properties within at least four hundred (400) feet of the subject parcel as reDorded in the latest
offiDial tax rolls in the Dounty Dourthouse shall be furnished by the applicant, including a tax map
showing placement of 400 feet boundary. Postage, and mailing labels or addressed envelopes
must also be provided. Said list shall be aCDompanied by an affidavit stating that to the best of
the applicant's knowledge said list is complete and accurate. NotifiDation of surrounding
property owners will be done by the City of Boynton Beach.
..JLf. A copy of the Palm Beach County Property Appraiser's maps showing all of the properties
referred to in paragraph e. above, and their relation to the subject parcel.
~g. A statement by the applicant justifying the zoning requested, including reasons why the
property is unsuitable for development under the existing zoning and more suitable for
development under the proposed zoning. The statement should address the following criteria
whiDh the Planning and Zoning Division utilizes in evaluating land use amendment and rezoning
appliDations:
1) Whether the proposed land use amendment/rezoning would be consistent with appliDable
Domprehensive plan policies. The division shall also recommend limitations or requirements
that would have to be imposed on subsequent development of the property in order to
comply with policies contained in the comprehensive plan.
2) Whether the proposed land use amendment/rezoning would be Dontrary to the established
land use pattern, or would create an isolated district unrelated to adjacent and nearby
districts or would constitute a grant of speDial privilege to an individual property owner as
contrasted with the protection of the public welfare.
3) Whether changed or changing conditions make the proposed land use
amendment/rezoning desirable.
4) Whether the proposed land use amendment/rezoning would be compatible with utility
systems, roadways and other public facilities.
5) Whether the proposed land use amendment/rezoning would be compatible with the current
and future use of adjacent and nearby properties or would affect the property values of
adjacent and nearby properties.
6) Whether the property is physiDally and economically developable under the existing land
use designation/zoning.
7) Whether the proposed land use amendment/rezoning is of a scale that is reasonably related
to the needs of the neighborhood and the Dity as a whole.

8) Whether there are adequate sites elsewhere in the city for the proposed use, in districts
where such use is already allowed.
-X.h. A comparison of the impacts that would be created by development under the proposed zoning,
with the impaDts that would be created by development under the proposed zoning, with the
impacts that would be Dreated by development under the existing zoning, which will include:
_(1) A comparison of the potential square footage of number and type of dwelling units under
the existing zoning with that which would be allowed under the proposed zoning or
development.
_(2) A statement of the uses that would be allowed in the proposed zoning or development,
and any particular uses that would be exoluded.
_(3)
Proposed timing and phasing of the development.
_(4) For proposed zoning of property to Dommercial or industrial districts, where the area of
the subject parDel exceeds one (1) acre, projections for the number of employees.
(5) A comparison of traffic which would be generated under the proposed zoning or
development, with the traffic that would be generated under the current zoning; also, an
analysis of traffic movements at the intersections of driveways that would serve the
property and surrounding roadways, and improvements that would be necessary to
aDDommodate sUDh traffic movements. For projects that generate move than five
hundred (500) net trips per day, a traffic impact analysis must be submitted whiDh
complies with the Municipal Implementation Ordinance of the Palm BeaDh County Traffic
Performance Standards OrdinanDe.
(a) For projects that generate two thousand (2,000) or more net trips per day, the
traffic impact analysis must be submitted to the City at least 30 days prior to the
deadline for land use amendment and/or rezoning, in order to allow for timely
processing of the application and review by the City's traffic Donsultant and Palm
Beach County. The applicant shall be billed for the DOSt of review by the City's
traffic consultant.
(b) For projects that generate between five hundred (500) and two thousand (2,000)
net trips per day, the traffic impact analysis must be submitted at the application
deadline for land use amendment andlor rezoning, in order to allow for timely
processing of the application and review by Paim Beach County. However, if it is
the desire of the appliDant to utilize the City's traffic consultant for review of the
traffic impact analysis prior to review by Palm Beach County, then the proDedure
and requirements outlined under item "a" above shall be followed.
NOTE: Failure to submit traffic impact analysis in the manner prescribed above may
delay approval of the application.
_(6) For parcels larger than one (1) acre, a comparison of the water demand for
development under the proposed zoning or development with water demand under the
existing zoning. Water demand shall be estimated using the standards adopted by the
Palm Beach County Health Department for estimating sUDh demand, unless a registered
engineer justifies different standards. Commitment to the provision of improvements to

