JANUARY 21,
Appearance Board reviewed the color elevation submitted by
Mr. Desiderio for the property located at 2755 South Federal
Highway. The Planning Department felt it necessary to have this
matter reviewed by the CAB because the colors do not fit the
palette for the design district in which the property is located.
The CAB rejected the proposed color elevations.
Dom Desiderio of 1000 White Drive, Delray Beach, owner of Atrium
Place, said the acceptable colors are light yellow, blue to grey,
beige, and eggshell. The CAB did approve dark green, which is
not an approved color. In answer to Vice Mayor Harmening, he
said the eyebrow is six inches.
Mr. Desiderio said Atrium Place was formerly in foreclosure with
Barnett Bank. He purchased it fLum Barnett Bank and described
the deplGrable condition of the property at that time, as well as
his intentions to repair it.
The colors were appealing to Commissioner Matson and she suggested
reviewing the Community Design Plan.
Commissioner Aguila had no objections to the colors; however, he
felt they were intense and should be toned down.
Vice Mayor Harmening felt the mansard is going to be a little
overpowering and suggested Mr. Desiderio paint the eyebrow grey.
Vice Mayor Harmening moved to approve the color scheme as pre-
sented. Commissioner Matson seconded the motion which carried

At the December 12, 1991 meeting, the community Appearance
Board reviewed the colored elevation submitted by the applicant
for a color scheme change at Atrium Place located at 2755 South
Federal Highway. After review, the Board denied the applicant's
proposed color change.
Dominic Desiderio, the owner of the property, has requested
that the City Commission review the Board's determination to
consider overturning their conclusion.
We have attached the backup presented to the C.A.B. and we
will have the color elevation available at the City Commission
meeting for viewing.
We would ask that this item be scheduled for City Commission
review and consideration on January 21, 1992.

DECEMBER 12, 1991
Ray Flow, of 722 South Lakeside Drive, Lake Worth, Florida, was
present and is the owner of the subject property. He explained
this is an existing project which has been annexed into the City.
Two years ago, petitions were filed for the City and the County.
Chairman Armas pointed out to Board members that a staff comment
exists with regard to the need for five additional parking spaces.
Upon visiting the site, it became obvious to Chairman Armas that
in order to add the additional parking spaces, some of the play
area would be lost.
Mr. Flow reported that originally fifty-five parking spaces were
required. After a traffic/parking survey was performed, it was
agreed that what existed would be sufficient and they signed an
affidavit stating they would not resist annexation into the City
at the City's request.
Chairman Armas also mentioned the fact that the site has a shor-
tage of native landscaping. The requirement calls for 50% native
material. Mr. Haag explained that the existing landscaping is
what was required by the County.
Mike Haag explained to the Board that Little Dude Ranch Day Care
Center is attempting to get site approval. The Board must decide
what recommendations should be made to the City Commission. The
Commission will then make the final decision. If this site is
approved as it stands now, they would need to get variances in the
future for parking spaces and landscaping if they decided to
expand.
Mr. Flow said the Little Dude Ranch Day Care Center has been
operating for two years and they had met all requirements. He
again pointed out that one of the original petitions had gone to
the City of Boynton Beach. One of the requirements for annexation
was to go through the City's site plan process. He further
explained that the Little Dude Ranch asked for City water and was
advised that at some future date, they might be annexed into the
City. They agreed.
In Chairman Armas' opinion, the site is beautifully landscaped and
he feels it is ludicrous to ask for changes to the existing land-
scaping.
Jean Sheridan questioned the height of the sign and was informed
that the sign is too high but he will have to change the sign
within six months. Code Enforcement will cite the Little Dude
Ranch for the sign.
Dale Mitchell suggested that a recommendation could be made by the
Board that if for any reason the existing landscaping needed to be
replaced, the replacements should be made with native material.

In response to Mr. Davis' question, Mr. Flow has seen all of the
staff comments and is in agreement with them.

