9 TERRITORY, PURSUANT TO ARTICLE I, SECTION 7
10 (32) OF THE CHARTER OF THE CITY OF BOYNTON
11 BEACH, FLORIDA, AND SECTIONS 171.044, AND
12 171.062(2), FLORIDA STATUTES; PROVIDING THAT
13 THE PROPER LAND USE DESIGNATION AND
14 PROPER ZONING OF THE PROPERTY SHALL BE
15 REFLECTED IN SEPARATE ORDINANCES TO BE
16 PASSED SIMULTANEOUSLY HEREWITH;
17 PROVIDING FOR CONFLICTS, SEVERABlllTY,
18 CODIFICATION AND AN EFFECTIVE DATE;
19 PROVIDING THAT THIS ORDINANCE SHALL BE
20 FILED WITH THE CLERK OF THE CIRCUIT COURT
21 OF PAIM BEACH COUNTY, FLORIDA, UPON
22 ADOPTION.

24 WHEREAS, the Comprehensive Plan for the City of Boynton Beach requires the
25 development of an Annexation Program; and
26 WHEREAS, National Land Company, Inc., through its agents, Michael J.
27 Covelli, Caulfield & Wheeler, Inc., as owner of the property more particularly described
28 hereinafter, has heretofore filed a Petition, pursuant to Section 9 of Appendix A-Zoning,
29 of the Code of Ordinances, City of Boynton Beach, Florida, for the purpose of annexing
30 a certain tract of land consisting of approximately :!::17.12 acres; and
31 WHEREAS, the City of Boynton Beach hereby exercises its option to annex the
32 following tract of land as hereinafter described, in accordance with Article L Section 7
33 (32) of the Charter of the City and Section 171.044, and 171.062(2), Florida Statutes;
34 and
35 WHEREAS, said tract of land lying and being within Palm Beach County is

- 1 contiguous to the existing city limits of the City of Boynton Beach, and will, upon its
2 annexation, constitute a reasonably compact addition to the City territory.

Section 2:
That Section 6 and 6(a) of the Charter of the City of Boynton Beach.

23 escribed in Section 1 of this Ordinance.
Section 3:
That by Ordinances adopted simultaneously herewith, the proper City
25 zoning designation and Land Use category is being determined as contemplated in Section
26 171.162(2), Florida Statutes.

Section 4.
All ordinances or parts of ordinances in conflict herewith are hereby
28 repealed.
29 Section 5: Should any section or provision of this Ordinance or any portion thereof
30 be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the
31 mainder of this Ordinance.

Section 6:
This Ordinance shall not be passed until the same has been advertised

This ordinance shall become effective immediately upon passage.

Specific authority is hereby given to codify this Ordinance.

Section 9.
This ordinance, after adoption, shall be filed with the Clerk of the
6 Circuit Court of Palm Beach County, Florida.

NOTICE IS HEREBY GIVEN that the Planning and Development Board of THE CITY OF BOYNTON
BEACH, FLORIDA, will conduct a PUBLIC HEARING, on Thursday, December 18, 2003 at 6:30 p.m. in
the CITY HALL COMMISSION CHAMBERS, 100 East Boynton Beach Boulevard, to consider this
request submitted by Michael J. Covelli, AICP/ASLA of Caufield and Wheeler, Inc. on behalf of National

Accompanying this memorandum you will find one (1) copy of the application and related
documents for the above-reference application. The application fees for staff processing and
review have been forwarded to the Finance Department.
The attached Property Owners' Notice relates to the Large-Scale Land Use Map Amendment
and has been prepared to meet the City of Boynton Beach Code requirements.
A NOTICE consistent with the requirements of Chapter 163, Florida Statutes, which will include
all Large Scale Amendments, will be prepared for the City Commission Public Hearing, and will
be forwarded to your office after review by the City Attorney.
This is a large-scale land use amendment; therefore the hearings for transmittal will be
advertised only one time. A second display ad will be requested at the adoption phase, which is
tentatively scheduled for May 18, 2004.
