West Industrial Associates also owns a half acre parcel adjacent to the east of subject property, which we plan to develop later as parking and/or open storage. At present, we are only concerned with the development of the subject property, and therefore, access to the other parcel is moot. The previously approved site plan varies from this site plan in the following manner: 1) N.W. corner of property has existing single pad for waste removal container. New site plan extends this to accomodate two containers, dimensions to be 10' deep, 18' wide, inside dimensions as per Boynton Beach Utilities criteria. Net loss of one parking space. 2) The utilities (drain storms, sewer lines, fire hydrants) as well as site lighting (except for the building lights of Phase 3) are existing, as per previously approved plans. 3) The parking plan was rearranged to accomodate the various doors of Phase 3 building. Parking spaces required: 167; spaces provided: 174. 4) Provision was made for a future access to property to the east of this site, which we acquired, for future parking. 5) Phase 3 building footprint was changed from 24,205 sq. ft. to 23,360 sq. ft., a reduction of 845 sq. ft. 6) Finished floor elevation, height of structure, and grades of surrounding driveway and parking areas of Phase 3 are unchanged from previously approved plans. It is understood that this temporary permission is to operate for business purposes at: 1370 West Industrial Avenue All equipment and facilities shall be maintained in a manner so that there is no hazard to life or property and we accept full responsibility. We hold the City of Boynton Beach harmless in the event of any accident or damage to life or property. All required fire equipment will be activated or located at the above address. Proper address identification shall be displayed onbuildinq. It is understood that if the above conditions are not met, the City of Boynton Beach retains the right to revoke permission of this Temporary permission to Occupy at any time or for any reason. In the event the conditions are not met and the City of Boynton Beach issues a Notice of Revocation of Temporary permission to Occupy, the owner/contractor shall cease occupancy of the property wi thin five ( 5 ) days of receipt of the notice. Failure to cease occupancy shall entitle the City to the immediate issuance of an injunction preventing occupancy and use. All costs and other fees associated with obtaining an injunction shall be paid by the owner/contractor.
