In response to your request for the administrative review and approval of the
modi fications proposed to the above-referenced, approved site plan, please be infomled
that the interior renovations as shown on the revised plans date stamped 06/05/01 are
"minor", as defined within the Land Development Regulations, Chapter 4- Site Plan
Review.
This project may continue to be processed by the Building Division as a pemlit
application. Be advised that the proposed changes may require a modification to the

Dear Mr. Rumpf:
On behalf of my client, Mr. Islam, I am requesting a determination "minor"
modification for the following project:
EXXON FOOD MART is an existing gas station and convenience food store with
a 3-bay automobile repair facility on the corner of N.E. 2nd Avenue and Federal
Highway. The proposed modifications would consist of terminating the function
of the repair shop and extending the convenience store into this space. The
physical modifications would consist of removing the front 3 overhead doors
blocking in one of them and replacing the other two with glass storefronts of
equal size, and enlarging an existing interior doorway.
Additional work would consist of clean up and beautification of the Property. The
new Owner will remove all debris from the front and rear of the building (old
tires, etc.) and upgrade the appearance of the main building.
The proposed modifications would nQ1 reduce the provided number of parking
spaces.
All proposed improvements would have a beneficial effect on adjacent and
nearby properties.
We are hoping for a positive ruling on this request.

Mr. Islam indicated to staff that he was interested in purchasing the gas station and
wanted to know the status of the Dropertv.
Quintus advised Mr. Islam that the CRA was very active in the CBD and that the
City possesses several properties in close proximity to the subject property. He
indicated that the CRA is "interested" in Block 1. Block 1 would consist of 6
individual lots with a 20-foot alley dissecting through the middle of the block.
Quintus explained to Mr. Islam that the City is drafting language for a "fee in lieu
or' to satisfy parking requirements. Applicants would pay a certain fee and the
City would provide satisfactory parking to serve those new businesses and their
anticipated demand. He also advised Mr. Islam of the status of the USl Corridor
Study and its recommendations for future permitted uses (gas station would not be
permitted),
Mike advised that the USl Corridor Study is the updated increment to the Vision
20120 plan. Single, isolated, auto-oriented uses, would be contrary to the plan for
the CBD. The plan would allow 15-30,000 sf grocery stores, eluding to the fact that
Mr. Islam owns the Ocean Mart nearbv.
Mr. Islam indicated that he aspired to eliminate the "auto-service" aspect of the
current Exxon and create a "convenience store", typical of the current trend of gas
stations.
Jose advised that the site would be non-conforming in that the building would not
meet the rear setback, the drive-ways are too close to the intersection, and the lot is
too small.
Mike informed Mr. Islam that the conversion of auto-services to convenience store
would constitute a change of use and would trigger the current parking
requirement.
Jose estimated that for a 1,900 sf building would require nine (9) parking spaces @
50% reduction (CBD) equals a total of five (5) Darkin!' SDaces .
Judith explained to staff that the proposed plan could provide the required five (5)
s aces, if not more.