the water system shall also be inoluded, where existing facilities would be inadequate to
serve development under the proposed zoning.
J....(7) For parcels larger than one (1) aDre, a comparison of sewage flows that would be
generated under the proposed zoning or development with that which would be
generated under the existing zoning. Sewage flows shall be estimated using the
standards adopted by the Palm Beach County Health Department for estimating such
flows, unless a registered engineer justifies different standards. Commitment to the
provision of improvements to the sewage collection system shall also be inoluded,
where the existing facilities would be inadequate to serve development under the
proposed zoning.
..1..(8) For proposed residential developments larger than one (1) aDre, a Domparison of the
projected population under the proposed zoning or development with the projected
population under the existing zoning. Population projections according to age groups
for the proposed development shall be required where more than fifty (50) dwellings, or
50 sleeping rooms in the case of group housing, would be allowed under the proposed
zoning.
_(9) At the request of the Planning Division, Planning and Development Board, or City
Commission, the applicant shall also submit proposals for minimizing land use conflicts
with surrounding properties. The applicant shall provide a summary of the nuisances
and hazards associated with development under the proposed zoning, as well as
proposals for mitigation of such nuisances and hazards. Such summary shall also
inolude, where appliDable, exolusion of particular uses, limitations on hours of operation,
proposed IODation of loading areas, dumpsters, and meDhanical equipment, location of
driveways and service entranDe, and specifications for site lighting. NuisanDes and
hazards shall be abated or mitigated so as to conform to the performance standards
contained in the City's zoning regulations and the standards contained in the City's noise
control ordinance. Also, statements concerning the height, orientation, and bulk of
struDtures, setbacks from property lines, and measures for screening and buffering the
proposed development shall be provided. At the request of the Planning and
Development Board or City Commission, the appliDant shall also state the type of
construction and architeDtural styles that will be employed in the proposed development.
_(10)At the request of the Planning Division, Planning and Development Board, or City
Commission, the applicant shall also submit the following information:
_(a) Official soil conservation service oIassifiDation by soil associations and all areas
subjeDt to inundation and high ground water levels.

hazardous waste disposal, fire protection, easements or rights-of-way, roadways,
recreation and park areas, school sites, and other publiD improvements or

dedications as may be required.
_(11)For rezonings to planned zoning distriDtS, the specific requirements for submission of
appliDations for rezoning to such districts shall also be satisfied. Furthermore, all
materials required for a subdivision master plan shall also be submitted.
(12) Where Donformance with the county's Environmentally Sensitive Lands Ordinance is
required, an AppliDation for Alteration of Environmentally Sensitive Lands (Environmental
Impact Study) must be submitted to the Palm Beach County Department of Environmental
ResourDes Management (copy to City) prior to or concurrent with the submittal of the Land
Use Amendment and/or Rezoning Application to the City.

Fees shall be paid at the time that the application is submitted, aDcording to the fees which
have been adopted by ordinance or resolution. The Planning Division will inform the appliDant
as to the fees which are required. All fees shall be paid by check, payable to the City of
Boynton BeaDh.

