Staff met with Pastor Smith and Rev. Lyons yesterday afternoon. The Pastors have nice plans to improve the appearance
of the Church and the right of ways adjacent to the Church. As part of their due diligence, they inquired if there is any
possibility to abandoning the right or way to the south east of the Church. This right of way is platted as Grand Ave. The
road has not been constructed in the Grand right of way nor are there any utilities in the right of way.
The Planning Staff prefers that this right of way (Grand) not be abandoned. The street network in this portion of the
community has a unique character in that the rights of way are platted as a series of diagonals and roundabouts. The
Planning staff prefers to preserve this unique street character for posterity and furthermore believes that the abandonment
of the Grand right of way may inhibit future growth creativity by private developers. The perspective of the Planning Staff
certainly has merit and warrants consideration. On the other hand, the Engineering staff projects no imminent need to
construct a street in the Grand Ave right of way nor is there a pressing need to construct utilities in same. Frankly, from a
traffic safety perspective it would be desirable to limit the number of access points for the various streets that access the
roundabouts. However, this safety concern is not a high priority because traffic volumes and speeds are low so the
potential for severe personal injury accidents is minimized.
Essentially, the Church would like to have the Grand Ave right of way abandoned so that they, and Rev. Lyons can make
use of this property. This is commonly the reason that the public asks government to consider right of way abandonment.
There are other alternatives to abandonment. One such alternative involves licensing the use of the right of way to the
Church and to Rev. Lyons. This would help the entities to achieve their goal while retaining the right of way for future City
needs and redevelopment. However, both the Church and Rev. Lyons wouid have to provide proof of insurance to the City
to protect the financial interests of the remainder of the City. Lastly, because the right of way would remain, construction
activities on adjacent parcels would continue to be governed by existing criteria such as setback.
We advised the Pastors that they may wish to consider improving the rights of way using the normal work permit process. I
advised them that if the Grand right of way remains public that I would have our City staff/contractors remove ail exotic and
undesirable plant materials within the next severai weeks. We also advised them that they could certainly pursue the
option of abandonment but we cautioned them that they should try to better gauge the potential for City approval before
they invested too many dollars in the project. Hence our discussion with them about the City staffs perspective of the pros
and cons of abandonment that are detailed above. Its good to see that they heeded our advice and they are now seeking
to meet with elected officials. Staff too would appreciate the thoughts of the elected officials related to the future character
and street layout of this neighborhood.

In accordance with the last reference noted above, and in my discussions with Peter Mazzella, Deputy
Utilities Director, our position in regards to a proposed Revocable License Agreement over the
applicant's insistence for an abandonment of the alley remains the same. This is, we will continue to
support the Agreement, but will oppose any Abandonment. The applicant's offer of creating an utility
easement for the City Utilities Department over the entire 10- foot alley for the purpose of supporting (and
maintaining) existing utility systems located within same has not worked well for the Utilities Department
in similar situations in the past. This Division concurs with that assessment.
The proposed creation of a unity of title via the applicant's application for an abandonment of the public
alley has no relevancy to the utility maintenance requirements of the City's Utilities Department. Again,
should you have any questions or wish to discuss this matter any further, please do not hesitate to contact
our office.

Dear Mr. Cascio:
This Division is in receipt of your January 21 st letter, received yesterday, January 24th on the above noted
matter. As requested in your letter, you asked the city in regards to which utilities would be affected by
the proposed abandonment. Attached is a copy of a utility map segment, which identifies both a 4-inch
water main and an 8-inch wastewater line within the 'alley' right-of-way. Both are "live and well",
serving all ofthe businesses along Railroad Avenue.
Therefore, any application submitted to the city for an abandonment ofthis 'alley' that is sent to this
Division for comment, will be recommended for denial or disapproval of same. The thought of any
relocation of the utility systems would be cost prohibited to the applicant.

NATURE OF REQUEST
CIty staff are requesting abandonment of an unimproved 50-foot wide right-of-way located on N. W. 8111 Avenue
approximately four hundred (400) feet west of Seacrest Boulevard. This abandonment is for the following
unimproved right-of-way segment:
That portion of the road right of wey for NW fIh Avenue lying north of lots 154 and 155, Block C, Boynton
Hills, according to the plat thereof as recorded In Plat Book 4, Page 51, Public Records of Palm Beach
County, Florida, Described as follows:
Beginning at the northwest comer of said lot 154; thence easterly along the north line of said lot 154, a
distance of 100.26 feet to a point on a curve concave to the southwest having a central angle of 126"26'42#
and a radius of 10.00 feet; thence southeasterly along the arc of said curve, a distance of22.07feetto a point
on the easterly line of said lot 154; thence northeasterly along the northeasterly project/on of the easterly line
of saId lot 154 a dlstence of 19.82 feet; thence northerly forming an Included angle of 143033'18#to the right
from the preceding course, a distance of 50.00 feet; thence westerly forming an Included angle of90"0()'OO#to

