We are pleased to submit our recently adopted Round 1, 2004 amendments for the City of Boynton
Beach Comprehensive Plan. Included with this submittal are three (3) land use amendments and one (1)
text amendment. These amendments, given your identification number DCA No. 04-1, were not
reviewed by the Department and were retumed to us on March 10, 2004 for adoption. The proposed
amendments remain unchanged; therefore, the City requests expedited publication of the Notice of
Intent. The City Commission at a public hearing held on April 20, 2004, following proper public notice
pursuantto ss163.3184 (see attachment), adopted these amendments. Please note that the NOI should
be published in the Palm Beach Post.
Please also note that the proposed amendments:
. are not, nor do they affect, An Area of State Concem;
. are not exceptions to the twice yearly limitation for plan amendments as noted in F.S. 163.3177(h)(4);
. are not proposed to be adopted under a joint planning agreement pursuant to Chapter 163.3171,
F.S.;
. have been submitted to Treasure Coast Regional Planning Council, South Florida Water
Management District, Florida Department of Transportation, and Florida Department of
Environmental Protection (see attached letters); and
. do include three (3) amendments to the Future Land Use Map or map series.
The adopted text amendment is attached to Ordinance 04-024.
Also note that the adopted text amendment has also been provided to you in a format to replace pages
within the copy of our Comprehensive Plan.
Lastly, this amendment package includes the revised cumulative list of plan amendments processed
subsequent to original adoption, and copies of the entire Comprehensive Plan have been sent to all the
agencies listed in 9J-11.oo8(9) (a).

WHEREAS, the City of Boynton Beach hereby exercises its option to annex the

29 Section 5: Should any section or provision of this Ordinance or any portion thereof
30 be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the

23 to Section 9 of Appendix A-Zoning, of the Code of Ordinances, City of Boynton
24 Beach, Florida, for the purpose of rezoning a tract of land consisting of
25 approximately 17.12 acres, said land being more particularly described hereinafter,
26 from GC-General Commerce, AR-Agricultural Residential, RS-Residential (Palm
27 Beach County) to R-l-AAB (Single Family Residential); and
28 WHEREAS, the City Commission conducted a public hearing and heard
29 lestimony and received evidence which the Commission finds supports a rezoning for

15 WHEREAS, the City Commission of the City of Boynton Beach, Florida ("City")
16 has adopted a comprehensive plan, pursuant to Ordinance 89-38 in accordance with the
17 Local Government Comprehensive Planning Act; and
18 WHEREAS, after public hearing and study, the City Commission deems it to be
19 In the best interest of the inhabitants of the City to amend the text of the City's
20 Comprehensive Plan by the creation of Objective 1.23, designating the downtown as an
21 Urban Central Business District for the purpose of increasing the DRI thresholds in the
22 Future Land Use Element and Future Land Use Map; and
23 WHEREAS, it is the recommendation of staff that the proposed text amendments
24 to the Comprehensive Plan designating the downtown as an Urban Central Business
25 District for the purpose of increasing DR! thresholds are consistent with the requirements
26 of Rule 28-24.014(a), FAC and will enable projects of a scale that will make a positive
27 impact on the central business district, and will further implement development
28 recommendations of the adopted Federal Highway Corridor Community Redevelopment
29 Plan.

Section 1. That Objective 1.23 of the City of Boynton Beach Comprehensive
Plan is hereby created, as follows:
Objective 1.23
As a part of Urban Infill and redevelopment strategies, higher densities
and intensities will be encouraged in the Urban Core. Pursuant to ,
Section 380.06(2)(e), Florida Statutes and Rule 28-24.014(1), F. A. C.,
the Urban Central Business District, as depicted on the Future Land
Use Map Rule 28-24.014(1), F. A. C.. the Urban Central Business
District, as depicted on the Future Land Use Map. is hereby established
to increase the development of regional impact guidelines and
standards. These increased thresholds shall apply only to those
developments approved after the effective date of the implementing
ordinance (Ordinance 03-039).
Policy 1.23.1
For residential. hotel. office or retail developments, the applicable
guidelines and standards shall increase by 50 percent.