The applicant is requesting to change the land use to S.H.D.R. Special High Density Residential and
change the zoning classification to IPUD - Infill Planned Unit Development to allow for the
construction of sixty five townhomes. A review of a zoning amendment request should include
consideration of the criteria listed below to determine if the request should be favorably reviewed.
Following please find the justification to the re-zoning request:
Criterion (a): Wether the proposed land use amendment/re-zoning would be consistent with
applicable comprehensive plan policies. The division shall also recommend limitation or
requirements that would have to be imposed on subsequent development of the property in order to
comply with policies contained in the comprehensive plan.
The property is more suitable for development under the proposed land use and zoning because
townhomes are an ideal match to the existing surrounding multiple-family residential complex. Due
to the property's proximity to Federal Highway, it will act a buffer to the adjacent projects and will
accommodate a medium density housing component which will benefit the area's housing
requirements.
The proposed development will not hinder the development of surrounding lands and will be a
positive addition to the community. We believe that the subject land use and re-zoning request is
consistent with the Adopted Comprehensive Plan and, therefore, meets this criterion.
Criterion (b): Wether the proposed land use amendment/re-zoning would be contrary to the
established land use pattern, or would create an isolated district unrelated to adjacent and nearby
districts or would constitute a grant of special privilege to an individual property owner as
contrasted with the protection of the public welfare.
The proposed change is compatible with the zoning districts that surround the subject site. The
property to the north is an existing gas station which is land used and zoned commercial; also, the
property abuts Southeast 23,d A venue to the north. On the west, the site is contiguous to an existing
condominium and future townhome project; on the south is contiguous to a commercial building and
a condominium and on the east is adjacent to a rental apartment complex and a condominium which
will benefit from the proposed changes. The proposed land use and re-zoning will have no negative
effect on the development of surrounding property, will not create an isolated district umelated to
nearby districts and therefore, is consistent with this criterion.
Criterion (c): Whether changed or changing conditions make the proposed land use amendmentlre-
zoning desirable.
We believe that the current land use and zoning is not consistent with the existing residential
developments and the proposed land use/re-zoning is more compatible, will establish a logical
transition to other surrounding uses, will have a positive impact on living conditions and will
contribute to the neighborhood by providing a pleasant housing environment. The subject request,
therefore, meets this criterion.
Criterion (d): Wether the proposed land use amendment/re-zoning would be compatible with utility
systems. roadways and other public facilities.
Currently all necessary utilities, roadways and public facilities are existing and have sufficient
capacity to serve the subject property. The proposed land use amendment/re-zoning is compatible
with the existing utility systems, roadways and other public facilities. The proposed request meets
this criterion.
Criterion (e): Wether the proposed land use amendment/re-zoning would be compatible with the
current and future use of adjacent and nearby properties or would affect the property values of
adjacent and nearby properties.
A residential development with recreation amenities, attractive elevations, well planned floor plans
and appealing landscape contributes to the quality of life in a community. The proposed change,
therefore, will serve to enhance property values. The proposed request meets this criterion.
Criterion (j): Wether the property is physically and economically developable under the existing land
use designation/zoning:
Due to the subject property's location, condition of surrounding buildings and current
economic/market status ofthe US I corridor, we believe that the site can not be developed to its full
potential. The proposed request meets this criterion.
Criterion (g): Wether the proposed land use amendment/re-zoning is of scale that is reasonab(v
related to the needs of the neighborhood and the city as a whole.
The proposed land use amendment/re-zoning meets the needs of the City of Boynton Beach to add
residential components to the Federal Highway corridor. The proposed request meets this criterion.
Criterion (h): Wether there are adequate sites elsewhere in the city for the proposed use, in districts
where such use is already allowed.
We believe that it is difficult to find adequate sites elsewhere in the city to accommodate the type,
size and quality of the proposed development. The proposed request meets this criterion.
As the foregoing discussion demonstrates, the requested land use/re-zoning to allow for the
development of a residential community is consistent with the adopted Comprehensive Plan and
meets all ofthe criteria contained in the Land Development Code. As a result, this request merits
favorable consideration.

The project will be constructed in one phase; construction is anticipated to commence in May 2003
and will be completed within 12 months.
Criterion (d): For proposed zoning of property to commercial or industrial districts, where the area
of the subject parcel exceeds one (l) acre, projections for the number of employees.

Colony project planned to be located on the southwest comer of Federal Highway and
SE 23rd Avenue in the City of Boynton Beach, Florida. The location of the project is
illustrated in Figure I. The study addresses the following:
o Queuing Study for Inbound Vehicles
Trip Generation
Coastal Bay Colony is a proposed residential devel~ment planned to be located on the
west side of Federal Highway just south of SE 23 Avenue in southeast Palm Beach
County. The project consists of65 townhomes.
According to the Institute of Transportation Engineers (ITE) Trip Generation Manual (6th
Edition), the most appropriate "land use" category is ITE's Land Use 230 - Residential
Condominium/Townhouse. Table I below documents the trip generation for the
proposed residential project. As indicated in Table I, the proposed project is anticipated
to generate approximately 451 daily trips, 36 trips (6 inbound and 30 outbound) during
the morning peak hour, and 43 PM peak hour trips (29 inbound and 14 outbound).

Queuing Analysis
The AM and PM peak hour traffic volumes generated by the proposed residential
development were assigned to the two project driveways (a right-turn in/right-turn out
only driveway off of Federal Highway and an exit-only driveway on SE 23rd Avenue).
Based on the surrounding land uses and the transportation network located in the vicinity
of the proposed project, the following trip distribution was assumed for the Coastal Bay
Colony residential development:
o Forty percent (40%) on Federal Highway north of the SE 23rd Avenue
o Forty percent (40%) on Federal Highway south of the site
o Twenty percent (20%) on SE 23rd Avenue west of Federal Highway
Figure 2 depicts the AM and PM peak hour traffic assignments on the two project
driveways. As illustrated in Figure 2, the maximum inbound vehicular flow occurs in the
afternoon peak hour (29 vehicles).
According to the site plan prepared by Keith & Ballbe, Inc. for the Coastal Bay Colony
project, the main project driveway provides a 20-foot wide inbound lane. Furthermore,
the available storage between the card reader/call box and the southbound travel lanes of
Federal Highway is approximately 75 feet, which is sufficient to accommodate a queue of
up to three vehicles.
Assuming a maximum waiting time of three minutes for visitors wishing to obtain access
to the residential homes, the average length of queue anticipated at the project entrance is
1.451-vehicles (say 2 vehicles). Furthermore, since the proposed ingress lane will have a
width of20 feet, which is sufficient to accommodate two entering vehicles (side by side),
a resident can pass a stopped visitor in order to access the development without delay and
without joining the queue.
In summary, the 75 feet of throat length provided at the project's main entrance off of
Federal Highway should be sufficient to accommodate the maximum expected length of
queue without interfering with southbound traffic on Federal Highway.