Dear Jim:
Please be advised that the Law Office of Carl A. Cascio, P.A. has the privilege of representing Habitat for
Humanity with respect to the Purchase of a Reversionary Interest from Leonard Smith, which is adjacent
to property already purchased by Habitat for Humanity. The right of way is more particularly described as
follows:
Northwest 8. Avenne headiDg West from Nortbwest I" Street to Grand Blvd. West;
and GraDd Blvd. West heading Nortbeast to Northwest I" Avenue.
It is Mr. Smith's belleflbat sometime in the past, the City of Boynton Beach may have abandoned any and
all rights it had to this right of way. This property lies within the same area as the right of ways that Were
previously abandoned by the City in connection with The First Baptist Church of Boynton Beach
Property .
If you could suggest how we could determine the best way to research whether or not this right of way had
been abandoned by the City of Boynlon Beach, it would be most helpful. Previously, Rosemarie, in your
office. had researched prior ordinances to determine whether or not the remaining portion of the
Northwest Third Court right of way had been abandoned. and was able to determine that it had not yet
been completed.
X. It is Habitat's intention to purchase the reversionary interest from Leonard E. Smith contingent upon the
City's Abandonmellt of this right of way. The reversionary interest is defined as follows: That part of
BOYNTON HILLS as mOre particularly described as a subdivision of all the boulevards, streers, drives
and circles as shown on that certain instrument dedicating same to the perpetual use of the public as public

I have enclosed a copy of the Quit Claim Deed ITom the owners of the property at the time of its platting
to Mr. Smilh, who was the Grantor to the church, for your review. Based on my review, it is our position
that since the parcel is no longer used for public purpose, as described in the Plat, that the propeny should
reven to the assigns of the reversionary interest. It is clear from this ar.., that the City has no intentions of
using this property for right of way purposes and has abandoned its use of this parcel for public purpose
some time ago
I would appreciate it if you could review these documents and if you are in agreement with my
assessment, we can proceed forward with purchasing (he property at minimum consideration and without
the necessity of an appraisal.
The reason why I'm requesting this done without an appmisal and that you determine that the City has
abandoned or discontinued the public use of the property, is to avoid the cost and delay of obtaining an
appraisal. We would like to have any opinion from you first as to whether or not the City has previously
abandoned the<e right of ways, and secondly, if the City has not, what actions will be necessary in order to
accomplish this and also in what time period. I look forward to your response in this matter.

incorrect and requires revision before second reading of the Ordinance, which is
scheduled to be considered by the City Commission at its meeting on October 19,2004.
Accordingly, please provide Dave Kelley with the information necessary to prepare a
corrected legal description that can be included in the pending abandonment ordinance.
You may also want to send Dave Kelley an e-mail requesting that he assist your
department by revising the legal description.

remaining unanswered question which I must ciarify is the issue of the preparation of the easement for the NW 8th
Ave item. This project has been a joint effort with Habitat For Humanity. We completed the application as city-
initiated and processed the legal notices, and I recall that they paid for the survey and 0 & E Report. The question
now is can we (the city) provide the easement document or should we require that of them as well? Since there
are no formal rules here, I'm looking for your feedback.

Once application is made for any abandonment and this Division comments on the validity of that application,
we usually attach any provisos that need to be addressed by the Legal Department or to be incorporated into
any proposed ordinance defining the limits and conditions of the action to be taken by the C. Comm.
HOWEVER, it is apparent that Legal never checks back with this Division on any legal description (w/any
provisos) that is to be incorporated into any proposed ordinance.
In regards to C. Comm. 8/17/04 agenda item XII.A.4., the legal for this one is pretty straight forward, but is
must contain the condition that the 20-foot wide alley be converted to a utility easement in that a sanitary
sewer lies within it. Since we do not get to review these ordinances, I am not sure if the proper language is
contained.
In regards to agenda item XII.A.5. (NW 8th Avenue), the legal for this one has to be a "metes and bounds"
legal description since the limits deai with angled intersections, AND the south half of this proposed
abandonment HAS to be converted into a 25-foot utility easement. There is a live water main, FP&L and
BellSouth all located in this strip of land; the cost of relocation of any (or all) of these systems would be

prohibitative. Again, since we do not get the change for review of the proposed ordinance (legal descriptions
that is), we only find out about the action taken "the hard way".
I agree with you, these second readings should be postponed until these (legal description) issues can be
checked to see what is in the best interest of the City.

not been met, that would mean the two up for 2nd reading next Tuesday were be tabled. One of those is
the NW 8th Avenue abandonment which the city is processing. Please concur or comment on this action

can be prepared/processed.

I called your office before lunch and left a message, because I thought it was easier for the two of us to just talk about this.
But since I haven't heard back from you, here are my thoughts:
1) If your anticipated expense for this work is going to be below $25,000 and the actual construction of the project is going
to be below $500,000, then you don't need to follow the Consultants' Competitive Negotiations Act (CCNA). However, if it
is going to be more than $2,000 and less than $25,000, then you have to get three quotes. It seems like you have gotten
three quotes. I would go with the low quote. If that is the case, I would go with the Tetra Tech quote. However, you are not
prevented from using a sub to another larger firm.
Again, I would go with the lowest quote.
Call me (x6456) if you think I have not answered your question or if I've created more confusion.