Dom Desiderio, of 1000 White Drive, Delray Beach, Florida, stated
the original color of the building was biege. He now wants to
paint the mansard roof light green, with the top of the building
dark pink going to light pink at the bottom. There will be an
"eyebrow" separating the two floors which will be painted dark
green. Mr. Desiderio presented a plan showing the colors.
It was determined that the colors requested by Mr. Desiderio did
not meet the requirements of Coastal Village as required in this
particular area. The dark green is acceptable; however, the light
green and pink colors are not.
Mr. Desiderio stressed the fact that many of the buildings around
his property are currently painted in the colors he requested.
Chairman Armas explained to Mr. Desiderio that the buildings with
these colors have been there since before the Coastal village
motif was adopted. At this point, there is nothing which can be
done to have these buildings repainted. However, a time will
eventually come when these buildings will have to comply with this
requirement.
Mr. Desiderio feels this color scheme will bring excitement to the
area and attract businesses to rent space. He explained that many
of the potential renters feel there is no excitement in this area.
He has signed three leases, but has twenty to offer. The renters
want something different. He stated that the City gets 6% of the
rents and pointed out that the higher rent brings more money into
the City; however, he cannot get the higher rent if he has nothing
to offer the tenants.

In response to Mr. Fleming's question, none of the Board members
found the colors unattractive, but it was pointed out by Ms.
Shuman that these colors are not acceptable in the area. Ms.
Shuman explained that a great deal of work went into adopting the
Coastal Village colors.
Chairman Armas stated that the City has adopted the Coastal
Village colors and a decision must be made whether or not to sup-
port it. If exceptions are made to the rule, there will never be
a rule. He feels if the Board does not want to stay with the
color scheme, then it should not have been adopted. Chairman
Armas suggested the Board adhere to the guidelines. If changes
are necessary, then that issue should be addressed.
After lengthy discussion with Mr. Desiderio about his color
choices, the Board members again attempted to explain the reasons
for the adoption of these colors. It was pointed out that the
adoption of these colors protects property owners. Jean Sheridan
explained the workshop which was conducted with regard to the
adoption of these colors. The Board has been urged to support
this color scheme and other color schemes designated for areas
throughout the City. This was done to set the architectural theme
of the City.
Motion
Eleanor Shuman moved that the Board NOT APPROVE the colors, but
recommended the applicant choose from the recommended colors for
Coastal Village. George Davis seconded the motion which carried

Mr. Desiderio stated he believes in the Constitution of the United
states which calls for freedom of expression. He feels he has the
right to paint his building in the colors of his choice. He
stated he served six years in the military to defend a person's
right to do this and feels this decision is wrong because so many
of the buildings are painted in these colors and not offensive to
anyone. He suggested the colors be reviewed. He again stated
that the City will be losing money because he cannot get the
higher rents. He stated the City is "missing the boat".
Dean Fleming interrupted him to explain that the Board members
voted based on the established guidelines. Although the members
agreed that the colors are not offensive, there is a set policy
they must adhere to. Mr. Fleming disagrees with the guidelines
and feels they need to be changed.
Chairman Armas suggested Mr. Desiderio plead his case to the City
Commission.

Mr. Desiderio further explained that he has had a great deal of
difficulty in getting his business off the ground. He stated that
he was told he did not require a permit to reseal his driveway
because he had an existing plan. He was later informed he did
need the permit. Since he was not on the computer, he needed to
furnish title to the property. He explained that the closing
would take six weeks and he would not have the title until then.
He was advised to bring in his legal. It took twelve days to get
the permit to seal his driveway. They would not issue Mr.
Desiderio the permit because he is a corporation. He was told an
Occupational License was not required because he owns the pro-
perty, but yet he was unable to seal the property because he is a
corporation. He stated he is flabbergasted he has to go through
all of this to get something done.
Eleanor Shuman suggested Mr. Desiderio appear before the City
Commission to explain his situation. She feels they would be
interested in knowing the difficulty he experienced in working out
his business in this City.
Dean Fleming pointed out he is a member of a task force which
deals with such problems and he asked Mr. Desiderio to speak with
him before he meets with Mr. Miller and others tomorrow on this
issue.
Dale Mitchell and Jean Sheridan apologized to Mr. Desiderio.
F. OTHER BUSINESS
1. CUrrent Development Project Update - Planning Department
Report
Mike Haag reported on Planning Department administrative deci-
sions. He again pointed out that the Board members should make
him aware if it is felt that the Planning Department is
overstepping its bounds. He explained that Mr. Desiderio's
situation was one which the Planning Department would not decide
upon. The two administrative decisions are:
1. Carriage Homes - They originally showed a wrought-iron and
concrete column block fence around the pool area. They
have done away with that fence and replaced it with a
picket fence.
2. Mack Office Building - This is located on the corner of
Seacrest Boulevard and Gulfstream Boulevard. They had
pink shutters on the building with pink trim. They have
removed the shutters and put an 8" raised band around the
window. The tone of the color pink has been changed from
the original shade. The color pink is acceptable in that
area.

