REQUEST FOR APPEAL OF ADMINISTRATIVE DECISION
DESCRIPTION: Request submitted by Milan Novotny, representative
for West Industrial Associates, for approval to eliminate
required perimeter landscaping where subject property abuts
adjacent properties. The project is located at 1300 W. Industrial
Avenue.
DETERMINATION: The Board approved, (6-1), the variance request
submitted by Mr. Novotny subject to the work proposed for the
project meeting the requirements of the Code of Ordinances.
Motion was made by Dean Fleming and seconded by Jean Sheridan.

Gentlemen:
We respectfully apply for a variance of Section 7.5-3.5 e of the
City Ordinance to be permitted to substitute a 6 foot high chain
link fence with 3 strand barbed wire, screened on the inside with
tennis court screening, instead of the 2 1/2 foot landscaped
perimeter area. Our projected use for said open storage area is
to accornnodate our multi-tenant requests to store equipnent,
trailers, trucks, material, boats, landscaping machinery and any
other code approved items. We have already experienced breakins
and vandalism. So far, nobody has been hurt, but we have concern
for the safety of our customers.
In our opinion, a 6 foot high visual screening is superior to a
hedge which, being 3 feet high, would not sufficiently hide such
equipnent. Maintaining a hedge would be difficult given the
various objects stored there and the result would be a hedge which
would be from time to time damaged by the equipnent. The subject
property is not visible from any angle of a populated or traveled
area.
We hope this request meets with your favorable decision.

5 7.5-35
(e) Perimeter landscaping relating to abutting properties.
On the site of a building or structure or open lot use_
providing an off-street parking area or other vehicular use
area, such area shall be provided with a landscaped barrier,
preferably a hedge not less than fOUI (4) feet nor greater
than six (6) feet in height to form a continuous screen
between the off-street parking area or other vehicular use
area and such abutting property. Such landscape barrier
shall be located between the common lot line. and the
off-street parking area or other vehicular use area in a
planting strip of not less than two and one-half (2 V, ) feet in
width. The provisions of this subsection shall not be
applicable in the following situations:
(1) When a property line ab;"is a dedicated alley.
(2) Where a proposed parking area or other vehicular
use area abuts an existing hedge, said existing
hedge may be used to satisfy the landscape
requirements of this subsection provided that said
existing hedge meets all applicable standards of
this article.
