The City Commission entered into an agreement with you on Auaust 23. 2007 relative to your site
plan. To date, no building permit has been issued for this project. A building permit must be secured
within eighteen (18) months of the effective date of the agreement in order to maintain the vested
status.
The Land Development Regulations Chapter 4, Section 5, provides for a one-year extension for site
plan approval if the application is submitted before the expiration date. Please call the Planning and
Zoning Division at (561) 742-6260 for more information regarding the site plan time extension
procedure.

Dear Dr. Morgan:
Governor Charlie Christ appreciates your letter dated August 29, 2007 and your concern for your
community. The Governor has asked that we write to you regarding your concerns about the proposed
industrial development on the former site of Seaboard Airline Railway Station adjacent to the Lake
Boynton Estates Neighborhood.
Based upon the information in your letter, a developer is proposing to construct three warehouses,
each housing thirteen bays in an area that is zoned for industrial use. You state that the zoning is
incompatible with the surrounding land uses. However, the zoning designation is required to be
consistent with the comprehensive plan, and according to information we have received the property is
designated Industrial on the future land use map. To support another use, the city council would need to
amend the comprehensive plan. The Department has no authority to require the city to amend its plan in
situations like this, and we recommend you work with the city as the most effective forum to initiate
change.

Staff has received your response to the Request for Additional Information dated
March 26, 2007 for the above referenced application. Pursuant to Rule 40E-40,
Florida Administrative Code (FAC), the District is requesting the following
inforrnation needed to complete the application:
1. As discussed with you, the District to date has not received sufficient
docurnentation to issue the perrnit for the above referenced project to
Boynton Industrial, LLC. The District can only issue the permit to the
titleholder of the property. In order to issue the perrnit to Boynton Industrial,
LLC, the title of the property needs to be transferred to Boynton, LLC.
Otherwise the perrnit can only be issued to Mr. DeSimone. If, at a later date,
the property is transferred to Boynton Industrial, LLC, an application for permit
transfer needs to be applied for by subrnitting a cornpleted form 0483,
required documentation and application processing fee. In that case, Mr.
DeSirnone will be responsible for all permit requirernents until the perrnit is
transferred to Boynton Industrial, LLC.
Please provide information to which entity the permit can be issued.

Dear Chief William L. Bingham (Director of Fire Rescue Services of Boynton Beach),
I am a citizen of Boynton Beach, FL and a resident of the Lake Boynton Estates community. The
Mayor is in the process of allowing the construction ofa 133,911 square foot warehouse complex
consisting of 39 individual bays. This warehouse building is to be enveloped on three sides by major
access roads with no means of egress. On the fourth side of the building complex are the Florida CSX
railroad and a residential neighborhood.
The only means of egress into the warehouse complex is an established railroad crossing. Though the
warehouse complex is zoned light industrial, it is estimated that 1300 trucks will pass through the
railroad crossing daily to access the warehouse building. It is also likely that these businesses will house
hazardous flammable and combustible materials. My question is, if a truck breaks down across the
railroad tracks or the railroad crossing malfunctions and a major fire breaks out in a warehouse how will
the fire be addressed? Are there any regulations requiring more than one means of access across a
railroad track to enter into the "enveloped" warehouse complex?

Although we don't have incident specific design criteria as presented by the
concerned citizen, we do have specific design criteria that addresses fire
protection access and fire suppression requirements, which are identified in the
Florida Fire Prevention Code and in the Boynton Beach City Ordinances. The
Florida Building Code enforced by our Department of Development requires
additional protective features.
I don't want to quote the entire library of codes that would govern a project of this
type, but I will list some key points:
. The building would be equipped with fire sprinkler systems.
. The building would be of fire resistant construction.
. The bays would be separated by fire rated walls.
. Fire lanes would be required
. Fire department access roadways would be required.
. An adequate water supply and hydrants are required.
. The RR right-of-way provides separation distance for exposure protection.
. The codes adequately address fire department access issues.
While there may be some concerns with this project, fire protection is not one of
them. With proper plans review and code enforcement we are prepared to deal
effectively with this project from a fire department perspective.