21 Policy 1.23.2 The applicable multi-use guidelines and standards shall increase by
22 100%, provided that one land use of the multi-use development is
23 residential, and that residential development amounts to not less than
24 35 percent of the city's applicable residential threshold.

27 delineated Urban Central Business District. the increased guidelines
28 and standards of Rule 28-24.014(10). F. A. C.. shall not apply.

Policy 1.21.3 The City shall establish and implement a public education program
emphasizing the value of sign regulation in terms of nuisance control and land
value enhancement.
Objective 1.22 In keeping with the "New Urbanism" principles established as guidelines
for development, the City shall incorporate the following policies in its
redevelopment and neighborhood planning activities in keeping with the
Visions 20/20 recommendations.
Policy 1.22.1 The Community shall be defined by a series of walkable neighborhoods. The
neighborhoods shall have a clearly defined center and edge. The distance
between the two should be no more than a five-minute walk. Streets shall be
laid out as networks. Each street shall be functional and safe for both the car
and the pedestrian/bicyclist.
Policy 1.22.2 The City shall look to civic buildings as providing places of assembly and be
predominately located so as to contribute to the identity of each neighborhood,
they should also be designed to serve as symbols of pride for the Community.
Policy 1.22.3 Neighborhoods shall provide residences of different income levels. Homes,
shops, and workplaces shall be designed to be in walking distance of each
other where appropriate. Architecture and landscaping shall reflect the
character of the region.
Policy 1.22.4 In the City's downtown areas the following standards are to be emphasized:
1. Mixed-use buildings are appropriate;
2. Height of buildings to be consistent with the City of Boynton Beach
Vision 20/20 Redevelopment Plan;
3. Density should be higher at the center and radiate out into edges with
lower density;
4. Streets should be pedestrian-friendly and safe, not totally designed for the
automobile.

17 WHEREAS, the City Commission of the City of Boynton Beach, Florida has
18 adopted a Comprehensive Future Land Use Plan and as part of said Plan a Future Land
19 Use Element by Ordinance No. 89-38 in accordance with the Local Government
20 Comprehensive Planning Act; and
21 WHEREAS, the procedure for amendment of a Future Land Use Element of a
22 Comprehensive Plan as set forth in Chapter 163, Florida Statutes, has been followed;
23 and
24 WHEREAS, after public hearing and study, the City Commission deems it in the
25 best interest of the inhabitants of said City to amend the aforesaid Element of the
26 Comprehensive Plan as adopted by the Cily herein.
27 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF

Introduction
The Local Government Comprehensive Planning and Land Development Regulation Act,
Chapter 163, Florida Statutes, requires that Council review local government
comprehensive plan amendments prior to their adoption. Under the provisions of this
law, the Department of Community Affairs (DCA) prepares an Objections,
Recommendations, and Comments (ORC) Report on a proposed amendment only if
requested to do so by the local government, the regional planning council, an affected
person, or if an ORC Report is otherwise deemed necessary by the DCA. If the local
government requests DCA to prepare an ORC Report, then Council must provide DCA
with its own objections, recommendations for modification, and comments on the
proposed amendment within 30 days of its receipt.
Background
The City of Boynton Beach is proposing text amendments to the Future Land Use Map
(FLUM) of the City comprehensive plan. The amendments relate to the Renaissance
Commons (formerly Motorola) Development of Regional Impact (DRI). On April 5,
2004, the DCA notified the City that an ORC Report would be prepared.
Evaluation
Text Amendments
The City proposes to adopt one new objective and three accompanying policies to the
Future Land Use Element. New Objective 1.24 is to establish a DRI FLUM designation
that is to be applied to the land of all DRl's. Each shall be governed by specific policies.
New Policy 1.24.l.a indicates that the Renaissance Commons DRI is a multiple use
project that is to contain commercial, office, and residential uses. New Policy 1.24.l.b
establishes land uses and intensity ranges for the Renaissance Commons DRI. New
Policy 1.24.I.c establishes the maximum amount of traffic to be generated by
Renaissance Commons DRI and indicates that this is to be in conformance with the Palm
Beach County Traffic Performance Standards.
FLUM Amendment
The proposed amendment is for the 87.0-acre Renaissance Commons DRI located at the
southeast comer of Congress Avenue and Gateway Boulevard (see attached maps). The
Motorola DRI was approved in 1979 for 825,000 square feet of industrial, research and
development, and office uses. A total of 325,000 square feet of development was
actually constructed on fifty acres of the site. The DRI development order and the City
comprehensive plan were revised in 2002 to allow 500 residential units and more
commercial retail uses in lieu of some unbuilt office use.
The existing FLUM designations are Industrial (37.3 acres) and Local Retail Commercial
(49.7 acres). The proposed FLUM designation is the newly established DRI designation.
The City indicates that the proposed amendment is consistent with the Future Land Use
Element, especially with Objective 1.15 that encourages planned and mixed use
development at appropriate locations. The City references changed market conditions as
pmi ofthe rationale for the amendment.
Extraiurisdictional Impacts
The proposed amendments were processed by the Palm Beach County Intergovernmental
Plan Amendment Review Committee (IPRC) on January 28, 2004. According to the
IP ARC Coordinator, no objections have been received.
Effects on Significant Regional Resources or Facilities
Analysis of the proposed amendments indicates that lhey would not have adverse effects
on significant regional resources or facilities.