Jean Sheridan wondered how far the Planning Department would go in
changing something already decided on by the Board. Mr. Haag
stated that is the reason for the report. Chairman Armas wondered
if the Board disagreed with an administrative decision, would the
case come back before the Board? Mr. Haag pointed out that would
probably not happen, but knowing their feelings would help him and
the Planning Department to know their limits.
G. ANNOUNCEMENTS

H. COMMENTS BY MEMBERS
Chairman Armas addressed the Board with regard to their respon-
sibility as Board members. He explained that the job of the Board
is to interpret the Code. If there is disagreement regarding this
particular area and color concept, then it should be brought to
the City Commission. This is an established Code. Speaking
against such Codes can make the applicant irate. If the task
force and the City Commission decide to abolish this Code, that is
the time for the Board to come forward.
Mr. Fleming explained that his reference to the task force did not
relate to the color scheme. That task force will deal with the
difficulties experienced in obtaining permits.
Chairman Armas stated he did not like telling Mr. Desiderio he
could not have the colors he wanted, but if the Board chose to
allow him to go ahead, when another applicant comes forward, it
will be impossible to say no. If Board members feel this color
scheme is not right, then the issue should be readdressed.
Mr. Fleming clearly understood and further explained that he was
not part of the team which adopted the color scheme.
Jean Sheridan stated that at times, the Board appears to be cruel,
but it is the Board's responsibility to follow the direction of
the City Commission.
Chairman Armas explained that he has been a Board member in three
different cities and this Board is the most compromising and
affectionate Board he has ever been a member of.
Mr. Berman explained that he was hesitant in voting, but realized
his job is to uphold the Code.
Mr. Fleming pointed out that he has not had any problems in
obtaining permits, but there is a lack of consistency in the City.

He pointed out that he intends to do more research in order to
become more knowledgeable. He understood why the Board voted as
they did, but could not go on record as agreeing with them since
he was not part of the establishment of the color scheme.
Eleanor Shuman suggested that a list of colors be provided to the
members when applications come before the Board.
Mr. Haag stated that if Board members feel the color pallet is too
constrictive, it could be expanded. This procedure would require
a change in the Code, but the Board could recommend to the City
Commission that such a Code change be initiated.

THE ATRIUM
All that part of the southeast Quarter of Section 33, Township 45
South, Range 43 East, in Palm Beach County, Florida, more
particularly described as follows: Beginning at a concrete
monument in the West line of the right-of-way of U.S. Highway No.
1, which is 385.56 feet South of the North line of the Southeast
Quarter of said section 3 and running thence South along the West
line of the right-of-way of said U.S. Highway No.1 a distance of
800 feet to a point that is the Southeast corner of land conveyed
to Raymond L. Brandewie and wife said point being the point of
this description; thence continue South along the West line of
the right-of-way of U.S. Highway No.1 a distance of 200 feet;
thence West on a line parallel with the North Line of said
Southeast Quarter of said Section 33, a distance of 300 feet
thence North on a line parallel with the West line of U.S.
Highway No. 1 to a point which is the Southwest corner of the
land conveyed to Raymond L. Brandewie and wife; thence East along
the South line of said property conveyed to Raymond L. Brandewie
and wife to the point of beginning excepting therefrom the
Easterly 17 feet which was conveyed to the State of Florida for

Re: Color scheme, Atrium Plaza, Boynton Beach
Color scheme change to Atrium Plaza from existing beige to a
multi-color commercial attraction is consistent with its area
surroundings. The enclosed green and pink color chips demon-
strate 'the pale pastel eye-catching nature of the colors. The
lightest green will be the roof area color. The pinks will run
from the darkest on the upper half of the building to the lighter
pink on the bottom. The darker green will be an accent stripe on
the catwalk eye brow separating the two pink colors. Pep's Sea
Grill, 2005 Federal Highway, Denny's, 2001 Federal Highway and
Sunshine Square at Woolbright and Federal Highway in Boynton
Beach all have various combinations of these pinks and greens.
Our objective is to re-new commercial traffic to this building so
it may support itself and be an attractive addition to the commu-
nity. Any assistance you can give us will be greatly appreciat-
ed.
