Dear Mayor Bmelling:
The Department has completed its review of the proposed comprehensive plan amendmEnt
for the City of Boynton Beach (DCA 03-1), received on February 7, 2003. The amendment
includes five proposed changes to the Future Land Use Map and text amendments to the Future
Land Use Element which include several proposed new land use designations.
Based on Chapter 163, Florida Statutes, we prepared the attached report, outlining our
fmdings regarding the amendment. We are concerned that the proposed land use designations are
not properly defined to specify intensity standards and percentage mix ofland uses. With regard
to the Future Land Use Map amendments, it is important to note that the Federal Highway
Corridor amendment could have the effect of increasing residential density in the Coastal High
Huard. Area unless the Mixed Use-Core category is further defined to limit the overall allocatiolJ
of residential use, Additionally, it is essential that proposed amendments be supported by tlll:
required data and analyses so that the full impact of the proposed development upon public
facilities and transportation may be determined.
The City should address the objections set forth in our review report so that the issues raised
in the report can be successfully resolved prior to adoption. We have also included copies of
local, regional and state agency comments for your consideration. Within the next 60 days, the
City should act by choosing to adopt, adopt with changes, or not adopt the proposed amendnent.
For your assistance, our report outline~, procedures for final adoption and transmittal of the
comprehensive plan amendment.

review of the City of Boynton Beach proposed Comprehensive Plan Amendment (DCA 03-1 )
pursuant to Section 163.3184, P.8,
Objections relate to specific requirL'TTlents of relevant portions of Chapter 9J -5, F.A. C., and
Chapter 163, Part II, F.S. Each objection includes a recommendation of one approach that might
be taken to address thc cited objection. Other approaches may be more suitable in specific
situations. Some of these objections may have been raised initially by one of the other external
review agencies. If there is a difference between the Department's objection and the external
agency advisory objection or comment, the Department's objection would take precedence.
The City of Boynton Beach should address each of these objections when the amendment is
resubmitted for our compliance review. Objections which are not addressed may result in a
determination that the amendment is mil in compliance. The Department may have raised an
objection regarding missing data and analysis, items which the City of Boynton Beach considers
not to be applicable to its amendment. If that is the case, a statement justifying its non-applicabi1 ity
pursuant to Rule 9J-5.002(2), PAC., IT\ust be submitted. The Department will make a
determination as to the non-applicabiJi.ty of the requirement, and if the justification is sufficient,:he
objection will be considered addressed,

1. CONSISTENCY WITH CHAPTER 163, F.S., and RULES 91-5 & 9J-11, F.A.C.
The Department has completed its review ofthc proposed amendment to thc City of Boynton
Beach Comprehensive Plan (DCA 03-1). The amendment includes five changes to the Future Land
Use Map (FLUM) and tCllt changes to the Future Land Use Element (FLUE). Thc Department ha,:
the following objections:
1. Future Land Use Element Objective l.lZ, Policies 1.12.1 and 1.12.Z
The proposed amendments are inconsistent with Intergovernmental Coordination Elemert
Policies 8.8.4, 8.8.5 and 8.8.6 which require the City to notify Palm Beach County of any
increase in residential densities located in the hurricane evacuation zone.

Recommendation: The City should revise Intergovernmental Coordination Element Policic;
8.8.4, 8.8.5 and 8.8,6 to be consistent with the proposed amendment to Future Land Use
Element Objective 1.12 and Policies 1.l2.l and 1.12.2.
Comment: The City may wish to consider combining Policies 1.12, I and 1,12,2,

The proposed new land uses, iVlixed Use-LoW Intensity, Mixed Use-Core and ConservatiOll
are not properly defined. Although the proposed amendment lists the type of uses allowed ir.
these categories. it does not include the intensity of use to be pemritted, JlCI'centage distribution
among mil< of uses, or other objective measurement and intensity standards for non-residential
land uscs allowed in the City's Milled Use-Low Intensity and Milled Use-Core land use
categories. Likewise, the Conservation dcsignation does not specify standards for density ard
intensity ofusc, The City's comprehensivc plan references the City's Code; of Ordinances and
land development regulations for the required intensity standards, Future Land Use Element
Policy 1.16.2, which attc:mpts to 'lStablish intensity standards for non-residential uses, is vague
because it states that ''mal\im\llnlloor/area ratio in non-residential categories shall be limited
by the mallimum lot coverage. th" maximum height, and the parking, landscaping and
stormwater retention requirements contained in the City's Code of Ordinances." It does not
specify the intensity standards to be applied Of the proportionate uses allowed in the Mixed
Use-Low Intensity and Milled Uf:e-Core categories. Rule 9J..5, F.A.C., requires that a millet