None
Recommendation
Council should adopt the above comments and approve their transmittal to the
Department of Community Affairs.

COMPREHENSNE PLAN AMENDMENT
IN COMPLIANCE

The Department gives notice of its intent to find the Amendment to the Comprehensive Plan
for the City of Boynton Beach, adopted by Ordinance Nos. 04-020, 04-022, 04-024 and 04-025 on
April 20, 2004, IN COMPLIANCE, pursuantto Sections 163.3184, 163.3187 and 163.3189, F.S.
The adopted City of Boynton Beach Comprehensive Plan Amendment and the Department's
Objections, Recommendations and Comments Report, (if any), are available for public inspection Monday
through Friday, except for legal holidays, during nonnal business hours, at the City of Boynton Beach, City
Hall, Planning and Zoning Department, 100 East Boynton Beach Boulevard, Boynton Beach, Florida
33425.
Any affected person, as defined in Section 163.3184, F.S., has a right to petition for an adinin-
istrative hearing to challenge the proposed agency detennination that the Amendment to the City of
Boynton Beach Comprehensive Plan is In Compliance, as defined in Subsection 163.3184(1), F.S. The
petition must be filed within twenty-one (21) days after publication of this notice, and must include all of
the infonnation and contents described in Unifonn Rule 28-106.201, F.A.C. The petition must be filed
with the Agency Clerk, Department of Community Affairs, 2555 Shumard Oak Boulevard, Tallahassee,
Florida 32399-2100, and a copy mailed or delivered to the local government. Failure to timely file a
petition shall constitute a waiver of any right to request an administrative proceeding as a petitioner
under Sections 120.569 and 120.57, F.S. Ifa petition is filed, the purpose of the administrative hearing
will be to present evidence and testimony and fOlward a recommended order to the Department. If no
petition is filed, this Notice of Intent shall become final agency action.
If a petition is filed, other affected persons may petition for leave to intervene in the proceeding.
A petition for intervention must be filed at least twenty (20) days before the final hearing and must include
all of the infonnation and contents described in Unifonn Rule 28-106.205, F.A.C. A petition for leave to
intervene shall be filed at the Division of Administrative Hearings, Department of Management Services,
1230 Apalachee Parkway, Tallahassee, Florida 32399-3060. Failure to petition to intervene within the

After an administrative hearing petition is timely filed, mediation is available pursuant to Sub-

of mediation shall not affect a party's right to an administrative hearing.

