For projects that generate move than five hundred (500) net trips per day, a traffic impact analysis must be submitted whiDh complies with the Municipal Implementation Ordinance of the Palm BeaDh County Traffic Performance Standards OrdinanDe. (a) For projects that generate two thousand (2,000) or more net trips per day, the traffic impact analysis must be submitted to the City at least 30 days prior to the deadline for land use amendment and/or rezoning, in order to allow for timely processing of the application and review by the City's traffic Donsultant and Palm Beach County. The applicant shall be billed for the DOSt of review by the City's traffic consultant. (b) For projects that generate between five hundred (500) and two thousand (2,000) net trips per day, the traffic impact analysis must be submitted at the application deadline for land use amendment andlor rezoning, in order to allow for timely processing of the application and review by Paim Beach County. However, if it is the desire of the appliDant to utilize the City's traffic consultant for review of the traffic impact analysis prior to review by Palm Beach County, then the proDedure and requirements outlined under item "a" above shall be followed. NOTE: Failure to submit traffic impact analysis in the manner prescribed above may delay approval of the application. _(6) For parcels larger than one (1) acre, a comparison of the water demand for development under the proposed zoning or development with water demand under the existing zoning. Commitment to the provision of improvements to the sewage collection system shall also be inoluded, where the existing facilities would be inadequate to serve development under the proposed zoning. ..1..(8) For proposed residential developments larger than one (1) aDre, a Domparison of the projected population under the proposed zoning or development with the projected population under the existing zoning. Population projections according to age groups for the proposed development shall be required where more than fifty (50) dwellings, or 50 sleeping rooms in the case of group housing, would be allowed under the proposed zoning. _(9) At the request of the Planning Division, Planning and Development Board, or City Commission, the applicant shall also submit proposals for minimizing land use conflicts with surrounding properties. The applicant shall provide a summary of the nuisances and hazards associated with development under the proposed zoning, as well as proposals for mitigation of such nuisances and hazards. Such summary shall also inolude, where appliDable, exolusion of particular uses, limitations on hours of operation, proposed IODation of loading areas, dumpsters, and meDhanical equipment, location of driveways and service entranDe, and specifications for site lighting. NuisanDes and hazards shall be abated or mitigated so as to conform to the performance standards contained in the City's zoning regulations and the standards contained in the City's noise control ordinance. Also, statements concerning the height, orientation, and bulk of struDtures, setbacks from property lines, and measures for screening and buffering the proposed development shall be provided. At the request of the Planning and Development Board or City Commission, the appliDant shall also state the type of construction and architeDtural styles that will be employed in the proposed development. _(10)At the request of the Planning Division, Planning and Development Board, or City Commission, the applicant shall also submit the following information: _(a) Official soil conservation service oIassifiDation by soil associations and all areas subjeDt to inundation and high ground water levels. _(b) _(c) Existing and proposed grade elevations. The division shall also recommend limitation or requirements that would have to be imposed on subsequent development of the property in order to comply with policies contained in the comprehensive plan. The property is more suitable for development under the proposed land use and zoning because townhomes are an ideal match to the existing surrounding multiple-family residential complex. Due to the property's proximity to Federal Highway, it will act a buffer to the adjacent projects and will accommodate a medium density housing component which will benefit the area's housing requirements. The proposed development will not hinder the development of surrounding lands and will be a positive addition to the community. We believe that the subject land use and re-zoning request is consistent with the Adopted Comprehensive Plan and, therefore, meets this criterion. Criterion (b): Wether the proposed land use amendment/re-zoning would be contrary to the established land use pattern, or would create an isolated district unrelated to adjacent and nearby districts or would constitute a grant of special privilege to an individual property owner as contrasted with the protection of the public welfare. The proposed change is compatible with the zoning districts that surround the subject site. The property to the north is