Quintus, the estimated fees for the abandonment procedure are as follows, including an explanation:
abandonment application fee - $500
survey - 2,000 (rounded-up from $1,850 estimate from Tetra TechIWHS)
ad fee - $175 (rounded up from $171 from past ads)
Title opinion - $225 (taken from the appx. midpoint of Jim's range of $150 and $300)
This does not include postage which should be minimal. Based on the offer received, Tetra Tech would do the survey,
and Jim has the source for the title opinion. I will move forward with these once an account is provided.

Per our meeting on September 22, 2003, Tetra Tech WHS is pleased to offer
this proposal for professional surveying and mapping services for the
abandonment of N.W. 8TH Avenue in Boynton Beach as recorded in Plat Book 4
Page 51, Palm Beach County. Please consider the following scope of services
and proposed fee schedule for the project.
Scope of Services:
Boundary Survey
Tetra Tech WHS will provide a boundary survey limited to the
platted right-af-way of N.W. 8th Avenue as outlined in our
meeting. The boundary corners of the proposed area to be
vacated will be set or found and a sketch and description will
be prepared in accordance with the standards as set forth by
the requirements stated by Chapter 61G17-6 of the Florida
Administrative Code pursuant to Florida Statutes Chapter
472.027. It will be the client's responsibilty to provide
a current Title Commitment reflecting the ownership and
recorded encumbrances on the parcel. In absence of
a Title Commitment encumbrances that affect the property will
be limited to those shown on the plat.
Deliverables / Fee Schedule:
The Boundary Survey will be produced utilizing Autocad R14 and
Softdesk software. Six signed and sealed hard copies
of the map of survey and a copy of the survey on Autocad R14
will be provided.
Tetra Tech WHS is pleased to complete the identified scope of
land surveying services for a lump sum fee of ~850.
The estimated time of completion is ten business days upon
notice to proceed. If you agree to the terms of this proposal

Humanity1s plan to build on two or three vacant lots in the Heart of Boynton. The
abandonment is of an unimproved segment of NW 8th Avenue measuring approximately 225 feet
long by 50 wide, beginning approximately 375 feet west of Seacrest Boulevard.
Wetll need it surveyed for the application and of course it is a rush so I am exploring
the options to yield the quickest turn-around. I can go directly to Shephard for the

Please be advised that the December date for City Commission action relative to the abandonment and any
variances required by these Habitat houses is based on the next available submittal deadline for CRA review
items. This would put It on the December 9 CRA Agenda and the December 16 City Commission Agenda.
Included in this time frame are the required survey as well as the legal advertisement for the public hearing on the
abandonment and any TRC review. From the meeting we had with Habitat the other day, I was under the
impression that December was acceptable to them.
With regard to the survey, Mike Rumpf and Maxime are looking into securing the services of an engineering firm
that may already have an existing contract with the city. If one is not available, we will have to 90 through the
city's procurement process. As you know, providing a survey is normally the responsibility of the applicant
requesting the abandonment.
Also, please be advised that SHIP funds can be made available to pay for the proposed upgrades to the Habitat
houses. However, they can only be paid to the purchaser of the home. Therefore, Habitat needs to advise the
city of the cost of the upgrades to each house as soon as possible so that funds can be available at the closing.
It should also be noted that the addition of a half bath to each house will result in an increase in capital facility
fees as a result of an increase in square footage and plumbing connections.
Is It your expectation that the city will pay these as well as any other additional costs resulting from these
upgrades? None of these costs have been budgeted so they need to be determined as soon as possible so that
funds can be identified.
Finally, Octavia will be in touch with Mr.. Fix, once she has had an opportunity to discuss the issues surrounding
the Simmons lot with Ross Hering at the county. Preliminary indications are that the property does not belong to
the county at this time.

When we spoke with Max following our meeting yesterday, he advised that it would probably be
sometime in December or next year before the city would be able to abandon the NW 8 Ave. Late
today when he call me he advised that the city would have to get a survey of the street and that he
did not how they could do that. I suggested that the City Engineer should be able to have the
survey completed, but he did not feel that he could make such a request. He also advised he is not
sure just how the City could apply to abandon/vacate its own street and that I should contact you.
I tried calling Octavia yesterday and today but she has not returned my calls concerning obtaining
the Simmons lot. I now understand that she will be out of town next week, more delays I hope not.
When we met with you Aug 22, 2003 we advised that the county told us in order for the county to
transfer the lot to the city the City Manager needed to send a letter to Mr. Ross C. Hering, Premo
Building #503,3323 Belvedere Rd.. West Palm Beach, FI. 33406. Mr. Hering would then transfer
the lot to the city.
Once the City has recorded the title then a commission agenda item can be done to swap this lot for
the 3rd Court Lot that the city gave us back on July 2. 2002.
Please note it was back on June 17, 2003, when the Commission denied our variance to build on
3rd Court and directed the Administration to find another buildable lot to swap for the 3rd Court lot.
Since then the City has not advised us of any available lots.
I would appreciate your doing what ever you can to help expedite these items so that we can
continue to affordable housing for God's people in need in the City of Boynton Beach. Please let me
know if there is anything I can do to assist you in this matter.