Description
Residential condominiumsltownhouses are defined as single-family ownership units that have at
least one other single-family owned unit within the same building structure. Both condominiums
and townhouses are included in this land use. Studies that did not identify whether the
condominium/townhouse was a low-rise or a high-rise were included in this category.
Additional Data
The peak hour of the generator typically coincides with the peak hour of the adjacent street traffic.
The sites were surveyed from the mid-1970s to the mid-1990s throughout the United States and
Canada.
The number of vehicles and the number of residents have a high correlation with average
weekday vehicle trip ends. The use of these variables is limited, however, because the number of
vehicles and residents is often difficult to obtain or predict. The number of dwelling units is
generally used as the independent variable of choice because it is usually readily available, easy
to project, and has a high correlation with average weekday vehicle trip ends.

Over 650 shopping centers including neighborhood centers, community centers, regional centers,
and super regional centers were surveyed for this land use. Some of these centers contained
non-merchandising facilities, such as office buildings, movie theaters, restaurants, post offices,
banks, health clubs, and recreational facilities (e.g., ice skating rinks or indoor miniature golf
courses). The centers ranged in size from 1,700 to 2,200,000 square feet of gross leasable area
(GLA). The centers that were studied are located in suburban areas throughout the United States
and therefore represent average U.S. suburban conditions.
Many shopping centers, in addition to the integrated unit of shops in one building or
enclosed around a mall, include outparcels (peripheral buildings or pads located on the
perimeter of the center adjacent to the streets and major access points). These buildings
are typically drive-in banks, retail stores, restaurants, or small offices. Although the data
herein do not indicate which of the centers studied included peripheral buildings, it can be
assumed that some of the data show their effect.
The vehicle trips generated at a shopping center are based upon the GLA of the center, In cases
of smaller centers without an enclosed mall or peripheral buildings, the GLA could be the same as
the gross floor area of the building.
Separate equations have been developed for shopping centers during the Christmas shopping
season. Plots are included for the weekday peak hour of adjacent street traffic and the Saturday
peak hour of the generator.

Infonnation on hourly, monthly, and daily variation in Shopping center traffic is shown in
Tables 1, 2, 3, and 4. It should be noted, however, the infonnation contained in these
tables is based on a limited sample size. Therefore, caution should be exercised when
applying the data. Also, some infonnation provided in the tables may conflict with the
results obtained by applying the average rate or regression equations. When this occurs,
it is suggested that the results from the average rate or regression equations be used as
they are based on a larger number of studies.

Per your request, Carter & Burgess, Inc, conducted a traffic study for the Coastal Bay
Colony project planned to be located on the southwest comer of Federal Highway and
SE 23,d Avenue in the City of Boynton Beach, Florida, The location of the project is
illustrated in Figure I, The study addresses the following:
o Daily trip generation analysis
o Trip generation comparison analysis
o Driveway analysis
Daily Trip Generation Analysis
Coastal Bay Colony is a proposed residential develo,fment planned to be located on the
west side of Federal Highway just south of SE 23 Avenue in southeast Palm Beach
County, The project consists of 65 townhomes,
According to the Institute of Transportation Engineers (ITE) Trip Generation Manual (6th
Edition), the most appropriate "land use" category is ITE's Land Use 230 - Residential
Condominium/Townhouse, The fitted curve equation, given by the ITE manual, is:
Ln(T) = 0,850 Ln(X) + 2.564
Where T = average daily vehicle trip ends
X = number of dwelling units
Using the above equation, the proposed 65 townhomes are anticipated to generate
approximately 451 net trips per day, Since the project is anticipated to generate less than
500 trips per day, a traffic impact analysis following the Municipal Implementation
Ordinance of the Palm Beach County Traffic Performance Standards Ordinance is not
required.