an existing gas station which is land used and zoned commercial; also, the property abuts Southeast 23,d A venue to the north. On the west, the site is contiguous to an existing condominium and future townhome project; on the south is contiguous to a commercial building and a condominium and on the east is adjacent to a rental apartment complex and a condominium which will benefit from the proposed changes. The proposed land use and re-zoning will have no negative effect on the development of surrounding property, will not create an isolated district umelated to nearby districts and therefore, is consistent with this criterion. Criterion (c): Whether changed or changing conditions make the proposed land use amendmentlre- zoning desirable. We believe that the current land use and zoning is not consistent with the existing residential developments and the proposed land use/re-zoning is more compatible, will establish a logical transition to other surrounding uses, will have a positive impact on living conditions and will contribute to the neighborhood by providing a pleasant housing environment. The subject request, therefore, meets this criterion. Criterion (d): Wether the proposed land use amendment/re-zoning would be compatible with utility systems. roadways and other public facilities. Currently all necessary utilities, roadways and public facilities are existing and have sufficient capacity to serve the subject property. The proposed land use amendment/re-zoning is compatible with the existing utility systems, roadways and other public facilities. The proposed request meets this criterion. Criterion (e): Wether the proposed land use amendment/re-zoning would be compatible with the current and future use of adjacent and nearby properties or would affect the property values of adjacent and nearby properties. A residential development with recreation amenities, attractive elevations, well planned floor plans and appealing landscape contributes to the quality of life in a community. The proposed change, therefore, will serve to enhance property values. The proposed request meets this criterion. Criterion (j): Wether the property is physically and economically developable under the existing land use designation/zoning: Due to the subject property's location, condition of surrounding buildings and current economic/market status ofthe US I corridor, we believe that the site can not be developed to its full potential. The proposed request meets this criterion. Criterion (g): Wether the proposed land use amendment/re-zoning is of scale that is reasonab(v related to the needs of the neighborhood and the city as a whole. The proposed land use amendment/re-zoning meets the needs of the City of Boynton Beach to add residential components to the Federal Highway corridor. The proposed request meets this criterion. Criterion (h): Wether there are adequate sites elsewhere in the city for the proposed use, in districts where such use is already allowed. We believe that it is difficult to find adequate sites elsewhere in the city to accommodate the type, size and quality of the proposed development. The proposed request meets this criterion. As the foregoing discussion demonstrates, the requested land use/re-zoning to allow for the development of a residential community is consistent with the adopted Comprehensive Plan and meets all ofthe criteria contained in the Land Development Code. As a result, this request merits favorable consideration. COMPARISON STATEMENT FOR LAND USE AND RE-ZONING REOUEST FOR COASTAL BAY COLONY The subject property consists of approximately 4.34 acres located at 2505 South Federal Highway, in the City of Boynton Beach. The site has a land use designation category of Commercial, a zoning district designation of C-2 & C-3 Community Commercial District and is currently occupied by a small hotel and 3 homes. Following are the property's adjacent zoning districts: East: West: C-2 & C-3 Community Commercial District R-3 Multiple-family residential district C-3 Community Commercial District R - 3 Multiple-family residential district R-3 Multiple-family residential district C-2 Community Commercial District North: South: The applicant is requesting to change the land use to S.H.D.R. Special High Density Residential and change the zoning classification to IPUD - Infill Planned Unit Development to allow for the construction of sixty five townhomes. A review of a zoning amendment request should include consideration of the criteria listed below to determine if the request should be favorably reviewed. Based on the surrounding land uses and the transportation network located in the vicinity of the proposed project, the following trip distribution was assumed for the Coastal Bay Colony residential development: o Forty percent (40%) on Federal Highway north of the SE 23rd Avenue o Forty percent (40%) on Federal Highway south of the site o Twenty percent (20%) on SE 23rd Avenue west of Federal Highway Figure 2 depicts the AM and PM peak hour traffic assignments on the two project driveways. As illustrated in Figure 