I have reviewed the above referenced plat and have the following comments:
1. Plat (Sheet 1) - Under "Dedications" and "Acknowledgement", Broward is noted instead of Palm
Beach County.
2. Plat (Sh. 2/3) - An access easement appears to exist where buildings and landscape are designated on
the approved site plan. Are they proposed to be modified to match with the proposed
drive aisles within the project?
3. Plat (Sh. 2/3) - The FPL easement depicted appears to be incomplete, based upon power locations
indicated on the survey. Are these poles intended to be relocated or eliminated?
4. Plat (Sheet 3) - The 50' dedicated perpetual drainage easement depicted does not match that
indicated on the approved site plan. The site plan depicts this east/west easement
running the entire width of the parcel, all the way to the CSX Railroad.
5. Plat (Sheet 3) - A force main and water line are depicted on the survey and approved site plan, just
south of the 50' dedicated perpetual drainage easement, however no easements for
these purposes are depicted on the plat. Are these facilities being relocated?

This was sent to the Commission this morning as an update.
Ocean 95 Meeting - On Monday, a meeting was held in the Commission Chambers to discuss the Ocean
95 industrial project. There were about 65-80 residents in attendance and I felt everybody conducted
themselves well. I was especially proud of staff and their presentations. While the news was not good
in terms oftraffic impact, it was factual and concise. Equally, the facts about the zoning of the property,
what was allowed was presented well by staff. Jeff Livergood and Mike Rumpf are to be commended
on presenting a tough subject. The developer also did a very good job of presenting the proposed
project. In my view the most significant item was the design of the building's docks and how this
design would preclude use by 55-foot trailer trucks except in cases where there was a parallel parking
and manual unload. A standard 55-foot truck cannot access any loading dock in the building without
blocking the access road.
In summary, four issues emerged from the meeting that will require additional attention before the next
City Commission review of the project on December 5th:
1. A new north access option emerged. This involves using the FDOT right of way on the north side
of the I-95/Boynton Beach bridge (next to the Stor-All) and using an opening under the bridge
either to 6th or directly to the site along the CSX right of way. This option requires purchase of
two homes, possibly.
2. A second option is related to this but the north access would be limited to either one-way in-bound
or out-bound. This would allow the access road to be smaller. However, additional property
would be required.
3. For the Ocean Drive route, a suggestion was made to route traffic SOUTH on 8th Street to
Woolbright instead of north to Boynton Beach Blvd. The reasoning was that there is better and
wider pavement south toward Woolbright.
4. City purchase the Ocean 95 site. I have asked Quintus Greene to contact our Real Estate
Consultant to provide a quick value assessment. I also briefly discussed this with the developer
after the meeting.

Dear Sir or Madam:
This project received site plan approval by the City Commission on October 17, 2006,
However, in light of concerns raised by residents in the vicinity, the City Commission was
prompted to reconsider this project at its regular meeting scheduled for December 5, 2006,
at 7:00 p,m, at the City Hall Commission Chambers, In preparation for this public hearing, a
meeting will be held on November 20th at 6:30 p.m. in the Commission Chambers at
City Hall located at 100 E. Boynton Beach Boulevard, solely to facilitate
discussions between residents, the applicants for the project and city staff, It is the intent
that all relevant issues will be discussed and appropriate solutions identified that, in part,
preserves the safety and quality of the neighborhood in this area,
The proposed project consists of three (3) office / warehouse buildings for a total of
133,911 square feet. The site is approximately 7 acres in size and located at the east end
of West Ocean Avenue, between the C,S.x Railroad tracks and the right-of-way
for Interstate 95 (see attached location map), This property was formerly occupied by the
Four Steel Corporation, As proposed, the project would include three (3) buildings
separated into 39 small bays for individual businesses, Each building is one-story and to
be 28 feet in height (see attached site plan and elevation drawings),
This project is to be located on industrially-zoned property in an isolated area of the city,
and would be limited to access through local streets, The applicants have advised thatthe
project is not designed with driveway aisles, turning radii and raised platforms that are
necessary for large tractor-trailer trucks, However, a "truck route" has been identified along
West Ocean Drive to which project traffic would be limited, This route was originally
selected due to its wider right-of-way, length of roadway segments, and characteristics that
accommodate maneuverability, The developer would also be required to improve this route
to accommodate the additional project traffic, Improvements may include, but not be limited
to, two 12-foot travel lanes, drainage enhancements, sidewalks, signage, and striping (see
Exhibit "C" for a description of the possible truck routes originally considered),

