I recommend the release of the cash bond posted by California
Federal Bank in the amount of $11,044.00 for landscaping
improvements. Attached hereto please find a copy of Resolution
No. R91-195 and Form No. 121 supplied as back-up data with
respect to releasing the bond.
Please acknowledge fulfillment of this request to the Site
Development Division of the Planning Department so we can
finalize this issue. Thank you for your cooperation with this
request.

REGARDING LANDSCAPING AT THE 1600 S. FEDERAL HIGHWAY
BRANCH OFFICE
The bond referenced above was a condition of California Federal
receiving an occupational License to open their branch office for
business. The bank had subcontracted a landscaping company to
remove part of the existing landscaping and install new
landscaping at the site. The subcontractor started removing
existing landscaping prior to submitting a permit application and
plans requesting approval to do the work.
However, to allow the bank to open for business, the bank
submitted to the City the above referenced cash bond and
proceeded to seek approval of the work by presenting the proposed
new landscaping to the Community Appearance Board for their
review approval and then to obtain the appropriate permit(s) from
the Building Department. Prior to submitting the plans to the
community Appearance Board and the City accepting the cash bond,
the landscape plans and cost estimate were reviewed by Kevin
Hallahan, Forester/Environmentalist. The bond money was
consistent with the materials and work shown on the plans. The
plans depicted landscaping consistent with the requirements of
the Landscape Code and the Coastal Village landscape theme.

species that could be placed at the site due to the proximity of
adjacent overhead power lines, the new tree landscaping
resembled, as close as possible, the visual appearance that the
existing streets cape landscaping presented prior to the
subcontractor removing same.
The plans were approved by the community Appearance Board at
their August 15, 1991 regular meeting, and on October 29, 1991
the appropriate permits were issued to proceed with the work. The
landscaping as shown on the plans was field inspected and
accepted on November 5, 1991 by Kevin Hallahan.

from the owner's agent to release the bond and a draft copy of

signed resolution in order that I may proceed with processing the
release of the monies.

Mr. Haag:
On Friday, November l, 1991, Kevin Hallihan of the Boynton Beach
Parks and Recreation Department inspected the above noted project
for compliance with the approved planting plan. While Mr. Hallihan
felt the planting was acceptable, he did not pass the project due
to deficiencies in the irrigation system.
As you know, our deadline for completion of this project was set
for November l. Due to the time necessary to make minor
adjustments to the irrigation system and have the project
reinspected by Mr. Hallihan, we are requesting an additional time
extension to November 8, 1991.
We anticipate having the irrigation up to par by Monday, November
4, and have already scheduled a reinspection for the following day.
We have requested the additional time in case any additional
unforseen problems arise in the second inspection.

Due to circumstances beyond our control, we find it necessary
to request a third time extension for the completion of the
landscape installation for the above noted project. The
current deadl ine is October l8, 1991. We are requesting an
additional lO working days to November l, 1991.
Our last time extension was based on the assumption that the
wax myrt 1 e woul d be dug by october 2. The myrt 1 e are, in
fact, being dug now and should be delivered to the contractor
by Friday, October l8. The new deadline date is based on the
same general time frame outlined in my letter of September 26,
1991.
For your information, Sinclair Landscape has also ordered new
bottlebrush trees since the old ones have obviously died.
These will be installed at the same time as the wax myrtle.
All other landscape items have been completed to the best of
my knowledge.

Due to circumstances beyond our control, we flnd it necessary

The reason for the de 1 ay is that the fie 1 ds where the Wax
Myrtle trees are located (Okeechobee area) have been under
water due to daily rains. The Wax Myrtle supplier tried to
dig a tree (since we were on a deadline) and found that the
soil would not hold to the roots due to the moisture. I have
asked the supplier to confirm the above in writing and will
forward you a copy as soon as I receive it.
The cont ractor , Sinc 1 ai r Landscape, looked into other
suppliers for the Wax Myrtle but was unable to find anyone
within a reasonable distance that had 16' trees (this is
extremely large for a Wax Myrtle).
We are requesting an additional 15 working days in the hopes
that the fields will dry sometime next week. If we can pull
the trees by Wednesday (Oct. 2) of next week then the trees
should sit on the rack at Sinclair for 7-l0 days to mist them
and bring them through the shock stage. The trees could then
be installed by Monday, Oct. l4. We're requesting the
deadline be on Friday of that week so there is some flex time
and also to complete irrigation adjustments, any final
planting adjustments and coordinate landscape inspection with
the City.
We were informed by the contractor that the remainder of the
plant installation was essentially complete. Kevin Hallihan
and I have, on separate occasions this week, observed the work
to date and found that there are numerous deficiencies in
meeting the plan specifications. I met, on site, with Dave

many in similar condition survive and do well with time.

