Dear Mr. Hoffman:
In response to your request for wavier of the site plan review process for certain improvements, as
described solely by a photograph of the existing roof and facade compared to an architects rendering, I
respond affirmatively. However, since you do not describe the actual changes in your letter, I will state
my understanding of these improvements on which this approval is granted. Said improvements will be
limited to facade enhancement and design of the roof portions of the 5 different parts of the restaurant.
This will exclude any restaurant expansion or added seating, improvements to the remaining facades or
related to those shown on the north facade of the photograph, and improvements to the small "tiki-hut"
seen at the far east side of the property (as proposed changes for this structure are not clear in your
request).
I should also note that administrative review does not exempt these changes from relevant regulations
found within the LOR, for example, staff will review the changes for conformity with established or
approved design and architectural patterns within the subject area, including colors.
Please also note that administrative review determination is typically conducted using actual plans or
drawings, which explains the reason for my assumptions and restrictions described herein. Obviously we
cannot review what is not explained nor shown on drawings. If this response does not adequately meet
your needs, I would recommend that you resubmit this request and include plans that specifically indicate
the proposed changes.

Request for Sitc Plan Review Waiver For Permit Application 98-4347
Dear Mike.
Please be advised of the following review of the criteria for allowing development without Site Plan
Review with respect to the proposed project referenced above and the request for consideration of a Site
Plan Review Waiver for the same.
As outlined in Chapter 4, Section C. of the City of Boynton Beach Code, a waiver from Site Plan Review
can be allowed base on the following:
I) The remodeling does not change the preexisting configuration of the building or site or reduce
emergency vehicle access.
2) There is no change in the use that would increase the off-street parking spaces.
3) Based on the review by the Building Department, the project is not a substancial improvement and
complies with development regulations.
4) Please accept this coorespondence as application for the waiver and evedence of receipt of any
fees due for the review.
5) The waiver shall be filed with the City Commission.
I would also like to add that our development team has meet with Urban Design and Hank Skokowski on
three different occasions to review our plans. Hank was very supportive of our "fishing village" concept.
Based on his input we changed roofing matcrials, altered railings and decorative columns and modified our
color scheme. In the end, we all were pleased with the "Florida Style" that resulted. We feel that this
project is a good example of what a good Comprehensive Plan can achievc.
Please accept this review as evidence that the proposed improvements referenced above meet the
reqnirements for a Site Plan Review Waiver as allowed by the City of Boynton Beach Code. If you have
