BACKGROUND
Mr. Carl A. Cascio, agent for the First Baptist Church of Boynton Beach is requesting a one (i)-year time
extension, for the major site plan modification approval (MSPM 01-021) originally granted on May 21,
2002. Its accompanying request for a height exception (HTEX 02-001) was simultaneously approved with
the site plan.
The subject property currently contains dual zoning districts, namely Neighborhood Commercial (C-2) and
Single-family Residential (R-1A). The northern one-half of the property is zoned R-1A and the southern
one-half is zoned C-2. It is also comprised of several lots assembled as one (1) parcel under one
ownership for a total of 3,84 acres.
At one time, Northwest 3rd Court traversed through the interior of the subject parcel. The original
abandonment process of this right-of-way began in 1994 when a 374-foot segment of Northwest 3rd Court
was abandoned per Resolution 94-53 and closed to Seacrest Boulevard. The 1999 request to abandon the
remaining portion of the right:-of-way for the anticipated church expansion is now complete.
The subject site is developed with an existing 23,040 square foot church. Built in 1948, the church is
located at the northwest corner of Boynton Beach Boulevard and Sea crest Boulevard, The property owner
(First Baptist Church of Boynton Beach) proposes to construct a two- (2) story 31,192 square-foot
expansion to the existing church facility for a total of 54,230 square feet. The applicant has already
demolished a commercial building on the lot in order to accommodate the church expansion. If this
request for site plan extension is approved, the new expiration date of this site plan would be May 21,
2004.
ANALYSIS
On May 21, 2002, the City Conmission approved this major site plan modification subject to 28 conditions
of approval. All project conditions of approval pertaining to the site plan would still apply, The
accompanying height exception (HTEX 02-001) application contained no conditions of approval.
According to Chapter 4, Section 5 of the Land Development Regulations, "the applicant shall have one (1)
year to secure a building permit from the Development Department". It states further that the City
Commission may extend the approval for one (1) year provided that the applicant has filed a request for
a time extension prior to the expiration of the original approval. In this case, the applicant has met the
requirement. The Planning & Zoning Division received the application for a site plan time extension on
February 16, 2003, prior to the expiration date,
On January 27, 2003, the applicant submitted drawings for building permits for the new church building,
Building Division staff reviewed the permit application and prepared comments to the applicant. A time
extension for the building permit application, which is set to expire on October 21, 2003, has been filed
with the Building Division. Therefore, the applicant is acting in "good faith" to start construction of the
church expansion. These reasons are justification and need for the formal request for major site plan
modification extension. However, the applicant may be required to submit an updated traffic study with a
build-out year past 2003 in order confirm continued compliance with the Traffic Performance Standards of
Palm Beach County (see Exhibit "B" - Conditions of Approval).

RECOMMENDATION
Staff recommends approval of this request for a one (l)-year time extension of the major site plan
modification approval (MSPM 01-021)) and its corresponding height exception (HTEX 01-003). This
recommendation is based on the "good faith" effort shown to build the project, the fact that traffic
concurrency has been maintained, and no changes have been made to the Land Development
Regulations that would impact this project since it was approved in 2002. Approval of this request for
site plan extension would extend the project's expiration date to May 21, 2004.
All conditions of approval included in the initial development order must still be satisfactorily addressed
during the building permit process. No new conditions of approval are recommended in conjunction with
this site plan extension except for perpetual maintenance of the approved traffic concurrency. In any
case, any new conditions of approval recommended by the Board or required by the City Commission
would be placed in Exhibit "B" - Conditions of Approval. Staff would not support a second extension, if
so requested, due to the upcoming rewrite of the land Development Regulations. The site plan would be
required to meet all new regulations at that time.
