WHEREAS, the City Commission of the City of Boynton Beach, Florida has adopted
Ordinance No. 02-013, in which a Revised Zoning Map was adopted for said City; and
WHEREAS, Ruth R. Dolly, as owner of the property more particularly described
hereinafter, has heretofore filed a Petition, through her agent, Jeffrey T. Schnars,
pursuant to Section 9 of Appendix A-Zoning, of the Code of Ordinances, City of
Boynton Beach, Florida, for the purpose of rezoning two parcels of vacant land
consisting of 0.35 acres and 0.17 acres, said land being more particularly described
hereinafter, from General Commercial District (C-4) and Single Family Residential (R-l-
A) to Mixed Use (MU-Low Intensity); and
WHEREAS, the City Commission conducted a public hearing and heard
testimony and received evidence which the Commission finds supports a rezoning for the
property hereinafter described; and
WHEREAS, the City Commission finds that the proposed rezoning is consistent
with an amendment to the Land Use which was contemporaneously considered and
approved at the public hearing heretofore referenced; and
WHEREAS, the City Commission deems it In the best interests of the
inhabitants of said City to amend the aforesaid Revised Zoning Map as hereinafter set
forth.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION
OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1.
The foregoing Whereas clauses are true and correct and incorporated
herein by this reference.
Section 2.
The following described land, located in the City of Boynton
Beach, Florida as set forth as follows:
Lot 20, less the East 55 feet thereof, and Lots 21, 22 and 23, Block 4, LAKE
ADDmON TO BOYNTON BEACH, according to the Plat thereof on file in
the office of the Clerk of the Circuit Court in and for Palm Beach County,
Florida, recorded in Plat Book 11, page 71.
SUBJECT TO restrictions, reservations and easements of
record.
e and the same is hereby rezoned from General Commercial District (C-4) and Single Family
esidential (R-1-A) to Mixed Use (MU-Low Intensity);. A location map is attached hereto as
xhibit "An and made a part of this Ordinance by reference.
Section 3: That the aforesaid Revised Zoning Map of the City shall be amended
accordingly.
Section 4: All ordinances or parts of ordinances in conflict herewith are hereby
repealed.
Section 6: Should any section or provision of this Ordinance or any portion thereof
e declared by a court of competent jurisdiction to be invalid, such decision shall not affect the
emainder of this Ordinance.
Section 7. This ordinance shall become effective immediately upon passage.

WHEREAS, the City Commission of the City of Boynton Beach, Florida has
adopted a Comprehensive Future Land Use Plan and as part of said Plan a Future Land
Use Element by Ordinance No. 89-38 in accordance with the Local Government
Comprehensive Planning Act; and
WHEREAS, the procedure for amendment of a Future Land Use Element of a
Comprehensive Plan as set forth in Chapter 163, Florida Statutes, has been followed; and
WHEREAS, after public hearing and study, the City Commission deems it in the
best interest of the inhabitants of said City to amend the aforesaid Element of the
Comprehensive Plan as adopted by the City herein.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1: The foregoing WHEREAS clauses are true and correct and
incorporated herein by this reference.

Ordinance No. 89-38 of the City is hereby amended to reflect the
following:
That the Future Land Use of the following described land shall be designated as
Mixed Use (MX). Said land is more particularly described as follows:
Lot 20, less the East 55 feet thereof, and Lots 21, 22 and 23, Block 4,
LAKE ADDITION TO BOYNTON BEACH, according to the Plat
thereof on file in the office of the Clerk of the Circuit Court in and for
Palm Beach County, Florida, recorded in Plat Book 11, page 71.
SUBJECT TO restrictions, reservations and easements of record.
Section 2: That any maps adopted in accordance with the Future Land Use Element
shall be amended accordingly.
Section 3: All ordinances or parts of ordinances in conflict herewith are hereby
repealed.
Section 4: Should any section or pTovision of this Ordinance or any portion theTeof
be declared by a court of competent jurisdiction to be invalid, such decision shall not affect
the remainder of this Ordinance.
Section 5: This Ordinance shall become effective 31 days after adoption, unless
challenged. If challenged, it becomes effective upon the issuance of a final order finding it in
compliance.