The Department of Community Affairs (Department) has completed its review of the adopted
Comprehensive Plan Amendment adopted by (Ordinance Nos. 04-020, 04-022, 04-024 and 04-025; DCA
No. 04-1) for the City of Boynton Beach, as adopted on April 20, 2004, and determined that it meets the
requirements of Chapter 163, Part II, Florida Statutes (F.S.), for compliance, as defined in Subsection
163.3 I 84(1)(b), F.S. The Department is issuing a Notice of Intent to find the plan amendment, In
Compliance. The Notice of Intent has been sent to the P AIM BEA CH POST newspaper for publication
on May 24, 2004.
The Departmenl' s nolice of intent to fmd a plan amendment in compliance shall be deemed to
be a final order if no timely petition challenging the amendmenl is filed. Any affected person may file a
petition with the agency within 21 days after the publication of the notice of intent pursuant to Section
163.3184(9), F.S. No development orders, or permits for a development, dependent on the amendment
may be issued or commence before the plan amendment takes effect. Please be advised that Section
163.3184(8)(c)2, Florida Statutes, requires a local govemment that has an internet site to post a copy
of the Department's Notice of Intent on the site within 5 days after receipt of the mailed copy of the
agency's notice of intent.
Please note that a copy of the adopted Boynton Beach Comprehensive Plan Amendment, and the
Notice oflntent must be available for public inspection Monday through Friday, except for legal holidays,
during normal business hours, at the City of Boynton Beach, City Hall, Planning and Zoning Department,

CITY OF BOYNTON BEACH
COMPREHENSIVE PLAN AMENDMENT
IN COMPLIANCE
DOCKET NO. 04-I-NOI-5005-(A)-(I)
The Department gives notice of its intent to find the Amendment to the Comprehensive Plan
for the City of Boynton Beach, adopted by Ordinance Nos. 04-020, 04-022, 04-024 and 04-025 on
April 20, 2004, IN COMPLIANCE, pursuant to Sections 163.3184, 163.3187 and 163.3189, F.S.
The adopted City of Boynton Beach Comprehensive Plan Amendment and the Department's
Objections, Recommendations and Comments Report, (if any), are available for public inspection Monday
through Friday, except for legal holidays, during normal business hours, at the City of Boynton Beach, City
Hall, Planning and Zoning Department, 100 East Boynton Beach Boulevard, Boynton Beach, Florida
33425.
Any affected person, as defined in Section 163.3184, F.S., has a right to petition for an adinin-
istrative hearing to challenge the proposed agency determination that the Amendment to the City of
Boynton Beach Comprehensive Plan is In Compliance, as defined in Subsection 163.3184(1), F.S. The
petition must be filed within twenty-one (21) days after publication of this notice, and must include all of
the information and contents described in Uniform Rule 28-106.201, F.A.C. The petition must be filed
with the Agency Clerk, Department of Community Affairs, 2555 Shumard Oak Boulevard, Tallahassee,
Florida 32399-2100, and a copy mailed or delivered to the local government. Failure to timely file a
petition shall constitute a waiver of any right to request an administrative proceeding as a petitioner
under Sections 120.569 and 120.57, F.S. Ifa petition is filed, the purpose of the administrative hearing
will be to present evidence and testimony and forward a recommended order to the Department. If no
petition is filed, this Notice of Intent shall become final agency action.
If a petition is filed, other affected persons may petition for leave to intervene in the proceeding.
A petition for intervention must be filed at least twenty (20) days before the final hearing and must include
all of the information and contents described in Uniform Rule 28-106.205, F.A.C. A petition for leave to
intervene shall be filed at the Division of Administrative Hearings, Department of Management Services,
1230 Apalachee Parkway, Tallahassee, Florida 32399-3060. Failure to petition to intervene \vithin the
allowed time frame constitutes a waiver of any right such a person has to request a hearing under Sections
120.569 and 120.57, F.S., or to participate in the administrative hearing.
After an administrative hearing petition is timely filed, mediation is available pursuant to Sub-
section 163.3189(3)(a), F.S., to any affected person who is made a party to the proceeding by filing that
request with the administrative law judge assigned by the Division of Administrative Hearings. The choice
of mediation shall not affect a party's right to an administrative hearing.