Trip Generation Comparison Analysis
A trip generation comparison analysis between the parcel's current zoning and the
proposed zoning was conducted. The analysis was performed using the trip generation
equations published in the ITE Trip Generation Manual (6th Edition). The trip generation
comparison analysis was undertaken for daily, AM, and PM peak hour conditions. The
analysis was based on the following assumptions:

o Existing Zoning: C-2 & C-3 Community Commercial District (Commercial)
o FAR: 25 percent
o Size ofParce1: 4.34 acres (189,050 square feet)
o Potential Size of Building: 47,263 square feet (25% of 189,050 square feet)
o Land Use: Commercial
PROPOSED ZONING
o Proposed Zoning: Infill Planned Unit Development (IPUD)
o Land Use: Townhomes
o Size: 65 dwelling units
Table 1 below documents the trip generation the current and proposed zoning. As
indicated in Table I, the proposed zoning would result in a significant reduction in daily,
AM, and PM peak hour trips.

Driveway Analysis
The AM and PM peak hour traffic volumes generated by the proposed residential
development were assigned to the two project driveways (a right-turn in/right-turn out
only driveway off of Federal Highway and an exit-only driveway on SE 23rd Avenue).
Based on the surrounding land uses and the transportation network located in the vicinity

of the proposed project, the following trip distribution was assumed for the Coastal Bay
Colony residential development:
o Forty percent (40%) on Federal Highway north of the SE 23rd Avenue
o Forty percent (40%) on Federal Highway south of the site
o Twenty percent (20%) on SE 23rd Avenue west of Federal Highway
Figure 2 depicts the AM and PM peak hour traffic assignments on the two project
driveways. Based on the peak hour turning movement volumes developed for each
driveway, the following driveway geometries are recommended for the subject project:
FEDERAL HIGHWAY DRIVEWAY
o One southbound shared through/right-turn lane (no improvements necessary on
Federal Highway)
o One right-turn only exit lane
SE 23rd AVENUE DRIVEWAY
o No inbound movements allowed (only emergency vehicles)
o One shared left-turn/right-turn exit lane

Description
Residential condominiumsltownhouses are defined as single-family owners hiD units that have at
least one other single-family owned unit within the same building structure. Both condominiums
and townhouses are included in this land use. Studies that did not identify whether the
condominiumltownhouse was a low-rise or a high-rise were included in this category.
Additional Data
The peak hour of the generator typically coincides with the peak hour of the adjacent street traffic.
The siles were surveyed from the mid-1970s to the mid-1990s throughout the United States and
Canada.
The number of vehicles and the number of residents have a high correlation with average
weekday vehicle trip ends. The use of these variables is limited, however, because the number of
vehicles and residents is often difficull to obtain or predict. The number of dwelling units is
generally used as the independent variable of choice because it is usually readily available, easy
to project, and has a high correlation with average weekday vehicle trip ends.

Shopping Center
Description
A shopping center is an integrated group of commercial establishments that is planned,
developed, owned, and managed as a unit. A shopping center's composition is related to its
market area in terms of size, location, and type of store, A shopping center also provides on-site
parking facilities sufficient to serve its own parking demands.
Over 650 shopping centers including neighborhood centers, community centers, regional centers,
and super regional centers were surveyed for this land use. Some of these centers contained
non-merchandising facilities, such as office buildings, movie theaters, restaurants, post offices,
banks, health clubs, and recreational facilities (e,g" ice skating rinks or indoor miniature golf
courses), The centers ranged in size from 1,700 to 2,200,000 square feet of gross leasable area
(GLA). The centers that were studied are located in suburban areas throughout the United States
and therefore represent average U.S, suburban conditions,
Many shopping centers, in addition to the integrated unit of shops in one building or
enclosed around a mall, include outparcels (peripheral buildings or pads located on the
perimeter of the center adjacent to the streets and major access points). These buildings
are typically drive-in banks, retail stores, restaurants, or small offices. Although the data
herein do not indicate which of the centers studied included peripheral buildings, it can be
assumed that some of the data show their effect.
The vehicle trips generated at a shopping center are based upon the GLA of the center. In cases
of smaller centers without an enclosed mall or peripheral buildings, the GLA could be the same as
the gross floor area of the building.
Separate equations have been developed for Shopping centers during the Christmas shopping
season, Plots are included for the weekday peak hour of adjacent street traffic and the Saturday
peak hour of the generator.
Information on hourly, monthly, and daily variation in shopping center traffic is shown in
Tables 1, 2, 3, and 4. It should be noted, however, the information contained in these
tables is based on a limited sample size. Therefore, caution should be exercised when
applying the data. Also, some information provided in the tables may conflict with the
results obtained by applying the average rate or regression equations. When this occurs,
it is suggested that the results from the average rate or regression equations be used as
they are based on a larger number of studies.