This memorandum is in reference to the landscape renovation
proposed for the above site. The following items should be
prepared by the applicant as part of the presentation to the
Community Appearance Board.
l. A review of the originally approved C.A.B. plan dated
2/7/77. The plant, shrubs and trees should be quantified
and the original size specifications explained by the
applicant.
2. The changes and removals to the landscape that reflect the
present conditions existing on the site. The quantified
difference in number of plant material should be explained
by the applicant.
3. The newly proposed landscape plan demonstrating that the
quantity of plant material (small plants, shrubs, trees)
installed compensates for the difference of item #2 above.
The plan should also demonstrate a larger quality
(specification) of plant material used in the proposed plan
to replace the mature trees which were removed. The
landscape plan should also demonstrate fulfilling the City
requirements for native percentages, xeriscape principles,
Florida Power & Light restrictions (overhead utility lines),
Community Design Plan, and the City Landscape Ordinance.
4. The applicant should bond the landscape and irrigation
improvements (lI0% cost) and provide an assurance that the
work will be completed within 30 days of C.A.B. approval.
5. The proposed landscape plan be approved by the C.A.B. and
any additional requirements to this board or the City
Manager's Office be incorporated into the landscape plan.

RE: PERFORMANCE SURETY FOR LANDSCAPING AT THE CALIFORNIA
FEDERAL BANK (1600 S. FEDERAL HIGHWAY)
The landscaping for the California Federal Bank is not in
conformance with the approved site plan and the bank wishes to
use Section 7.5-37, Performance Surety of the Boynton Beach Code
of Ordinances. Attached is a check in the amount of $11,044.00
~hich is one hundred ten (110) percent of the cost of material,
~- ~~bor and other attendant costs incidental to completing the work
at the project.
The site Development Division finds ,the proposed figures and
accompanying letters provided by California Federal Bank and
Kilday and Associates stating the cost estimates and the proposed
time frame for completing the required work amenable.
Please deposit this check into the appropriate account until
notification from the Building Department to return said bond
money. Kindly acknowledge receipt of the above-mentioned check by
returning a signed copy of this memo. Thank you.

SUBJECT: Landscape Removal at 1600 S Federal Highway
In response to Building Department memorandum No. 91-291 I would first
state that California Federal should be cited and fined for their actions
involved in the removal of landscape trees and plants without a permit and
an approved plan. Their total disrespect for trees and the environment
should not go unnoticed and unpunished. However, their willingness to sit
down and discuss what needs to be done (on their part) in order to bring
this site to code requirements should not be overlooked, and therefore I
certainly would withhold adjudication until, and as such time as, they reno-
vate the site landscaping to at least a point to where it was prior to the
area being raised of the trees and plants.
In summary, California Federal Bank should take it upon themselves to make
this wrong a right by sufficiently landscaping the area with trees. palms,
and plants, at least to the point of meeting the provisions of the City
code. please keep this office informed of this matter. Thank you.

Kevin Hallahan and I had a meeting this morning with
representatives from Carteret Savings Bank and California Federal
Bank to discuss the landscaping at 1600 S. Federal Highway.
The landowners, Carteret savings Bank, are submitting plans to be
presented at the August community Appearance Board meeting. They
have agreed to meet all requirements to bring this property into
compliance in a timely manner and through the proper channels.
As you requested, I will keep you apprised on the progress of
this matter. The Building Department and the City
Forester/Environmentalist will follow through to ensure total
code compliance on this site.

As you requested I have researched the landscaping conditions at
1600 S. Federal Highway. It appears that California Federal Bank
authorized the work. A bank representative telephoned Site
Development last week requesting permission to perform
maintenance only on the site; permission was granted.
After obtaining a copy of the landscape plan, Kevin Hallahan and
I visited the site and found large quantities of trees, hedges
and shrubs missing.
The following is a list of materials that appear to have been
removed according to landscape plan #16714, dated February 7,
1977:

Existing landscape conditions are as follows:

Mike Sherman from California Federal was contacted to discuss his
company's plans to renovate the site landscaping.

1. The work involved exceeded the scope of service requested for
maintenance of the existing landscape.
2. The ov.erall appearance of the landscape has changed from one
of a lush densely covered vegetation to a more open look.
3. Renovate the landscaping to assimilate the California
Federal Bank's plans with the originally approved C.A.B.
plans.
A meeting between Kevin Hallahan, California Federal
representatives and me will be scheduled at the earliest
convenience. We request your input, direction and additional