Good Evening
Dear City Commissioners and City Mayor:
The many signatures of local residents of our neighborhood, have signed this petition, WE DO NOT
WANT A TRUCK ROUTE GOING THROUGH OUR RESIDENTIAL NEIGHBORHOOD.
VOTE NO TO OCEAN DRIVE! (Please see the attached signature list).
According to Florida Statutes, residents need to be notified of any intended changes that impact their
community, Failure to do so is a violation of our constitutional rights and our right to public hearings,
We are a working class community and stakeholders in the decision making process, Please do not take us
lightly, We will fight to maintain our safe and tranquil community. Furthermore, WE DO NOT WANT
Ocean Drive to be the designated Truck Route for the Ocean 95 Exchange Plaza Proiect.
There is a city park located adjacent to Ocean Drive where our children play and have fun, This impact
changes the residential nature of this area to an industrial park, The following are a list of our concerns:
I, We request a Truck Route Management & Community Impact Reduction Study that considers
alternative routes - Home DepotJExpo, Industrial Road opening, or a road alongside the railroad,
along with a Truck Route Analysis,
2, Safety strategies for children, (This neighborhood has limited public park space, The roadway
geometJy regarding the park is a critical safety issue, Children and truck traffic are a deadly
combination),
3, Noise complaints, (This neighborhood borders 1-95, Tri-Rail, and the train tracks, Noise is already a
major problem).
4, Time restrictions, (We are a working class neighborhood wanting the bundle of rights inherent in our
real estate investment, namely peaceful enjoyment),
5, Accident data, Illegal dumping, trash and debris; Gas, oil & chemical spills, and fumes (Air Quality
Issue),
6, Truck violations and illegal truck traffic, Over-height and height clearance issues,
7, Traffic circulation for the general area, and increased traffic congestion with an increase in Negative
signage,
We are tax payers voicing our right to object. We say NO to OCEAN DRIVE!
As our representatives, serious thought must be given to the contributing factors, which will negatively
impact our neighborhood, We will continue to monitor these meetings until mutual consensus is reached;
the alternatives are weighed and the issues are resolved in win-win situation,

Depot/Expo, However, the action by CSX to purchase the additional RR right of way (curved track on aerial)

device for your City business, I don't know if AOL can link to the Blackberry or not so you could also send and
receive your AOL mail on the device, I have my Blackberry linked to my Bellsouth account and it shows up on a
different mailbox on the screen and goes only to/from the Bellsouth server. We can research this for you,
However, once you are aboard, your official City e-mail should go through the City server - this would be your
City e-mail address:rodriguezj@ci.boynton-beach.fl.us - we are getting this set up, I hope you consider the
Blackberry as we can keep your City schedule up to date and I can send out e-mail updates or items to the
Commission, The City has a web-enabled access point to our Outlook e-mail server that can be used to access
e-mail remotely also, I found it works best on Explorer or Firefox,
Shirts/Cards/Jacket ,Joyce will want to talk to you about polo shirts, business cards and a windbreaker jacket with
the City logo also,
Paycheck I ' HR will need to talk to you about payroll and benefits,
Access to Building -, We also need to get you over to PD to have a photo id and a proximity card issued, The
proximity card will get you into City Hall after hours and will also eliminate the need to do the drivers license swap
at the front desk, I think there may be a key involved to get you in the City Clerk's Office for your mail.
Joyce can coordinate all of these items and others she has with you when you are ready,
Finally, as we discussed, I will be out of town next Wednesday, Carisse and/or Wilfred are available to meet with
