping
Fig (Ficus Pumila). Although all ficus species is prohibited by our Code, the Creeping Fig proposed for
this project is limited in use (20 are specified) and location. Based on this I am willing to accept their use.
Comment #5, in your letter of March 12, 2003 to Winston Lee & Assoc., may be deleted.

Dear Ms. Brinkman:
In response to your request for the administrative review and approval of the modifications proposed
to the above-referenced, approved site plan, please be informed that the changes proposed on the
revised plans date stamped 02/26/03 are "minor", as defined within the Land Development
Regulations, Chapter 4- Site Plan Review. The modifications include the following:
· Relocation of freestanding monument sign and reduction of height to 10 feet;
. Location of directional sign;
. Relocation of handicap spaces;
· Location of the guardrail along the southern boundary of the lake;
· Building area reduction;
· Revisions to parking space dimension and drive aisle width;
· Removal oflettering / striping per TRC agreement;
· Civil plans to allow roof water to drain west via guttering / downspouts;
· Building height revision to 30 feet - 8 Yz inches (33 feet - 8 inches at entries only).
The proposed changes address some of the project's conditions of approval (see attached). The
project satisfies Conditions of Approval 14, 15, and 18. This project may continue to be processed
by the Building Division as a permit application subject to the following conditions:
1. If the scope of the project demands removal of plant material, the new plant material is subject to
the review and approval of the City Forester / Environmentalist;
2. Show all proposed wall signage, including the lettering style, color, and signage area on the
permit plans. The maximum wall signage area shall be based upon the linear frontage of the two
(2) buildings plus the depth (north elevation) of Building "B".
3. Replace the Live Oaks with another tree. The proposed Live Oaks will not be allowed near the
dumpster enclosure because they will prevent Solid Waste trucks from being able to pick up and
dump the dumpsters.

4. Remove the reference(s) to the ten (10) foot sight triangles on the plans; they are no longer
applicable.

Thank you for your approval letter dated March 12, 2003 for our request for a minor modification
to the approved site plan for the above referenced project (MMSP 03-012). 1 have reviewed the
conditions contained therein and would like to request that Condition No.5., regarding the
prohibition of the specitied Ficus pumila be deleted based upon the following.
Upon review ofthe code section in question, this office has had conversations with Laurinda Logan,
the staff member who originated the comment. It appears that the code is referring to trees
belonging to the Ficus family In this case, the specified plant is actually a small vine, with a non-
aggressive root system. Laurinda is In agreement that, this type of vine would be acceptable as
prevIOusly approved on the plans.
Therefore, 1 would appreciate it irthe letter could be reissued without this comment, so as to avoid
any confusion during the building permitting process. Please feel free to call if you have any
questions or require any additional infonnation. Thank you for your assistance in this matter.

The above referenced Site Plans, forwarded on March 3, 2003, were reviewed by this office and we have
no objection to the minor modification request. Further, the applicant has adequately addressed
Conditions of Approval #1 and #2 and these may now be removed. Following are additional comments
found during our review, with the appropriate Code and Land Development Regulations (LDR)
referenced.
1. There is a conflict between the dumpster enclosures and the proposed landscaping. The proposed
Live Oaks will not be allowed as they will prevent Solid Waste trucks from being able to pick up and
dump the dumpsters.
2. Remove the reference(s) to the 10ft. sight triangles on the plans; they are no longer applicable.
3. The use of Ficus Pumila (Creeping Fig) has been proposed (Sheet PP4 of 4). The Code prohibits
the use of Ficus species (LDR, Chapter 7.5, Article II, Section 5.C.2).
The three new comments noted above do not affect the minor modification request and may be handled
at the time of permitting.

referenced project These plans are submitted tor the purpose of requesting a minor modification
to the site plan approved by the City Commission on January 21,2003. This original site plan
approval was for 139,500 square feet Conditions of approval required revisions to the plans which
resulted in other minor changes which are also addressed on the revised plans. In addition, the
following modifications, as allowed by code, have been made to the plan:
I. The free standing monument sign has been relocated fi'om the southern entlY drive to the
northern entry drive (Industrial Way entry). The hcight ofthc sign has also bccn adjustcd
to comply with the condition of approval limiting the height to ten (10) feel (Condition 18).
2. Location of the directional sign has becn indicated on the site plan and complies with code
(Condition 17).

on the plans.
5. The squale footage has been revised to 134,946, consisting of 11 0,946 square feet of ground
floor area and 24,000 square feet of potential mezzaninc floor area. This was accomplished
by extending the southern most building further to the south and eliminating the row of
parking originally depicted along the southern property line.
6. The building had been adjusted and the parking space dimensions revised to comply with
the terms of David Kelley's drive aisle reduction waiver approval letter.