2, the maximum inbound vehicular flow occurs in the afternoon peak hour (29 vehicles). According to the site plan prepared by Keith & Ballbe, Inc. for the Coastal Bay Colony project, the main project driveway provides a 20-foot wide inbound lane. Furthermore, the available storage between the card reader/call box and the southbound travel lanes of Federal Highway is approximately 75 feet, which is sufficient to accommodate a queue of up to three vehicles. Assuming a maximum waiting time of three minutes for visitors wishing to obtain access to the residential homes, the average length of queue anticipated at the project entrance is 1.451-vehicles (say 2 vehicles). Furthermore, since the proposed ingress lane will have a width of20 feet, which is sufficient to accommodate two entering vehicles (side by side), a resident can pass a stopped visitor in order to access the development without delay and without joining the queue. In summary, the 75 feet of throat length provided at the project's main entrance off of Federal Highway should be sufficient to accommodate the maximum expected length of queue without interfering with southbound traffic on Federal Highway. Many shopping centers, in addition to the integrated unit of shops in one building or enclosed around a mall, include outparcels (peripheral buildings or pads located on the perimeter of the center adjacent to the streets and major access points). These buildings are typically drive-in banks, retail stores, restaurants, or small offices. Although the data herein do not indicate which of the centers studied included peripheral buildings, it can be assumed that some of the data show their effect. The vehicle trips generated at a shopping center are based upon the GLA of the center, In cases of smaller centers without an enclosed mall or peripheral buildings, the GLA could be the same as the gross floor area of the building. Separate equations have been developed for shopping centers during the Christmas shopping season. Plots are included for the weekday peak hour of adjacent street traffic and the Saturday peak hour of the generator. ;;;,: Infonnation on hourly, monthly, and daily variation in Shopping center traffic is shown in Tables 1, 2, 3, and 4. Based on the surrounding land uses and the transportation network located in the vicinity 3 of the proposed project, the following trip distribution was assumed for the Coastal Bay Colony residential development: o Forty percent (40%) on Federal Highway north of the SE 23rd Avenue o Forty percent (40%) on Federal Highway south of the site o Twenty percent (20%) on SE 23rd Avenue west of Federal Highway Figure 2 depicts the AM and PM peak hour traffic assignments on the two project driveways. A shopping center's composition is related to its market area in terms of size, location, and type of store, A shopping center also provides on-site parking facilities sufficient to serve its own parking demands. Over 650 shopping centers including neighborhood centers, community centers, regional centers, and super regional centers were surveyed for this land use. Some of these centers contained non-merchandising facilities, such as office buildings, movie theaters, restaurants, post offices, banks, health clubs, and recreational facilities (e,g" ice skating rinks or indoor miniature golf courses), The centers ranged in size from 1,700 to 2,200,000 square feet of gross leasable area (GLA). The centers that were studied are located in suburban areas throughout the United States and therefore represent average U.S, suburban conditions, Many shopping centers, in addition to the integrated unit of shops in one building or enclosed around a mall, include outparcels (peripheral buildings or pads located on the perimeter of the center adjacent to the streets and major access points). These buildings are typically drive-in banks, retail stores, restaurants, or small offices. Although the data herein do not indicate which of the centers studied included peripheral buildings, it can be assumed that some of the data show their effect. The vehicle trips generated at a shopping center are based upon the GLA of the center. In cases of smaller centers without an enclosed mall or peripheral buildings, the GLA could be the same as the gross floor area of the building. Separate equations have been developed for Shopping centers during the Christmas shopping season, Plots are included for the weekday peak hour of adjacent street traffic and the Saturday peak hour of the generator. Information on hourly, monthly, and daily variation in shopping center traffic is shown in Tables 1, 2, 3, and 4. It should be noted, however, the information contained in these tables is based on a limited sample size. Therefore, caution should be exercised when applying the data. Also, some information provided in the tables may conflict with the results obtained by applying the average rate or regression equations. When this occurs, it is suggested that the results from the average rate or regression equations be used as they are based on a larger number of studies.
