THE PROPER LAND USE DESIGNATION AND
PROPER ZONING OF THE PROPERTY SHALL BE
REFLECTED IN SEPARATE ORDINANCES TO BE

ADOPTION.
WHEREAS, the Comprehensive Plan for the City of Boynton Beach requires the

jdevelopment of an Annexation Program; and

I WHEREAS, Beth Peschl, through her agents, Chip Bryan, Julian Bryan &
Associates, Inc., as 0 wner 0 fthe property more particularly described hereinafter, has
heretofore filed a Petition, pursuant to Section 9 of Appendix A-Zoning, of the Code of
Ordinances, City of Boynton Beach, Florida, for the purpose of annexing a certain tract
of land consisting of approximately :!:9. 7 4 acres; and
WHEREAS, the City of Boynton Beach hereby exercises its option to annex the

i(32) of the Charter of the City and Section 171.044, and 171.062(2), Florida Statutes;
and
WHEREAS, said tract of land lying and being within Palm Beach County is

annexation, constitute a reasonably compact addition to the City territory.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION
OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
That each and every Whereas clause is true and correct.
Section 1.
Section 2.
Pursuant to Article I, Section 7 (32) of the Charter of the City of
Boynton Beach, Florida and Section 171.044, Florida Statutes the following described
unincorporated and contiguous tract of land situated and lying and being in the County
of Palm Beach, Florida, to wit:
The Southeast quarter (S.E. 1/4) of the Southwest quarter (S.W. 1/4) of the
Southeast quarter (S.E. 1/4) of Section 31, Township 45 South, Range 43
East, Palm Beach County, Florida. LESS the South 40 feet thereof.
AREA OF SITE: 424,377 Square Feet or 9.742 Acres, more or less.
Containing approximately ::!:9. 7 4 acres ofland
is hereby annexed to the City of Boynton Beach, Florida, and such land so annexed shall
be and become part of the City with the same force and effect as though the same had
been originally incorporated in the territorial boundaries thereof.
Section 2:
That Section 6 and 6(a) of the Charter of the City of Boynton Beach,
Florida, ish ereby a mended to reflect the annexation of said tract of land more particularly
described in Section 1 ofthis Ordinance.
Section 3:
That by Ordinances adopted simultaneously herewith, the proper City
zoning designation and Land U se category i s being determined as contemplated in Section
171.162(2), Florida Statutes.

be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the
remainder of this Ordinance.
Section 6:
This Ordinance shall not be passed until the same has been advertised
for two (2) consecutive weeks in a newspaper of general circulation in the City of Boynton
Beach, Florida, as required by the City Charter and Section 171.044, Florida Statutes.
Section 7.
This ordinance shall become effective immediately upon passage.
Section 8.
Specific authority is hereby given to codify this Ordinance.
Section 9.
This ordinance, after adoption, shall be filed with the Clerk of the
i Circuit Court of Palm Beach County, Florida.

DESIGNATION IS BEING CHANGED FROM MR-5
(PALM BEACH COUNTY) TO LOW DENSITY
RESIDENTIAL (LDR); PROVIDING FOR
CONFLICTS, SEVERABILITY, AND AN EFFECTNE
DATE.
WHEREAS, the City Commission of the City of Boynton Beach, Florida has
adopted a Comprehensive Future Land Use Plan and as part of said Plan a Future Land
Use Element by Ordinance No. 89-38 in accordance with the Local Government
Comprehensive Planning Act; and
WHEREAS, the procedure for amendment of a Future Land Use Element of a
Comprehensive Plan as set forth in Chapter 163, Florida Statutes, has been followed; and
WHEREAS, after public hearing and study, the City Commission deems it in the
best interest of the inhabitants of said City to amend the aforesaid Element of the
Comprehensive Plan as adopted by the City herein.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1: The foregoing WHEREAS clauses are true and correct and
incorporated herein by this reference.
Section 2:
Ordinance No. 89-38 of the City is hereby amended to reflect the

That the Future Land Use of the following described land shall be designated as
Low Density Residential (LDR). Said land is more particularly described as follows:
The Southeast quarter (S.E. 1/4) of the Southwest quarter (S.W. 1/4) of the
Southeast quarter (S.E. 1/4) of Section 31, Township 45 South, Range 43
East, Palm Beach County, Florida. LESS the South 40 feet thereof
AREA OF SITE: 424,377 Square Feet or 9.742 Acres, more or less.
Containing approximately :t9. 74 acres of land
Section 2: That any maps adopted in accordance with the Future Land Use Element
shall be amended accordingly.
Section 3: All ordinances or parts of ordinances in conflict herewith are hereby
repealed.
Section 4: Should any section or provision of this Ordinance or any portion thereof
be declared by a court of competent jurisdiction to be invalid, such decision shall not affect
the remainder of this Ordinance.
Section 5: This Ordinance shall take effect on adoption, subject to the review,
challenge, or appeal provisions provided by the Florida Local Government Comprehensive
Planning and Land Development Regulation Act. No party shall be vested of any right by
virtue of the adoption of this Ordinance until all statutory required review is complete and all
legal challenges, including appeals, are exhausted. In the event that the effective date is
established by state law or special act, the provisions of state act shall control.

WHEREAS, the City Commission of the City of Boynton Beach, Florida has adopted
Ordinance No. 02-013, in which a Revised Zoning Map was adopted for said City; and
WHEREAS, Beth Peschl, as owner of the property more particularly described
hereinafter, for the project known as Serrano at Boynton., has filed a Petition, through its
agent, Chip Bryan, Julian Bryan & Associates, Inc., pursuant to Section 9 of Appendix
A-Zoning, of the Code of Ordinances, City of Boynton Beach, Florida, for the purpose of
rezoning a parcel ofland consisting of approximately :!: 9.74 acres, said land being more
particularly described hereinafter, from AR (Palm Beach County) to Planned Unit
Development (PUD); and
WHEREAS, the City Commission conducted a public hearing and heard
testimony and received evidence which the Commission finds supports a rezoning for the
property hereinafter described; and
WHEREAS, the City Commission finds that the proposed rezoning is consistent
with an amendment to the Land Use which was contemporaneously considered and
approved at the public hearing heretofore referenced; and
WHEREAS, the City Commission deems it III the best interests of the

NOTICE IS HEREBY GIVEN that the Planning and Development Board of THE CITY OF BOYNTON
BEACH, FLORIDA, will conduct a HEARING, on Tuesday, July 22, 2003 at 6:30 p.m. in the CITY HALL
COMMISSION CHAMBERS, 100 East Boynton Beach Boulevard, to consider this request submitted by
Chip Bryan of Julian Bryan and Associates on behalf of Beth Pesch I. The City Commission of THE
CITY OF BOYNTON BEACH, FLORIDA, will also hold PUBLIC HEARINGS to consider this request on