3. LUAR 02-008 - Beachside at Boynton
The Mixed Use land use designation does not establish intensity standards or specify the
proportionate uses that would be allowed in this category. Rule 9J.5, F.A.C., requires that a
mixed use designation include these standards so that impacts of a mix~d used designation ca~
be fully evaluated in terms ofland use compatibility and impaets to public facilities and
transportation. The City has not demonstrated, through data and analysis, its ability to maintain
its adopted level of service standard, for public facilities. Without data and analysis, there is m
objective basis for evaluation of the potential impacts of the proposed amendment on the City s
existing and committed public facility capacities, There has been no consideration of the
impacts of the proposed amendment on 1.95, a Florida Intrastat~ Highway System fa~ility.

Re~ommendation: Jt is re~ommendcd that the City:
1. Revise the Mixed Us~ land use category to establish intensity slandards and
proportionate mix as previously recommended.
2. Provide data and analysis for the availability of ell public facilities based upon the
maximum allowable development intensities for Mixed Use. The City should then analyz.
those services and make a det",mination that sufficient capacity exists, with \,\0 towering ,)f
an adopted level of service, to provide essential services based upon the maximum extent
of potential d~velopment allowed. If the City identifies any public facility capacity
deficiency based on the data and analysis, the City should adopt mitigation measures
necessary to correct the deficiency.
3. Provide a traffic analysis, based on the maximum intensity of d",,-elopment, using tht
most recently available data, tc, addrcss the peak-hour, peak direction, roadway level of
service standards, and determ,ine the impact of this amendment upon the Florida Intrastat.
Highway System.
4. LUAR 02-009 - Arbolata Townh,~mes
The proposed amendment is internally inconsistent with Futme Land Use Elem""t Polic~'
1,19.2 which prohibits the conversion ofland designated Industrial to residential uses without
supporting data, including market 'lnalysis, and with Future Land Use Element Policy 1.19.4,
which discourages the breakup of industrial land use linkages.

Re~omm.nd..tion: It is recommended that the City:
I. Provide the justification, as required by the Future Land Use Element Policy 1.19.2,

The proposed Future Land Use Element Policy I. t 6, I, which creates the new land use
designation of Mixed Use-Core is not properly defined as it does not provide the necessary
intensity stmdards and peroentage mix of uses to be implemented for the proposed category.
Rule 9J-5, F.A.C., requires that a mixed use designation include these standards so that impac:s
of a mixed used designation can be fully evaluated in tenns ofland use compatibility and
impacts to public facilities and transportation. Consequently, Policy 1.16.1 is inadequate for tlte
adoption of this proposed amendment. Therefore, the revision to the Future Land Use Map is
premature, pending revision ofFut\lre Land Use Elementpolicy 1.16.1. Rule 9J-5, F.A.C.,
requires that population concentrati!Jlls be directed away from the Coastal High Hazard Area.
The amendment has the potential for increasing the residential density in the Coastal High
Hazard Area. The City has not demonstrated the consistency ofthe proposed FLUM
amendment with Coastal Managemmt Element Objective 7.6 regarding the City's commitment
to maintain or reduce cUITent estilImted hu1'ricane evacuation time if development increases il1
the COIIStal High Hazard Area of the City of Boynton Beach. The City did not provide analysis
of the projected impact of the anticipated 775 residential units, and llOtential evacuation need,
of the population, on hurricane evacuation planning. The City has not demonstrated
consistency with Intergovernmental Coordination Element Policy 8,8.5 which requires the Ci:y
to obtain comments from the Palm Beach COWlly Division of Emergency Management and tre
City of Boynton Beach Risk Management Officer, ''prior to approving any increase in
residential densities in the Hurricane Evacuation Zone.. .if the proposed density increase would
result in an incl'ClIse of 50 or more dwellings." The City has not supported the proposed FLUM
amendment with such comments.

demands and transportation impacts created by the proposed land use change based on the
City's adopted level of service standards and the maximum development allowed under t~e
proposed designation. The Cit)' should then analyze those services and make a

service, to provide essential services based upon the maximum extent of potential
development allowed.
