DEPARTMENT OF DEVELOPMENT Memorandum PZ 03-136 TO: FROM: Department staff and project file i:'\~ Michael Rumpf' ~ Planning & Zoning Director DATE: June 5, 2003 RE: Linton Black Variance for 202 NE15th Avenue The purpose of this memorandum to Department staff is to explain why the above-referenced variance application was withdrawn, thereby redirecting the applicant back to the permit process. The subject property is a corner lot and based on previous agreements with respect to orientation, which was understood to be a condition of a previous building permit, the property would have a side setback on the south side of the property and a rear setback on the east side of the property. However, it was ultimately determined that a "rear" setback was not necessary at the east side of the property. This conclusion was reached based on the northern-orientation of the abutting property (to the east) and its side yard which abuts the east side of the subject property. The east side of the subject property being a "side yard" would be consistent and compatible with the side yard of the abutting property. This position was reinforced by fact that a single property is not required to have front and rear setbacks and two side setbacks. Considering that most corner lots have two "fronts", it is impossible for that same property to also have two sides and a rear. I trust this rationale is acceptable to all those involved; however, please contact me if there are any questions on this matter.
